CODE ENFORCEMENT BOARD MEETING
April 26, 2011
CALL TO ORDER
Chairman Godek called the regular meeting of the Ocoee Code Enforcement Board to order
at 7:00 p.m. in the Commission Chambers at City Hall. Member Lowery led the Invocation
and Member Blynder led the Pledge of Allegiance to the Flag. The roll was called and a
quorum was declared present.
PRESENT: Chairman Godek, Members Kelley, Osborne, Lowery, Amey and Alternate
Member Blynder. Also present were Deputy Fire Chief Butch Stanley, Code
Enforcement Officers Delgado, Loeffler, Rodriguez and Siegrist, Fire Inspector
Sorenson, Administrative Assistant Bridgett Ballard, Board Attorney Mary
Sneed, and Recording Clerk Stella McLeod.
ABSENT: Vice -Chair M. Godek and Alternate Member Sais were absent excused.
GUESTS: None.
Administrative Assistant Ballard administered the oath to the Code Enforcement Officers,
Fire Inspector, and anyone intending to speak regarding a case.

Observation: Installation of solar panel without required permits, plans, approval and inspection.
Officer Delgado presented the case and gave its history. Documents were presented as
exhibits. The property is still non - compliant.
Chairman Godek asked when the first permit expired. Building Official Jim Washington
approached the podium to answer.
When an application is presented, it stays active for six months according to the building
official. He continued that when the six months ended for this application, the application
was declared abandoned. An inspector went to confirm this. The work, however, had been
performed. The building inspector reported the same. At this point, no permit has been
awarded although the application was made, Mr. Washington said.
Mr. Daniel Gregoire, Prestige Plumbing vice - president and current license holder,
approached the podium to speak about the case. His company (which was working for a
company called Solar Smart) had a falling out with the owner, so Prestige Plumbing did not
do the work. Member Osborne recapped what Mr. Gregoire said. She asked who the
homeowner is. Officer Delgado named them. Member Osborne asked if the homeowner
should be responsible ultimately. Officer Delgado said that no one has heard from the owner
and since the contractor's name was listed, it was assumed that the work was done by him.
Attorney Mary Sneed advised the board of its options. Chairman Godek suggested that

the case be continued to confirm what has been stated thus far. The chairman solicited the
board for a motion.
Member Kelley, seconded by Member Osborne, moved that case #11 -055 be dismissed
against Prestige Plumbing. The motion passed unanimously.
Following the motion, Attorney Sneed said that Member Kelley could now make
suggestions. Member Kelley said that he would like them to find out who did the work and
reapply the same violations to that person/company.

Officer Delgado presented the case and gave its history. She reported that as of today, the
property is in non - compliance. Building Official Jim Washington said there is a slight
difference between this case and the previous one. He said that he had never received an
incomplete notarized application. He said that he needs something in his file saying that
Prestige Plumbing did not do the work.
Ms. Mary Lu Rodriguez, 823 Hammocks Drive, spoke on the case. Chairman Godek
asked who did the solar installation. She said that folks came from the City, but she did not
know who these workers were. There was a big problem with the plumbing. Chairman
Godek asked who took care of that. She said that the same men were still at her house when
the plumbing failed. Member Osborne asked Ms. Rodriguez who paid for the work. Ms.
Rodriguez said that she and her husband had the cost of the work financed through
GeoSmart. Chairman Godek concluded that the company has been paid in total and is now
gone. Attorney Mary Sneed asked Ms. Rodriguez if she ever saw Mr. Gregoire or any kind
of vehicle with `A & E' on her property. Ms. Rodriguez answered `no'. Member Lowery
asked if the plumbing problem was resolved. Ms. Rodriguez confirmed that it was.
Building Official Jim Washington said that in order to go out and inspect, there would have
had to be a permit for the work. Alt. Member Blynder asked if this has happened before.
The official said that it happens more often that he would like. Further discussion ensued.
The board and the board attorney told Ms. Rodriguez that she will need to get with the
building department to get a permit.
Member Kelley, seconded by Member Osborne, moved to dismiss case #11 -056 against
Prestige Plumbing. The motion carried unanimously.

Member Kelley asked that the City take steps to move the violations to the homeowner and
that Prestige Plumbing get with the City to remove any liability from the company so that the
good relationship between the business and the City can continue.

Observation: Excessive weed and grass growth.
Member Lowery, seconded by Member Amev, moved that the board re -hear Case #09 -155
for possible recommendation for a reduction of fine. The motion carried unanimously.
Officer Rodriguez presented the case and gave its history. The respondent was given until
September 11, 2009, to come into compliance. The property came into compliance on
November 30, 2009. The fine amount (at a rate of $100 per day) is $6,200 plus $849.52 (cost
for the City's abatement of the property and other administrative costs).
Chairman Godek asked if someone was present to speak about the case.
Mr. David Crawford, 2243 Laurel Blossom Circle, said that he was informed about the fine
in mid - February of this year upon his attempt to sell the home. The home is in foreclosure
and has twice been rescheduled for auction. Since July, 2009, he received no communication
from the bank about the home. He was under the assumption that the house would go on to be
auctioned. Mr. Crawford submitted documentation showing when he was notified of the
final foreclosure and auctioning off of the property on January 22, 2010. He later received
notification that the property had not gone into foreclosure, nor had it been sold. While the
fine was being assessed, Mr. Crawford said that he was notified that the property had been
foreclosed on and auctioned off.

Mr. Crawford said that he is currently in the midst of short- selling the house. There is a
contract on the house. He is asking for a reduction of the fine, not the elimination of the fine,
he said. The bank has given him $500 towards the property's lien. He is pleading for help
from the board. Chairman Godek asked if anyone had any questions. No member posed
questions about the case. Attorney Sneed reminded the chairman that this is a
recommendation.
Member Osborne, seconded by Member Kelley, moved that in Case #09 -155, the board
recommend to the commission that the fine be reduced to $1000 plus the $849.32 which is the
cost that the City has incurred. The motion carried unanimously.
Mr. Crawford asked if the matter could be placed on the agenda for the next commission
meeting. Officer Rodriguez said that he would need to get with the City Clerk.

Observation: Outside display and storage of merchandise. Miscellaneous trash / debris. Two (2) canopy / tent
and structures without permit, behind the building. Also, damaged store sign, missing facing, with exposed inner
electrical components. Storage trailer parked on property.
Officer Siegrist presented the case and gave its history. He presented exhibits (photos).
Robert and Sandra Watson are identified as the homeowners. The new compliance date
was March 26th (extended due to request from tenants).
The property is compliant with 108 -33B and 51 -13. It is non - compliant for all the other
violations. He added that the property owner has been very cooperative. The property is non-
compliant with the remaining three codes, but greatly improved as of today, April 26, 2011.
Mr. Robert Watson, 12166 Walker Pond Road, (P.O. 1486 Windermere - mailing address),
has owned the property for two years. He said that he has never had this kind of problem
before with tenants. The rental agreement has been terminated. Mr. Watson assured the
board that he has done what he could to correct things structurally. He has documents
demonstrating his communication with the tenants asking them to improve the property. The
tenants did make improvements. He expressed concerns to the tenants that they perhaps
needed more of an office rather than a retail store. Member Lowery verified with the owner
that he will take over the property by May 3, 2011.

Member Lowery asked how much time Mr. Watson would need to come into compliance if
he regains the property by May 3, 2011. Mr. Watson said that the property will be in
compliance by the board's next meeting in May.
Chairman Godek invited Lourdes Vazquez, 562 Silver Star Road, to speak. Ms. Vazquez
said that they already resolved most of the issues. There are two or three things left to
resolve. She says that she needs a week or less to resolve everything.
Chairman Godek asked if the board had questions. No members had questions.
Member Lowery, seconded by Alt. Member Blynder, moved that the board continue the case
until the next meeting in May.
Member Lowery moved to withdraw the motion; Alt. Member Blynder seconded that.
Attorney Sneed cautioned the board to be specific about the violations

the respondents be found in violation of 6- 14C(1)(K)(3), 115 -3, 108 -34A, 108 -33B. 51 -13C, as of
March 25, 2011; however, in compliance with 108 -33B and 51 -13C and that no fine be
assessed in result of those, with the respondents remaining in violation 6- 14C(1)(K)(3), 115 -3,
108 -34A, and be given until May 24, 2011, to come into compliance or be fined $100 per day
per violation. The motion carried unanimously.

Attorney Sneed clarified that the violation in question is 165 -3 A & B.
Member Osborne asked about abatement and if the neighbors were asking for abatement.
The officer replied affirmatively.
Ms. Maggie Jones, 1104 Doreen Avenue, came to the podium to speak about the case. Ms.
Jones said that the truck was supposed to be returned to her father until her ex- husband
slashed the tires. She said that she has filed charges against her ex- husband. Chairman
Godek asked if the state attorney told her not to repair the tires. Ms. Jones said they told her
not to replace the tires if she did not have the money to do so. She continued that (the state
attorney's office) had not taken photos of the damage yet.
Member Lowery asked where she is receiving the certificates for the tags. She said that she
will ask her father for the registration documents since the vehicle is duly registered in
Georgia.
Attorney Sneed said that the board could set a time for compliance. Then the board could
grant an extension of that time if the investigation was still ongoing.
Alt. Member Blynder recapped that the police had been to the property and photos taken but
yet she's being told not to put tires on the vehicle. Ms. Jones said that the police did not take
pictures. Alt. Member Blynder said the investigation is separate from the police report. He
asked how much time she needs to put tires on the vehicle and get it registered. Ms. Jones
said thirty days. Alt. Member Blynder expressed surprise that so much time would be
needed. Further discussion ensued.
Attorney Sneed reiterated her previous suggestion to the board regarding setting a time for
compliance and extending that time if the need arose.
Member Lowery, seconded by Member Amey, moved that the respondent be found in
violation of 165 -3 A & B as of March 18, 2011, and be given until May 24, 2011, to come into
compliance or be fined $50 per day thereafter. The motion carried unanimously.

Officer Delgado presented the case and gave its history. She requested a motion to impose
fine including City's cost of $302.50.
Member Osborne, seconded bv Member Kelley, moved that in case #11 -033 the board to
impose a fine as of April 13, 2011, of $100 per violation per day to include the Ciry's cost of
$302.50. The motion carried unanimously.
The board reverted back to the order of the agenda.

Officer Siegrist presented the case and gave its history. Exhibits were presented to the board.
Respondents (property owners) were to come into compliance by March 11, 2011. Although
two incomplete inspections were performed, no final inspection was done although the work
was completed. Property is currently non - compliant.
Member Lowery asked what Officer Siegrist was requesting of the board. The officer
suggested that the board find the respondent in violation and impose a fine. Member
Osborne asked if the situation is a danger. Officer Siegrist could not confirm that. He did
confirm that the matter concerned electrical elements.
Member Amey asked if the officer had spoken to the respondents. The officer said `no'.
Member Kelley asked why this has gone on for two years. The officer said that the building
official would be the one to be asked about that.
Member Osborne asked what needs to be done to bring the property into compliance. The
officer said that he could not testify about that, but the building official could.

Observation: Fire alarm in trouble; fire alarm out of inspection date; fire sprinkler in red tagged and needs
repair. Missing ceiling tiles.
Inspector Sorenson presented the case and gave its history. On March 28, 2011, the property
was found to be non - compliant. As of April 26, 2011 the property was found to be partially
compliant. The ceiling tiles were replaced/repaired (NFPA 1 (13.3.3.3). The roof and
sprinkler system are non - compliant.
Member Amey asked if he was given input from the respondents as to when the rest of the
repairs would be made. Inspector Sorenson answered 'no'. Member Amey asked if
Inspector Sorenson had discussed the matter with the respondents. Inspector Sorenson said
that the case is actually that of Inspector Dingman. The inspector told Inspector Sorenson that
the monitoring company which is monitoring the alarm has not been paid, but the company is
continuing to monitor so that the alarm does not get shut off. Beyond that, Inspector
Sorenson said, there has been nothing done other than tiles being replaced. He continued that
no attempt has been made to resolve the other issues.
Member Lowery, seconded by Member Kelley, moved that in case #11 -059, the respondents
be found in violation as cited as of March 21, 2011, in compliance with NFPA 1 (13.3.3.3.)
as of4pril 26, 2011, and be given until May 13, 2011, to come into compliance with the
other violations or be fined $100.00 per day per violation. The motion carried unanimously.

Chairman Godek said that the respondents have never paid any fines which they had in 2009
and two in 2010. Officer Delgado confirmed that this is true. It is a repeat violation. Further
discussion ensued. Member Lowery asked for the City's cost which is $290.75.
It was asked if the City had placed a lien on the property. Attorney Sneed answered that if
the property is homesteaded, a lien is not allowed.
Member Kelley moved that the respondent be found in violation for 21 days and in
compliance as of April 12, 2011 and that they be fined $250 per day in violation and that they
pay $300.00 to be recouped by the City for its cost.
The motion failed for lack of a second.
Member Amey moved that the respondents be found in violation as of a repeat violation cited
as of March 22, 2011 and have come into compliance as of April 12, 2011, and that there be
no fine.
The motion failed for lack of a second.
Member Osborne, seconded by Member Kelley, moved that in case #11 -063 the respondents
be found in violation as of March 22, 2010, as a repeat violation and be found in compliance
as of April 12, 2011, but be fined for $150 per day for the 21 -day period and $300 for the
City's cost. The motion carried unanimously.

Attorney Sneed added that the board will simply need to make a motion to dismiss for each
case.

2011, at $100 per day plus $352.19. The motion carried unanimously.

Observation: Miscellaneous debris on property
Officer Delgado presented the case and gave its history. The respondent is a repeat violator.
The City's costs are $390.75.
Attorney Sneed advised that the board can impose a fine if it wants to. Member Amey
asked when the first violation occurred. Officer Delgado said the first violation occurred on
July 27, 2010.
Member Osborne, seconded by Member Lowery, moved that in case #11 -037, the
respondents be found in compliance as of April 13, 2011, and assess fines of $500 to cover
City's costs. The motion carried by majority vote 9f 5 to 1 with Member Amey dissenting..
COMMENTS
Attorney Sneed — Reminded the board about the board workshop in June; the Florida
Association of Code Enforcement (F.A.C.E) workshop will be in June also.
