HomeMy WebLinkAbout01-09-1996 MINUTES OF THE PLANNING AND ZONING COMMISSION REGULAR MEETING HELD TUESDAY, JANUARY 9, 1996 CALL TO ORDER The meeting was called to order by Chairman Switzer at 7:35 p.m. followed by a moment of silent meditation and the pledge of allegiance. A quorum was declared present. PRESENT: Chairman Switzer, Vice Chairman Bond, Members Jones, Landefeld, Miller, and Rhodus, and Alternate Members McKey and Williams. Also present were Planning Director Wagner, Assistant City Attorney Formella, and Deputy City Clerk Green. ABSENT: Member Hopkins. CONSENT AGENDA The consent agenda consisted of approval of items A and B: A. Minutes of the Planning and Zoning Commission Regular Meeting held Tuesday, November 14, 1995. B. Minutes of the Planning and Zoning Commission Regular Meeting held Tuesday, December 12, 1995. tor Member Landefeld noted that line 5, paragraph 3, page 3 of the November 14th Minutes should be corrected by the insertion of "not" to read ". . . he does not anticipate . . ." and asked Mr. Wagner if he had checked with the City Engineer about his findings concerning the maintenance bond for street repairs in Silver Glen. Mr. Wagner said he had not, but would do so shortly. Member Landefeld seconded by Member Miller, moved to approve the Consent A. enda as corrected. Motion carried 6 -0. NEW BUSINESS PLANTATION GROVE PUD - CROSS CREEK, PHASE II - PROJECT NO. 95 -005 FINAL SUBDIVISION PLANS (INCLUDING MOORE ROAD CONSTRUCTION PLANS) Planning Director Wagner presented the staff report for Phase II (162 lots) of the Final Subdivision Plans for the single family portion of Plantation Grove PUD identified as "Cross Creek." He explained that the Moore Road Construction Plans provided for the paving of the road from the subdivision west to Maguire Road and that the road would be realigned from its present location to form what eventually would be a fully signalized intersection with Roberson Road. He explained staff's suggestion for the waiver of Condition of Approval No. 22 on the revised PUD Land Use Plan (See Attachment #1) as its requirements would hold up the subdivision for many months. He said in lieu thereof that staff recommended requiring the developer to build both the subdivision improvements and Moore Road concurrently and that the Planning and Zoning Commission Regular Meeting January 9, 1996 City not give a Certificate of Completion on the subdivision until the road had also been accepted. Mr. Wagner also said staff recommended approval subject to changes (largely minor, technical) as recommended in comments by the attorney and engineers in their memoranda which had been distributed in the meeting. (See Attachment #2) He added that revised plans have been submitted reflecting those changes. He concluded with staff's recommendation for approval subject to the waiver, subject to the inclusion of additional notes on the plans and subject to the completion and acceptance of the paving of Moore Road prior to the issuance of the Certificate of Completion. An area road about which Chairman Switzer expressed concern was determined to be east of the Plantation Grove property. Attorney Formella assured him, with respect to Moore Road, that the developer would be required to provide written verification that all of the improvements for the new Moore Road that they were constructing would be within the area delineated on the plan and that that matched up with the right of way that had already been conveyed to the City. Member Landefeld asked how the alignment of Moore and Roberson Roads would be accomplished. 1 "'' Mr. Wagner said a number of the details were shown in their plan sets but that more right of way would need to be acquired on Roberson for the intersection. Mr. Mark Evans, Regional Director of Land Development, Cross Creek Development Company, Orlando and Mr. Joe Kolb, P.E., Vice President, CCL Consultants, Inc., Maitland were present to answer questions. Motion carried 6 -0. COMMENTS Planning Director Wagner reported: 1. The mall was expected to open on time as construction was on schedule. 2. Three annexations were pending: an addition to Burnden Park; the 40 acre Pease property on the southeast corner of Clarke and Silver Star; and a parcel on SR 50 across from Health Central. 3. Senior Planner Horne has almost completed the ORC response to the Comprehensive Plan Amendment and will be working on the Land Development Regulations. Nor" Several members expressed their concerns about problems with termites and siding in the City. They suggested that the City should do all it could to assist the residents in resolving the problems through setting policy, providing inspectors, and educating the citizens. Phase II /Final Subdivision Plans In connection with the above - referenced matter, we have reviewed the following documents: Si '"' 1. Cross Creek Phase II Final Subdivision Plans for Plantation Grove, Parcels B, C, D, G, and I stamped received by the City of Ocoee December 26, 1995 (the "Plans ") 2. Response letter from Joseph F. Kolb of CCL Consultants, Inc. dated December 22, 1995 and stamped received by the City of Ocoee December 26, 1995 (the "Response "); 3. Owner's Affidavit dated December 19, 1995 and stamped received by the City of Ocoee December 26, 1995; and 4. Page 2 of Application fcr Subdivision or Site Plan Review. This memorandum supplements our prior memoranda dated November 30, 1995 and December 6, 1995 ( "Prior Memoranda "). Based upon our review of the above - referenced documents pursuant to the new Land Development Code, we have the following comments: 1. As noted in our Prior Memoranda, the approved Preliminary Subdivision Plan ( "PSP ") references utility and drainage easements in vote 7 on Sheet 1 and on Sheet 2. We have requested that the Applicant reflect the easements on the err Plans by locating the easements on the Plans or by adding notes to the Plans. Note 8 on the Plans is not sufficient because it does not specifically identify the easements. The following steps should be taken: a. Add PSP Note 7, which states the following, to the Plans: A 15'- utility easement shall exist over all watermains within the single family portion as well as an easement over all sanitary lines with a width of twice the depth of the sewer or I5* miniMUm - b . It appears that the drainage easements are shown on Sheet 6. City Staff should confirm that the location and width of the drainage easements are acceptable. c_ Add the following note, which is similar to a note on PSP Sheet 2, to the Plans: The land underlying the drainage easements shall be owned by the individual lot owners. The drainage easements are for the benefit of and shall be maintained by the Homeowner•s Association. 2.. For the private easement, the PSP referenced Book "4334" while the Plans reference Book "3443 ". Please confirm the correct recording information and revise the Plans if necessary. The private nature of the easement should be specified. Please change the labeling to "Private Roadway Easement ". If documentation of a 10 foot width and power use is provided, the labeling can be adjusted accordingly. j 3_ Please be advised that, prior to issuance of a certificate of completion, - the temporary easements - to .. accommodate a temporary water line, must be recorded. I have no problem with, nor anything to add to Martha Formella's comments_ She is better inforned than I am as to the wording of any notes regarding easements. 2. I still have not seen the easement document for the temporary ware: line easement. If this project goes to DRC on January 3, 1996, provision of an acceptable easement document prior to City Commission action should be a condition of DRC approval 3. On the comments submitted by PEC, I have the following: • I_ We had not discussed the need for a right turn lane into Cross Creek from Moore Road, nor was it a requirement of the preliminary plan_ I do not believe we should require this turn lane; 2. Unless PEC fwis that using the Orange County rainfall distribution will significantly affect the design, I do not feel that we should required CCL to revise the drainage calculations in this manner.
