REGULAR MEETING HELD TUESDAY, FEBRUARY 11, 2003
AS LOCAL PLANNING AGENCY
CALL TO ORDER
Chairman Bond called the meeting to order at 7:10 p.m. in the Commission Chambers.
Following a moment of silent meditation and the Pledge of Allegiance to the Flag, a quorum was
declared present.
PRESENT: Chairman Bond, Members Golden, Keller, McKey, and West. Also present were
Community Development Director Wagner, Senior Planner Grimms, Assistant
City Attorney Cookson, and Deputy City Clerk Whitford.
ABSENT: Member Miller, Landefeld, and Rhodus. Member Riffe was excused.
CONSENT AGENDA
The consent agenda consisted of approval of Item A:
A. Minutes of the Planning and Zoning Commission Regular Meeting held on Tuesday,
January 14, 2003.
Sow Member Golden, seconded by Member McKey, moved to accept the Consent Agenda as
presented. Motion carried unanimously.
NEW BUSINESS
Election of New Officers
Member West, seconded by Member Keller, moved to nominate Pat Bond as Chairman and
Jim Golden as Vice Chairman.
Member McKey nominated himself for Chairman.
The vote for Pat Bond for Chairman was 4 -1 with Member McKey voting no.
The vote for Rob McKey for Chairman was 1 -4.
The vote for Jim Golden for Vice Chairman was 5 -0.
OCOEE CHURCH OF THE NAZARENE PUD /LAND USE PLAN LS - 99 - 015 Public Hearing
Planning Manager Lewis presented the staff report for the Ocoee Church of the Nazarene
PUD/Land Use Plan. He said the church site includes about 4.7 acres and is located on the east
side of Clarke Road, between Silver Star Road and White Road. The subject property and all of

side of Clarke Road, between Silver Star Road and White Road. The subject property and all of
the surrounding properties have a Low Density Residential future land use designation in the
Comprehensive Plan. The surrounding properties to the south and east have R -1 -A zoning. The
subject property is currently undeveloped and is covered with numerous trees. He said the
proposed site would ultimately include a worship center, a family life center, religious education,
and child day care. He stated the church anticipates building its facilities in three phases. Phase
1 of the development will include a 6,200 square foot education building, with a larger family
life center and sanctuary building to follow in later phases. The only access to the site will be
from Clarke Road. As with other church sites, there will be a 6 foot fence with appropriate
landscaping. He said the church intends to preserve a significant number of the existing trees on
the site. He said there is one proposed waiver, which involves the required 50' building setback
along the southern property line. Mr. Lewis said the applicant believes that a 25' building
setback along the southern property line is justified because the entire southern boundary is
adjacent to a retention pond rather than residential homes, and it would allow more flexibility to
provide landscaped open space in the interior of the site. Mr. Lewis stated staff supports the
waiver request. The DRC reviewed the PUD Zoning and Land Use Plan January 24, 2003, and
voted unanimously to approve the proposed PUD Zoning and Land Use Plan.
The Public Hearing was opened, and as no one wished to speak, the public hearing was closed.
A brief discussion followed. Member McKey inquired about the lack of landscaping and
expressed concern regarding the lack of a right turn lane. Both Members McKey and Golden
expressed concern about the number of trees that would be removed. Mr. Lewis responded to
their concerns and questions.
Community Development Director Wagner said he had received an inquiry from a resident
wanting to know about the life center and the type of activity which would take place there.
Applicant and Pastor John Rogers responded to the question indicating there were plans for a
day care center, but at this time no plans for a K -12 school. He also addressed the tree issue.
Member West, seconded by Member Keller, moved to approve the Ocoee Church of the
Nazarene PUD /Land Use Plan Project LS -99 -015. Motion carried 5 -0.
MULTI - FAMILY DEVELOPMENT STANDARDS
AMENDMENT TO THE LAND DEVELOPMENT CODE
ORDINANCE No. 2003 -09. Public Hearing
Community Development Director Wagner explained that even though the Land Development
Code allows multi - family development in various zoning districts, the only place in the Code that
currently provides design standards for such development is the PUD section. He said due to this
factor, the Code does not have provisions for multi - family developments with fee simple land

ownership such as townhouses with smaller lot sizes and zero side yard building setbacks.
Therefore, even though this may be the only unique feature of a townhouse project, that type of
development would be forced to go through the cumbersome PUD process, simply because of the
small lot sizes and the zero side yard building setbacks. He said this proposed Land
Development Code amendment is intended to resolve these problems. The standards in the
proposed Multi - Family Development Standards ordinance would apply to all multi - family
development in all zoning districts, including areas with PUD zoning.
Public hearing was opened.
Jim Fleming, 511 Orange Ave., expressed concerns about ADA requirements, setback
requirements, potential traffic problems, units per acre, and short-term rentals.
As no one else wished to speak, the public hearing was closed.
Community Development Director Wagner explained the developers would have to follow the
specific requirements and the parking and sidewalks would definitely have to meet ADA
requirements. He also addressed the traffic and units per acre issues as well as the short-term
rental question. Mr. Wagner said the short-term rental issue was a concern of the City
Commission also.
During the following discussion Member McKey voiced several concerns that he also had
regarding the units per acre, parking, and short-term rentals. He said he would also like to see
the City raise the bar for minimum living area square footage from 650 sq. ft. to 1000 sq. ft.
Member McKey said he would also like to see a minimum standard of 4" DBH (Diameter
Breadth Height) for new landscape trees.
Chairman Bond gave a brief synopsis of how the 650 sq. ft. standard came to be.
Member McKey, seconded by Member Keller, moved to recommend approval to the City
Commission of proposed Ordinance Number 2003 -09 Multi- Family Development Standards
Amendment to the Land Development Code with the suggested changes to item 5 of an increase
in the minimum living area standard from 650 sq. ft. to 1000 sq. ft.. and item 12 to state tree size
of 4" DBH. Motion carried 3 -2 with Bond and Golden voting no.
Following the vote Mr. Wagner stated the concerns expressed at this meeting would be brought
up for further discussion during the two public hearings that would be held before the City
Commission regarding Ordinance number 2003 -09.

Chairman Bond, seconded by Member Golden, moved to continue the public hearing
indefinitely. Motion carried 5 -0.

PETITION CASE # 1 -3SE -2002.
The public hearing was opened, and no one wished to speak.
Chairman Bond, seconded by Member West, moved to continue the public hearing
indefinitely. Motion carried 5 -0.
OTHER BUSINESS
None.
COMMENTS
Planning Director Wagner said the Comprehensive Plan Books have been passed out and the
Plan is also available on CD and the website. He said Jennifer Willman did a great job putting it
all together. He said she is currently working on the Land Development Code, updating it and
putting all the old amendments into it, and it too will soon be available on disk and on the web.
All of this is helping to bring them into the twenty-first century. He said the cost to the public to
purchase the Comprehensive Plan book is $114.00, so the ability to be able to look it up on the
web is quite an advantage.
Member Mckey stated he would like to know about the projects being done in the city that are
beneath the threshold for coming before the Planning and Zoning Commission, and he would
like that threshold moved down from 25,000 sq. ft. to 15,000 sq. ft. Mr. Wagner explained that
the projects are all listed on the City website and explained the 25,000 sq. ft. cap was put into
place to help expedite the review process.
