HomeMy WebLinkAbout08-25-88 MINUTES OF THE MEETING OF THE CHARTER REVISION COMMITTEE HELD AUGUST 25, 1988 N olti Chairman Beatty called the meeting to order at 7:58 in the Community Center Training Room and he declared a quorum present. Rev. Mitchell led in the prayer and the pledge of allegiance to the flag. Present: Chairman Bruce Beatty, Members Tom Hendrix, James Mitchell and Harold Switzer. Also present were City Attorney Rosenthal,Assistant City Attorney Mlsna and City Clerk Grafton. Absent: Member Pounds Approvals: The Minutes of the Meeting of August 11, 1988 were reviewed. Rev. Mitchell, seconded by Mr. Hendrix, moved to approve the Minutes of August 11, 1988. Motion carried unanimously. Attorney Mlsna reviewed for the Committee Article 3, page 8. New language had been inserted giving instructions on the election of a mayor pro tem and on swearing in the new mayor pro tem, providing for the mayor pro tem to serve until his successor is sworn in. Another change defined "All members of the City Commission" to mean all members, not just those present. All "voters" has been changed to "Electors ". Article VII: (Page 24) clarifies when terms begin and end by stating each commission member will serve until his successor is sworn in. This change was made as necessary throughout the Charter. There were some other minor technical enhancements. Other minor changes: Article I, Page 1, Section 6. No city is allowed to amend boundaries by charter, so Section 6 now reads as it did originally. Addendum A has not been located yet but is necessary. Every reference in the Charter to "3 members" has been changed to "all members of the Commission ". Article V, Page 20, Section 6(a). Personnel Board was changed to read "All members of the Personnel Board must be qualified electors of the City during their entire term on the Personnel Board in order to remain a member of such board. Any city employee, City Commissioner, or person holding a management position with the City who is appointed to the Personnel Board mnust hold their respective positions with the City during their entire term on the Personel Board in order to remain a member of such board ". Ms. Mlsna stated that this is the final revision of the Charter. Attorney Rosenthal has reviewed this revision and he feels it is consistent with all laws. Chairman Beatty asked the committee to reread the August 22 001110' revision. Attorney Rosenthal explained the mechanics of the referendum and the ordinances that will be necessary. Since the issue of the Page 2 N Charter Revision Committee August 25, 1988 Charter will be presented in three separate referendums, the possibility of the base Charter passing and the other two referendums failing was discussed. Attorney Rosenthal explained that this could be handled in an ordinance placed before the City Commission. The Charter Revision Committee consensus was to tie together the three issues, base Charter and amendments. Ballot #1 Single member district, language was refined to reflect election in terms of time in office, run -off elections, mayor pro tem to be elected after run -off. Article VII was revised to reflect single member districts instead of seat numbers. Article XI, Section 7 added annexed territory to an appropriate election district. Ballot #2 Amendment to Charter providing for 4 year terms instead of 2 year terms for Mayor and Commissioners. Chairman Beatty reported on the recent Public Hearing. The only item that resulted from this hearing was a request for the Mayor's vote to be considered as a separate ballot item. The committee consensus was to leave this item in the Base Charter. Rev. Mitchell said it should be emphasized that there is no change in power, only accountability. The City Manager had said that he would provide some material to assist in composing the agenda, but those materials were not available yet. Next Thursday the Committee will meet to approve the ordinance that will be presented to the City Commission. There is another Public Hearing on August 30. The City Clerk will transmit a complete set of the latest version to the City Commission along with the ballots language. Ten copies of the "clean" copies will be available for the public hearing. A legislative copy in a binder will be available at City Hall for anyone to read. Attorney Rosenthal expressed his feeling that this was a remarkable change in the Charter. The City Manager had also expressed pleasure with the work on the Charter. The Committee requested Attorney Mlsna to be at the Public Hearing. Mr. Hendrix, seconded by Rev.
