HomeMy WebLinkAboutPZ 08-27-1985 MINUTES OF THE PLANNING & ZONING BOARD MEETING HELD ON AUGUST 27, 1985 Meeting called to order at 7:35 P.M. by Chairman Breeze. Chairman Breeze and Board Members Sanders, Linebarier, Brooklyn, Smith present. Board Members Cook and Swickerath absent. Board Member Collella arrived at 7:40 P.M.. APPROVALS Marvin Sanders moved to approve the Special Joint Workshop Minutes of July 9, 1985, Edgar Brooklyn seconded. Approved unanimously. Edgar Brooklyn moved to approve the Workshop Minutes of July 23, 1985, Marvin Sanders seconded. Approved unanimously. NEW BUSINESS A. Application for Zoning Change - Bruce Stricker Bruce Stricker has petitioned the City of Ocoee for a zone change from Al and RC2 to R -1 -A for his property located at Johio Shores Road for the purpose of developing single family homes. Chairman Breeze commended Mr. Stricker for changing from the duplexes he had originally planned to ask for to the single family homes, since his neighbors objected to the duplexes. It was noted that Mr. Stricker has received the waiver of the moratorium from Orange County on the zoning change. Comments were made from the audience in reference to the number of homes per acre, whether the developer would pave the road and a provision for saving trees. Chairman Breeze explained that Nor this was not a function of the Zoning Board but rather up to the City Board of Commissioners. Burton Smith moved to approve the petition for zone change as submitted, John Linebarier seconded. Approved unanimously. B. Application for Zoning Change - Marc Grimes, Agent for Rodney Metz, Partner Marc Grimes, Agent for Rodney Metz has petitioned the City of Ocoee for a zone change from Al and C2 to PS for his property located at the Northwest corner of Maguire Road and the Florida Turnpike. Mr. Grimes explained that they wanted to subdivide the property into a professional park with mainly medical and professional offices. He is concerned with the request by the City for a street extension through his property as most of the property behind them is zoned C3 and they do not want semi trucks running through their property. Planner Russ Wagner explained that the reason they asked for the street extension was to get direction for Mr. Grimes when he is preparing his plat. There are several long and landlocked parcels that could be developed in the future and the city should plan for future develop- ments. Chairman Breeze stated that he could not see penalyzing the developer or City purchasing right -of -way. Mr. Grimes stated that he would not be able to deny those property owners access or shut them off. Wayne Dann told the board that he owned property behind this property and a lot of it was swamp and the muck is very deep in that area. Chairman Breeze was not in favor of the road. City Manager Griffin stated that the only reason Mr. Wagner brought it up was to try to provide dual access. Edgar Brooklyn moved to approve the zoning request as submitted, Marvin Sanders seconded. Application for Deannexation - Wayne Dann, Sr. Wayne Dann, Sr. has petitioned the City for deannexation of his property %ow located on Marshall Farms Road South of Highway 50. City Manager Ken Griffin explained the reason for this petition to the board. In 1977, Ordinance 648 of the City of Ocoee was adopted and this included the property owned by Mr. Dann. Mr. Dann was never notified of the annexation and the Ordinance shows the owners to be First Realty Advisors. It is thought that possibly the wrong legal description was used for the Ordinance as it includes a whole 1/4 section. This matter was brought to light when City staff was working with Orange County in trying to make sure all of the annexations had been sent to them and in trying to get new maps showing current city boundaries. Mr. Dann's property was then put on the City tax roll and he was made aware of being in the City limits - this was his first notification. Chairman Breeze stated that they wanted to do what they could to make it right. City Manager Griffin said they would have to deannex. Marvin Sanders moved to approve the petition for deannexation as presented, John Linebarier seconded. Approved unanimously. COMMENTS A. CITY MANAGER 1. Site Plan Ordinance - City Manager Griffin asked the boards'feelings on a site plan ordinance. The new subdivision regulations are brief and the staff feel they could process better if they had guidelines. Chairman Breeze felt they could handle better also if they pick up the spot lots and regulate those. 2. Short Form Subdivision Ordinance - City Manager Griffin asked the board if they would favor a short form subdivision ordinance and establish a break off point of say 12 or less(13 or more) or 5. Chairman Breeze asked if we needed or could we adjust the existing subdivision regulations. 3. Report on Building Official - City Manager Griffin explained that we have not had a building official; therefore, the last 6 weeks have not been entirely devoted to planning. B. CITY PLANNER 1. Land Use Study - City Planner Wagner submitted a land use map to the Zoning Board. He stated this was the first land use map done to this extent for the City of Ocoee. It is the basic planning tool as you have to know where you are before you know where you are going. He and Intern Hommersom drove all over the City and saw every parcel in the City of Ocoee. Mr. Hommersom is doing the statistical work up. The progress is slow on the Comprehensive Land Use Plan due to the development going on within the City and the lack of a Building Official. Planner Wagner reported that they met with Orange County today reference a reserve area. Chairman Breeze stated that we ultimately need to know a definite service area. Mr. Wagner said we hope to eventually reach the point where our plan and their plan is compatible. Mr. Linebarier asked how receptive the County was to our suggestions. City Manager Griffin stated that the County had been congenial, helpful and candid and this was the second face to face meeting with them. Chairman Breeze stated that we could and should square off our boundaries and eliminate islands. C. No Comments D. No Comments "�Irr Edgar Brooklyn moved to adjourn, Marvin Sanders seconded.
