Minutes of the Planning and Zoning Commission Meeting held on December 14, 2010 MINUTES OF THE PLANNING AND ZONING COMMISSION ACTING AS THE LOCAL PLANNING AGENCY MEETING HELD TUESDAY, DECEMBER 14, 2010 CALL TO ORDER Chairman Campbell called the meeting to order at 7:00 p.m. Following a moment of silent meditation and the Pledge of Allegiance to the Flag, a quorum was declared present. PRESENT: Chairman Campbell, Vice Chair Golden, Member McKey, Member Sills, Member De La Portilla and Member West. Also present were Assistant City Attorney Watson, City Manager Rumer, and Recording Clerk T. Williams. ABSENT: Member Dillard and Member Morris were both absent excused. CONSENT AGENDA Minutes of the Planning and Zoning Commission Meeting held on Tuesday, October 27, 2010. Vice -Chair Golden, seconded by Member Sills, moved to accept the Minutes of the October 27, 2010, Planning and Zoning Commission meeting. Motion carried unanimously. OLD BUSINESS -none NEW BUSINESS ZEPEDA, 244 E. SILVER STAR ROAD City Planner Rumer gave a brief overview of property location and reason for annexation. The requested annexation is for water in which the current property owner has already begun usage of city water at the rate provided for an unincorporated resident. The north property has already annexed into the city. DISCUSSION Chairman Campbell inquired if the property will remain a single family plot and if future subdivision of the property will be allowed. City Planner Rumer stated it would be difficult to accomplish this and meeting the criteria to sub -divide from one lot to two. Public Hearing Opened No comments Public Hearing Closed Vice -Chair Golden, seconded by Member McKey, moved to recommend approval of the Zepeda annexation for water based upon staff recommendation for approval. Motion carried unanimously. Planning and Zoning Commission Meeting December 14, 2010 ORLANDO AVENUE PARTIAL VACATION OF RIGHT-OF-WAY City Planner Rumer gave an overview of why the partial right-of-way vacation is before the Planning and Zoning Commission. Explaining the specific area of the right-of-way runs in and East-West direction between Bluford Avenue and Kissimmee Avenue. The request is to vacate and abandon the northern 30 feet of the 60 feet right-of-way. He further stated that the subject area has been identified as a future drainage project in the Wekiva Parkway and Protection Act Regional Master Stormwater Management Plan. The City has challenges in constructing that area and feels the most viable opportunity is to vacate the right-of-way. DISCUSSION Member West inquired if safety surrounding the Fire Station was the reason the City did not vacate two surrounding lots. City Planner Rumer explained how the legal access of the other lots will be maintained; the city will shorten it's vacate of the right-of- way by 20 feet. Member McKey inquired if once the right-of-way is vacated on the current one way street, will two way access then be granted. City Planner Rumer stated a previous vacate of Washington Street was completed. Chairman Campbell inquired who initiated the vacate of this parcel. City Planner Rumer stated the adjacent property owners initiated the vacate. Member McKey inquired if drainage projects involve the south side of Orlando Avenue. City Planner Rumer stated there will be 30 feet made available; the City Engineer and Public Works Director are satisfied that future construction will be not be stopped by granting this vacate. Vice -Chair Golden inquired if this in an opportunity to add the drainage problem to a two lane road. City Planner Rurner stated the City can not repair the road until it becomes a two lane road. Vice -Chair Golden inquired if there was a DRC meeting and input from the Fire Department concerning public safety. Public Hearing Opened No comments Public Hearing Closed Member McKey is concerned about allowing two way access on Orlando Avenue and suggested extending two way access from Washington Street. Chairman Campbell stated how extending Washington Street will encroach on existing home owners' properties. Rusty Johnson spoke on behalf of the City vacating the right-of-way, future road construction plans and the future drainage project. Member West inquired about plans to extend Main Street to Clarke Road. City Planner Rumer stated there are plans to extend Main Street to Blackwood Avenue. Planning and Zoning Commission Meeting December 14, 2010 Member West, seconded by Member Sills, moved to recommend approval of the Orlando Avenue Partial Vacation of Right -of -Way. Motion carried unanimously. ALCOHOL ORDINANCE BRIEFING City Planner Rumer stated that this issue came about with a recent approval of a special exception of a church in a retail center. The Commission inquired how will allowing a church into a retail center will affect establishments wanting to sell alcohol within the retail center. Further the Commission inquired what are the notification requirements for special exceptions; can the footage be increased under certain conditions. City Planner Rumer commented there are exemptions that can be used to accommodate businesses interested in serving alcohol in retail centers in which special exception has been granted or they may want to grant a special exception to the establishment. Member McKey inquired if there will be a challenge of different notification(s) for different uses. Assistant City Attorney Watson commented she did not foresee that as a problem. Further discussion ensued regarding alcohol ordinance. MISCELLANEOUS Chairman Campbell inquired if there are any comments on project status or calendar. City Planner Rumer stated Transaction Data's building permit is almost complete and the StorKwik pre -construction meeting is being planned. Chairman Campbell wished everyone Happy Holdidays. Keller, District 4 Should the Planning and Zoning Commission recommend approval of the Amended Preliminary/Final Subdivision Plan for the Villages of Wesmere? BACKGROUND: The subject property is approximately 49.48 acres in size and is located on the southeast corner of the intersection of Maguire Road and Tomyn Boulevard. It is currently known as the Villages of Wesmere townhome community which was approved for 369 townhome units by the City Commission in 2006. On November 16, 2010, the City Commission reviewed and approved a Land Use Plan and PUD (Planned Unit Development) rezoning for the northern portion (40.60 acres) of the development. This PUD allows for a total of 178 single-family detached homes to be built instead of the previously approved townhome units. The rest of the development is zoned R-3 (Multi -Family Dwelling) which allows for townhomes as a permitted use. The development plan layout has the townhomes on the southern portion of the site and to the north the single-family portion. The townhomes are a mix of twenty 20-foot and thirty 30-foot wide units with one and two story products. Each unit will have a two car garage with an additional space provided in the driveway. Visitor parking is provided throughout the townhome portion of the site. All units will have clay tile roofs and brick paver driveways. Currently, there are approximately 54 townhome units with associated infrastructure which are completed and owner occupied. The minimum dwelling size for both the townhomes and single- family is 1,200 square feet. The single-family portion of the site proposes 40-foot wide by 80-foot deep (3,200 square foot) lots in a Traditional Neighborhood Design (TND) concept. The cornerstone of the TND concept is the inclusion of alleyways. During the review process, Staff suggested the applicant include alleyways as a way to enhance the 40-foot wide lots that were proposed which would ultimately give the project a TND feel. The alleyways are proposed to be contained within 20-foot wide tracts that will be owned and maintained by the homeowners association. The alleyway will be 12-feet wide, which will only allow for one-way traffic. The remaining 8-feet of the alley tract will be grassed. The setbacks for the front loaded and alley loaded lots will differ. For the front loaded units; a 20-foot front setback, 5-foot side setback, and 10-foot rear setback will be provided. For the alley loaded units; a 10-foot front setback, 5-foot side setback, and a 20-foot rear setback will be provided. The rear setback will be used as the entry and the units will be accessed from the alley. In addition to the alleyways being owned and maintained by the homeowners association, all internal roadways are private and owned and maintained by the homeowners association. At this time, all internal roadways, access points, peripheral fencing and landscaping are essentially completed. Existing access into the subject site will continue to be provided from the east side of Maguire Road across from Wesmere Parkway and on the south side of the Tomyn Boulevard extension. It should be noted that an adjustment to a small portion of the brick wall will need to be modified in order to accommodate the single-family lots. Recreational amenities proposed include a clubhouse, swimming pool, tot lot, soccer field and multi purpose fields. The developer intention is to begin construction of the amenities immediately after it is properly permitted for construction. To this goal, there is a Condition of Approval to this effect with specific performance dates on the plans. The maximum permitted density per the Comprehensive Plan is 16 units per acre. The density of the single-family portion of the development is proposed at 4.38 units per acre. The overall density of the entire development is 6.12 units per acre thus being consistent with the adopted Comprehensive Plan designation for the property. Moreover, the Amended Preliminary/Final Subdivision Plan as proposed is consistent with the approved PUD Land Use Plan and the adopted Ocoee Land Development Code. DEVELOPMENT REVIEW COMMITTEE RECOMMENDATION: The Development Review Committee (DRC) reviewed the Villages of Wesmere Amended Preliminary/Final Subdivision Plan on February 1, 2011. The DRC discussed the items in the review memorandums from the Planning Department, Engineering Department and the City Attorney's office. The developer agreed to the additional conditions of approval that were mentioned on the City Attorney memorandum and to address all the minor technical engineering changes to the plans. Planning and Zoning Commission - February 3, 2011 - Page 3 When the discussion was finished, the Committee voted unanimously to recommend approval of the Amended Preliminary/Final Subdivision Plan, subject to making the changes agreed upon at the DRC meeting before the Ocoee City Commission meeting. STAFF RECOMMENDATION: Based on the recommendation of the DRC, Staff recommends that the Planning and Zoning Commission recommend approval of the Amended Preliminary/Final Subdivision Plan for Villages of Wesmere, subject to resolving the last remaining issues addressed at the DRC meeting before the Ocoee City Commission meeting.
