MINUTES OF THE OCOEE CITY COMMISSION REGULAR SESSION
HELD MAY 18, 2004
PRESENTATIONS TO DREAMERS ND DOERS
At 6:05 p.m., Mayor Vandergrift welco ed parents, teachers, principals, and students to the
Fifth Annual Recognition of Dreamers a d Doers. Mayor Vandergrift and Commissioner Parker
presented certificates to the winners of t e Dreamers and Doers awards for this year.
A list of the winners follows, with Teach r of the Year designated as "toy" and Walt Disney
Dreamers and Doers as "wdd".

Commissioner Parker and Mayor Van ergrift again expressed their appreciation to the
parents and teachers. The Ceremony end d at 6:22 p.m.
REGULAR SESSION
CALL TO ORDER
Mayor Vandergrift called the regular meting to order in the Commission Chambers at 7: 17
P.M. Pastor W. M. Queener, Church 0 God of Prophecy, opened with prayer and Betty
Ervine, President of Ocoee Historic Ass ciation, led the Pledge of Allegiance to the Flag. City
Clerk Grafton called the roll and declar d a quorum present.
PRESENT: Mayor Vandergrift, Commi sioners Anderson, Howell, Johnson, and Parker. Also
present were Acting City Manager Willifi rd, City Attorney Rosenthal, City Clerk Grafton,
Community Relations Director Shira, Ac ing Human Resources Director Bertling, Information
Systems Director Ross, Police ChiefGoc on, Public Works Director Wheeler, and Deputy Public
Works Director Zaitooni.

PRESENTATIONS AND PROCLAM
Hunter Hollis, representing the gifted st ents at Citrus Elementary, presented Mayor
Vandergrift with a rocket, commemoratin Mayor Vandergrift's visit to their school and in
appreciation for his assistance during a re ent rocket launching.
Citrus Elementary Science Pavilion - r. Andy Anderson
Andy Anderson invited all to the dedicat on of the Learning Pavilion being erected in Sean
Anderson's memory at Citrus Elementary School on May 24,2004, at 9:00 a.m. He said the cost
of the pavilion would be $55,000 and it is being built by award winning custom builders. He
displayed a list of the contributors and sai he had missed the deadline for a community grant,
but wished to petition the Commission fo a donation in the sum of $2,500, which will be used in
the completion of this project and to cons ruct a clay brick paver path which will surround and
lead to the pavilion.
Proclamation: Neurofibromatosis Awa eness Month
Mayor Vandergrift read the proclamatio and presented it to Bill Brooks, Mayor of Belle Isle.
Mayor Brooks accepted the proclamatio and then spoke about Neurofibromatosis, a disease
that has no known cure or treatment at thi time.
Mayor Vandergrift invited David Morri , Chairman of the Education Commission, to step
forward and receive a donation from the ayor's campaign fund for the Education Foundation.

Mark Scalzo, 6938 Crosscut Court, th ed the Commission for the opportunity to attend the
reception for the city manager candidates t Westyn Bay.
COMMISSIONERS ANNOUNCEME TS/CORRESPONDENCE
Commissioner Johnson said he would Ii e to see the City purchase the Methodist Church
complex to be used for performing arts, t senior program, and for rental purposes. He noted
the price has come down and the rental fe s could help to pay for the purchase.
Betty Ervine, 402-13C Orlando Avenue, aid the Historical Commission is very interested in
having a performing arts center and woul do their share to raise funds for it.
Commissioner Parker said she would Ii e to see staff directed to bring back information on the
current price along with the specifics pro . ded previously, and without objection, this direction

Commissioner Anderson announced th change-over to private garbage service effective June
1, 2004, with no change in the level of se ice.
Commissioner Howell said he has been alking to the residents at Amber Ridge regarding
service from BrightHouse and he asked rs. Moore, if she is watching, to let him know - as he
has been unable to contact her.
Commissioner Johnson also thanked Pu lic Works for paving Lee Street and Lyle Street. He
said it was good to get calls from citizens thanking the Commission for some things.
Mayor Vandergrift apologized for not eeting with Eugene Hickock, U. S. Deputy Secretary
of Education, to witness his address to M ey Elementary School. Mayor Vandergrift
commended the school for improving fro a 'D' school to a 'B' school.
CONSENT AGENDA
The consent agenda consisted of items A B, C, D, E, and F.
Commissioner Howell seconded b Co missioner Parker moved to a rove the consent
agenda as oresented. Motion carried 5-0.
Mayor Vandergrift commented on Item B asking for a photo-op and a thirty (30) second
commercial on OGTV for businesses and residents who live on the lakes, both in Ocoee and
Winter Garden, to learn what they canno put into our lakes. Deputy Public Works Director
Robert Zaitooni said that he would com unicate with Winter Garden and arrange the details.
Mayor Vandergrift commented on the eavy trucks and equipment frequently riding on the
roads in subdivisions and tearing them u . He further commented that the City of Ocoee becomes
responsible for the upkeep on these roads The Mayor asked for staff review of a requirement to
put a half-inch cap on their roads so that ey last longer.

B. Approval and Authorizatio of Joint Funding with the City of Winter Garden
Public Works Department ~ r a Public Education Campaign by METRA
(Metropolitan Environment I TRaining Alliance) as an Element of the City's
NPDES Permit and Approv $4,000 from the Current Fiscal Year Stormwater
Operating Funds for this Pu pose. (Deputy Public Works Director Zaitooni)
As a part of the NPDES perm t, the City is required to conduct public education
activities regarding the benefi s of the stormwater management program and the
potential consequences from i proper use of fertilizers, herbicides, pesticides, and
other harmful substances to w ter quality and environmentally sensitive areas. The
City of Ocoee and the City of inter Garden have proposed to partner in sponsoring
a Level A Partnership Packag which will include a series of television
advertisements designed to de iver an effective message to the public with respect to
the environment. The objecti e of METRA is to take a leadership role in education

and to share knowledge, exp ience, and resources in environmental compliance
matter in private/public partn rship.
C. Approval and Authorizatio for Professional Elll~ineerin2 Consultants (PEC) to
Proceed with Work Order 0.27 for the Final Design and Permitting of the
Improvements at the Inters ction of Bluford Avenue at Orlando Avenue in the
Amount of $43,801 to be Ta en from Impact Fees. (Deputy Public Works
Director Zaitooni)
This is an approved CIP proj ct for the FY 2003-04. This phase of the project
consists of design survey, det rmination of right-of-way needs, final design, and
permitting for the intersectio improvements at Bluford Avenue and Orlando Avenue.
D. Approval and Authorizatio for Southeastern Surveyin2 to Conduct a Right-of-
Way Survey for the Sidewa on the North Side of Orlando Avenue, from S.
Lakewood Avenue to the E st Entrance to Sleepy Harbour Condominiums in
the Amount of $3,000 to be aken From the General Contingency Fund.

The City has received numer us complaints regarding the safety of the sidewalk on
the north side of Orlando Ave ue, from E. Lakeshore Drive to S. Lakewood Avenue.
Temporary safety measures h ve been taken to ensure the safety of the school
children by providing a guard d crossing at Sleepy Harbour Drive until such time that
the sidewalk issue has been a dressed. The subject sidewalk is narrow and is located
immediately at the back ofth Miami curb. Funds are available from the General
Contingency Fund. The esti ated balance of the General Contingency Fund will be
$144,790 after assignment for this project.
E. Approval and Authorizatio for the Mayor and City Clerk to Execute Plat for
Westvn Bay-Phase 2. ((Pub ic Works Director Wheeler)
This plat consists of 136 singl -family lots located on the northwest corner of the
intersection ofOcoee-Apopk Road and West Road and east of Lake Apopka. All
required documentation pertai ing to the platting of this development has been
reviewed and approved by Cit Staff. The developer has posted a Performance Bond
in the amount of $563,000 for the completion of all construction.
F. Approval and Authorizatio for the Mayor and City Clerk to Execute Remote
Network Connection A ree ent with the Orange County Sheriff Office. (Police
Chief Godon)
The Connection Agreement w uld allow the Ocoee Police Department the ability to
tie into the existing network a d data at Orange County Sheriff s Office and Orange
County Government. There i no fee attached to this agreement and the agreement
would remain in effect until e' her party wishes to terminate the agreement.
OTHER BUSINESS
Old Winter Garden Road/Professional Parkway Improvement Project - Award of
Construction Contract to Prime Const uction Grou Inc. (Public Works Director
Wheeler)
Public Works Director Wheeler descri d the construction contract for Old Winter Garden
Road/Professional Parkway Improvemen Project and asked that it be awarded to Prime
Construction, Inc. for $1.67 Million, as t ey were the best choice for the City ofOcoee.

Mayor Vandergrift declared the followi to be an Emergency Item due to time constraints.
Commissioner Johnson said this request for a road closure for a May Celebration ofthe Rosary
was brought in by resident Mr. Santiago f 63 Periwinkle Key too late to get on the agenda.

Approval and Authorization for Mayo and City Clerk to Execute Master Contract for
Sensus Meterine: Systems. (Public Wo Director Wheeler)
Commissioner Anderson asked if we ha e enough funding to cover the meters increasing in
price on an annual basis. Public Works irector Wheeler answered that we are currently below
the cost stated of $500 and a contingency ill be made to cover rising costs. Mayor
Vandergrift added that the cost of the m ters will be included in the price for new homes.

Consideration and Action Regarding C'ty Manager Finalists (Human Resources
Director Diedrich)
Acting City Manager Williford spoke i the absence of Human Resources Director Diedrich
regarding the City Manager finalists. Th three candidates were Robert Frank, Ben Saag, and
Rex Taylor. Acting City Manager Willi ord distributed a tally sheet to each member of the
Commission and asked that they rank eac candidate by number of preference.
In the meantime, Commissioner Anders n read an informative article about the "Click It or
Ticket" Campaign regarding zero toleran e for seat belts not fastened.
Acting City Manager Williford tallied t e votes for City Manager and announced the first
choice listed by the majority of the Com issioners was Robert Frank. Commissioner
Anderson said before going any further ith the selection he wanted to offer the position to Mr.
Williford, as he had done an outstanding job as Acting City Manager. Mr. Williford declined to
accept the position permanently, saying p evious commitments were binding. Commission also
discussed, in the event the winning candi ate declines, whether a new list of candidates should

be researched. The negotiation process for the City Manager contract was discussed. Reynolds
Allen, the City of Ocoee's labor attorney, would be responsible for the contract and Commission
asked Acting City Manager Williford to get with the attorneys on that subject of negotiating the
contract.
Commissioner Parker. seconded bv Commissioner Anderson. moved to direct ActinQ Citv
ManaQer Williford to neQotiate with Robert Frank as first choice candidate as Citv ManaQer.
Motion carried 5-0.
STAFF REPORTS
There were no staff reports.
COMMENTS FROM COMMISSIONERS
Commissioner Howell asked Deputy Public Works Director Zaitooni about speed tables
being put into place in areas such as Marlene Drive, Lady Avenue, and Kimberly. Deputy
Public Works Director Zaitooni responded with the cost estimate of$I,200 - $1,500 per speed
bump. Discussion ensued regarding the background of speed bumps and City policy thereof.
Deputy Public Works Director Zaitooni will research the topic and bring it back to
Commission for the next meeting.
Commissioner Howell asked Public Works Director Wheeler when the water tower would be
coming down. Public Works Director Wheeler responded that they are waiting for the
Department of Transportation to give approval. Commissioner Howell also asked what the
future entailed for the old boxing club. Public Works Director Wheeler answered that the
removal of the old boxing club would be part of the demolition process of the construction
project and if someone were interested in moving the building they should contact his
department as soon as possible.
Commissioner Howell asked if Commission would be able to help the Ocoee Little League with
the cost of the lights on the field. Acting City Manager Williford said the shortfall for the
project would be $29,000 and he has been working with the Ocoee Little League on the issue in
order to have a response for the next Commission meeting.
Commissioner Howell questioned City Attorney Rosenthal about a City Ordinance regarding
impact fees on houses being replaced within one year of purchasing property. City Attorney
Rosenthal responded with the current provisions. Acting City Manager Williford added that
other cities did not charge impact fees for places that already had utility services. Without
objection, staff was directed to report back to Commission with information on the issue.
Mayor Vandergrift thanked Commissioner Parker for her help with the Dreamers and Doers
presentation. Mayor Vandergrift talked further about the debate of citizens vetoing the
construction of new subdivisions due to the impact on the school district.
