HomeMy WebLinkAboutPZ 12-08-1992 MINUTES OF THE PLANNING AND ZONING COMMISSION REGULAR MEETING HELD TUESDAY, DECEMBER 8, 1992 CALL TO ORDER The meeting was called to order by Vice - Chairman Switzer at 7:30 p.m. followed by a moment of silent meditation and the Pledge of Allegiance. The determination of a quorum was made. PRESENT: Vice - Chairman Harold Switzer Members: Darlene Rhodus, Jim Swickerath, Gerald Weeks, Alternate: Louis Landefeld ABSENT: Members: Pat Bond and Tanya Miller CONSENT AGENDA A. Minutes of the Regular Planning and Zoning Commission Meeting of November 10, 1992 B. Minutes of the Special Session Planning and Zoning Commission 411 Meeting of November 16, 1992 C. Minutes of the Special Session Planning and Zoning Commission Meeting of November 18, 1992 D. Wesmere, Village 5 - Final Subdivision Plans Deputy Clerk Ellen King read into the record corrections to Item B, they were as follows: Page 21, Paragraph 3, Line 3, should read, "and the motion was denied 5 -2. Voting to approve the motion was: Weeks and Swickerath. Voting against the motion was: Bond, Landefeld, Rhodus, Shiver, Switzer ". Page 30, Case No. 2- 10AR- 92:STARBIRD Change To: Case No. 2- 17AR- 92:SHARP, and change the last paragraph, line 7, Sharpe - remove the e. Commissioner Landefeld moved to approve Items A, B, and C on the Consent Agenda as corrected. Commissioner Swickerath seconded, and the motion carried with an unanimous vote of 5 -0. PLANNING AND ZONING COMMISSION REGULAR MEETING DECEMBER 8, 1992 PAGE 2 Consent Agenda Item D (Wesmere, Village 5 - Final Subdivision Plans) Planning Director Behrens stated for clarification that the Staff Report was in error that the Minimum lot size is 6,000 sq. ft. With that, Commissioner Weeks moved to approve Item D on the consent agenda, Commissioner Swickerath seconded, and the motion carried with an unanimous vote of 5 -0. NEW BUSINESS CASE NO. 2- 29SE- 92:COSTANTINO, SPECIAL EXCEPTION REQUEST Planning Director Behrens commented from the Staff Report of December 3, 1992, that a Special Exception, as required by Code, has been requested for an Indoor Retail Center (Indoor Flea Market) - Farmers Market in a "C -2, Community Commercial District ". The subject property is located between Silver Star Road and Palm Drive and west of Ocoee - Apopka Road. The Planning Staff made the following findings subject, however, to the approval of the Conditions of Approval and Site Plan, per the City's Code and Ordinances at Final Site Plan approval by the Board of City Commissioners. 1. The proposed use and use of structure is consistent with the Comprehensive Plan and the Land Development Code. 2. The proposed use and structure would be compatible with the surrounding structure and lands. 3. The proposed uses and structure will not exceed any density or bulk restrictions, will not significantly impair pedestrian or vehicular traffic; not create a fire hazard; will not exceed the noise requirements of the Land Development Code; will not prevent an adjoining landowner from the use of this property or any laws, and will not result in the significant impacting of any adopted Level of Service Standards (LOS). The Development Review Committee unanimously approved the Staff Recommendation of the "Special Exception ". rr PLANNING AND ZONING COMMISSION REGULAR MEETING DECEMBER 8, 1992 PAGE 3 Vice - Chairman Switzer opened the Public Hearing for comments. George Garrett, 1915 E. Colonial Drive, Orlando, FL came forward as the project engineer for Dr. and Mrs. Ernest Costantino Jr. Mr. Garrett stated that the site would be brought up to code, including the parking area, and that a site plan would be submitted for City Staff's review and approval. Glenda Hall, 806 Apricot Drive, Ocoee, FL came forward as the Applicant /Owner's authorized agent. Ms. Hall commented that the interior layout of the building would have one end of the building as a farmer's market, the perimeter would be new merchandise, and the inside of the market would be crafts that locals could make and sell on weekends. Ms. Hall stated that there have been no commitments as of yet. The hours of operation would begin on, Friday, Saturday, and Sunday, and then later consider a full week. With some concern shown by the Board that the project would become a eyesore, Planning Director Behrens stated that the City must require the developer to bring the site up to code, but it was not the City's responsibility to make sure of its success. Rob McKey, 1110 Wineberry Court, Ocoee, FL came forward commending the developer in fixing up the empty buildings. After no further input from the public, the Public Hearing was closed and the issue was brought to the table for discussion. Commissioner Swickerath moved that the Planning and Zoning Commission recommend to the City Commission to approve the Special Exception Request for Case No. 2- 295E- 92:COSTANTINO. Commissioner Rhodus seconded, and the motion carried with an unanimous vote of 5 -0. OTHER BUSINESS Vice - Chairman Switzer asked Planning Director Behrens to check into adding a Comprehensive Plan Element to address educational services and /or requirements. And, to see what are the possibilities of updating the recreation element to include ballfields and parks that coincide. �r► PLANNING AND ZONING COMMISSION REGULAR MEETING DECEMBER 8, 1992 PAGE 4 Commissioner Swickerath moved that the Planning and Zoning Commission recommend to the City Commission to instruct the City Manager to look into having the Comprehensive Plan amended to include 1) an Education Element, and 2) an upgraded Recreation Element, and that both elements would take into consideration the growth of the City. Commissioner Landefeld seconded, and the motion carried with an unanimous vote of 5 -0. Mayor Scott Vandergrift was present and requested to speak, he commended the Planning and Zoning Commission on a job well done at the Annexation and Zoning Meetings. Mayor Vandergrift gave a brief description of the meeting he attended with Ellis Shapiro and Bruce Behrens regarding the Mall. Planning Director Behrens stated that Homart Development Company called asking when the first Comprehensive Plan Amendment would be, and Mr. Behrens stated that they could apply anytime (Homart said maybe June). Mayor Vandergrift stated that the opening of Clarke Road would be the first two weeks of February 1993.
