HomeMy WebLinkAbout07-24-03 r MINUTES OF THE BOARD OF ADJUSTMENT REGULAR MEETING HELD THURSDAY, JULY 24, 2003 CALL TO ORDER Chairman Resnik called the meeting to order at 7:00 p.m. in the Commission Chambers at City Hall. He led the Pledge of Allegiance to the Flag and led a moment of silence. Chairman Resnik called the roll and declared a quorum to be present. PRESENT: Chairman Resnik, Cox, Kimbrell, and Wilsen. Also present were Community Development Director Wagner, Building Official Phelps, Principal Planner James, and Deputy City Clerk Maxwell. ABSENT: Members Tice and Colburn, who were excused. Vice - Chairman Savino, who was unexcused. APPROVAL OF MINUTES Member Kimbrell, seconded by Member Cox, moved to approve the November 21, 2002, Board of Adjustment Minutes as corrected. Motion carried 4 -0. Member Wilsen's absence should have been excused. OLD BUSINESS -None NEW BUSINESS APPLICATION FOR VARIANCE - CASE NOS. VR -03 -001 AND VR -03 -002: DAVID W. & GEORGE MILTON Principal Planner James presented the staff report for the Variances for the properties located on the north side of Lafayette Street between Lakewood Avenue and South Bluford Avenue in Block B of Marion Park. BACKGROUND & DISCUSSION The Applicant has requested a Variance from the 70 -foot minimum lot width requirement and the 8,000 -foot minimum lot size requirement within a Single Family Residential (R- 12A) zoning classification. RECOMMENDATION Staff believes that the Miltons, acting in good faith, thought they could separate Lots 12 and 13 to develop each lot individually providing they met the LDC required setbacks and the Florida Department of Health septic tank constraints. Since most of the residential homes in this area of the community are already built on 50 -foot wide lots, there should not be any adverse affects on the surrounding properties. The public hearing was opened. Member Wilsen, seconded by Member Kimbrell, moved to recommend approval of the Variance to the City Commission based on Staff's recommendation. Motion carried 4 -0. APPLICATION FOR VARIANCE — CASE NO. VR -03 -003 — DANA HOPKINS Principal Planner James presented the staff report for the Variance for the property located at 414 South Cumberland Avenue. BACKGROUND AND DISCUSSION The Applicant is proposing to build a 30 by 40 foot garage separated from the residence on the southeast corner of the property. The applicant is requesting a Variance to permit the garage to encroach on the required setback and a reduction in the minimum side setback requirement to 7 -1/2 feet from West Washington Street. There are no plans to pave this roadway for the conveyance of vehicles; therefore, the 25 -foot minimum setback is not necessary. The public hearing was opened. Applicant Dana Hopkins, stated he would be building a garage separate from his home to store vehicles and equipment. The public hearing was closed. Nair Member Cox, seconded by Member Wilsen, moved to recommend approval of the Variance to the City Commission based on Staff's recommendation. Motion carried 4 -0. APPLICATION FOR VARIANCE — CASE NO. VR -03 -004 — CAROL K. AMEY Principal Planner James presented the staff report for the Variance for the property located at 401 South Bluford Avenue. The property is located at 401 South Bluford Avenue and the applicant is proposing to enclose an existing concrete slab at the rear of the house to create a 20 -foot by 18 -foot roofed and screened porch. The proposed porch will match the existing side setback of the existing structure at 18 feet from West Delaware. RECOMMENDATION The Planning Division Staff recommends that the Board of Adjustment recommend that the Variance for the reduction of the minimum side setback from 25 feet to 18 feet be approved to allow for the addition of the proposed 360 square foot screened porch to the existing principal building /residence. The public hearing was closed. Member Kimbrell, seconded by Member Cox, moved to recommend approval of the Variance to the City Commission based on Staff's recommendation. Motion carried 4 -0. OTHER BUSINESS Member Wilsen asked why there were so many illegal lots in the City of Ocoee. Community Development Director Wagner stated they are not illegal lots but there are many lots in the older section of town that are non - conforming lots.
