HomeMy WebLinkAbout03-22-2011 Minutes MINUTES OF THE CITY OF OCOEE CODE ENFORCEMENT BOARD MEETING MARCH 22, 2011 CALL TO ORDER Chairman Godek called the regular meeting of the Ocoee Code Enforcement Board to order at 7:00 p.m. in the Commission Chambers at City Hall. Member Hopper led the Invocation and Member Kelley led the Pledge of Allegiance to the Flag. The roll was called and a quorum was declared present. PRESENT: Chairman Godek, Members Hopper, Kelley, and Alternate Member Blynder. Also present were Deputy Fire Chief Butch Stanley, Code Enforcement Officers Delgado, Loeffler, Rodriguez and Siegrist; Administrative Assistant Bridgett Ballard, Board Attorney Mary Sneed, and Recording Clerk Stella McLeod. ABSENT: Vice -Chair M. Godek, Members Sais, Osborne and Lowery, and Alternate Member Amey were absent excused. GUESTS: Administrative Assistant Ballard administered the oath to the Code Enforcement Officers, Fire Inspector, and anyone intending to speak regarding a case. CONSENT AGENDA ALL MATTERS LISTED UNDER THE CONSENT AGENDA ARE CONSIDERED ROUTINE BY THE CODE ENFORCEMENT BOARD AND WILL BE ACTED UPON BY ONE MOTION. Officer Rodriguez presented the case and gave its history. A four -foot fence was requested first; then later a 6 -foot fence. Officer Rodriguez said that the City's Code says the fence has to be 10.8 feet away from the house. The fence, not meeting the requirement, must be moved. No final inspection can be done. Mr. Troy Kurt East, 2224 Twisted Pine Road, son of the respondents, said on February 15, 2011, his father was admitted to the hospital, and discharged on March 5, 2011. The father was later re- admitted on March 8, 2011. Referring to the architectural drawing, Mr. East said that the measurement of the drawing is incorrect, and that, therefore, the fence is within the code specifications. He was advised to get another survey showing correct measurements. The reference point on the drawing does not reflect the actual property line, thus throwing off the measurements. Member Hopper recommended that Mr. East meet with the City staff and find out what needs to be done prior to hiring the surveyor. Officer Rodriguez suggested he contact the City's building department. Member Hopper asked Officer Rodriguez to guide Mr. East through the process. She agreed to do so. Member Hopper, with a second by Member Kellen, moved that in case #11 -030 the respondents be found in violation as cited as of February 24, 2011, and be given until April 18, 2011, to come into compliance or be fined $100 / day thereafter. The motion carried unanimously. Page 3 of 13 Code Enforcement Board Minutes March 22, 2011 Officer Delgado presented the case and gave its history. Exhibits were shown (photos). The property is non - compliant as of today (3/22/2011). Mr. Charles Lowery, 1000 Center Street, addressed the board. He said he has been working really hard on it. He has lost his job and has had to cancel storage. He also has a pinched nerve in his neck. He showed the board pictures of the property showing where he has done clean-up (he used pictures from his cell phone). Chairman Godek asked how much time is needed before clean-up is completed. Mr. Lowery responded another week or so is needed. Member Hopper encouraged Mr. Lowery to speak with City staff so that they can be of assistance to him. Member Kelley, seconded by Member Hopper, moved that in case #11 -033 the respondent be found in violation and cited as of February 23, 2011, and be given until April 12, 2011, to come into compliance or forfeit $100 / day per violation. The motion carried unanimously. Case No. 11 -037 Catherine M. Repeat violation. Exhibits were presented (photos). Property is currently non - compliant. Chairman Godek asked what the debris was on the past case. Officer Delgado had pictures from the prior case. Ms. Catherine M. Hall, 584 Neumann Village Court, said that she is unemployed. She had two homes but one was emptied causing there to be debris at the home in question. Chairman Godek noted that there is still debris in front of the house. She said that the table in front of her garage cannot be moved by herself alone. Member Hopper asked what the HOA (homeowner's association) is saying about the matter. Officer Delgado replied that the association is unhappy that there is debris in front of the house. Member Kelley asked Ms. Hall when her son would be able to help her. She said she did not know. Alt. Member Blunder, seconded by Member Hopper, moved that in case #11 -037 the respondent be found in repeat violation as cited as of February 24, 2011, and be given until April 12, 2011 to come into compliance or be fined $100 /day thereafter. Officer Rodriguez presented the case and gave its history. As of today the property is in compliance. Mr. Ed Wrobel, 2619 Coventry Lane, had his own business as a trim carpenter. He presented photos. Member Hopper asked if he backs his trailer into the garage. Mr. Wrobel said that he backs it up to the garage. Member Kelley, seconded by Member Hopper, moved that in case #11 -053 the respondents be found in violation as cited on February 22, 2011, and in compliance as of March 22, 2011, and that no fine be assessed at this time. The motion carried unanimously Case No. 10 -086 — Gamelz / Loudgere Delcy- Cinevert 2261 Laurel Blossom Circle Officer Rodriguez Violation Cited: 115 -5 04 -05 -10 NOV Re- inspection date: 04 -20 -10 05 -04 -10 SOV 05 -04 -10 NOH Meeting date: 05 -25 -10 05 -04 -10 POS Reg. & cert. mail 05 -13 -10 POS 05 -27 -10 CO Per C.E.B. found in violation as of 04 -19 -10 and to comply by 05 -28 -10 or fined $100.00 per day. Observation: Excessive weed and grass growth. This is a request for reduction of fine. Member Hopper, seconded by Member Kelley, moved that in case #10 -086, the board re- hear the case to make a recommendation for reduction of fine. The motion passed unanimously. Officer Rodriguez presented the case and gave its history. Mr. Kelley Bruce, 3413 Furlong Way, said that the property was taken in foreclosure action. Member Kelley clarified that Mr. Bruce took ownership on November 29, 2010, and that the property came into compliance as of January 11, 2011. Attorney Sneed added that there is testimony that the first lawn service was December 13, 2010. Officer Rodriguez presented photos in the packet. Member Hopper, seconded by Member Kelley, moved that in case #10 -086, the board recommended that the fine be reduced to $5, 750 ($5000 plus $750 for City's cost). The motion carried unanimously. Chairman Godek advised Mr. Bruce to attend the commission meeting when this matter is on the agenda. Case No. 11 -010 — Craig M. Member Kelley, seconded by Member Hopper, moved that in case #11 -016 the respondent be found in violation as cited as of January 25, 2011, and in compliance as of January 27, 2011, and that no fine be assessed at this time. The respondents are ordered to pay the City's administrative costs of $700. The motion carried unanimously. Officer Rodriguez presented the case and gave its history. Member Hopper clarified that they pulled a permit but never picked it up, and Officer Rodriguez confirmed it. Member Hopper said that the work was done. The respondents did pay for the permit and got plans approved by the City, but never picked up the permit; hence, no final inspection was done. Member Hopper, seconded by Alt. Member Blunder, moved that in case #11 -031 the respondents be found in violation as cited as of February 24, 2011, and be given until April 18, 2011 to come into compliance or be fined $50 /day thereafter. Attorney Sneed pointed out that the date the respondents were found in violation should be February 21, 2011 rather than February 8, 2011. Alt. Member Blynder, seconded by Member Hopper, amended his motion to include the violation as cited as of February 21, 2011 rather than February 8, 2011. The amendment passed unanimously. Alt. Attorney Sneed — The Florida Association of Code Enforcement has its annual conference in June. The class offered is to be taught by Bob Hamilton. It would be good to attend. The attorney herself will be there. She mentioned that there will be a workshop in June that would be good to attend also. Discussion ensued regarding where invoices should be sent.
