HomeMy WebLinkAboutPZ 12-10-1991 MINUTES OF THE PLANNING AND ZONING COMMISSION MEETING HELD ON TUESDAY, DECEMBER 10, 1991 CALL TO ORDER: 7:30 p.m. PRESENT: Planning and Zoning Commission Vice Chairman Shiver, Members Swickerath, Weeks and Carrol, Director of Planning Behrens and Deputy Clerk Muchetti. ABSENT: Planning and Zoning Commission Chairman Sims, Members Bond, Switzer, Rhodus and Bateman. Planning and Zoning Commission Vice Chairman Shiver presided over the meeting as Chairman Sims was not in attendance. CONSENT AGENDA Planning and Zoning Commission Meeting Minutes of November 12, 1991 Planning and Zoning Commission Vice Chairman Shiver called for a motion to approve the Planning and Zoning Commission Meeting Minutes of November 12, 1991. Planning and Zoning Commission member Weeks moved to approve the Minutes; Planning and Zoning Commission member Carroll seconded and the motion passed Nor unanimously, 4 -0. NEW BUSINESS Approval of Twin Lake Forest Addition Final Engineering Subdivision Plans, #91 -005. Planning and Zoning Commission Vice Chairman Shiver said that since this is just a consent agenda did they have to discuss it or could they just move to approve it. Planning Director Behrens said they could do as they wish; approve it or pull it. Planning and Zoning Commission member Swickerath wanted to know if he could ask the Vice Chairman and Planning Director a question of something on the consent agenda without owing it. Planning Director Behrens said yes. Planning and Zoning Commission member Swickerath said that the plans had been reviewed by everyone and everyone seemed happy; typically the members received a list of items that are to be resolved or agreed upon to be resolved; this was absent from this package. Planning Director Behrens said that there were no items; everything had been resolved to the satisfaction of the City Engineer and all other department heads. Planning and Zoning Commission Vice Chairman Shiver asked Commission member Carrol if the question he had on Lot 20 had been Minutes, P &Z Meeting, 12 -10 -91 Page 2 `rr resolved. Planning and Zoning Commission member Carrol said no, that he could still see it on the plans. Commission member Carrol said he could see the easement for a drainage ditch but not down Lot 20; on top of that, according to his estimations, [looking at plans] they are running a low of a 160 elevation; at the corner of the lot is 158.5 but going into Lot 18, where the water will flow, it goes up 6" -- water isn't going to climb 6 ". Planning and Zoning Commission Vice Chairman Shiver said that maybe this is pollution control. Planning Director Behrens said here is the engineer [motioning towards Mr. Weinstein] who could speak for the issue. Planning and Zoning Commission Vice Chairman Shiver asked Mr. Weinstein to step forward and, using the plans spread out on the table in front of him, asked Mr. Weinstein to explain Lot 20; [pointing to plans] the plans show Lots 17 and 18 having a 10' easement but no easement on Lot 20. Jack Weinstein, Donald W. McIntosh Associates, Inc., 2200 Park Avenue North, Winter Park, FL 32789, representing the developer: Yes, I can; this easement [pointing to plans] is in effect benefiting Lot 20; this part of easement benefits Lots 18 and 20. Lot 20 being the benefactor would not need an easement on the lot as there is no public water from the roadway -- it drains around Now into the system -- this is just to provide for lot drainage around the side. Planning and Zoning Commission Vice Chairman Shiver [pointing at plans] said we are going to dump water here; is this eleveation good over in the other property? Planning and Zoning Commission member Swickerath said 159 and 158? Planning and Zoning Commission Vice Chairman Shiver said we're dumping water at this point, 160, here we have 159, running at 158 1/2, now back up to 159; I don't believe water will run up hill. Someone asked Mr. Weinstein if that was pollution control. Mr. Weinstein [looking at plans] said it looks like this should have been 158, possibly these are wrong numbers. Planning and Zoning Commission Vice Chairman Shiver [pointing at plans] said here's the same thing over here, climbing almost a foot. Mr. Weinstein said that once Mr. Todd gets here he can explain this; that this must be a type -o. Planning Director Behrens asked if they would please red line the areas they are discussing so that he could show it to the City Engineer. Planning and Zoning Commission Vice Chairman Shiver said [still pointing to plans] here's another over here, imagine this was just a type -o, 146. Mr. Weinstein said [pointing at plans] that the level of the water supercedes the weire elevation, the bump; this may be a 5 year storm, this may be a 20 year storm. (At this point all Commission members and Mr. Weinstein were Minutes, P &Z Meeting, 12 -10 -91 Page 3 ifirw discussing different parts of the plans all at the same time, each group speaking into a microphone. There was no way to correctly transscribe conversation) Planning Director Behrens asked Planning and Zoning Commission member Carrol if all his questions had been answered. Planning and Zoning Commission member Carrol said, no. Planning Director Behrens said to write them down and we will have the City Engineer answer them. Mr. Weinstein asked how we can solve the problem if there is one. Planning and Zoning Commission Vice Chairman Shiver said the first question is, is there a problem. Mr. Weinstein said he wasn't sure with the utilities if there was; he couldn't tell if that easement was granted with this plat. [Enters Mr. Todd of McIntosh Associates] Planning and Zoning Commission Vice Chairman Shiver to Mr. Todd, we have a couple of questions on the plat; (pointing to plat) here it shows water running uphill in 3 places. Mike Todd, Donald W. McIntosh Associates, Inc., 2200 Park Avenue North, Winter Park, FL 32789 representing the developer; [walking up to the front table]: No it doesn't show it running uphill, it shows it can't run any further [pointing to plan] than that between points a and b. Planning and Zoning Commission member Weeks said according to indications it's uphill. Mr. Todd said [pointing to plan] this 158.5 is the center line of swale, 159 is property line, 1/2 foot drop off property; lines run this way, not this way; goes from 157 to 155 to swale; these are high spots and this in the center is low spot; 3 grades that create up, down, up. Planning and Zoning Commission Vice Chairman Shiver said [pointing to plan] this shows water going from 146 up to 164; don't think you can do that. Mr. Todd said that is obviously a type -o. Planning and Zoning Commission member Swickerath said the next question is about easements along the property. Someone asked if Mr. Todd was familiar with the easement grating at Shari Estates? Mr. Todd said [pointing at plan] there is an easement along the property line. Planning and Zoning Commission member Swickerath said I think the question is whether or not we need a few more feet on our side to make the easement whole; do you know if the plat calls for an easement ?; a five foot easement won't make it. Planning and Zoning Commission Vice Chairman Shiver said that really you have it here [pointing at plan] but you need it here [pointing at plan]. Planning and Zoning Commission member Swickerath said that is just drainage up there; all they're doing is the swale. Mr. Todd said that easement doesn't benefit, won't benefit the phone company. Planning and Zoning Commission member Shiver said [pointing to plan] this 5' easement won't either if this guy puts up a fence line; there's no way in the world you can ,. get down there. Mr. Todd said that's the way esements always are, Minutes, P &Z Meeting, 12 -10 -91 Page 4 `or split on property lines; the line [pointing to plan] is completly on the other side of the fence which is continued -- utility line is on this side; would seem reasonable to put 5' (pointing to plan) down here - they can add that to whatever they have on the other side. Planning and Zoning Commission Vice Chairman Shiver said to Mr. Todd, as you said, show it here (pointing to plans), line here; this may be the telephone line that you are speaking of but it just appears to me that this part right here (pointing to plans) is an easement; I think the other set of drawings we went over, we had discussed before, this right here (pointing to plans) was the property line of this section here, at this point, and all the easement was on one side. Mr. Todd said as it stands, right now all easements are on one side but this isn't dedicated yet. When it does get dedicated...Planning and Zoning Vice Chairman Shiver said if that's sufficient. Mr. Todd said typically, 5 -6 -7' on lot line is what they get. Planning Director Behrens asked if that answered all questions. Planning and Zoning Commission Vice Chairman Shiver asked all members present if they were satisfied; all were; he asked for a motion concerning this agenda item, to approve or disapprove Final Engineering plans for Twin Lake Forest Addition. Planning and Zoning Commission member Carrol motioned to approve the Final Engineering plans for Twin Lake Forest Addition. Planning and Zoning Commission member Weeks seconded the motion. Planning and Zoning Commission Vice Chairman Shiver asked if there was any discussion before passing? Planning and Zoning Commission member Swickerath said he wanted a committment from the Engineer to correct the one spot elevation; could the motion be ammended to state that? Planning and Zoning Commission member Carrol said ok, so motion will be as is with the understanding the Engineer is to correct the one item. Planning and Zoning Commission Vice Chairman Shiver asked if everyone understood; the vote was taken and the motion carried unanimounsly, 4 -0. OTHER BUSINESS Planning Director Behrens asked if everyone knew we had been found in compliance - all members present had been informed; contract in works for the golf course; space needs analysis on new City Hall next Tuesday night at 6:30 pm. Planning and Zoning Commission Vice Chairman Shiver asked if it is a bonded project? Planning Director Behrens said it is ICMA, he believed the money is already in the bank. Planning Director Behrens said the 5 developers have brought in Preliminary Engineering plans: Plantation Grove East; modified lioror Plantation Grove West; possibly Lake Lotta; amended Silver Glen; Minutes, P &Z Meeting, 12 -10 -91 Page 5 possibly Prairie Lake PUD. Planning and Zoning Commission Vice Chairman Shiver asked how many of these are take -offs of Wesmere change? Planning Director Behrens said there is a big push for everyone to ask for 55 -60' lots; haven't seen any 40' yet but understand that's what's happening in CA; the modular concept starts with 900 -1200 sq ft and as you grow in income and family then you add on another modual; new rage in CA but haven't seen it here yet. Planning and Zoning Commission Vice Chairman Shiver said there is nothing wrong with high density use of property -- it's insane spreading all the services out. Planning Director Behrens said look at Silver Glen -- ask where the 2 story 40' products are -- one of their requests will be for 55' lots -- they have a 40', 2900 sq ft, 2 story product in the ground, 2 of them, at Silver Glen that I've seen; they want to take their 80' lots and drop to 55' -- part of a national trend; people want to get away from yard maintenance. Planning and Zoning Commission Vice Chairman Shiver asked for a motion to adjourn. Planning and Zoning Commission member Carrol motioned to adjourn; Planning and Zoning Commission member S 'ckerath seconded; the meeting was adjourned at 7:57 pm.
