HomeMy WebLinkAbout09-14-1993 MINUTES OF THE PLANNING AND ZONING COMMISSION REGULAR MEETING HELD TUESDAY, SEPTEMBER 14, 1993 s ir► CALL TO ORDER: The meeting was called to order by Acting Chairman Switzer at 7:30 p.m. followed by a moment of silent meditation and the Pledge of Allegiance. The determination of a quorum was made. PRESENT: Acting Chairman Switzer, Members: Jim Swickerath, Louis Landefeld, Darlene Rhodus, Tanya Miller, Alternates: Rob McKey and Dan Draia Director of Planning Bruce Behrens, and Deputy Clerk Ellen King ABSENT: Members: Pat Bond and Ralph Jones CONSENT AGENDA: A. Minutes of the Regular Planning and Zoning Commission Meeting of August 10, 1993 Commissioner Swickerath corrected the Minutes stating that he was absent at the August 10, 1993 meeting. Commissioner Landefeld moved to approve the Minutes as corrected. Commissioner Miller seconded and the motion carried unanimously. NEW BUSINESS: Acting Chairman Switzer welcomed new Alternate Dan Draia to the Planning and Zoning Commission. OLD BUSINESS: HUDSON COMMERCIAL SUBDIVISION, PHASE I - (GRIFFIN CENTER) FINAL SUBDIVISION PLANS, PROJECT NO. 92 -003 Bruce Behrens, Director of Planning, read the Staff Report of September 9, 1993 into the record. The issue being, "Should the Planning and Zoning Commission recommend approval of the Final Subdivision Plans for Hudson Commercial Subdivision, Phase I ?" The subject property is located on the south side of State Road 50 (West Colonial Drive) across from Denny's Restaurant. Phase I consists of a small 2.359 acre parcel with frontage on State Road 50. Included are Lots 1 and 2 and a small retention area (the kiir overall site is 17+ acres). Planning and Zoning Commission Regular Meeting September 14, 1993 Page 2 Phase I would not impact the Class II Wetland area discussed at an earlier meeting; there will be a 25' buffer between the Class II Wetland and development. The Staff Recommendation is to recommend approval of the Final Subdivision Plans for Hudson Commercial Subdivision - Phase I, subject to the issuance of a Final Certificate of Concurrency. Commissioner Swickerath commented that the Developer should have all the permits prior to selling his land. Commissioner Swickerath is aware that the Developer is in a hurry to plat his property and sell, and feels the buyer should beware of pending permits. Director of Planning Bruce Behrens stated that SJRWMD has been out on -site looking at the wetland area. The wetland buffer requirement is 25 feet and no development is allowed within that area, per the City. If SJRWMD changes the buffer requirement and the buffer is less than the City requirement of 25 feet then the City prevails; if SJRWMD says the buffer is greater than 25 feet the Director of Planning Behrens stated that he was not certain of the consequences. The City will be notified by SJRWMD of any correspondence and of their permit when issued. (Prior to a Pre - Construction Conference all permits are required by the City.) Alternate Member Rob McKey commented that on Sheet 3 of 5, Post - Development detail on Lot 2 the language "(DEVELOPMENT ONLY WITH CITY APPROVAL) should be struck through to match all other sheets. Director of Planning Behrens stated that he would make sure the deletion was made. Commissioner Swickerath moved to recommend to the Board of City Commissioners that Hudson Commercial Subdivision, Phase I be approved subject to: 1) the issuance of a Final Certificate of Concurrency, and 2) acceptance of permits from SJRWMD and any other required regulatory agencies. Seconded by Commissioner Landefeld and the motion carried unanimously. 'or Planning and Zoning Commission Regular Meeting September 14, 1993 Page 3 OTHER BUSINESS: COMMERCIAL SEPTIC TANK The Planning and Zoning Commission requested that the City Engineer (Jim Shira) look at a situation that just occurred along Silver Star Road in a commercial development involving a septic tank and the removal of parking spaces. The underground septic tank was put under an area that was paved. Commissioner Swickerath felt that the field initially ran along the backside of the property. Some parking spaces have been dug up and covered with grass. Commissioner Swickerath felt that the City Engineering Department should react when a septic tank is requested in a commercial district and that there be enough property for two drain fields so that parking spaces are not lost. It may technically comply with criteria the City has, but the City Engineering Department should t,`, take a look at it. Director of Planning Bruce Behrens said that he had heard the situation and stated that in order for the commercial site to get a septic tank permit they have to go through the Orange County Health Department. The County apparently issued the septic tank permit and the parking was eliminated by the Developer. The site, therefore, does not now meet the parking requirements of our Code. The appropriate Staff Members have been directed by the City Manager to study the situation. Commissioner Swickerath stated that this becomes a site specific planning issue when a commercial piece of property that has certain parking requirements that is not serviced by sewer. This should be an item on a checklist for the City Engineer and should be brought to the attention of the Planning and Zoning Commission or the Local Planning Authority or the Board of Adjustment whenever anything like this goes on, and the Boards can take steps. Commissioner Swickerath asked the P &Z Commission to ask the Board of City Commissioners to make it a priority and that it be put in writing in the Development Code. The P &Z Members had no objections to this request. Planning and Zoning Commission Regular Meeting September 14, 1993 Page 4 SODA MACHINE The Planning and Zoning Commission requested that they have access to the soda machine located in the Community Center. The Members discussed relocating the soda machine into the kitchen or Commission Chambers for easier access by the public. Commissioner Swickerath requested a motion take place and that it go to the City Commission. Commissioner Swickerath moved that the soda machine located in the Community Center be made more accessible to the public, seconded by Commissioner Landefeld and the motion carried unanimously. COMMENTS: Planning Director, Bruce Behrens - ►" 1. Director of Planning stated that he has enjoyed the past five years as the Planning Director and will be giving this position up as of October 1, 1993. Russ Wagner will be coming on board October 1, 1993 to replace Bruce Behrens as Planning Director; Mr. Wagner was the City Planner before Mr. Behrens. Mr. Behrens will become Economic Development Coordinator. 2. Planning Director Behrens mentioned that progress was being made on discussions with Orange County concerning the Settlement over the issue of the recent annexations and the resulting lawsuit. 3. Mr. Behrens stated that a first draft of a Settlement Agreement along with a Settlement Agreement Map indicates that Orange County may finally be starting to share the vision that Ocoee sees for the future of the City. Board Members - 1. Commissioner Swickerath stated that he would like the Board to officially thank Bruce for serving the City in some difficult times and for doing a good job.
