HomeMy WebLinkAbout09-24-1997 MINUTES OF THE PLANNING AND ZONING COMMISSION fir.- REGULAR MEETING HELD WEDNESDAY, SEPTEMBER 24, 1997 (ACTING AS LOCAL PLANNING AGENCY) CALL TO ORDER The meeting was called to order by Chairman Switzer at 7:30 p.m. followed by a moment of silent meditation and the pledge of allegiance. A quorum was declared present. PRESENT: Chairman Harold Switzer, Vice Chairman Bond, Members Jones, Hopkins, Rhodus and Alternate Member McKey. Also present were Planning Director Wagner, Assistant City Attorney Formella, Senior Planner Horne and Deputy City Clerk Green. ABSENT: Members Landefeld and Miller and Alternate Member Williams. CONSENT AGENDA The consent agenda consisted of approval of item A: A. Minutes of the Planning and Zoning Commission Regular Meeting held Tuesday, August 12, 1997. Member Jones, seconded by Member Rhodus, moved to approve the consent agenda as '‘how presented. Motion carried 5 -0. (Members Landefeld and Miller were absent.) NEW BUSINESS Assistant City Attorney Formella advised that the hearing for the annexation would be quasi - legislative and the hearings for the rezonings and the Comprehensive Plan would be quasi-judicial proceedings. Clerk's Note: As Senior Planner Horne presented the staff report for each of the following public hearings she pointed out the subject property on the map. WEST OAKS UNITED METHODIST CHURCH - ANNEXATION - PUBLIC HEARING (CASE No. AR- 97 -03 -02) Senior Planner Horne presented the staff report for the proposed annexation of the 7.9 acre parcel located north and east of the intersection of Clarke Road and White Road. She said the parcel was vacant and that, if the requested annexation was approved, the West Oaks congregation would establish a multi - purpose church on the property. Mrs. Horne said no annexation agreement was required with this development as the Church had previously contributed right -of -way when Clarke Road was constructed. She concluded with staff's recommendation for approval based on the findings noted in the motion below. Mr. Ernest M. Post, 1711 Sparkling Water Circle, was present to answer questions as the Now applicant and pastor of the West Oaks United Methodist Church. WEST OAKS UNITED METHODIST CHURCH - REZONING - PUBLIC HEARING (CASE No. AR- 97 -03 -02) Senior Planner Horne presented the staff report for the application to rezone the 7.9 acre parcel located north and east of the intersection of Clarke Road and White Road from A -1, Citrus Rural District (Orange County), to A -1, General Agricultural District (Ocoee). She explained that, under the A -1 zoning the applicant was requesting, the project would not be reviewed as a Special Exception. Planning Director Wagner pointed out that the site plans would be reviewed administratively by staff if the total project was less than 25,000 square feet. Mrs. Horne concluded with staff's recommendation for approval based on the findings as noted in the motion below. The public hearing was opened. Member Rhodus asked about the ballfields proposed as a use for the Church's property and Pastor Post said they plan to build the church in phases and, initially, they want to prepare the site for use as ballfields, placing them in such a way that they can remain for the longest period of time. Alternate Member McKey asked if a school was planned and expressed concern about the traffic impact. Pastor Post said potential uses of the property included a school, a community room, and a day care center as well as the baseball fields. He said the Congregation would ultimately determine the uses of the property and the phasing of construction. Mrs. Horne said that without a specific range of uses and building sizes it would be difficult to estimate the impact of the potential church uses. The public hearing was closed. In further discussion members expressed concern about the effect of the uses on surrounding property owners and whether or not they would be notified about specific plans for the property. Mrs. Horne said notices had been mailed to 41 neighboring property owners. Mr. Wagner said it would not be standard procedure to notify property owners again when building began. PRAIRIE LAKE JOINT VENTURE PARTNERSHIP - SMALL SCALE COMPREHENSIVE PLAN AMENDMENT - CPA - 97-001 PUBLIC HEARING (As LPA) Senior Planner Horne presented the staff report for the application to change the Future Land Use designation from Commercial to Low Density Residential for the 5.15 acre parcel located on Hackney - Prairie Road approximately 200 feet east of Clarke Road, south of Prairie Lakes Subdivision. Mrs. Horne concluded with Staff's recommendation for approval based on the findings as noted in the motion below. Assistant City Attorney Formella pointed out that the Planning and Zoning Commission was acting as the Local Planning Agency for this hearing. The applicant was present to answer questions. PRAIRIE LAKE JOINT VENTURE PARTNERSHIP - REZONING - PUBLIC HEARING (CASE No. R- 97 -03 -03) Senior Planner Horne presented the staff report for the application to rezone from C -1, Neighborhood Shopping District to R -1A, Single Family Dwelling District the 5.15 acre parcel located on Hackney- Prairie Road approximately 200 feet east of Clarke Road, south of Prairie Lakes Subdivision. She concluded with staff's recommendation for approval based on the findings as noted in the motion below. GOMES (SPRING LAKE PLAZA) REZONING - PUBLIC HEARING (CASE No. R97 -07 -05) Senior Planner Horne presented the staff report for the application to rezone from C -1, Neighborhood Shopping District, to C -2, Community Commercial District, a 1.4 acre parcel located at 1500 Wurst Road. Half of the property contains an existing 5,000 square foot shopping center and the other half is undeveloped. She concluded with staff's recommendation for approval based on the findings as noted in the motion below. The public hearing was opened. As no one wished to speak, the public hearing was closed. SAFE STOR OF OCOEE, INC. - REZONING FROM C-2 TO C -3 - PUBLIC HEARING (CASE No. R- 97- 07-06) Senior Planner Horne presented the staff report for the application to rezone from C -2, Community Commercial District, to C -3, General Commercial District, a 2.4 acre parcel located on Bluford Avenue approximately 750 feet north of State Road 50. She explained in detail the reasons for the staff recommendation to DENY the requested rezoning, and those reasons are summarized in the findings in the motion below. The public hearing was opened. Mr. Ed Williams, 2712 Tyron Place, Windermere, representative for the current and prospective property owners, Mr. Ron Stucki and Safe Stor, respectively, gave his background and credentials as an expert witness. He presented an elevation of the proposed building and the information on which they based their request that Planning and Zoning Commission overturn staff recommendation and recommend approval of the C -3 rezoning request. Mrs. Horne established her credentials for the record and advised that this was a precedent setting case. In lengthy discussion, members generally agreed that the building as proposed by Mr. Williams would be an attractive addition to Bluford. They discussed concerns about other zonings in the area and the options available to allow the project to go forward. Chairman Switzer said his concern was not the building of this building, which would be an attractive improvement to Bluford. He said he had concerns about the road and traffic it may or 4 Planning and Zoning Commission Regular Meeting y September 24, 1997 may not generate. He was concerned about setting a precedence and how that would affect the property around it, as C -2 uses would give a pleasant entrance into the City along Bluford. He said, although there were area businesses that have existed prior to City zoning restrictions, it was the goal now to make it a better looking community. He cautioned against making zoning changes which might contribute to "hodge - podge" in the area. He said he thought the board should follow along with the thinking of planning staff because planning is "what it is all about." Mr. Williams said he thought a PUD zoning would be the best way to start a trend and precedent in the area to improve quality. A consensus was reached to take action on the request before the board and to later review it as a PUD rezoning if requested. Recess: 9:00 p.m. - 9:10 p.m. The public hearing was closed.
