HomeMy WebLinkAbout11-18-85 MINUTES OF THE BOARD OF ADJUSTMENT MEETING HELD NOVEMBER 18, 1985 CALL TO ORDER Present: Chairman Bruce Beatty, Board Members Cliff Rhodes, Bob Colburn, Albert Nettles and Vern Combs, Building Official Sam Gerace, Deputy Clerk Susan Amesbury and Don Tyndall. Absent: Jack Marsden Chairman Beatty called the meeting to order at 7:41 p.m. APPROVALS Chairman Beatty noted that in the minutes of the October 22, 1985 Board of Adjustment meeting Bob Colburn and Jack Marsden were listed as present and should have been listed as absent. Mr. Nettles moved to dispense with the reading of the October 22, 1985 Board of Adjust- ment meeting minutes and approve them with those corrections, seconded by Mr. Rhodes and approved unanimously. VARIANCE REQUEST - Don Tyndall Mr. Tyndall showed the Board an old survey plat for O.A. Gurganus dated November 07, 1958 with boundaries and a hand drawn sketch showing the lot in question. Chairman Beatty gave Mr. Colburn a short background discussion of the case since he was not present at the last Board of Adjustment meeting. Mr. Rhodes questioned Mr. Tyndall about the City Commissions decision since Mr. Tyndall had ,w appeared before them at their November 05, 1985 meeting. Mr. Tyndall stated that the City Commission was waiting for a recommendation from the Board of Adjustment. Mr. Tyndall asked the board for a variance on all 4 items of nonconformity as stated in the City's letter dated November 06, 1985 as follows: 1. The location does not allow for off - street customer parking. 2. The building covers more than 80% of the lot 3. A 50 foot buffer yard along Arterial Street (Kissimmee Ave.) is required. 4. Vehicles can not be parked within the required 35 foot yard of Story Road. Mr. Rhodes stated he felt Mr. Tyndall had a legitimate request and moved to approve all four (4) requests for variance based upon the City's delay in reference to the grandfather clause, seconded by Mr. Nettles and approved unanimously.
