HomeMy WebLinkAbout03-29-88 rr MINUTES OF THE BOARD OF ADJUSTMENT MEETING HELD MARCH 29, 1988 CALL TO ORDER PRESENT: Chairman Bruce Beatty, Vice Chairman Bob Colburn, Members Cliff Rhodes, Vern Combs and Lowell Boggs, Building Official Harvy Nagel, and Deputy Clerk Teresa Braddy. ABSENT: Alternates Geneva Foster and Tanya Miller. APPROVALS: Mr. Combs moved to approve the minutes of September 22, 1987 Board of Adjustment Meeting as printed, seconded by Mr. Rhodes and approved unanimously. SPECIAL EXCEPTION REOUEST- VICTORY BAPTIST CHURCH Chairman Beatty proceeded with asking Building Official Nagel to explain the special exception. Building Official Nagel stated that a church is permitted in all Zoning districts under special exception. Victory Baptist Church has no past record of a special exception. Building Official Nagel stated there are two items to be considered: (1) Use of property in a R -1 -A zoning district and (2) Joint Use of parking facilities. Building Official Nagel stated that the present parking facility meets all requirements plus extra spaces, and according to the City Code (Chapter III, section 9.5, page 1346) parking facilities can be joint, due to different time periods. Chairman Beatty asked Jerrit Percell (Chairman of the Building Committee for Victory Baptist Church) if the parking times would be different. Mr. Percell stated yes, that the church would be meeting on Sunday and Wednesday night, and the educational building would be used Monday through Friday during the day. Mr. Combs stated that he for saw no problems with the use of the property in a R -1 -A zoning district, and that the parking facilites would also be adequate. Mr. Colburn stated that the facility would be a good addition, and he agreed with Mr. Combs. rocs �r► Page 2 Board of Adjustment Meeting March 29, 1988 Mr. Rhodes stated that he also for saw no problem with either exception. Mr. Boggs stated that as long as the church meets all the requirements on parking he would agree to the exception. Chairman Beatty stated that the Board of Adjustment only makes recommendations to the City Commission, not final decisions. He then asked if any citizens wished to address the board. Mr. Percell thanked the board for their consideration, and stated that all the church wanted to be was a blessing to the Ocoee community. He stated that the building would be used for school and church education, and the church would comply with all building requirements. Patricia Coppola stated that currently the water run off from Slaw the parking lot was draining on to her property and hoped that with the new construction proper retention ponds would prevent this from happening. Building Official Nagel assured her that upon review of the site plans proper retention would be enforced and also stated that the approval of the site plans would not be until a later date. Chairman Beatty stated that the special exception was on the zoning and the joint use of parking, not on the site plan submittals. Chairman Beatty asked the board to entertain a motion that the special exception be granted, Mr. Colburn moved to recommend that the special exception for the use of a educational facility be permitted in a R -1 -A Zone. The motion was seconded by Mr. Combs, and approved unanimously. Chairman Beatty stated that to allow dual use of parking, the church would need to provide a notarized statement indicating the hours the parking facility would be in use. Mr. Percell agreed to the notarized statement. Mr. Combs moved to recommend that the special exception on the joint use of parking be granted according to the statement provided. The motion was seconded by Mr. Rhodes and approved unanimously. Chairman Beatty stated that he would go before the City 111,, Commission on April 5, 1988 with the boards recommendations. CITIZENS No comments from the citizens. ADJOURNMENT Mr. Rhodes moved to adjourn. The motion was seconded by Mr. Boggs and approved unanimously.
