REGULAR MEETING HELD TUESDAY, NOVEMBER 14, 1995
CALL TO ORDER
The meeting was called to order by Chairman Switzer at 7:33 p.m. followed by a moment of
silent meditation and the pledge of allegiance. A quorum was declared present.
PRESENT: Chairman Switzer, Vice Chairman Bond, Members Hopkins, Jones, Miller
(arrived 7:45 p.m.), Landefeld, and Rhodus, and Alternate Member Williams.
(Alternate Member McKey was present until it was determined that he would not
be needed in order to have a quorum, then left as the meeting began.) Also
present were Planning Director Wagner, Assistant City Attorney Formella, and
Deputy City Clerk Green.
ABSENT: None.
CONSENT AGENDA
The consent agenda consisted of approval of item A:
A. Minutes of the Planning and Zoning Commission Regular Meeting held Wednesday,
October 25, 1995.
Noting that the word "one" on page 8, line 8 should read "done," Member Landefeld, seconded
by Vice Chairman Bond, moved to approve the minutes as corrected. Motion carried 6 -0.
(Member Miller had not yet arrived.)
NEW BUSINESS
COORDINATED CARE - PUBLIC HEARING
PRELIMINARY /FINAL SITE PLAN - PROJECT No. 93 -013
Planning Director Wagner presented the staff report dated November 9, 1995 for the proposed
120 bed, 45,000+ s.f. nursing home facility to be located on Lot 6 of Lake Bennet Centre,
which is situated southwest of Blackwood Avenue, north of S.R. 50. He said the property was
zoned C -2, Community Commercial District, which permits a nursing home use. He noted that
the Plan provided for preservation of an extensive conservation zone adjoining Lake Bennet and
an existing oak hammock on the northwest corner of the site. He said approval of the
Coordinated Care project will allow the Lake Bennet Centre's developers to begin the overall
project including the extension of Blackwood Avenue north of S.R. 50 as well as internal streets
and sewer and water extensions. He concluded with Staff's recommendation for approval of the
Plan as submitted.
In response to questions from Chairman Switzer about plans for Blackwood Avenue, Mr.
Wagner said Lake Bennet Centre would be developed in three phases and in the first phase
Blackwood would be extended to where the road starts to curve to tie in to a lift station. He
said the Fire Chief required a stabilized roadway up to Maine Street to provide a second access

to the facility.
Chairman Switzer opened the public hearing.
Roger Hill, 700 East Washington Street, Orlando, the engineer who designed the project, was
present to answer questions as the owners' representative.
As there was no other comment, the public hearing was closed.
Mr. Wagner said that a slight technical change was needed on the Plan. He explained that a
notation for a drainage easement on Lake Bennet needed to be corrected to match the Lake
Bennet Centre Plat.
Attorney Formella said moving the labeling of the drainage easement over Lake Bennet from
the normal high water line to the edge of water as field located would provide consistency with
the Plat.

SILVER GLEN, PHASE II, VILLAGE II - FINAL SUBDIVISION PLAN - PROJECT No. 94 -015
Planning Director Wagner presented the staff report for the Phase II, Village II segment of the
Silver Glen PUD which is located immediately north of the Albertsons' Shopping Center on
Silver Star Road, west of Clarke Road. He said this phase of the project provided for 54
residential lots on a 13.6 acre parcel. He explained that Staff recommended approval subject
to two conditions having to do with (1) St. John's permit/modification of the retention pond and
(2) reimbursement of 25 % of the cost for signalization of the intersection of Clarke Road and
Silver Star Road. (See motion below for details of conditions.)
Member Landefeld asked if their entrance sign would meet the new signage requirements and
Mr. Wagner responded that the new requirements would not apply as their sign would fall
under the existing regulations.

In response to a question from Vice Chairman Bond about the reduced corner setbacks, Mr.
Wagner said that, while the City normally required 25 foot front yard setbacks for both
frontages of corner lots, the developer had requested a reduction to 15 foot setbacks where the

lots were back to back. He said the City had agreed to the developer's request because this was
permitted under the Conditions of Approval for this PUD.
Chairman Switzer said he was concerned about problems with streets in the Silver Glen project
and that the citizens of Ocoee might have to pay for the repairs. He asked if the roads were not
built right or had not been adequately inspected.
Mr. Wagner said he believed a City Commissioner had commented that some of the streets in
Silver Glen were in need of repair and that the City Engineer had been directed to determine if
the two -year maintenance bond might be in effect. Mr. Wagner will check with the City
Engineer about his findings. He said at the time those streets were built the City did not have
the inspection staff that it has today, and that he doessipticipate any problems with streets in the
new section.
Mr. R. P. Mohnacky, 1820 Prairie Lake Boulevard, asked if the traffic light at Silver Star and
Clarke Road was working properly as it seemed to lack sensor units. Mr. Switzer suggested
that Mr. Mohnacky direct questions about the light to the City Engineer.
Member Landefeld, seconded by Member Jones, moved to recommend approval of the Final
Subdivision Plans for Phase II Villa. e II of Silver Glen PUD as date stam s ed received b the
City on November 9, 1995, subject to the following conditions:
1. That the developer secure a permit from the St. John's River Water Management
District to modify the retention pond serving this phase of the project prior to the
Pre - Construction Conference, and that all revisions to the retention pond be
corrected at the developer's expense prior to the Certificate of Completion being
issued.
2. That the developer reimburse the City for 25 % of the original cost for the
si . nalization of the intersection of Clarke Road and Silver Star Road I rior to the
Pre - Construction Conference.

Planning Director Wagner presented his staff report of November 9, 1995 for the third and
final submittal of Final Subdivision and Final Site Plans for the West Oaks Mall. He said the
developer had combined the Final Subdivision Plan with the Final Site Plan in one duplicate set
of drawings, but that individual Commission action would be required on each portion of the
Final Plans. He pointed out that the staff report included a number of pages of comments from
the City Attorney, the City Engineer, and consulting engineers. He said the comments have
been reviewed in detail, and they have assurances from the developer that all of these changes,
which are for the most part minor, will be included in the plans prior to presentation to the City
Commission. He concluded with the staff recommendation for approval as submitted subject
to the developer making all the changes that they have listed.
Chairman Switzer asked if Mr. Wagner felt comfortable with allowing them to do this. Mr.
Wagner said that he did and that they have, in fact, already received the corrected plans in the
Planning office.
Present to answer questions for Homart Development Company, the developers of the mall,
were Mr. Jim Grant, Mr. Fred Gardner and Mr. John Kelly of Post Buckley.
Member Rhodus said she was already experiencing traffic delays at the intersection of S.R. 50
and Clarke Road. Mr. Wagner said the plans now provide for left turn movement via dual left
turn lanes by utilizing a former thru lane in addition to the existing left turn lane.
Member Miller questioned the intersection's alignment with the expressway. Mr. Wagner said
there would be a very slight offset, but that the engineers felt that the slight weave was within
the engineering parameters. He said if it became a problem it would be a simple matter to add
a few feet of pavement to the expressway ramp.
Mr. Mohnacky asked about citizens speaking when it was not a public hearing and Attorney
Formella said the public could give their input though it was not a public hearing in the
technical sense. He asked if there would be sensors at the mall entrance as he was concerned
about the traffic and that the signalization would not impede the flow of traffic.
Mr. Wagner said all the traffic signals along Clarke Road will be coordinated. He said the
plans called for the developer to install all facilities that may be permitted by FDOT.
Mr. Switzer said, as Clarke Road had been built to move traffic, it had been his concern from
the beginning that if any signalization occurred it should be synchronized such that the road
could serve its original function.

COMMENTS
Planning Director Wagner had no comments.
Vice Chairman Bond asked Attorney Formella if she had correctly understood that people in
audience could make comments even if it were not a public hearing.
Attorney Formella said yes, though she had not specifically researched the non - public hearing
issue. She advised that it would be the better practice to allow public input, because there was
such a liberal construction of public input and government in the sunshine. She said various
matters which were not technically public hearings were given notice of in the paper and by
posting the agenda, etc. She said that comments that were repetitive or outside the scope of the
matters under consideration could be limited.

We have reviewed the following documents in connection
with the above - captioned matter:
1. Off -Site Roadway and Signalization Plans dated
received by the City of Ocoee on October 13, 1995.
The Off -Site Roadway and Signalization Plans are
hereinafter referred to as the "Third Incremental
Portion of the Final Plans ".
Based on our review of the foregoing pursuant to the new Land
Development Code, the Development Order for the Lake Latta Mall
DRI, the West Oaks Mall PUD, the Development Agreement (as amended)
and the Revised West Oaks Mall PUD Final Subdivision Plans /Final
Site Plan Processing Agreement we have the following comments:
1. Reference is made to Note 18 of the Key Sheets. Please
note that there is a typographical error. The phrase
"/sold agreement" should be changed to "said agreement ".
2. Reference is made to Note 19 of the Key Sheets. Delete
the word "revised" in front of all references to "West

I RE: West Oaks Mall Final Off -Site Construction Plans Review
Dear Ms. King:
! Pursuant to the City's
request, we have reviewed the Final Off-Site Construction Plans
( received by the City of Ocoee, October 18, 1995) for West Oaks Mall. Our
review is limited to rendering comments based on comparison proposed
water /sewer improvements with existing City master studies, and general g neral ,g ��l traffic,
guidelines for
development. Our review is primarily related to the off -site traffic, water /sewer, and
tow drainage impacts caused by the proposed project. It does not include a derailed review
of the project with regard to the City Subdivision Regulations or proposed on -site
improvements.
DRAINAGE
See attached memorandum.
ROADWAY PLANS
1. Existing construction plans for Clarke Road show
type "E" curb and gutter in
median for sections in super elevation. Revise median curb type "A" (gy
Station 90 +39.84 to Station 96 +30) to type "E" curb and cutter on both sides of
median to match existing curb and gutter.
2. Cross slopes shown on Clarke Road typical sections for existing pavement and
proposed widening should be verified. Some inconsistencies were noticed when
these cross slopes were checked against existing construction plans. Also, spread
calculations should be checked to verify that cross slopes show for proposed
widening are appropriate.
3. Due to the variable width widening on White Road and the need to mill the
*air existing pavement markings in conflict with proposed pavement markings, White
Road must be milled and resurfaced within the construction limits.
4. Please evaluate the need for an additional curb inlet at approximately Station
97+50 (RT.) on Clarke Road, Clarke Road northbound lanes are in super

elevation transition from +0.038 to -0.02 and the longitudal slope is +1.0175%
(Station 96 +41.20 to Station 98 +16.20).
5. Please add sidewalk to the south side of White Road on the west side of Clarke
Road to beginning of the 48' pavement section.
6. A few utility poles along the north side of White Road east of Clarke Road will
need to be relocated. These poles are currently 15' from edge of pavement.
Please evaluate.
7. Extend curb and gutter on north and south sides of White Road west of Clarke
Road to the beginning of the 48' pavement section in order to tie into the
proposed section to the west.
TRAFFIC CONTROL PLANS
1. Clarke Road lane closure analysis should utilize a directional distribution value of
1 instead of the 0.55 used by designer due to the fact that the traffic counts used
are directional counts. Please revise lane closure restrictions accordingly. Also,
re- evaluate the feasibility of the proposed traffic control method in light of this.
2. The traffic control plan for White Road assumes existing 12' lanes where in
reality these lanes are narrower (10 feet in some locations). Temporary pavement
may be required to provide sufficient lane widths. Please re- evaluate.
3. Note I unde± Phase I and Phase II for White Road needs to be revised. The City
will only approve plans prepared and signed and sealed by a professional
eng neer.
SIGNING AND PAVEMENT MARKING PLANS
1. We recommend the addition of lane designation suns for the southbound traffic
on Clarke Road approaching S.R. 50. This is necessary due to the lane drop of
the inside through lane.
2. Extend skip striping to beg of taper for southbound right turn lane on
Clarke Road approaching S.R. 50. Also, please explain why reflective pavement
markers are used with the 6' -I0' slap for this turn lane.
Nor 3. Remove control radii from signing and pavement marking plans. They could be
confused for pavement markings (for single left turn lanes only).

4. We recommend the use of 6" striping on White Road.
SIGNA UZATTON PLANS
1. We continue to recommend upgrading the State Road So /Clarke Road intersection
to a fully actuated signal and tieing it into the Clarke Road coordination system.
2. Pedestrian signs "FI'P -47" and "FrP 49" should either be added to plans or a
note be added to include these signs under pay item number 665 -11 with
appropriate quantity. This will eliminate the need for a change order during
construction.
3. Revise item number 653 -111 under signal display and on quantity sheet to match
item number (653 -171) shown in plans (plan view).
4. We note that the interconnect plan will not be complete until the campledon of the
utility pole design.

6. The proposed swale on the north side of White Road, east of CIarke Road appears
to be very shallow (0.36 -feet in depth from the proposed edge of pavement, per
partial typical section, Sheet 1313 ). A field inspection of the area suggests that
there may be some significant offsite runoff from the north that could drain to this
swale. Please provide evidence that this swale will have sufficient conveyance
capability to contain both the roadway improvement runoff and the offsite runoff
for the appropriate design storm frequency.
A review of the HGL calculations provided for the Clarke Road turn Iane improvements
shows Char the proposed inlet locations and pipe sizes will not have any adverse effects on
the performance of the existing storm sewer system.

3. In all areas of Clarke Road where pavement striping or marking is to be removed, the
existing friction course will be milled full width, and new friction course will be installed.

7. Sheet U -6 Orange County's 24." water main is not shown. This line is on the east side of
Clarke and north side of White. Revise drawing to show this line.
Also on Sheet U-6, there is a connection between the 12" water main on the north side of
White (west of Clarke) and the 12" water main on the east side of Clarke. This connection
is in the area of the portion of 12" water main shown to be relocated. Ensure that this
connection is restored. Provide note on Sheet U-6 that tie -in of relocated section of 12"
water main is to be done at night, with 43 hours prior notice to Ocoee Utility Department,
and that contactor is responsible for overtime pay for City employees.
8. Sheet U -5 Open cut of Clarke Road will be allowed only with full D.O.T. approved
traffic control. Revise open cut detail to show subgrade compaction of 98%, and concrete
extending a minimum of 3' beyond utility trench both directions. Add note that no
patching of friction course will be permitted.
9. Sheet U-4 Provide same note as on Sheet U -6 regarding tie -in of relocated water main,
notification to City, and overtime pay.
10. All sheets referring to Clarke Road paving: In all areas where pavement widening or
,.► median modification is proposed, the existing friction course will be milled full depth, full
width, and replaced after all pavement or median modifications are complete, with new
action course and striping. Provide a clear note co that effect on all sheets which show
such work. Revise tabulations of pavement rnarlangs accordingly.
