HomeMy WebLinkAbout05-11-1993 %rr MINUTES OF THE PLANNING AND ZONING COMMISSION REGULAR MEETING HELD TUESDAY, MAY 11, 1993 CALL TO ORDER: The meeting was called to order by Chairman Shiver at 7:35 p.m. followed by a moment of silent meditation and the Pledge of Allegiance. The determination of a quorum was made. PRESENT: Chairman Mickey Shiver, Vice Chairman Harold Switzer, Members: Tanya Miller (7:55), Jim Swickerath, Gerald Weeks, Alternates: Louis Landefeld, Robert McKey, Director of Planning Bruce Behrens, Development Administrator Concurrency Management Janet Resnik, and Deputy Clerk Ellen King ABSENT: Members: Pat Bond and Darlene *4610 CONSENT AGENDA: A. Minutes of the Regular Planning and Zoning Commission Meeting of April 13, 1993 B. Johio Meadows, Final Subdivision Plans Project No. 92 -005 Alternate McKey requested item "B" be removed from the consent agenda. Switzer moved to approve the minutes of April 13, 1993, seconded by Weeks and the motion carried unanimously. Mr. McKey pulled the Johio Meadows, Final Subdivision Plans from the consent agenda to discuss the flag lots. Vice - Chairman Switzer moved to approve the Johio Meadows, Final Subdivision Plans, seconded by Commissioner Swickerath and the motion carried unanimously. NEW BUSINESS: Commissioner Swickerath requested to speak publicly so that he could apologize to the Director of Planning Bruce Behrens for accusing him of violating the Sun Shine Law during a public hearing held a couple months ago before the Planning and Zoning Commission. 4 4r. , Commissioner Swickerath proceeded to apologize to Mr. Behrens. Planning and Zoning Commission Regular Meeting May 11, 1993 Page 2 PROPOSED ORDINANCE NO. 93 -06 PUBLIC HEARING ZONING CODE REVISIONS INCLUDING DEFINITIONS OF AUTOMOBILE REPAIR, AUTOMOTIVE BODY REPAIR, AUTOMOTIVE WRECKING SALVAGE YARDS AND AMENDING TABLE 5 -1 ENTITLED "USE REGULATIONS" Director of Planning Bruce Behrens read the Staff Report of April 29, 1993 in to the record. The issue is "Should the Planning and Zoning Commission recommend approval of the proposed Zoning Code revisions as set out in Ordinance No. 93 -06 ? ". The Staff's recommendation was for the Planning and Zoning Commission to recommend to the Board of City Commissioner to adopt Ordinance No. 93 -06. The Public Hearing was opened. After no comments the public hearing was closed. After a brief discussion between the Board Members and Planning Director Behrens, Commissioner Swickerath asked what was the reason or urgency for the change and no one was present at the meeting to answer his question. ,.• Commissioner Switzer moved that the Planning and Zoning Commission reject Ordinance #93 -06 in its entirety and have it come back before the P &Z Board with corrections and explanations, seconded by Commissioner Weeks and the motion carried unanimously. PLANTATION GROVE P.U.D. (PIZZUTI) [PUBLIC HEARING] PARCELS B,C,D,G &I OF THE R.L.U.P. PRELIMINARY SUBDIVISION PLANS (SINGLE- FAMILY) PROJECT NO. 93 -001 Director of Planning Bruce Behrens read the Staff Report of May 6, 1993 for the record. The issue is "Should the Planning and Zoning Commission recommend approval of the Preliminary Subdivision Plans for the Single Family portion of the Plantation Grove P.U.D. ? ". Planning and zoning Commission Regular Meeting May 11, 1993 k,,,,,. Page 3 The Staff's Recommendation is that the Planning and Zoning Commission recommend to the City Commission to approve the Preliminary Subdivision Plans for Plantation Grove PUD (Single Family - Pizzuti) , with the condition that prior to City Commission approval of the Preliminary Subdivision Plans the required rights - of -way of Moore and Maguire Roads shall be conveyed to the City per the R.L.U.P. The Public Hearing was opened. Dan Roberts, Pizzuti Development, Inc., 255 S. Orange Ave., Orlando, FL was present as the Developer of the single - family portion of the project. The project will be two phases and the developer is looking at two national builders coming to the site. Construction is expected to begin as soon as possible. The proposed name for the single - family subdivision is Cross Creek. Glenn Jackson, V.P., Heller Brothers was present to say that they find the plans satisfactory and request approval. After no further comments the public hearing was closed and the issue was brought to the table for discussion. �1r After a lengthy discussion on the spine road the following motion was made: Commissioner Switzer moved that the Planning and Zoning Commission recommend to the City Commission to approve the Preliminary Subdivision Plans for Plantation Grove PUD (Single Family - Pizzuti), with the condition that prior to City Commission approval of the Preliminary Subdivision Plans the required rights -of -way of Moore and Maguire Roads shall be conveyed to the City per the R.L.U.P. Seconded by Commissioner Miller and the motion carried 5- 0. Alternate Robert McKey voted against the project and wanted it noted for the record. OTHER BUSINESS: None Planning and Zoning Commission Regular Meeting May 11, 1993 Page 4 COMMENTS: Planning Director Bruce Behrens: 1. Homart (mall) expect to file their DRI in 30 -45 days. 2. Albertsons start construction in 30 days. 3. Golf course starting construction soon. 4. City Hall moving June 18, 1993 to the Community Center and trailer. 5. State Farm plans have been submitted to the Building Dept. for review to be located at S.R. 50 and Old Winter Garden Road in the Goodman Commercial Center. 6. On the June 8th P &Z meeting will be the Wetland Mitigation Plan for Hudson Commercial Subdivision south of S.R. 50 across from Denny's. The issue is to allow impact or not.
