REGULAR MEETING HELD WEDNESDAY, AUGUST 25, 1999
AS LOCAL PLANNING AGENCY
I. CALL TO ORDER
The meeting was called to order by Vice Chairman Bond at 7:37 p.m. A moment of silent
meditation was followed by the Pledge of Allegiance to the Flag. A quorum was declared
present.
PRESENT: Vice Chairman Bond, Members Christoefl, McKey, McNeil, Matthys, and Miller
(arrived at 7:40 p.m.). Also present were Assistant City Attorney Formella,
Principal Planner Lewis and Administrative Secretary Dawson.
ABSENT: Chairman Switzer, Member Landefeld and Member Rhodus.
II. CONSENT AGENDA
The consent agenda consisted of approval of Item A:
ITEM A: Minutes of the Planning and Zoning Commission Regular Meeting held on
kkr.• Tuesday, August 10, 1999.
Member McKey, seconded by Member McNeil, moved to approve the consent agenda as
presented. Motion carried 5 -0 (Member Miller had not yet arrived).
III. NEW BUSINESS
ITEM A: ORDINANCE NO. 99 -28: TEMPORARY BALLFIELDS AND PLAYFIELDS
OCOEE CODE OF ORDINANCES AMENDMENT AND
LAND DEVELOPMENT CODE AMENDMENT PUBLIC HEARING
Assistant City Attorney Formella presented the staff report explaining Ordinance No. 99 -28.
She stated that this ordinance allows non - profit organizations to use property in any zoning
district as a temporary ballfield or playfield for 90 consecutive days and makes them exempt from
permitting requirements.
Vice Chairperson Bond asked about the wording of "90 consecutive days" , and about
provisions for extensions. Assistant City Attorney Formella and Principal Planner Lewis
responded that the language in the ordinance was drafted intentionally.
A discussion ensued about extensions, methods of recourse by unhappy neighbors, limiting the
playfields to commercial and industrial areas and cost -free permitting requirements.

The public hearing was opened, and there being no comment from the audience, the public
hearing was closed.
There being no comments or further discussion by the Board,
Member McKey moved to recommend Ordinance No. 99 -28 to the City Commission, subject to
adding a nominal permit for City control. After some discussion, Member McKey then
amended the motion and moved to not recommend Ordinance No. 99 -28 as it stands. Member
McKey amended the motion again and moved to recommend Ordinance No. 99 -28 to the City
Commission, subject to deleting the word "consecutive" and adding a no -fee permit to be
completed by the applicant for record keeping purposes. Motion died for lack of a second.
Another discussion ensued about the City being able to respond to neighbor complaints and how
the City could maintain information about the temporary playing fields. Principal Planner Lewis
advised the Commission that the Land Development Code will be up for revision soon, and that
this issue could be addressed at that time if there are any problems that develop with its
implementation.
There being no comments or further discussion by the Board,
Now Member Matthys, seconded by Member Christoefl, moved to recommend Ordinance No. 99-
28 to the City Commission, subject to requiring written notice to the City Building Official as to
playfield location, name of organization with contact person and start date of use of the playfield.
Motion passed 6 -0.
ITEM B: ORDINANCE NO. 99 -29: OPEN REAR YARD PORCHES IN RESIDENTIAL DISTRICTS
LAND DEVELOPMENT CODE AMENDMENT PUBLIC HEARING
Assistant City Attorney Formella presented the staff report explaining Ordinance No. 99 -29.
She stated that this ordinance allows porches to extend more than 5 feet into the rear yard
provided they meet the following criteria: 1) the open porch does not cover more than thirty
percent (30 %) of the rear yard; 2) the open porch does not increase the maximum impervious
surface of the lot to be greater than fifty percent (50 %); 3) the open porch is no closer than
seven and one -half (71/2) feet to the rear lot line and no closer than seven and one -half (71/2) feet
to either side lot line; and 4) the open rear porch does not extend into and utility, drainage or
landscape easement or conservation area. The 5 foot restriction would still apply to side and
front porches.
In response to questions from the Commission, Principal Planner Lewis advised the
Commission again that the Land Development Code will be up for revision soon, and that this
issue could be revisited if necessary at that time.

The public hearing was opened, and Mayor Vandergrift advised the Commission about
microphone etiquette. There being no other comment from the audience, the public hearing was
closed.
There being no comments or further discussion by the Board,
Member Christoefl, seconded by Member McKey, moved to recommend Ordinance No. 99 -29
to the City Commission, as presented by staff. Motion passed 6 -0.

VI. COMMENTS
Principal Planner Lewis advised the Commission that he anticipates having a meeting on
September 14, 1999. He stated that there will probably be a preliminary subdivision plan to be
reviewed for Village West Oaks and a final subdivision plan for review for Ocoee Crossings.

The meeting was adjourned at 8:15 p.m.
