REGULAR MEETING HELD JULY 22, 2010
CALL TO ORDER
Chairman Resnik called the meeting to order at 6:00 p.m. in the Commission Chambers
at City Hall. Member Colburn led the Invocation and the Pledge of Allegiance to the
Flag; the Clerk called roll and declared a quorum.
PRESENT: Chairman Resnik, Members Colburn, Wilsen, Alternate Member Cadle,
and Alternate Member Robinson. Also present were Principal Planner Rumer, Assistant
City Attorney Watson, and Deputy City Clerk Sibbitt.
ABSENT: Members Elliott and Warren were absent excused.
APPROVAL OF MINUTES — JUNE 17, 2010
Member Colburn, seconded by Member Wilsen, moved to approve the minutes of June
17, 2010. Motion carried 5-0.

NEW BUSINESS
8 SUNDIAL KEY DRIVE — VR -10 -03
Principal Planner Rumer presented exhibits and the staff report for the Variance located
at 8 Sundial Key Drive.
BACKGROUND
This variance application requests that a proposed replacement mobile home at 8 Sundial
Key Drive be allowed to encroach 5 foot into the 20 foot rear yard setback established by
the zoning district. The applicant's intent is to replace the mobile home constructed in
1967 with one that was constructed in 1985. The applicant consulted with the Building
Department on the requirements for making the replacement and was informed that due to
the 20' setback; a variance would be required. The replacement mobile home is titled at
65 feet with an actual measurement of 64 feet 4 inches long by 13 feet 6 inches wide.
The replacement mobile home was inspected by the Building Department and passed
inspection.
RECOMMENDATION
Based on the findings, staff recommends the Board of Adjustment recommend approval
of the variance request by James Creech for a rear yard setback variance from 20 feet to
15 feet for a proposed replacement mobile home.
DISCUSSION
The Public Hearing was opened
Alternate Member Cadle inquired as to what type of development might occur to the
west if it were rezoned. Principal Planner Rumer stated without going through hoops

they could put some sort of detached single - family residential development. He further
stated the property is currently owned by Groundtek. Member Wilsen inquired if the
neighbors were notified of this request for a variance. Principal Planner Rumer stated
they sent the 300 ft. notice and did not receive any objections from the neighbor.
Member Colburn stated he went out to the property and did not see anything behind the
property that would become a hassle in the future. Principal Planner Rumer stated he
spoke with the Capital Improvements Manager and he liked the idea of making things
newer so the board should keep in mind that the 1967 mobile home is being replaced with
a 1985 mobile home.
James Creech, applicant, stated that the trailer he has there has a long history with his
family but it is an old trailer. They have a family who is living in it now but would like to
move them out and put them in the newer trailer.
The Public Hearing was closed
Member Wilsen, seconded by Alternate Member Cadle, moved to recommend to City
Commission the approval of the request for Creech Variance – 8 Sundial Key Dr. per
staff's recommendation. Motion carried unanimously.
