HomeMy WebLinkAboutPZ 07-14-1992 MINUTES OF THE PLANNING AND ZONING COMMISSION MEETING HELD JULY 14, 1992 CALL TO ORDER The meeting was called to order by Chairman Shiver at 7:35 p.m. followed by a moment of silent meditation and the Pledge of Allegiance. The determination of a Quorum was made. PRESENT: Chairman Shiver, Vice - Chairman Switzer, Members: Weeks, Rhodus, Swickerath (arrived 7:38), Alternates: Miller, Landefeld, Director of Planning Behrens, and Deputy Clerk King. ABSENT: Members: Sims and Bond CONSENT AGENDA Previous meeting minutes were unavailable for review and recommendation at this meeting. NEW BUSINESS OCOEE INDUSTRIAL PARK, PRELIMINARY SUBDIVISION PLAN (Public Meeting) Planning Director Behrens read the staff report of July 10, 1992 stating that the issue is "Should the Planning and Zoning Commission recommend approval of the Preliminary Subdivision Plans for Ocoee Industrial Park? The Ocoee Industrial Park is zoned I -2, and consist of 22 Lots (1/2 acre lots) on 17 +/- acres. There were four (4) major issues on this proposed development: 1) How the alignment of the Western Beltway would impact the proposed development; 2) How the proposed development would impact the adjacent residential area (Joe Louis Subdivision) in Winter Garden; 3) Conservation area determination; and 4) Defining the flood prone area. err• Planning and Zoning Commission Meeting Minutes July 14, 1992 Page 2 Issue #1 The proposed development was discussed with the Orlando Orange County Expressway Authority. In their response letter the Authority states that the financial feasibility of the Western Beltway is undetermined and that the Authority has neither funded nor scheduled right -of -way acquisition. In any event, the construction of the Beltway would not affect the first phase of this proposed development - Lots 1,2,3,19,20,21, and 22. Issue #2 Impacts to the residential area adjacent to the proposed development have been minimized by: a) allowing no vehicular traffic from the proposed development into the subdivision; and b) a 25 foot natural buffer separating the proposed development from the residential subdivision. Lots 13 and 14 on a cul -de -sac are adjacent to existing Bay Street (a 60' right -of -way) this is the Joe Louis Subdivision in Winter Garden. The DRC felt that putting an entrance into the Joe Louis Subdivision would not be the right thing to do. There is a 25' natural buffer and a 40' tree line that should be preserved. Issue #3 Assistance from Orange County was requested to help staff determine the possible existence of a conservation area on the site of the proposed development. The determination was made that there are no jurisdictional wetlands connected with this proposed development. Attached to the staff report was a letter from Ed Williams, Orange County Planning Director at the time, dated February 17, 1992. The letter describes the investigation they did on site. The City has an intergovernmental local agreement that provides for the City to get assistance from Orange County at no charge when there is a need for a jurisdictional wetlands determination. Issue #4 The Development Review Committee (DRC) met and reviewed this proposed development on June 3, 1992. The DRC voted unanimously to approve the Preliminary Subdivision Plans subject to the City Engineer's review of the Flood Elevation Study submitted by Harling Locklin. Planning and Zoning Commission Meeting Minutes July 14, 1992 Page 3 The City Engineer asked that the following appear on the Preliminary Plan as Note #14 under Site Data: "14. The owners acknowledges that the City does not agree with the flood prone area provided and that elevation shall be determined during Final Engineering design to support flood prone area to the satisfaction of the City Engineer." This note does appear on the plan. Staff recommends that the Preliminary Subdivision Plans for Ocoee Industrial Park be approved as submitted. Joan Randolph, Planning Director, Harling, Locklin & Associates, 850 Courtland Street, Orlando, Florida 32804. Joan Randolph stated that the unincorporated area - the FEMA Map for Ocoee shows no flood area. Ms. Randolph will provide information to City Engineer Jim Shira knowing that she must address his concerns on the flood prone area at Final Engineering. The Location Map on the plan should be changed to show City of Ocoee on the east side of the dividing line and Winter Garden on the west side. The property is zoned I -2 for heavy industrial. Concerns brought up by the Board were: 1) the length of the cul -de- sac; 2) emergency traffic availability since this is a heavy industrial area; 3) small size lots; 4) no secondary access (one - way into the subdivision); 5) uses permitted; 6) flag lots; and 7) road width. Planning Director Behrens stated that Note #13 on the plans request a waiver to permit a cul -de -sac at the end of Street "A ". This request is based on compliance to the Future Land Use Polices 2.2 and 2.5 that prohibit road connections between industrial developments with existing residential neighborhoods. Planning and Zoning Commission Meeting Minutes July 12, 1992 r► Page 4 Planning Director Behrens stated that there was little choice to have a secondary access since the Joe Louis subdivision is a single - family subdivision. Jim Swickerath commented that: 1) would it be possible to access the Joe Louis Subdivision; 2) the road does not have to be a paved road, and 3) a crash bar or gate at Joe Louis Subdivision be recommended as a secondary emergency access. Planning Director Behrens strongly recommended against the access through the Joe Louis Subdivision because of the 40' tree line. Jim Swickerath stated that people can get hurt at the office especially in I -1 or I -2 zoning. There is only one way to get into the place, provide another means of ingress /egress for fire and emergency traffic (crash gate). This would protect the health, safety and welfare of the community. Planning Director Behrens stated that the letter from Harold Worrall, Orlando- Orange County Expressway Authority of May 11, 1992 says that the right -of -way acquisition has not started for this area. 4 "'` Rick Neal, Representative, Orange Bank stated that when the Preliminary Subdivision Plans are approved, a full set of Final Engineering plans for Phase I and II will be submitted. Building will be done in phases. Phase II will be built and the concerns about the Beltway will come later. There was some question on the marketability of Phase II from the Board knowing that the Beltway is planning to take that area. (The Expressway Authority funding is not in place at this time.) Chairman Shiver called for the question. Member Rhodus recommended approval of the Staff Recommendation to recommend approval of the Preliminary Subdivision Plan. Member Weeks seconded. Discussion: Joan Randolph stated that on the plans Note #12 should be deleted because the developer withdrew the waiver after the Development Review Committee denied the request that no sidewalk be required along local streets. The Developer did not want to pursue the waiver request. The vote was 4 -1 in favor of the motion with Jim Swickerath opposing. klav Planning and Zoning Commission Meeting Minutes July 12, 1992 Page 5 The cul -de -sac on this plan is 1600 feet long. The code calls for 800 feet between intersections. The cul -de -sac was looked at by the fire department and the DRC approved it. Planning Director Behrens stated that if the Board felt that there is a flaw in the code then we need to look at it and make a possible change. OTHER BUSINESS None ADJOURNMENT Member Rhodus moved to adjourn, Vice - Chairman Switzer seconded, and the motion carried unanimously.
