MINUTES OF THE PLANNING AND ZONING COMMISSION
REGULAR MEETING HELD TUESDAY, NOVEMBER 10, 1992
CALL TO ORDER
The meeting was called to order by Chairman Shiver at 7:30 p.m.
followed by a moment of silent meditation and the Pledge of
Allegiance.
The determination of a Quorum was made.

Jim Swickerath, Gerald Weeks, Alternate: Louis
Landefeld, Director of Planning Bruce Behrens,
Deputy Clerk Ellen King.
ABSENT: Tanya Miller

Vice - Chairman Switzer moved to approve the items on the Consent
Agenda, Commissioner Landefeld seconded, and the motion carried
unanimously.
NEW BUSINESS
JOHIO MEADOWS, PRELIMINARY SUBDIVISION PLANS
Chairman Shiver stated that the Public Hearing was duly advertised
in the Orlando Sentinel, per notice attached to the Staff Report.
Director of Planning, Bruce Behrens read the Staff Report into the
record. The issue was "Should the Planning and Zoning Commission
recommend approval of the Preliminary Subdivision Plan for Johio
Meadows ?"

The Development Review Committee (DRC) met and reviewed this
proposed development on October 13, 1992. The DRC unanimously
voted to approve the Preliminary Subdivision Plan subject to
building the park (25 car parking lot and tennis court) within one
year of Final Subdivision Plan approval.
Staff recommended that the Preliminary Subdivision Plan for Johio
Meadows be approved as submitted.
Planning Director Behrens stated that a waiver has been requested
on Lot #16 for a 25' Setback Line. This is a waiver to Appendix
5.1 of the Land Development Regulations (Gold Book), determining
the Building Setback Lines. This is a flag shaped lot, and on Lot
#16 the developer would, according to code, have to measure back to
the minimum lot width of 70'; that would mean the Developer would
have to move back 60' to meet the 70' lot width requirement;
creating an area that would not be big enough for a lot pad to
build a house. If the developer measures back 25' at that point
the lot width would be 55', a difference of 15'.
Chairman Shiver opened the public hearing.
Gary Singer, Applicant, 6305 Westwood Blvd., Orlando, FL, came
forward and stated that he had met with City Staff and had no
problems. He stated that he had asked for a waiver on this plan
and would like to see the plan approved.
R. P. Mohnacky, 1820 Prairie Lake Road, Ocoee, FL, came forward
with a general question on the setbacks of the plan.
David Knopp, 2718 Springfield Drive, Orlando, FL, came forward and
stated that he lives in the Richfield Subdivision that backs this
project. Mr. Knopp wanted to know (1) who the developer was, (2)
the price range of the house, (3) type of houses, (4) what kind of
restrictions, and (5) whether the park is public or private.
Gary Singer came forward as the Developer of the Johio Meadows
project and stated that he is with Unibilt Development, they have
built the Williamsburg Development. The price range of the Johio
Meadows houses will be similar to Centex homes in Richfield,
$90,000 to $120,000. Mr. Singer stated that it is possible that
Unibilt would sell to another builder, but the price range should

stay about the same. The homes will be block homes and framed on
the second floor, if two - story. The Developer stated that he
would like the restrictions to be similar to Richfield. This
subdivision will have its own Homeowners Association. The park is
a public park (a City Park) and any one is welcomed to use it.
David Knopp questioned the Developer if he was going to plan to
develop all 72 lots. Mr. Singer stated that he could not answer
that question; that if the market collapsed that is something he
could not help.
After no further input from the public the public hearing was
closed.
The park facility was designed by Jim Beech, Recreation Director.
There is a ballfield and green space. The park is shared by
Coventry and Park Side Subdivisions. The parking lot will be
available for the rest of the park that adjoins Park Side
Subdivision.
Commissioner Swickerath moved that the Planning and Zoning
Commission recommend to the City Commission to approve the Johio
r Meadows Preliminary Subdivision Plan with the waiver request for a
25 foot Front Setback Line. Commissioner Bond seconded, and the
motion carried unanimously 7 -0.
OTHER BUSINESS
Planning Director Behrens commented on the Annexation /Initial
Zoning Requests that will be coming up this month on November 16,
and 18, 1992. Behrens told the Board that the application
presented were going to be split into to two evenings. The first
evening would be all the applications on the north side of town.
The second evening would be everything south of State Road 50.
Everything that will come before the Planning and Zoning Commission
will be compatible with the Comprehensive Plan. Attending these
meetings will be the land owners and attorneys.
Mayor Scott Vandergrift, 2625 Cedar Bluff Lane, Orlando, FL, came
forward requesting to speak. He thanked the Planning and Zoning
Board for all the hours they have put in to this Board. He

informed them that as Mayor he was at their beckon call and that
his home phone number was available at City Hall. Mayor
Vandergrift stated that he had been in the building earlier working
with the equipment used to televise the City Commission Meetings.
He would like the citizens to receive a better picture and sound on
their televisions at home. The Mayor stated that he was thinking
about having the Planning and Zoning Board Meetings televised as
well, stating that it would be good for the community, and that
they would be informal meetings.
Planning Director Behrens commented on the thorough Impact Study
that was performed on each Annexation /Initial Zoning Application
received. What was looked at was sewer, ERU's, and road right -of-
way. These studies were looked over by Montye Beamer,
Administrative Services Director; Ken Hooper and Bob Campbell,
Professional Engineering Consultants; and Paul Rosenthal, City
Attorney, Foley & Lardner. There are infrastructure needs in
these area of annexation. Growth and future growth should be done
in an orderly fashion.
Chairman Shiver stated that he was not anti - growth, but that the
City needs to address growth vs. schools. There needs to be some
controls placed on Ocoee, to see that enough schools are being
provided for the number of children that are coming into this area.
Planning Director Behrens stated that the Orange County School
Board is aware of the City's growth. Lee Ann Lowery receives all
of the subdivision plans submitted to the City for review, and has
an opportunity to comment to the Planning Department. Ms. Lowery
is aware of the pace the City is growing. Ocoee has increased 18%
in population in the last two years.
Commissioner Swickerath moved to adjourn, Commissioner Landefeld
seconded, and the motion was unanimous.
