Planning and Zoning Commission Meeting Minutes of July 9, 1991
Planning and Zoning Commission member Carroll moved to approve the
Planning and Zoning Commission meeting minutes of July 9, 1991,
Commission member Weeks seconded, and approval was unanimous.

Presentation by Orange County Parks and Recreation Department
Regarding the West Orange Greenway
Director of Planning Behrens introduced Bill Thomas, Planner for
the Orange County Parks and Recreation Department. Mr. Thomas
explained that the Greenway was a proposed recreation facility
which could be used for bicycling, hiking, horseback riding, etc.
He said it would be comprised mostly of an abandoned railroad
corridor and that the West Orange section would start in Apopka and
would run through Ocoee, Winter Garden, and Oakland to the Orange
County /Lake County line. He said eventually they may take it north
through Apopka to Weikiva State Park. Mr. Thomas had a map showing
the proposed route and explained that there were alternate routes
being examined as well, especially since the portion through Winter
Garden was currently an active railway line. He said there was
potential for 70 miles for the entire corridor and that the West
Orange section would run about 16.5 miles from Apopka to the
Orange /Lake County line.
Mr. Thomas showed slides of the land proposed for the West Orange
Greenway including a slide of a bridge over the Turnpike to be
utilized. He said the committee studying the trail was proposing
a 12 foot width. He also showed slides of existing trails in
Baltimore and Washington.

Mr. Thomas explained that of the land proposed for the Greenway, 30
percent was still owned by the CSX Railroad Company, 30 -40% was
already publicly owned, and 30% was currently under private
ownership, 50% of which the Greenway committee felt could easily be
purchased. He said the County would be working on acquiring the
CSX land over the next six months.
Mr. Thomas said the State of Florida had recently ranked this
section the highest for new corridors for priority in funding, and
third on the list overall. He said he was here before the Planning
and Zoning Commission tonight to provide the members with an update
of what has been happening in the past year with the Greenway as
well as to let them know that a portion of the Greenway is slated
to go through the proposed new City of Ocoee golfcourse. Mr.
Thomas asked that if at all possible, the City keep the Greenway in
mind when design is going on so that the continuity of the Greenway
can be preserved by somehow providing for the trail through the
golfcourse property.
Mr. Thomas said he will go before the City Commission on Tuesday,
August 20, to give them a similar presentation. He reminded the
Planning and Zoning Commission that the City Commission had passed

Greenway.
Public Hearing - Case No. 1- 6R- 91:NJB FEINSTEIN
Director of Planning Behrens read the staff report in its entirety.
Mike Todd of Donald McIntosh Associates was at the meeting on
behalf of the petitioner in the event there were any questions.
Vice Chairman Shiver opened the public hearing for comments.
Frank Fenneran, 507 Nicole Boulevard, wanted to know what the
process was for developing the property if the petitioner was
granted the rezoning. Director Behrens explained that the
developer would have to submit plans for staff review and that the
plans would have to come back before the Planning and Zoning
Commission and then to the City Commission and that the property
owners within 300 feet would be notified of these hearings.
Director Behrens explained that it is quite a lengthy process with
both Preliminary and Final Engineering Plans and then the property
has to be platted.
Frank Torbort, 2001 Paula Michelle Court, wanted to know whether
the rezoning request was for the total parcels outlined or just the
gray shaded areas. Director Behrens explained that the petitioner
was only seeking rezoning for the gray shaded area.

There being no further public comments, Vice Chairman Shiver closed
the public hearing. Planning and Zoning Commission member
Swickerath moved to recommend approval of the rezoning request as
outlined in the staff report, Commission member Carroll seconded,
and approval was unanimous.
Public Hearing - Case No. 1- 2AR- 91:GOODMAN
Director of Planning Behrens read the staff report in its entirety.
Director Behrens explained that the request for annexation and
rezoning not only complied with Ocoee's proposed Comprehensive Plan
but it also complied with Orange County's Plan and the County did
not have any objections to this petition.
Vice Chairman Shiver opened the public hearing.
Charlie True of Donald McIntosh Associates was at the meeting
representing the petitioner. Mr. True said they were pleased that
Ocoee and Orange County were in agreement and had no further
comments.

There being no further comments, Vice Chairman Shiver closed the
public hearing. Vice Chairman Shiver asked Director of Planning
Behrens if the annexation and rezoning of the property should be on
the same agenda as the Preliminary Plan approval for a subdivision
on that same property. Director Behrens said the City Attorney
said it was legally permissible and that at the City Commission
level the Preliminary Plan approval would be subject to the
annexation /rezoning approval.
Vice Chairman Shiver said he would like to discuss the general
issue of how these items are placed on agendas but that he would
defer any further comments to Other Business later on in the
meeting.
Planning and Zoning Commission member Carroll moved to recommend
approval of the annexation and rezoning request as stated in the
staff report recommendation, Commission member Swickerath seconded,
and approval was unanimous.
Goodman Commercial Park - Preliminary Subdivision Plan
Director of Planning Behrens read the staff report in its entirety.
He gave a copy of the Development Review Committee meeting minutes
to the Commission members for their information or reference.

meeting discussion concerned the road through the project that
connected Old Winter Garden Road with State Road 50. He said the
developer had to obtain a DOT permit for State Road 50 as well as
approval from Orange County for Old Winter Garden Road. Director
Behrens said that all the standards and specifications would be
outlined in detail on the Final Engineering Plans.
Commission member Swickerath commented that the signal (green
light) from Old Winter Garden Road across State Road 50 to Bluford
Avenue was on a very short cycle and that the traffic backed up
there especially during the two peak times of day. He said his
biggest concern was that there be no curb cuts from either Old
Winter Garden Road or State Road 50 into or out of the lot on the
corner (Lot 1). Commission member Swickerath also said he would
like to see as many of the trees preserved as possible. Director
of Planning Behrens said the City requires a tree survey and
mitigation of 4 to 1 for trees that must be removed.
Commission member Carroll asked about the retention pond and the
drainage design. Charlie True explained that there would be no
more water running off the site than there is at the current time
and that they would show more detail at Final Engineering. He said
Pond B was designed to handle any overflow from Pond A which was
part of an already existing pond.
Mr. True said as far as access to Lot 1 on the corner of State Road
50 and Old Winter Garden Road, the only access would be from the
interior road. He said the developer would not have any problem
with a condition of approval being that Lot 1 not be permitted any
access from State Road 50 or Old Winter Garden Road. Mr. True said
the interior road would be the only thing to access State Road 50
or Old Winter Garden Road and that all the lots would be accessed
only from that interior access road.
Alternate member Bateman said he spent time out at the site
watching the traffic between 4:30 -5 p.m. and that one of every
three cars turned right onto State Road 50 from Old Winter Garden
Road. He feels that the access road will become a short cut for
traffic trying to go east on State Road 50 and he would not approve
of a plan that would encourage this sort of "cut through ".
Commission member Swickerath said Alternate member Bateman had a
valid point and he asked Mr. True about the possibility of making
the access road a little less attractive for use as a short cut.
Charlie True said the "cut through" that everyone was talking about
would be unlike cutting through a shopping center. He said it
ripw would be more difficult and less attractive for a short cut because

the access road would be a public street with signage. He said the
traffic would therefore be more controlled and that it may even
ease the congestion on Old Winter Garden Road at State Road 50.
Vice Chairman Shiver agreed with Mr. True and said he had seen
similar improvements with easing the traffic congestion at Old
Winter Garden Road and Professional Parkway once people were able
to use the West Orange Commercial Park as a cut through.
Alternate member Bateman said if the road was left as is on the
Preliminary Plan, he would recommend that only a right turn be
allowed from the access road onto State Road 50 (heading east).
Vice Chairman Shiver recommended approving the Plan as presented
and then making that change later if a problem presents itself.
Alternate member Bateman stressed that he did not want to wait for
accidents to happen before acting. Mr. True said they were not
convinced that the access road will be a problem and if it ended up
being a problem, they would not mind changing it to a right turn
only. Mr. True said his staff had discussed all the issues
regarding the access road that the Planning and Zoning Commission
was raising this evening and that he thought they had done a good
job at minimizing any potential problems. He said one of the
reasons the road was designed that way was to keep from having to
have any of the lots directly access either Old Winter Garden Road
or State Road 50.
Commission member Carroll moved to recommend approval of the
Preliminary Plan for Goodman Commercial Park subject to the traffic
onto State Road 50 being limited to making right hand turns only.
Commission member Swickerath seconded the motion and then under
discussion asked Commission member Carroll to amend his motion to
include the provision that there be no curb cuts onto Old Winter
Garden Road or State Road 50 other than the access road.
Commission member Carroll agreed to the amended motion and
Commission member Swickerath agreed to second the amended motion.
The vote was unanimous in favor of the motion.
OTHER BUSINESS
Director of Planning Behrens told the Planning and Zoning
Commission members that the Westridge PUD amended Land Use Plan
that they had unanimously denied at the July meeting had been
pulled from the City Commission agenda by the developer. The
developer said he wanted to reanalyze the Plan before going any
further.

Director of Planning Behrens also reported that the City was just
about finished with its responses to the State's ORC Report on the
City of Ocoee's Comprehensive Plan. Director Behrens said Montye
Beamer took the responses to the Department of Community Affairs
and thought they received a favorable reaction. Director Behrens
said there are no major issues left unaddressed although the State
still has to go through the responses once they are formally
approved by the City Commission before the City finds out if we are
in compliance or not. He said the changes would be brought before
the Planning and Zoning Commission at the September meeting for
their recommendation for approval.
Commission member Swickerath complimented Director of Planning
Behrens, City staff, and his Planning and Zoning Commission
colleagues for an exceptional job in putting together the
Comprehensive Plan. He said he was very impressed with Ocoee's
efforts, especially when he looked at what other communities had
done. Director Behrens said he was proud of the Plan and if they
were for some reason found not in compliance, the City was ready to
negotiate with the State.
Director of Planning Behrens also told the Planning and Zoning
Commission members that the section of Clark Road to be built by
the developer of Prairie Lake PUD may be built at the same time as
the rest of Clark Road.
