HomeMy WebLinkAbout07-02-84 MINUTES OF THE BOARD OF ADJUSTMENT MEETING HELD JULY 2, 1984 „► PRESENT: Bruce Beatty, Willie Goff, Rick Kempher, Jack Marsden, Cliff Rhodes, Margaret Ryan ABSENT: Gene Dickerson CALL TO ORDER Chairman Bruce Beatty called the meeting to order at 7:30 P.M. in the Commission Chambers and then led those present in the Pledge of Allegiance to the flag. MAY 22, 1984 MINUTES APPROVED After reviewing the minutes of the meeting held May 22, 1984, Mr. Rhodes moved to approve the minutes as written and Mr. Marsden seconded. Vote was unanimous in favor. SAM HODGE REQUESTS VARIANCE ON RIGHT -OF- WAY,LOTS 17,18 & 19 REUBEN KEGLER SUB. Assistant City Manager Griffin explained to Board that although Lots 17, 18 & 19 of Reuben Kegler Subdivision appear to be platted with a 60' road right -of -way, closer examination reveals that the west 30' of those lots had been designated right -of -way, leaving the remaining 30' to be platted at a later date. When those lots immediately west of lots 17, 18 & 19 were platted, that portion which should have been the remainder of the road right -of -way was designated 25' utility easement instead, leaving the road of insufficient size to be termed a street. Mr. Hodge wishes to use lots 17, 18 & 19, which are adjoining, to construct only two houses and use the road right -of -way to allow ingress /egress to those houses. As the Code provides that a 20' driveway shall supply one home, a variance is requested to allow this driveway to supply two homes. Present in the audience were John Carter, previous owner of adjacent land; also Jerry Carter,owner of property east of right -of -way, who stated that if right -of- way is opened it will be within 20' of his carport. Mr. Marsden moved to grant variance as requested and Mr. Kempher seconded. Vote was 4 -2 in favor with Mr. Goff and Mr. Rhodes voting nay. Mr. Goff objected to the wording, as a drive way becomes private property and he felt that the right-of -way would lose its identity as a street if variance is granted. Mr. Rhodes said that a variance is not necessary as access to the property could be accomplished by crossing railroad tracks. CH. BEATTY REQUESTS INFORMATION Chairman Beatty requested that members be supplied with copies of the City Charter and other pertinent information which will them. ADJOURNMENT Upon a motion by Mr. Marsden and second by Mrs. Ryan, meeting adjourned at 8:00 P.M. De uty City Clerk Chairman Beatty
