HELD JANUARY 9, 1979
Present: Bowness, Brooklyn, Carter, Timbes, Hager, Busch
Absent: Hall, Rodgers, Thomas, Lait, McRobert
Meeting called to order at 7:30 P. M. by Chairman Bowness.
I. Public Hearing - Petition 78 -8. Henry Stogwall from Westcott
Realty appeared before the Board to represent the Church of God
of Prophecy on Petition 78 -8, requesting a zoning change from R -1
to C -2 on property that runs from Taylor to Kissimmee and Lee to
Silver Star Road. Mr. Stogwall indicated that the church plans to
sell the property and said property would be worth more if zoned
commercial.
Mr. Bowness asked if there were any comments or objections from
the audience. There were two citizens present in behalf of said
petition out of 70 notices sent.
Mr. James A. Baker stated he is not against the zoning being
changed to commercial, but is opposed to C -2 zoning because of
the allowances said zoning affords and feels the property should
be zoned C -1.
Following comments from the Board, Mr. Busch stated that when the
new comprehensive plan goes into effect the area will likely be
zoned C -2, therefore, he moved to recommend to Council to change
the zoning from R -1 to C -2. Brooklyn seconded. One nay by
Mr. Carter. Motion carried.
II. Mr. John Hallahan appeared before the Board in reference to
expansion of his foster home in Peach Lake Manor. Mr. and Mrs.
Hallahan keep small crippled children in their home and are
presently keeping 10 but plan to go to the State maximum of 16.
The home is located on Jemima Avenue. They have purchased another
residence adjoining their property on the rear facing on Mona
Avenue. Mr. Hallahan wants to construct a covered walkway between
the two houses to protect the children when it rains. Mr. Hallahan
indicated that he had discussed his plans with his neighbors and
there were no complaints or objections.
Mr. Hurst raised the following questions regarding legality and
easement:
(1) At what point do we cease to become a private residence and
become a child care center or nursing home which is not allowed
in R -1?
(2) When two single family residences are connected together,
do they become a duplex which is not allowed in R -1?
Mr. Carter indicated that human lives are to be considered in
this matter.
Mr. Timbes moved to recommend to Council to grant Mr. Hallahan's
request for a covered walkway stipulating that an agreement be
signed and notarized and kept on file at City Hall stating that
if Mr. Hallahan should sell the home or should something happen to
Mr. Hallahan and his wife of if enough neighbors complain agree-
ment is voided. Mr. Busch seconded. Vote unanimous.
III. Discussion was brought up by Board members regarding the
Peddler's Corner on the corner of Geneva and Kissimmee Avenue
which has become a "junkyard" rather than a credit to the com-
munity. The building inspector was requested to look into said
matter and inform. Mr. Heeb that he is in violation of the zoning
ordinance.
IV. The minutes of the meeting held December 19th were accepted
as read.
V. Mr. Busch moved to adjourn. Mr. Timbes seconded. Meeting
adjourned at 8:45 P. M.
