MINUTES OF THE PLANNING AND ZONING BOARD MEETING HELD MARCH 11, 1980

Call to Order
Meeting was called to order in the Commission Chambers by Chairman McRobert
at 7:35 P.M.
Minutes Approved
Brooklyn moved to accept minutes of the meeting held February 26, 1980
as written. Mr. Aho seconded. Vote unanimous.
Public Hearing - Zoning Request, Petition 80 -3 - Change from C -2 to R -3,
Silver Star Road (Lots 20 -21, Town of Ocoee; Lots 70 -73 Sims)
Mr. Jack Thomas, Representative for the prospective buyers Mr. & Mrs. Pedrick,
stated that the Pedricks intend to construct 6 - 4 unit apartments on property
if Petition 80 -3 is approved.
.. Three Board members and two property owners in Pioneer Key Park commented that
they were against the change of zoning if the apartments would be rented to an
undesirable class of people.
Building Inspector, Mr. Hurst said the area at present is an "eyesore" and
needs to be cleaned up and that any old buildings left would be downgrading
to said area.
Sanders moved to recommend to Council to change zoning from C -2 to R -3.
Motion died for lack of second.
Mr. Aho moved to recommend to Council that zoning request be denied.
Mr. Brooklyn seconded. Brooklyn, Aho and Lait voted yea. Lande and Sanders
voted nay. Motion carried.
Tim Gabriel - 701 Comprehensive Plan
Tim Gabriel from Briley, Wild & Associates commented on the review of the
701 Comprehensive Plan received from the State Department of Community Affairs.
Mr. Gabriel read the letter he had written in reply to said review. (See
attached letter dated March 10, 1980).
Mr. Gabriel made the following comments:
.. 1. Keep the plan updated as the City grows.
2. Schedule both hearings at the same time within the next three weeks.
3. City should be able to adopt the plan in the next 30 to 45 days.
4. Legal requirements have been met.
5. Priorities need to be scheduled implementing plan.
Mr. Lait moved that the board retain Briley, Wild for professional help
�... and that the City Commission should have Briley, Wild's professional help
as an advisory capacity. Mr. Lande seconded. Vote unanimous.
Members of the Board recommended that Mr. Gabriel be present for the public
hearing on said plan.
Adjournment
Meeting adjourned at 8:30 P.M.

Dear Mr. Garretson:
Pursuant to your letter of 02- 11 -80, regarding the above referenced
document, the following represents a written reply to state objections and
comments in accordance with s. 163.3184 (2) FS.
.., I. OBJECTION
•
The proposed plan does not contain fiscal proposals for identified
capital improvements requiring the expenditure of public funds, nor the
economic assumptions on which the plan is based as required by s. 163.3177
(3) F.S.
RESPONSE
At the present time, the City of Ocoee has recently completed the
majority of improvements identified in their long range capital improvement
program. Consequently, a new program is being developed that will rely
heavily on recommended courses of action contained in this plan. It is
anticipated that priority rankings and timing for these improvements will be
established based on identified needs and actual availability of funds. When
this program is developed, and accepted by local officials, the proposals
contained therein will become part of the Comprehensive Plan for the City of
Ocoee.
With regard to economic assumptions on which the plan is based,
Chapter 3 Population and Economy presents existing and projected populations
for the city. Analysis of this information and data presented regarding 1970
Employment Characteristics establishes Ocoee as a "Bedroom" community with
the majority of existing and projected future residents working outside the
city limits. Therefore, the prime stimulus for future growth will be

directly related to regional economic growth patterns. Consequently, the
plan assumes continued growth of the Orlando Metropolitan Area as indicated
in the plan.
II. OBJECTION
The proposed plan does not contain an adequate discussion of the
City's drainage problems and needs or a description of general facilities
that will be required to address the needs. The brief discussion of drainage
in the natural systems section of the plan is much too general to meet the
requirements of s.163.3177 (6)(c) F.S.
_., RESPONSE
As indicated on Page 2 -7 of the plan, there is little or no surface
drainage patterns in the city. Consequently, drainage facilities to control
runoff are not a key consideration at the present time. In addition,
adequate authority for stormwater management rests with DER for permitting
surface runoff from specific projects. Consequently, there are no existing
problems or needs. Any problems that may develop will primarily relate .to
water quality considerations. Conservation principle 10 on Page 2 -9, should
provide adequate direction to the city in this regard.
III. GENERAL COMMENTS
The City has reviewed the general comments submitted by the various
agencies. These canments will be discussed at a later date with regard to
applicability to the city's plan. Copies of all comments will become part of
the public record as per s.163.3184 (5) F.S. and made available for citizen
review.

Pursuant to s.163.3184, Florida Statutes, the Department
of Community Affairs has conducted a review of the proposed
Comprehensive Plan for the City of Ocoee.
gam„ Our review indicated that your comprehensive plan is
adequate to satisfy the statutory requirements except as noted
in the attached objections. Specific comments which provide
the basis for our objections are shown in the attachment for
your consideration and possible use, as well as additional
general comments on the plan. Comments of other state agencies
are also attached.
We would like to remind you that under the provisions of
s.163.3184(2), Florida Statutes, a written reply to our objec-
tions must be provided to this office within four weeks.
In order for the Department of Community Affairs to comply
with the provisions of s.163.3184(1)(a), Florida Statutes, we
request that you provide us with the date, time, and place of
public hearings to consider adoption of the Comprehensive Plan
for the City of Ocoee. Further, we request that you provide us
a copy of the adopted plan once the adoption process has been
completed.

This is in reply to your Review and Comment Cover Sheet of January 8,
1980 which transmitted Comprehensive Planning Documents prepared by the
City of Ocoee. You requested that the documents be reviewed as specified
in Sections 163.3161- .3211, Florida Statutes, and that written comments be
provided.
The City of Ocoee's Traffic Circulation Element generally meets the
requirements of the Traffic Circulation Element required by Section 163.3177(b),
roar F.S. However, it does not show proper coordination with the Orlando Urban
Area Transportation Study even though Ocoee is in the Study Area. It's
Intergovernmental Coordination Element should include the need to coordinate
transportation planning with the Metropolitan Planning Organization for the
Orlando Urban Area Transportation Study. It is suggested that the Plan
should incorporate the Orlando Urban Area Transportation Plan into the Ocoee
Plan by reference to keep these plans in consonance. The latest urban trans-
portation plan prepared by the Orlando Urban Area Metropolitan Planning
Organization and the Florida Department of Transportation could then be
included in the Ocoee Local Government Comprehensive Plan with Ocoee repre-
sentation in the Metropolitan Planning Organization through its County
Commissioners.
Ocoee should continue to coordinate its transportation planning and
implementation with the Metropolitan Planning Organization and staff of
the Orlando Urban Area Transportation Study as well as with the Fifth
District of the Florida Department of Transportation at DeLand.

COMMENTS:
It would have been helpful if a copy of the citizen survey was
included in Addendum B2 along with information about number distributed,
response rate and an analysis of the replies. The Element information could
` then contain references to this data. .
The Recreation and Open Space Element appeared to be quite superficial.
The Public Recreation Facility Inventory was poorly done. No mention at
all was made of school buildings and lands, or private facilities. This
situation could be corrected with the addition of an Inventory Table divided
into Public and Private sections and outlining facility name, location,
acreage and development. Sites could be numbered and then pinpointed (by
number) on an accompanying map to illustrate facility distribution.
We noted no correlations between the Recreation & Open Space Goals and
Objectives and those in county, region or state recreation and open space
plans. We also found no correlations between the Recreation and Open Space
Element Implementation Policies and those in other plan elements.
The analysis was also superficial. If the standards cited are not
felt to be suitable, they can be adapted to fit community characteristics.
The analysis should result in an identification of needs and, if possible,
they should be priority ranked.
While policies were outlined, a specific action plan was omited.
Information provided under the heading Planning Program seemed too general
and somewhat disorganized like the rest of the element.

SUBJECT: Comprehensive Plan for the City of Ocoee
The Sewage Technology and Planning Section of the Bureau of Wastewater Management
and Grants has reviewed the Potable Water and Sanitary Sewer Element of the
above referenced comprehensive plan. It is noted in the plan that the City elected
not to participate in the Winter Garden 201 Facility Plan, but has the option
to participate in the Orange County Southwest 201 Facility Plan. However, the
comprehensive plan did not make any recommendations as to the direction the City
should follow in the matter of waste treatment.

Pursuant to the requirements of the local Government Comprehensive Planning
Act of 1975 (H.B. 782), this office has completed its review of the subject
plan and offers the following comments and recommendations for your considera-
tion:

imw 1. The Ocoee Comprehensive Plan appears to be consistent with
the adopted Goals, Policies, and Objectives of the East
Central Florida Regional Planning Council.
2. One of the City's goals is to use "....innovative land use
techniques such as density transfers," (p.l -4). This goal
is supported by the Council. A detailed report in transfer
of development rights (TDR) is presently being prepared by
the Council staff which, when completed, may he used by the
City to achieve this worthwhile goal.
3. The Comprehensive Plan should include economic assumptions
as required by the Local Government Comprehensive Planning
Act.
4. The Council encourages and supports local government compre-
hensive planning throughout the East Central Florida Region
and commends the City of Ocoee for continuing its comprehen-
sive planning efforts.
