CALL TO ORDER The meeting was called to order by Vice Chairman Bond at 7:35 p.m. followed by a moment of silent meditation and the pledge of allegiance. A quorum was present. PRESENT: Vice Chairman Bond, Members Hopkins, Jones, Miller (arrived 7:40 p.m.), and Rhodus, and Alternate Members McKey and Williams. Also present were Planning Director Wagner, Assistant City Attorney Formella, and Deputy City Clerk Green. ABSENT: Chairman Switzer and Member Landefeld. CONSENT AGENDA The consent agenda consisted of approval of item A: A. Minutes of the Planning and Zoning Commission Regular Meeting held Tuesday. September 12. 1995. Member Jones, seconded by Member Rhodus, moved to approve the consent agenda as submitted. Motion approved by consensus. NEW BUSINESS Pozo SUBDIVISION - PUBLIC HEARING PRELIMINARY /FINAL SUBDIVISION PLAN, PROJECT NO. 94 -003 Planning Director Wagner presented the staff report for the two lot subdivision located at the northwest corner of Old Winter Garden Road and Professional Parkway. He said the property was zoned C -3, General Commercial District, and that a two -story residence and a storage warehouse were located on the western parcel. He said research had disclosed that the property had been zoned C -3 when originally annexed, but that, due to scriveners' errors, the zoning and land use maps had reflected a multi - family designation. He noted that the correction to Commercial usage had been included in the ORC Report in the recent Comprehensive Plan Amendment. Mr. Wagner explained that the property had been purchased by Mr. Pozo a few years ago and had been split into two parcels without benefit of a subdivision plan or plat. He said the western parcel containing the existing buildings had been sold to another party, and that neither owner could develop his property until the land was properly subdivided and platted in accordance with the City Land Development Code. The Preliminary and Final Subdivision Plans have been combined but will allow each owner to proceed with separate site plans once a plat has been filed. He said there were many conditions on the Plans because the owner of the undeveloped parcel had not determined its use. He said a Developer Agreement required prior to platting would stipulate certain improvements to be accomplished at the time of site development for Planning and Zoning Commission Regular Meeting December 12, 1995 low each tract. He said the Plans required the developer to dedicate an additional 27 feet of right - of -way along Old Winter Garden Road for future roadway widening and intersection improvements. Mr. Wagner concluded his presentation with Staff's recommendation for approval including the Conditions of Approval as stipulated on the Plans. (Member Miller had arrived at 7:40 p.m. during Mr. Wagner's presentation.) In response to a question from Vice Chairman Bond, Mr. Wagner said the width of the current right -of -way along Old Winter Garden Road was 33 feet from the center line. He said the total width of right -of -way with the dedication would be approximately 100 feet and should give sufficient width to expand the road to four lanes. Ms. Bond asked if requiring the additional 27 feet of right -of -way might impact the property negatively or cause the owners to request a variance in order to develop their property. Mr. Wagner said he did not envision that happening, as in these cases the set back line was calculated from the original right -of -way. One of the owners, Mr. Joe Pozo, National Developers, Ltd., Orlando, and the engineer, Mr. Randy June, June Engineering Consultants, Orlando, were present to answer questions. 40100. Motion carried 5 -0. OLD BUSINESS: None. OTHER BUSINESS: None. COMMENTS Planning Director Wagner thanked members for coming out for the short agenda and reviewed the status of current projects underway in the City. Members expressed concern that the City did not have enough inspectors to review all the projects and buildings underway, and suggested that the City Commission should look into ways to improve this situation to protect the citizens. 'Er 2 Planning and Zoning Commission Regular Meeting December 12, 1995 Mayor Vandergrift invited Planning and Zoning Commission members to attend the City Commission Meeting on December 19th to express their views, shared his ideas for an Ocoee Trail, and wished members a Merry Christmas and a safe and Happy New Year.
