ACTING AS THE LOCAL PLANNING AGENCY
MEETING HELD TUESDAY, DECEMBER 14, 2010
CALL TO ORDER
Chairman Campbell called the meeting to order at 7:00 p.m. Following a moment of
silent meditation and the Pledge of Allegiance to the Flag, a quorum was declared
present.
PRESENT: Chairman Campbell, Vice Chair Golden, Member McKey, Member Sills,
Member De La Portilla and Member West. Also present were Assistant
City Attorney Watson, City Planner Rumer, and Recording Clerk T.
Williams.
ABSENT: Member Dillard and Member Morris were both absent excused.
CONSENT AGENDA
Minutes of the Planning and Zoning Commission Meeting held on Wednesday, October
27, 2010.
Vice -Chair Golden, seconded by Member Sills, moved to accept the Minutes of
the October 27, 2010, Planning and Zoning Commission meeting. Motion carried
unanimously.
OLD BUSINESS - none
NEW BUSINESS
ZEPEDA, 244 E. SILVER STAR ROAD
City Planner Rumer gave a brief overview of the property location and reason for
annexation. The requested annexation is for water in which the current property owner
has already begun usage of city water at the rate provided for unincorporated residents.
The north property has already annexed into the city.
DISCUSSION
Chairman Campbell inquired if the property will remain a single family lot and if future
subdivision of the property will be allowed. City Planner Rumer stated it would be
difficult to accomplish this and meet the criteria to sub - divide from one lot to two.

Vice -Chair Golden, seconded by Member McKev, moved to recommend approval
of the Zepeda annexation for water based upon staff recommendation for
approval. Motion carried unanimously.
Planning and Zoning Commission Meeting

ORLANDO AVENUE PARTIAL VACATION OF RIGHT -OF -WAY
City Planner Rumer gave an overview of why the partial right -of -way vacation is before
the Planning and Zoning Commission. Explaining the specific area of the right -of -way
runs in an East -West direction between Bluford Avenue and Kissimmee Avenue. The
request is to vacate and abandon the northern 30 feet of the 60 feet right -of -way. He
further stated that the subject area has been identified as a future drainage project in
the Wekiva Parkway and Protection Act Regional Master Stormwater Management
Plan. The City has challenges in constructing that area and feels the most viable
opportunity is to vacate the right -of -way.
DISCUSSION
Member West inquired if safety surrounding the Fire Station was the reason the City
did not vacate two surrounding lots. City Planner Rumer explained how the legal
access of the other lots will be maintained; the city will shorten it's vacate of the right -of-
way by 20 feet. Member McKey inquired if once the right -of -way is vacated on the
current one way street, will two way access then be granted. City Planner Rumer
stated a previous vacate of Washington Street was completed. Chairman Campbell
inquired who initiated the vacate of this parcel. City Planner Rumer stated the adjacent
property owners initiated the vacate. Member McKey inquired if drainage projects
involve the south side of Orlando Avenue. City Planner Rumer stated there will be 30
feet made available; the City Engineer and Public Works Director are satisfied that
future construction will be not be stopped by granting this vacate. Vice -Chair Golden
inquired if this in an opportunity to add the drainage problem to a two lane road. City
Planner Rumer stated the City can not repair the road until it becomes a two lane road.
Vice -Chair Golden inquired if there was a DRC meeting and input from the Fire
Department concerning public safety. City Planner Rumer stated there was not a DRC
meeting held but staff has met and discussed the safety concerns.

Member McKey is concerned about allowing two way access on Orlando Avenue and
suggested extending two way access from Washington Street. Chairman Campbell
stated how extending Washington Street will encroach on existing home owners'
properties. Rusty Johnson spoke on behalf of the City vacating the right -of -way, future
road construction plans and the future drainage project. Member West inquired about
plans to extend Maine Street to Clarke Road. City Planner Rumer stated there are
plans to extend Maine Street to Blackwood Avenue.

Member West, seconded by Member Sills, moved to recommend approval of the
Orlando Avenue Partial Vacation of Right- of -Way. Motion carried unanimously.
ALCOHOL ORDINANCE BRIEFING
City Planner Rumer stated that this issue came about with a recent approval of a
special exception of a church in a retail center. The Commission inquired how allowing
a church into a retail center will affect establishments wanting to sell alcohol within the
retail center. Further, the Commission inquired about the notification requirements for
special exceptions; can the footage be increased under certain conditions. City Planner
Rumer commented there are exemptions that can be used to accommodate businesses
interested in serving alcohol in retail centers in which a special exception has been
granted or they may want to grant a special exception to the establishment. Member
McKey inquired if there will be a challenge of different notification(s) for different uses.
Assistant City Attorney Watson commented she did not foresee that as a problem.
Further discussion ensued regarding alcohol ordinance.
MISCELLANEOUS
Chairman Campbell inquired if there are any comments on the project status or
calendar. City Planner Rumer stated Transaction Data's building permit is almost
complete and the Stor Kwik pre- construction meeting is being planned.
Chairman Campbell wished everyone Happy Holidays.

The meeting adjourned at 7:46 p.m.
