Rosenthal, Esq., City Attorney , 1 I RE Resolution 88 -13/ nn I 1 0,1 The City Commission at its meeting of June 7, 1988, adopted Resolution 88 -13 and directed the City Attorney to draft a Resolution complying with the direction of the City Commission. The direction of the City Com- mission was to cause the removal pursuant to City Code Section 11 -24 of certain buildings constituting a nuisance and menace to public health, safety and wel- fare. Upon investigation, the City Attorney discovered that certain actions had previously been taken by the City pursuant to City Code Section 5 -8. The City Attorney advised the Building Official that removal pursuant to Section 5 -8 would be more expeditious than removal pur- suant to Section 11 -24. Accordingly, on June 13, 1988, the Building Official directed notices with respect to the removal of buildings located at 613 Melva Street and 131 North Cumberland Avenue. In light of the actions taken by the Building Official, it is the opinion of the City Attorney that Resolution 88 -13 is not necessary in order to accomplish the re- moval of the buildings. RECOMMENDATION: It respectfully is recommended that the City Commission rescind Resolution 88 -13 adopted at the City Commission meeting of June 7, 1988. C ti, 11! Paul . Rosenthal, City Attorney per /etb cc: Mr. Teddy C. Ryan, City Manager Mr. Harvey Nagle
