HELD AUGUST 26, 1975
Members Present: Brooklyn, Carter, Thomas, McRobert, Turner,
Garlington, and Lait.
Members Absent: Bowness.
Meeting called to order at 7:30 P. M. by Mr. Thomas. Minutes
from previous meeting were read and approved.
1. James Crosby, Sr. - Petition #75 -3
Mr. James Crosby, Sr. appeared before the Board in reference to
Petition #75 -3 requesting a Use Permitted on Review on 740 Lyman St.
Mr. Thomas asked those in the audience to come forward and speak
their opinion in regards to the petition. No one objected or
commented. Being no comments from the audience or Board, Mr. McRobert
moved that the proposed Petition b75 -3 be recommended to the Council.
Mr. Garlington seconded. No nays. Motion carried.
2. James S. Watson - Petition #75 -4
Mr. James S. Watson came before the Board in reference to Petition
#75 -4, a petition requesting a change of zoning from R -1AA to C -1
on 301 N. Bluford (N. E. Corner of Silver Star and Bluford).
The Board read letter from Mrs. Grace Kerr opposing zoning.
Mr. Thomas asked if anyone in the audience had any comments for
or against said petition to come forward.
Mrs. Eleanor Vandergrift came before the Board with a petition
signed by thirty -two people saying they opposed the change of
zoning and want it to stay residential.
Mr. Watson explained to the audience that he was unable to rent
the property under the present zoning and that he has had offers
from business firms to commercialize the property. He indicated
that the change would be good for the City and and would bring
more jobs. Mr. Watson stated that Mr. Lester Pepper owned property
adjacent his and that Mr. Pepper was also for the change.
Mr. Lester Pepper told the Board that he and his sister were both
in favor of the change.
Mr. Donnie Aycock stated that he too had problems renting property
in another location, but opposed the change due to the traffic,
robberies and children in the area. He said his parents were also
against the change.
Mr. W. H. Wurst was present. He stated that he did not own property
near the area, however, the owner of the property on the N. W.
Corner of Silver Star had tried to have his property zoned commercial
and was turned down. Mr. Wurst said he was against the proposed
petition.
Commissioner Bill Stinnett told the Board he was against the change
and that it would be detrimental to make all of the area commercial
if the property was zoned commercial.
Mr. Delmer Fields came before the Board representing his mother
at 2 Lakeview. He is against spot - zoning and feels it should
remain residential or be all commercial.
Table discussion was held. Mr. McRobert said that the Board had
heard some good recommendations as far as all of Silver Star going
commercial and wanted to know if they could invite discussion from
the floor.
Mr. Donnie Aycock, who was against the recommendation, asked them
if they would like a business at their back door. Others agreed
they would not. Mr. Pepper said he was still in favor of the
property going commercial.
Commissioner Bill Stinnett advised that the Board stick only to the
parcel of property they came to discuss and to keep it legal and
not involve other areas.
i m Being no further comments, Mr. Thomas motioned to deny the proposed
petition seconded by Mr. Carter. One obstained from voting.
Motion carried.
Mr. McRobert repeated his previous request of inviting discussion
from the audience on making all of Silver Star commercial and
asked Commissioner Stinnett if it would be in order at that time.
Mr. Stinnett said it was the City's intention to develop the areas
commercially and residentially in an orderly manner and that the
ones they have are not fully developed and he was against any
more commercial until they finish developing what they have
already.
Mr. Carter felt it would be in order to bring to the floor's
attention that the State Road Dept. says that by 1980 all of
Silver Star Road will be four - laned.
Being no further discussion, Mr. Turner motioned to adjourn,
seconded by Mr. McRobert. Meeting adjourned at 8:15 P. M.
Due to the confusion regarding the intent of the Zoning Board
regarding Petition #75 -3, Use Permitted on Review filed by
Mr. James Crosby, the Zoning Board reconvened at 9:10 P. M.
26 August 75.
Mr. Frank Turner made the motion to grant the Use Permitted on
Review provided all specifications are met by Mr. James Crosby.
Motion seconded by John Carter. Vote Unanimous.
Meeting adjourned at 9:10 P. M. 26 August 75.
