HomeMy WebLinkAbout05-27-1998 MINUTES OF THE PLANNING AND ZONING COMMISSION REGULAR MEETING HELD WEDNESDAY, MAY 27, 1998 CALL TO ORDER The meeting was called to order by Vice Chairman Bond at 7:36 p.m. A moment of silent meditation was followed by the Pledge of Allegiance. A quorum was declared present. PRESENT: Vice Chairman Bond, Members Christoefl, Hopkins, Landefeld, and Miller. Also present were Planning Director Wagner, Assistant City Attorney Clements, Senior Planner Lewis and Deputy City Clerk Green. ABSENT: Chairman Switzer, Member Rhodus, Alternate Members McKey and Williams. * *Clerk's Note: Alternate Member Williams resigned effective as of May 26, 1998 in a letter received in the Office of the City Clerk on May 29. CONSENT AGENDA - None. NEW BUSINESS SUMMERVILLE AT OCOEE ASSISTED LIVING FACILITY PUD LAND USE PLAN - REZONING CASE NO. 98 -001 PUBLIC HEARING Senior Planner Lewis presented the staff report for the application to rezone the subject property, an outparcel (Lot 2) of the Lake Olympia Square Shopping Center, from C -2, Community Commercial District to PUD, Planned Unit Development. He displayed a map of the approximate five acre parcel and adjacent properties and pointed out the zoning and uses of the surrounding property. Mr. Lewis explained that the applicant wished to develop a 120 bed Assisted Living Facility for senior citizens, and that the facility would require both PUD zoning and Special Exception approval. He said as part of the conditions of approval for the PUD, a waiver to allow 18' parking spaces with a 2' overhang into landscaped areas was being requested as had been done for the adjacent shopping center. He concluded with staff's recommendation for approval. Mr. Kevin M. Robillard, Vice President of Daniel Corporation, was present to answer questions for the developer, and responded to members questions as follows: • An "Assisted Living Facility" is for senior citizens who do not need the full services of a nursing home but are unable to care for themselves at home. • Typical resident would be an 83 to 85 year old female. • A certificate of need was not required for one of these facilities. • Admission decisions would be made by the admissions coordinator and the caregiver along with a physician. • Staff would include RN's and LPN's with a physician coming certain hours per week. Mrs. Martha Lopez- Anderson, 2438 Alclobe Circle, asked for the record, if the business should not succeed in this area, if the requested zoning would allow for that facility to become an apartment complex. Mr. Lewis responded that apartments would not be permitted in the requested zoning. Mrs. Lopez- Anderson commended the developers for communicating with adjacent development. The public hearing was closed As had been recommended by Staff, Member Landefeld seconded b Member Ho ' kins moved to recommend approval of the rezoning request for Summerville at Ocoee Assisted Living_ Facility (Case No. 98 -001), rezoning the subject property from C -2, Community Commercial District, to PUD, Planned Unit Development, consistent with the PUD Land Use Plan date stamped received by the City on Mav 19, 1998. Motion carried 5 -0. SUMMERVILLE AT OCOEE ASSISTED LIVING FACILITY - SPECIAL EXCEPTION APPLICATION CASE No. 1- 1SE -98 PUBLIC HEARING Senior Planner Lewis presented the staff report for the Special Exception Application for the Assisted Living Facility. He displayed the Preliminary Site Plan for the purposes of the Special Exception and pointed out significant features of the Plan, including landscaping on all sides, buffering, and fencing. He presented a rendering of the proposed facility and concluded with staff's recommendation for approval. Member Christoefl asked if a new owner could purchase Summerville after it is built and change the use of the facility. Planning Director Wagner explained that, in order to do so, the new owner would have to apply for rezoning and a land use change. The public hearing was opened. Mr. Nick Pagano, 201 Olympus Dive, said the Lake Olympia Club Homeowners Association has no reservations about the proposed facility. In discussion about Lynx bus service for the proposed facility, Member Miller suggested a covered Bus Stop Pavilion. Planning Director Wagner suggested that it might be advisable to have one bus stop for the shopping center and one for the new facility. 2 Planning and Zoning Commission Regular Meeting May 27, 1998 Mr. Nick Burdick, with Summerville, pointed out that typically their residents would not rely on public transportation, but that caregivers and employees might do so. Mr. Robillard said he will contact Lynx to see if they can build a bus stop in keeping with the style of the development. In response to questions by Commissioner Scott Anderson, Mr. Robillard said their company was in the process of developing four assisted living facilities in central Florida, and that they intend to develop between 8 and 12 in the next three years for Summerville Healthcare. He said they are in the business of operating assisted living facilities, not in the business of developing them and selling them. He said they have facilities in development or in operation throughout the east coast of the United States, and he would have more information about them at the City Commission meeting. The public hearing was closed. Member Christoefl expressed safety concerns about the cross - access easement to the shopping facility. She asked if there would be a gate or something that could be closed at night to prevent traffic from crossing the property to enter and exit the adjacent shopping center. Mr. Wagner said a gate or vertical metal pipes that are moveable could be incorporated into the Nor Final Site Plan, and that Plan would come back before Planning and Zoning Commission in another public hearing. Member Landefeld pointed out that there was handicapped parking in every lot except for the one located on the southeast side of the parcel. He asked if there were a reason that there was no handicapped parking in the southeast parking lot. Mr. Lewis pointed out that few of the residents will have their own cars, and that the spaces are primarily for the employees and the visitors. Mr. Wagner said staff will be sure that a ramp will be included somewhere within each parking lot in the Final Plan. Vice Chairman Bond said that wheel chair accessible parking might be needed when family members visit residents in Assisted Living Facilities to take them on outings. As had been recommended by staff, Member Ho I kins seconded b Member Landefeld moved to recommend approval of the Special Exception for Summerville at Ocoee Assisted Living Facility (Case No. 1- 1SE -98), as date stamped received by the City on May 19, 1998. Motion carried 5 -0. r 3 Planning and Zoning Commission Regular Meeting Now May 27, 1998 Member Miller thanked the representatives for the developer for attending and answering members questions. And Mr. Wagner pointed out that the public hearings before City Commission would be held on June 16. OLD BUSINESS - None. OTHER BUSINESS Planning Director Wagner gave an overview of the matters to be considered by Planning and Zoning Commission in meetings to be held on June 9, June 18 and June 24.
