HomeMy WebLinkAbout09-06-11 Presentation - Districting Commission Cit y of Ocoee 2011 Districting Commission Recommendation R e p ort August 31, 2011 Board Members Lester Dabbs, Chair Victoria Laney, Vice Chair Tony Adams Julie Butler Joe Chinelly A Formal Presentation will be made at the next regular City Commission meeting on September 6, 2011 Summary: On June 7, 2011 the City Commission voted to create an early Districting Commission in order to change the commission district boundaries in time for the 2012 Municipal Election. The Districting Commission began meeting in July 2011 and has held six meetings, including a Public Hearing on August 30, 2011. The board began with population data from the 2010 Census, and considered other factors such as future growth, race /ethnicity percentages, zoning, foreclosures, etc. to create a plan that would work efficiently over the five year period. After creating and reviewing six redistricting plans, the Districting Commission first voted to eliminate Board Plans 1 through 4, and then unanimously voted to recommend Board Plan 5 to the City Commission as the most preferred plan. Process: Ocoee City Charter Article XI, Section C -66(D) Recommendations to the City Commission. All reports of the Districting Commission shall be available to the public and submitted to the City Commission in accordance with such reasonable deadlines as may be established by the City Commission or as may otherwise be required by law. Within two (2) months of the receipt of any such reports, the City Commission shall accept or reject the recommendations contained therein, or the City Commission may send such reports back to the Districting Commission for further study and consideration. The establishment of the initial geographic boundaries of the four (4) single- member districts and any subsequent redistricting of such boundaries shall be done by ordinance by the City Commission; provided, however, that the City Commission shall not establish or redistrict such boundaries until after receipt of a report from the Districting Commission containing recommendations relating thereto, unless the Districting Commission fails to deliver its report by the deadline established by the City Commission. Recommendation: After creating and reviewing six various plans for the redistricting of the City of Ocoee commission districts and holding a Public Hearing on August 30, 2011, the Districting Commission unanimously voted to recommend Board Plan #5. Attachments: Current District Boundary Map Board Plan #5 Map (recommended by Districting Commission) Board Plan #6 Map Minutes of the Districting Commission MINUTES OF THE CITY OF OCOEE DISTRICTING COMMISSION MEETING S,,. HELD JULY 27, 2011 CALL TO ORDER Chairman Dabbs called the meeting to order at 6:43 p.m. in the Commission Chambers. Chairman Dabbs then led in prayer and the Pledge of Allegiance. The roll was called and a quorum declared present. PRESENT Chairman Dabbs, Vice -Chair Laney, Members Adams, and Chinelly were present. Also present were City Attorney Rosenthal, Staff GIS Analyst O'Halloran, City Clerk Eikenberry and Deputy City Clerk Sibbitt. ABSENT Member Butler was absent excused. APPROVAL OF MINUTES FOR JULY 6, 2011, AND JULY 20, 2011 Vice Chair Laney, seconded by Member Adams, moved to approve the regular minutes of July 6, 2011, and July 20, 2011. Motion carried unanimously. TRIALS OF VARIOUS DISTRICT BOUNDARY ADJUSTMENTS — Creation of Additional Board Plans libse GIS Analyst O'Halloran summarized the last meeting and presented the new Board Plan 1 (see attachment), which the committee requested. All the numbers were within the 5% deviation and resulted in an improvement over the current districts. Board Plan 1 District 1: -0.75 District 2: -0.24 District 3: 1.04 District 4: -0.40 Chairman Dabbs clarified that this was the district plan that Member Butler had requested to be saved. GIS Analyst O'Halloran answered affirmatively. GIS Analyst O'Halloran showed the two proposed changes to the districts and stated that Ingram Estates is all built out so the population for that subdivision has been accounted for as of the census. He further stated the Security Circle split that is proposed would go straight down that subdivision and cut it in half so he split the census blocks to provide two other options that would not split Security Circle, should the board want to adjust the boundary line. GIS Analyst O'Halloran provided handouts of the population density by race maps. City of Ocoee Districting Commission Meeting July 27, 2011 Member Adams stated he would like to see Mr. O'Halloran adjust a different line because when rlire they look at the potential population growth, District 2 is built out whereas District 3 has an incredible amount of on -going projects for development. Member Adams requested if the boundary line from Orlando Avenue could be moved down to either Geneva or Maine Street. City Clerk Eikenberry advised that staff had tried the option of moving boundary lines around the area he is referring too and it did help the deviation a lot but the only problem is that it moved a Commissioner out of his district. Member Chinelly stated he also looked at that area and he counted the total of the census block in that area at 396. Member Adams stated that when they look at the current numbers as they stand District 2 and 4 are negative. Chairman Dabbs stated to save Commissioner Johnson's district he would suggest that they move the boundary from Ohio Street to McKey Street into District 2. He further stated they could also move Kelton Ave. to Hwy 50 because it would allow for growth. City Attorney Rosenthal stated that if the moved the boundary down to Maine Street as they just discussed then they will be picking up some land, which is designated multi- family as part of the CRA, and there could be some intensive growth with District 2. GIS Analyst O'Halloran briefly demonstrated the change in the boundary line requested and he further stated he will have to split the census block and reassign the population if they are looking to create a new area. Further discussion ensued regarding the boundary line being moved in the Geneva Street area. City Attorney Rosenthal advised the board that the census block can be split but it cannot be done tonight since that would take Mr. O'Halloran several hours so if they are suggesting a split it should be something they are seriously considering. r Member Chinelly stated he agrees with what Member Adams has expressed regarding the growth issues in the City and can see that having to change larger number of populations between districts is difficult unless they off set it with other areas. He further stated the other area he looked at in addition to the Maine Street/Geneva Street areas is moving population from District 1 to District 3 on the north end of District 3. This move would bring the northern limits of District 3 to Fuller's Cross Road as well as take anything west of Lakewood Ave. City Attorney Rosenthal stated that if there is interest in this plan they could save it as a board plan or make some further tweaks before they decide to save it. Board Plan 2 District 1: 2.68 District 2: 4.04 District 3: -3.83 District 4: -2.89 Consensus of the board was to save the plan suggested by Member Chinelly, as detailed above, as Board Plan 2 (see attachment). Member Chinelly stated if the plan above becomes too much of a delta then they can exclude the Maine Street area which would then require a split. He further suggested they could also keep the change recommended in Board Plan 1 with Ingram Estates going into District 4. City Clerk Eikenberry inquired if the board had the option of stating they would like this plan to go Slow 2 City of Ocoee Districting Commission Meeting July 27, 2011 into effect after the upcoming election because the proposed districts may move the districts farther from ideal population that existing districts. City Attorney Rosenthal stated it will just ►° be a matter of laws to when the ordinance is adopted and the timeframe with the Charter. If it is in place 90 days prior to the election than the districts could be based on this, if it is not then they would have the existing districts until the next election cycle. City Clerk Eikenberry stated she was trying to come up with a way to not make the 2012 election less ideal than it currently is. City Attorney Rosenthal stated that would be a policy question for the City Commission as to when they acted or did not act on the recommendations of this board. He further advised Mr. O'Halloran of a minor tweak that may take place on Maine Street due to an upcoming project that is to be discussed at the next City Commission meeting. GIS Analyst O'Halloran briefly demonstrated the change to Board Plan 2 by incorporating Ingram Estates subdivision into District 4. A brief discussion ensued regarding District 1 and 4 having a fair amount of land which would potentially be developed. Board Plan 3 District 1: 0.19 District 2: 4.04 District 3: -3.83 District 4: -0.40 Member Chinellv, seconded by Vice -Chair Lanev, moved to save Board Plan 3(see attachment). Motion carried unanimously. GIS Analyst O'Halloran stated that he would like for the board to look at Board Plan 1 and some of the areas they were looking to modify. He further stated at the last meeting Board Plan 1 was created but it has a boundary line that cuts the subdivision in half down Security Circle so he split the census block to create some other options. City Clerk Eikenberry clarified that the census splits that Mr. O'Halloran made will now either exclude the entire trailer park section or includes the entire trailer park section. GIS Analyst O'Halloran demonstrated a split to the block so there is a proposed boundary line down Mack Street instead of splitting Security Circle. A brief discussion ensued on whether they would like to make this change to Board Plan 3 or create a new Board Plan 4. City Attorney Rosenthal clarified that this plan is a modification of Board Plan 1. Board Plan 4 District 1: 0.17 District 2: -1.17 District 3: 1.39 District 4: -0.40 Member Chinellv, seconded by Vice-Chair Lanev, moved to save Board Plan 4(see attachment). Motion carried unanimously. 3 City of Ocoee Districting Commission Meeting July 27, 2011 GIS Analyst O'Halloran inquired if the board is instructing that he split the census block along Geneva Street so they can consider that at the next meeting as a boundary option. Consensus of the board was to have Mr. O'Halloran split the census block along Geneva Street. Member Chinelly stated he would like to make a request in having staff provide the board with information on what was changed at the 2007 re- districting commission. City Attorney Rosenthal stated the report from the Districting Commission to the City Commission should have the information Mr. Chinelly is requesting. City Clerk Eikenberry stated she does have that information along with a copy of the map they adopted with all the dashed lines to show the changes they made. The roll was called and a quorum declared present. PRESENT Chairman Dabbs, Vice -Chair Laney, Members Adams (arrived at 6:48 p.m.), Butler, and Chinelly. Also present were City Attorney Rosenthal, Staff GIS Analyst O'Halloran, City Clerk Eikenberry and Deputy City Clerk Sibbitt. ABSENT None City Clerk Eikenberry stated the first order of business on the agenda is for the election of officers but she feels this should be held off until Members Adams arrival. DISCUSSION/DISTRIBUTION OF HANDOUTS AND MATERIALS GIS Analyst O'Halloran provided a PowerPoint presentation that briefly summarized some of the points he made at the last meeting such as the ideal population and deviations. He briefly explained that what they are ideally trying to achieve is one person one vote which is why they try to target equal population for each district. His PowerPoint presentation further summarized the direction that the board requested of staff in providing them with the district builder website, maps with census blocks and population, vacant/foreclosure homes, land use maps, population race data, and a list of the approved residential development projects. During the review of the residential development projects spreadsheet Member Dabbs inquired if there is legal ramifications if they consider population based on more than three years and if it remains skewed five years from now. City Attorney Rosenthal stated the answer would be "no" because that is a factor which they can take into account; however, the 5% deviation has to be based strictly on the 2010 census population. The information provided to them are factors that they can take into account to look at how those district might become balanced or unbalanced over the next five years. Our charter calls for an interim Districting Commission at the five year level. Member Chinelly clarified that if they are looking at an ideal population for this process then they cannot recommend something that skews the difference by more than 5 %. City Clerk Eikenberry stated that it is 10% total; they can have one district skewed 5% under ideal and other 5% over. City Attorney Rosenthal stated the ideal would not be a 10% spread between two districts but that would be legally sufficient. Member Chinelly stated that looking at the residential development project spreadsheet the numbers would presume everything is totally 16„ built and occupied. GIS Analyst O'Halloran stated that is correct. City Attorney Rosenthal City of Ocoee Districting Commission Meeting July 20, 2011 stated that all the under construction will not necessarily be completed within the five year period before there is a new Districting Commission; that is speculative. DISTRICT BUILDER SOFTWARE GIS Analyst O'Halloran briefly demonstrated and provided a step -by -step handout to the board members for the district builder software available on the Florida Senate website. He advised the board of several situations (such as moving around census blocks to reassign that population to different districts) that the State's software could not do. Member Butler clarified that they could still meet with GIS Analyst O'Halloran to use the software provided by the city. GIS Analyst O'Halloran demonstrated his software and the improvements he made based on the information they had requested (i.e. foreclosure info. and census race data). ELECTION OF OFFICERS Member Laney stated she would like to nominate Member Dabbs as Chairman. Member Dabbs accepted the nomination. Member Laney, seconded by Member Adams, moved to elect Member Dabbs as Chairman. Motion carried unanimously. Member Butler and Member Chinelly both nominated Member Laney as Vice Chair. Sire Member Adams, seconded by Member Butler, moved to elect Member Laney as Vice -Chair by acclamation vote. Motion carried unanimously. REDISTRICTING STRATERGIES AND TIMELINES City Clerk Eikenberry briefly reminded the board that the City Commission formed this board early with the assumption that they wanted this board to come back with some better numbers for the 2012 election. This puts them on a very tight timeline and if they want to come up with numbers for the 2012 election than this will have to happen by the end of August or the first week of September. Chairman Dabbs stated this timeline works for him because he will be out of town the first week of September. GIS Analyst O'Halloran stated he also has vacation scheduled for the 1st of September. City Clerk Eikenberry stated the City Commission has voted on their budget dates so this board can now plan around those dates. Budget dates for August are on Monday the 8th and Wednesday the 17th. After much discussion on meeting dates the following timeline was created: July 27 - Board Meeting August 3 — Board Meeting August 24 — Board Meeting; Finalize Boundaries August 30 - Final Meeting/Public Hearing (if needed) t tlaw 2 City of Ocoee Districting Commission Meeting July 20, 2011 TRIALS OF VARIOUS DISTRICT BOUNDARY ADJUSTMENTS GIS Analyst 0' Halloran demonstrated some possible adjustments to the boundaries. City Attorney Rosenthal stated that in the past if individual committee members met with Mr. O'Halloran and they came up with a plan that they liked he would then save it and present it as an option at the following meeting for the whole committee to look at. City Clerk Eikenberry stated they had six board plans with various changes during the last Districting Commission and they narrowed it down to two to present to the Commission. Member Butler inquired if staff has come up with any potential plans. GIS Analyst 0' Halloran stated that staff has not come up with any plans but they have looked at potential areas that they could split. He further demonstrated the area that he and the City Clerk looked at which helped bring the deviation to almost 0 percent for each district except for District 3 which is still the highest deviation at 1.39. City Clerk Eikenberry explained that this was the closest deviation to 0 they could get in working with small populated areas. She further stated trying to take residents out of District 3 was very difficult because there were no small areas and they would have had to split a development. Member Butler stated she would like Mr. 0' Halloran to save the demonstration he just provided as Plan "A ". She felt this was a pretty good option. Chairman Dabbs also added that his first take on this option is that there is not much more work that they would have to do because it is already in compliance. Vice -Chair Laney inquired if they could get a hard copy of this option to look at or if it would be available on -line for them to view. GIS Analyst 0' Halloran stated he could forward them a pdf or link to where they can view the map. Member Adams clarified that the projections they are coming up with is for the 2012 election tier and beyond that they have projections going out three years; however, it is a five year window. He further inquired if it is there obligation to forecast or draw out the maps for the five years. City Attorney Rosenthal stated that while this is certainly ideal today from the census standpoint they may decide that they may want to be 3% lower or less ideal in a district because of what they think may happen growth wise over the next 5 -6 years. He further stated that is purely their decision as to whether or not they want to go in that direction. The plan they were just demonstrated is legally sufficient under the law and can be the plans for the 10 years no matter what happens in the population growth over the 10 years because it is based on the 2010 census. Under the charter there is an ability to take the look back at everything in five years based upon projections but that is not a constitutional requirement. Member Chinelly stated he feels this is a good time for them to discuss the process. He further explained what he understood the process to be and added that he had some other factors he would like the Board to consider because he does not feel this should be strictly a numbers exercise. One of the factors he raised was the effect on a neighborhood if it were split; could that interfere with a connection they may have to a particular district or commissioner. Chairman Dabbs stated is that he understands what he is saying and agrees with him to a point but the bottom line is that this is a numbers game. He further stated he is in favor of any compassion or human element they want to consider. Vice -Chair Laney inquired if this could split up any Homeowners Association. GIS Analyst 0' Halloran stated it can because the census block boundary lines do not always follow neighborhood boundary lines of subdivision boundary lines so one of the criteria is that they do not want to split up neighborhoods. City 3 City of Ocoee Districting Commission Meeting July 20, *airy Attorney Rosenthal inquired if the current districts have any split subdivisions. City Clerk Eikenberry stated there are no split subdivisions. GIS Analyst 0' Halloran stated that can use the original re- districting criteria such as keeping the districts as compact and contiguous as possible. City Clerk Eikenberry stated they can also keep in mind that if they decide on a specific plan to present to the Commission they can target those residents that will be affected to make sure they come to the Public Hearing and have a voice. Further discussion ensued regarding criteria they could consider. City Clerk Eikenberry announced that there is a Public Hearing regarding the Congressional State Senate and State House districts. The meeting is in Orlando on July 27, 2011, at 2pm- 4pm and 6pm -8pm at the Bob Carr Performing Arts. The roll was called and a quorum declared present. PRESENT Members Anthony Adams, Julie Butler, Joe Chinelly, Lester Dabbs, and Victoria Laney. Also present were Mayor Vandergrift, Commissioner Keller, City Attorney Paul Rosenthal, Staff GIS Analyst Michael O'Halloran, City Clerk Beth Eikenberry and Deputy City Clerk Sibbitt. ABSENT None City Clerk Eikenberry explained that tonight's meeting will mostly involve the administrative details such as covering the purpose of the board and the guidelines they have to follow, Florida sunshine law, and their timeline. She further stated that the Commission created this board early in order to make changes for the upcoming 2012 election; therefore, they are on a tight timeline to get everything done by September so that an ordinance can be created with the amendments and adopted before the election deadlines. The election date has not been determined yet because the city is piggybacking off of the presidential preference primary and the date for that is being determined at the federal level. As of right now it seems there is a tentative date of January 31, 2012, but we will not know for sure until October 1 The Presidential Preference Primary can be set any time between the first Tuesday in January and the first Tuesday in March. City Clerk Eikenberry stated that the election of Chair and Vice Chair is on the agenda but recommended they hold off on this election due to Member Dabbs' position not having been officially adopted by the Commission. The members of the Districting Commission briefly introduced themselves. ELECTION OF OFFICERS Due to Member Dabbs not having been officially appointed by the City Commission this item was tabled to the next meeting. REPORT ON LEGAL ISSUES City Attorney Rosenthal discussed the Florida Sunshine Law for those who have never served on a board. He also explained the rules of the Public Records Law and how it applies to this committee. He stated this committee is formed as a Charter requirement and the Districting Commission is appointed every five years to match the timing of the census and interim period. ice, City Attorney Rosenthal stated that, as the City Clerk mentioned, they are starting a little bit City of Ocoee Districting Commission Meeting July 6, 2011 early because they have a schedule in the charter; however when that charter was put together elections were held with the presidential election and now they do not have any idea on when the next city election will be held because it has to match the presidential preference primary. They are trying to accelerate the work of the committee so that the City Commission can have an opportunity to put new districts in place prior to the 2012 election. If for some reason they miss the 2012 election that will be fine because the districts can stay in place as they are now and pick up with the 2013 elections. City Attorney Rosenthal reminded the committee that they are an advisory group to the City Commission; therefore, the City Commission is asking them to do all the leg work in putting together the recommendations. This also means they can disagree /agree with what is presented to them. The charter does state that if the Commission wants to reject some of their recommendations they will need to refer some actions back to the Districting Committee. He stated at the end of this process what they will need to do is put together a report with their recommendations to the City Commission. City Attorney Rosenthal explained the City Charter and the requirements for the Districting Commission therein. City Attorney Rosenthal explained that districting is based on pure population and not registered voters or active voters. He said they may take into account the number of registered voters and active voters and balance that with the population; however, the goal is to create ,,,,,,. districts that are equal to population. The current estimated population of Ocoee is 35,570 and each district should have 8,892 voters. They should aim for +/ -5% deviation or a 10% range. He further explained that if they go over +/ -5% range then they can have problems with the courts. City Attorney Rosenthal explained the data information that they can provide to them from the Supervisor of Elections Office such as racial mix in the city. He further explained it is legally permissible to maintain minimal disruption of existing districts. It is permissible to try and preserve the existing districts. It is permissible to look at the incumbent elected officials and where they live or do not live; they can consider this in drawing the boundaries but they do not have to take this into account. It is permissible to look at data related to party affiliation to the extent they feel it is relevant. BRIEFING ON CURRENT STATUS OF DISTRICTS City Clerk Eikenberry advised the board that they are currently under the 5% population deviation in all the districts but the City Commission has asked for the City to go ahead and form a Districting Commission since the census numbers are in and everyone at the county and federal level is moving their boundaries around. The county is also requesting our numbers by September or early fall so that they can consider our boundaries when they recreate county lines. GIS Analyst O'Halloran introduced himself and said he would be working with the Districting Commission regarding maps and the statistics of the redistricting project. He presented data showing the 2007 population and deviation as well as the current population and deviation. He also presented data on current district lines and stated new district lines should be drawn to equalize the districts. 2 City of Ocoee Districting Commission Meeting July 6, 2011 4kr.` GIS Analyst O'Halloran explained that the ideal population for each district would be 8893 because according to the census there are 35,570 total people within the City. He further explained how he used the census blocks to come up with the population numbers for each district. He stated using the census blocks is also how this board could make changes to the districts. They can take a census block and move it to a different district to see how the population numbers change and whether that makes the district more or less equal. Mr. O'Halloran presented a census block map to show them how he had to split some of the census blocks to assign them to their appropriate district. He also did a software demonstration and explained that he can add or remove any of the data layers in the program to customize the map the way the board would like to view it. Mayor Vandergrift inquired if the program being presented tonight was something the board members could access in their home so they could play around with the numbers. GIS Analyst O'Halloran stated he will look into that possibility advise them at the next meeting. City Attorney Rosenthal advised the board members that they could always set up a meeting individually with Mr. O'Halloran to come to city hall if the program is not available. Member Dabbs inquired as to what "unassigned" meant on the map. Mr. O'Halloran explained that he has manually assigned all the areas in our city and that there are some unincorporated orange county areas which still read "unassigned" because it is not in the city. City Clerk Eikenberry advised the board that if they look at the numbers they will notice that Districts 1 and 3 have more than the ideal population and District 2 and 4 have less than the ideal population. She further explained that she and Mr. O'Halloran looked at those numbers when they played around with the software. The deviation is so small that they were looking for small areas to move around so it does not skew the numbers in the opposite direction. City Clerk Eikenberry stated one of the options they came up with was moving Ingram Estates out of District 1 and into District 4. City Attorney Rosenthal stated one other factor they can consider is looking at where growth is going to occur over the next five years. He added that there are approved subdivisions within the city that have 0 or small populations where building permits are being pulled and those are numbers that will not be in the census. City Clerk Eikenberry stated in 2007 they deliberately left District 1 underneath the ideal population because the Planning Department gave them figures that showed the population would change. Currently that district has the highest deviation over ideal population. Member Dabbs inquired if the Planning Department would be able to tell them where there are approved subdivisions. City Clerk Eikenberry stated she can provide that information to them. Member Adams inquired if they could get something that would show each census block throughout the city. He added that the program Mr. O'Halloran is presenting is a really good tool but they do not have access to that. He further inquired if the census blocks would show the subdivisions that are authorized for development. City Clerk Eikenberry stated that the census blocks would only account for the people that were present at the time it was counted. They have to figure out what has happened since then and what might happen in the next five 3 City of Ocoee Districting Commission Meeting July 6, 2011 years until their next districting committee. GIS Analyst O'Halloran demonstrated how his software program can add a layer and show new residential area projects within the city. Member Adams inquired if there were anticipated density to go along with the various colored developments on the map. GIS Analyst O'Halloran stated he cannot show density but he can show the total lots planned in each development. City Attorney Rosenthal stated that there is an average number for persons per household so they can use that information along with the number of lots. Mr. O'Halloran stated he believes it is 3 persons per single family residence and 3.2 persons for multi - family residence but he can bring that information to the next meeting. Member Adams commented that it seems a lot of information is being scattered around in different places and he was wondering if they could gather all that information so they can do what is needed for them to do. The board members requested a print out of the map with the census block numbers. City Attorney Rosenthal inquired if the state has a program on -line with the census block information. GIS Analyst O'Halloran stated he believes Beverly Willis with the Supervisor of Elections Office has mentioned such a website. City Clerk Eikenberry informed the board members that the only problem with using the State's website is that it will not reflect the district boundaries in Ocoee. Member Chinelly inquired if there is vacancy information at the time of the census with the number of homes that were not occupied. He further stated it would be the flip side of the growth question where this would show the areas of the city already built but vacant. It could r help show what the total population of the city would be if the economy was not turned around. Mr. O'Halloran stated he does that have that information. Member Laney stated the HOA would normally know which houses are vacant in their neighborhoods. Mr. O'Halloran inquired if he is looking for this information on new development where only a few people have moved in or is he looking for this information on established housing subdivision where there are a number of foreclosures and people have moved out. Member Adam stated that if they use the same logic that they used when they projected the growth in the city such as using the number that is authorized and zoned for the area and the average amount of people per dwelling then they should derive at a number. City Clerk Eikenberry stated that is a situation that will arise in several parts in the city and they will just have to get the best numbers that they can to make estimates. City Attorney Rosenthal stated it is be easier to get macro information as opposed to micro information because it the totality of a district as opposed to an individual subdivision. At the last districting committee they tried to have some districts over and some under as opposed as trying to get zero deviation based on just projections. Further discussion ensued regarding vacancy in subdivisions. City Attorney Rosenthal advised that they could have a representative from the Planning Department speak with the board regarding the general terms and trends regarding vacancies in developments. Mayor Vandergrift addressed the board and briefly gave background information on how this committee was created. He also thanked all the members for volunteering to serve on the board. SCHEDULE MEETING DATES 4 City of Ocoee Districting Commission Meeting July 6, 2011 fir„ City Clerk Eikenberry briefly advised the board of the week days that the Commission Chambers is available for a meeting. She also stated that the budget hearings are going to be scheduled at the next Commission Meeting for August and September. It was decided to hold the next meeting for the Districting Commission on July 20 at 6:30 p.m. and to schedule the following meetings once they know what days the budget workshops and hearings is going to fall on. DIRECTIONS TO STAFF City Clerk Eikenberry clarified that the board had requested the following to be provided at the next meeting: 1) Map with Census numbers 2) Census Website information 3) Information about vacant units (if applicable) 4) Information from Planning Department regarding what development has been approved 5) Residential development projects map 6) Future land use map City Attorney Rosenthal added that if they would like to have this in advance of the meeting they can contact staff. Motion carried unanimously. err, UPDATES SINCE THE LAST MEETING — MAPS OF THE FOUR BOARD PLANS GIS Analyst O'Halloran said most of what he has in his PowerPoint presentation tonight are updates from the last meeting which includes the various board plans they created. GIS Analyst O'Halloran briefly explained each individual board plan that resulted in the following deviations from ideal population in each of the four districts: Board Plan 1 Board Plan 2 District 1: -0.75 District 1: 2.68 District 2: -0.24 District 2: 4.04 District 3: 1.04 District 3: -3.83 District 4: -0.40 District 4: -2.89 Board Plan 3 Board Plan 4 District 1: 0.19 District 1: 0.17 District 2: 4.04 District 2: -1.17 District 3: -3.83 District 3: 1.39 District 4: -0.40 District 4: -0.40 Chairman Dabbs inquired if Board Plan 4 moves Prima Vista into District 2. GIS Analyst O'Halloran explained that Board Plan 4 does not affect Prima Vista. Board Plan 4 would `r• move District 2 up to Mack Street so not to split up the subdivision and also incorporates Ingram City of Ocoee Districting Commission Meeting August 3, 2011 Estates into District 4. GIS Analyst O'Halloran further provided a bar graph to show the shift in deviations and also explained the highlighted areas of change. Member Butler inquired as to which plans affect the Maine Street area. GIS Analyst O'Halloran said that both Plans 2 and 3 would apply to the Maine Street area. Chairman Dabbs stated he likes the different district boundary moves but he likes the deviations to Board Plan 4 better than any of the others. Member Butler inquired if at any point could they eliminate a plan. Some of the plans are very similar and she was wondering if they could narrow it down since they are on a time frame. Member Chinelly stated he would suggest in terms of process that they would come up with as many possibilities as they could discuss and then decide as a commission what their preferred plan would be after input from the Public Hearing. He further states that he feels they are still in the process of building and tweaking. Chairman Dabbs inquired from the member's as to what their intention is for the Public Hearing. Member Adams stated he would think that they as a board would narrow it down and then identify that map which would affect those residents and call those residents to the Public Hearing. Member Butler inquired if they are still looking to have the Public Hearing on August 30` City Clerk Eikenberry said it depends on whether they are trying to tie this into the 2012 election or continue meeting and not be prepared to change the numbers until the next election. Chairman Dabbs inquired as to which of the plans would/would not be ready for the 2012 election. City Clerk Eikenberry said any of the plans could be ready on time and would work for the 2012 election as long as they stick to the noted timeline and produce numbers that are better than the existing numbers. If they need more time to consider other options, then they probably would not be able to make the tight timeline for the 2012 election. Chairman Dabbs inquired as to how much wiggle room they would have if *r they present a plan and the Commission is not happy with it. City Attorney Rosenthal stated that part of the wiggle room is that no one knows when the 2012 municipal election is going to be because it is tied to the presidential preference primary (PPP). The legislature does not have a time set for the PPP as of yet. City Clerk Eikenberry added that a committee that was formed at the federal level has until October 1, 2011 to provide a date for the PPP. Chairman Dabbs said he heard recently that they may set the PPP election date in January. City Attorney Rosenthal stated that the key provision here is the charter provision which states that you cannot change districts within 90 days prior to a municipal election. He further said the good news is that the existing districts are in compliance even with the 2010 census so there are no legal issues to the city. Member Chinelly said in his experience with Public Hearings, he would suggest they show and display what they have gone through and then show the preferred plan. It would be helpful in that they can demonstrate the various pieces of the puzzle that they have looked at with data to support it. City Attorney Rosenthal clarified that he and City Clerk Eikenberry found the Charter provision and it states that they cannot change districts within 4 months prior to a municipal election. If we follow the timeline for adoption of the ordinance and the PPP is at the end of January or later, we would still make the deadline in time for the 2012 %lbw 2 City of Ocoee Districting Commission Meeting August 3, 2011 SPLIT CENSUS BLOCK INFORMATION FOR GENEVA STREET AREA Member Chinelly stated in addition to the four board plans he would also like to see the census block split for Geneva Street as well. Board members gathered around the large Board Plans on display to discuss the four current plans. GIS Analyst O'Halloran presented the Geneva Street split and how he cut the census block. Member Butler inquired if Mr. O'Halloran could add the Geneva split to Board Plan 3 so they can see how the deviation changes. GIS Analyst O'Halloran said with the changes to Board Plan 3 as Member Butler suggested, Districts 2 and 3 have a little bit of a change. District 2's deviation is now 3.57 and District 3's deviation is now -3.37. GIS Analyst O'Halloran continued with his PowerPoint Presentation showing the population density map and population by race and ethnic group pie chart. A brief discussion ensued regarding one of the plans that would have the district line going down the 429 verses Fuller's Cross Road and if they would like to keep it that way. Consensus was to keep it down the 429. Member Butler inquired if they could save the Geneva Street split plan as Board Plan 5. Chairman Dabbs said they have had a chance to review all four plans and see the map for the 2007 re- districting; he further clarified that they are now creating an additional plan. City Attorney Rosenthal said that they would have to make a motion to add Board Plan 5. Member Butler, seconded by Member Adams, moved to save Board Plan 5(see attachment). Motion carried unanimously. Member Adams inquired if the numbers on the bottom of the projection screen are the actual numbers for Board Plan 5. GIS Analyst O'Halloran said that was correct. He further said that the Geneva Street split continues on past the cemetery in a straight line. Member Chinelly inquired if he had the numbers for the 2007 District Final Map, in terms of population. He further inquired if they can bring annual Ocoee population numbers to the next meeting. City Clerk Eikenberry said that would be the information they get from BEBR and they can provide that. GIS Analyst O'Halloran said he believes he showed that information in one of his previous presentations and he will look for it and bring to the next meeting. Chairman Dabbs said the next meeting is August 24` and they just made an addition to their options so he further inquired if they are looking to eliminate any plans tonight and how soon do they feel like they will be ready to come up with a final plan. Member Butler inquired if they are taking one plan to the Public Hearing or will they present options. Chairman Dabbs said it was his understanding they would take one preferred plan with explanations of what they went through with the different board plans. Member Adams clarified that they would have the five board plans available at the Public Hearing but they would also have the preferred plan that they recommend. Chairman Dabbs answered affirmatively. City Attorney Rosenthal inquired if they would like staff at the public hearing to give an explanation of all five plans or do they want to narrow it since some of these plans are essentially the same. Chairman Dabbs inquired if they are going to only invite people who are affected by the changes. City Clerk Eikenberry % stated they can put an advertisement out to inform everyone but if there is a certain area that is 3 City of Ocoee Districting Commission Meeting August 3, 2011 11160 going to really be affected then they may want to make sure to inform those residents. Member Chinelly stated he would recommend, based on similarities, that they make some decisions and reduce the number of plans. He further said he would use the term "preferred plan" rather than "recommended plan" for the Public Hearing because ultimately they will be recommending to the City Commission based on public input. Member Chinelly inquired if the city had a format for the public hearing or is it something they just put together. City Attorney Rosenthal said the board can run the public hearing as they chose. He briefly gave them suggestions on how they could proceed with the public hearing. Member Butler clarified that if they have a preferred plan and the residents agree, than they can decide that night to make that plan a recommendation before the Commission. Chairman Dabbs expressed his concerns with presenting five plans and agrees with Member Chinelly that they should break it down to fewer plans. A brief discussion ensued on how they would be sending out publication and notices regarding the public hearing. Member Adams inquired about board Plan 5 and also commented that he would like to be able to identify the number that represents percentage deviations and he feels the bar graph was the most clear in showing that information. Board Plan 5 District 1 0.19 District 2 3.57 District 3 -3.38 District 4 -0.40 Member Chinelly said he would suggest Board Plan 5 take the place of Board Plans 2 and 3 and that they eliminate those two board plans. Member Chinelly, seconded by Member Butler, moved to eliminate Board Plans 2 and 3 due to the creation of Board Plan 5 and its similarities. Motion carried unanimously. GIS Analyst O'Halloran said that one of their options when they get to the public hearing can be the status quo. City Attorney Rosenthal said that they would present what the existing districts are currently and they will also keep the board plans numbering the same. City Clerk Eikenberry inquired if they would like to consider Board Plans 1 and 4 the same. The difference between the two plans is the split in the trailer park area. Member Butler, seconded by Chairman Dabbs, moved to eliminate Board Plan 1. Member Butler explained that Board Plan 1 was the first plan they created when they were just getting used to working with the software in moving the census blocks. The change that they made to create Board Plan 4 was for the better in not splitting Security Circle. Deviation numbers are also very similar and she does not feel they will lose a whole lot in eliminating that plan. Member Chinelly said that he wanted to point out that of those two plans if they look strictly at deviations, the better of the two is plan 1 but the other consideration is it does split the subdivision which they would prefer not to do. Member Butler commented that she is very 4 City of Ocoee Districting Commission Meeting August 3, 2011 familiar with that neighborhood and it is a very tightly knit neighborhood and she just thinks splitting it would not be a good idea. Member Chinelly inquired if he could suggest they move the boundary line to include more of that subdivision into District 2. Discussion ensued regarding moving the boundary from the Mack Street boundary up to the property line behind Mobile Lane. Further discussion ensued regarding moving the boundary line from Lakewood Avenue over to Lyman Avenue. City Attorney Rosenthal reminded the board these changes would be for a potential additional board plan. Chairman Dabbs inquired if they were ready to vote. Member Butler said she does not think she is ready to vote. City Clerk Eikenberry suggested they tray taking Mobile Park out of District 2 and put it back into District 1 and then take the boundary line over to the west. Chairman Dabbs inquired if they affect a Hispanic community would they have to explain any of the changes to them in Spanish. City Attorney Rosenthal said they would not be required. VOTE: Motion on the floor to eliminate Board Plan 1 was defeated 0 -4, with all members opposing. Member Butler, seconded bv Member Chinelly, moved to save Board Plan 6 (see attachment). Motion carried unanimously. Board Plan 6 District 1 0.16 District 2 0.34 District 3 -0.13 District 4 -0.40 Member Butler, seconded bv Member Adams, moved to eliminate Board Plans 1 and 4 due to the creation of Board Plan 6 and its similarities. Motion carried unanimously. City Attorney Rosenthal clarified that at the next meeting before the public hearing the board would pick the preferred plan from the two they have created. Chairman Dabbs said that is his understanding. Member Butler inquired if Board Plans 5 and 6 could be e- mailed to them. City Clerk Eikenberry commented that the board plans will also be on the city's website and she will notify the members when it is up so that they may review it. Chairman Dabbs said he would try to come in and meet with Mr. O'Halloran to review both plans 5 and 6. He then led in prayer and the Pledge of Allegiance. The roll was called and a quorum declared present. PRESENT Chairman Dabbs, Vice Chair Laney, Members Adams, and Chinelly were present. Also present were City Attorney Rosenthal, Staff GIS Analyst O'Halloran, City Clerk Eikenberry and Deputy City Clerk Sibbitt. ABSENT Member Butler was absent excused. GUEST Brenda Ingle, Mapping Assistant at Supervisor of Elections Office. APPROVAL OF MINUTES FOR AUGUST 3, 2011 Member Adams, seconded by Vice Chair Laney, moved to approve the regular minutes of August 3, 2011. Motion carried unanimously. UPDATES SINCE THE LAST MEETING GIS Analyst O'Halloran said that one of the items they asked for at the last meeting was to look at the results of the districting that they did after the 2007 re- districting. Using the exhibits, he briefly explained the changes that were made. Member Chinelly inquired if the population figures for the 2007 action were from the 2000 census since that is what is listed as the source. GIS Analyst O'Halloran said the information was built in 2007 by taking the 2000 census data and adding in building permits. Mr. O'Halloran said it is similar to what they are doing this time. Member Chinelly inquired if the population included the known occupied buildings in the city. Mr. 0' Halloran clarified that it was based on certificate of occupancy and not building permits. City Attorney Rosenthal said the 2007 Re- Districting Board used an educated estimate since the census is the only true count and at the time it was not a re- districting based on the census count. Member Adams said in retrospect to what Mr. Rosenthal just shared, how close was the educated estimate to the actual population. GIS Analyst O'Halloran said they were fairly close to the 2007 BEBR numbers. City Clerk Eikenberry explained that a handout was provided to show annual population figures from the University of Florida, Bureau of Economics and Business Research (BEBR) from 2007 -2011, as requested by the board. For 2007 it shows the population at 33,533 and the City Planner's corrected estimate at 33,837; the population used for the Districting Commission later that year was figured at 34,285 by Mr. O'Halloran. Member Chinelly thanked the staff for providing the information; he said it was very useful to determine the rate of growth which has slowed considerably with City of Ocoee Districting Commission Meeting August 24, 2011 only 1300 additional people since 2007. City Attorney Rosenthal stated the Ocoee Charter is different from most municipalities in that regard; we have a Districting Commission that meets midway between the ten -year Censuses and it allows the Commission to redistrict earlier or at any time they feel it is necessary. Most cities and governmental bodies redistrict once every ten years with the release of the Census figures. GIS Analyst O'Halloran continued with his presentation stating that the largest percentage deviation today is 3.98 and the lowest is -2.88. For the two new plans, Board Plan 5 has the largest deviation at 3.58 and lowest at -3.37. Board Plan 6 the largest deviation is 0.35 and lowest is -0.40. Mr. O'Halloran further showed a bar graph for visual purposes. He said if he understands correctly Board Plan 5 is for the purpose of accounting for future population growth and Board Plan 6 is straight population. The Chairman opened the floor for discussion and said that his opinion is that Board Plan 6 is the most evenly balanced by deviation but how important is it to the rest of the board. Member Adams referenced Board Plan 5 and inquired if that was the subdivision in which Chairman Dabbs resided. He asked if he has an opinion about how the residents in Prima Vista feel about switching commissioners. Chairman Dabbs answered that it really does not matter to him personally, but to answer his question, he has not polled the subdivision. The chairman said he is hoping that notices would go to the residents in that subdivision so they can show up at the Public Hearing on August 30 Member Adams said listening to the attorney they do not need to take into consideration the five year projection but he feels they would be almost remiss if they did not look at future growth. Mr. Adams further added that when you look at Board Plan 5 the numbers almost look glaring in terms of deviation percentage but overtime he feels it may even out. He further inquired about District 4 and if it was a candidate for potential growth. The board briefly reviewed and spoke about the planned residential projects list which had been previously provided to them by Mr. O'Halloran. FINALIZING OF BOARD PLAN(S) After reviewing the planned residential projects list, the board members gathered in front of the dais to view the larger maps of preferred plans 5 and 6 to discuss the boundary changes. There was discussion among the group as to how to expand the population in District 2 since it is essentially built out. City Attorney Rosenthal advised that if they wanted to put growth into District 2, there is a piece of land on Maine Street that is R -1AAA. There has been talk amongst the Planning Department regarding a possible high rise but it may not be developed within the five years. The property is currently vacant and would not affect the current deviation numbers presented. Member Chinelly inquired as to what the duration would be for the proposed development for that land. City Attorney Rosenthal said if a developer walked in today to build a high rise, it would probably take a couple of years. Discussion ensued regarding whether or not the old Colony Plaza location and Health Central will have residential growth. After discussion, the chairman inquired what the pleasure of the board was. Vice Chair Laney, seconded by Member Adams, moved to include the parcel north of Maine Street and east of Chicago Avenue right -of -way, to both Board Plans, thus creating a Revised Board Plan 5 and 6 (see attachment). Motion carried unanimously. 2 City of Ocoee Districting Commission Meeting August 24, 2011 Chairman Dabbs inquired if they have a motion as to what plan they want to submit as a preferred plan. Vice Chair Laney, seconded by Member Adams, moved to present Revised Board Plan 5 as their preferred plan. Member Chinelly said the only reservation he has on Board Plan 5 is that if they look back at the 2007 redistricting action, they would be flip flopping a block of the city (that includes Lakewood Manor). Mr. Chinelly said he was the one that proposed they move that block, but after revisiting it the change they just adopted to add to both board plans, would give District 2 the growth it needs. He would be more inclined to support Revised Board Plan 6. Vice Chair Laney said that in looking at Board Plan 5, the area being returned to District 3 does not have much population in it and there was no population there during the move in 2007. She does not feel there will be anyone in that area objecting to being moved. A brief discussion ensued regarding how many residents would be affected by the change to District 3 moving the boundary line up to Fullers Cross Road and down the 429. City Clerk Eikenberry said the other thing they may want to consider with the moving that boundary line north is the compactness of District 3 which would really stretch that district out north to south. Chairman Dabbs said he also agrees and was going to comment on that same issue. He further said since there is not a lot of population in that area he would have no problem with moving that boundary line back to District 1 to shorten the long District 3. GIS Analyst O'Halloran said there is population in that block. Mr. 0' Halloran further added that it shows 114 people who would most likely come from the Lakewood Manor subdivision. There was discussion that in 2007, when they had the last redistricting, those houses were not there and possibly not even there for the last Commission election; this was a Homes in Partnership development that was fairly new. Member Chinelly said his question has been clarified in that he did not want to take the same residents and move them back and forth between districts. It has been shown that within the last redistricting, Lakewood Manor did not exist, so residents will not be affected twice. Chairman Dabbs asked the Clerk to restate the motion on the floor: "Motion to approve revised Board Plan 5 as the preferred Plan of the Districting Commission." After the discussion, motion carried 5 -0. Vice Chair Laney — Briefing on County Commission Redistricting Meeting. Vice Chair Laney gave a summary of how the meeting was handled at the County level. She said that one of the things she did like about the county's public hearing was the idea of having the comments about the specific maps, as well as, at the end of the meeting they also allowed public input before adjourning. Further discussion ensued regarding the county's redistricting meeting. She stated much of the discussion was the splitting up of West Orange cities and the possibility of splitting Ocoee into more than one Commission District. DISCUSSION ON PUBLIC HEARING SCHEDULED FOR AUGUST 30, 2011 Chairman Dabbs inquired if there was an order of business for public hearings that they should adhere too. Vice Chair Laney inquired if at this point she could give a report on what happened at the county's redistricting hearing. Ms. Laney commented that the County's 3 City of Ocoee Districting Commission Meeting August 24, 2011 Redistricting Board had thirteen members who provided 9 different proposals. She further added that they also had public proposals which Ocoee has not received any at this time. The county structured their meeting with old business than allowed for comments. Comments were no more than 3 minutes long after each presentation, as well as, at the end of the meeting. She briefly explained the interest the county's redistricting board had in splitting Ocoee. Vice Chair Laney said that for this board's agenda they should have the following: I. CALL TO ORDER Invocation, Pledge, and Roll CaII and Determination of a Quorum II. APPROVAL OF MINUTES OF AUGUST 24, 2011 III. OLD BUSINESS 1. GIS Analyst 0' Halloran to present data related to the maps and how they chose Revised Board Plans 5 and 6. IV. NEW BUSINESS 1. Public Hearing - Public Comments for Revised Board Plans 5 & 6 2. Motion by board on preferred plan V. Adjourn Chairman Dabbs inquired as to how widely publicized do they expect this meeting to be and if there was notice prepared for the West Orange Times. City Clerk Eikenberry said it is in the water bills, on the city's website, and they will be targeting individual homes in affected subdivisions with door hangers. The West Orange Times also did a write up on the board in addition to the ad that was placed announcing the public hearing. The City Clerk announced, in regard to the earlier question, it appears the last county redistricting will be in September because there are none scheduled for October. She announced the upcoming county and school board redistricting board dates for those interested in attending. There was further discussion about the County Districting meetings and the apparent intent of some of the Commissioners. GIS Analyst 0' Halloran inquired if they should present Board Plans 1 -4 or even mention them. Vice Chair Laney said she believes it should just be Revised Board Plans 5 and 6 that they present since they voted to eliminate the others. Chairman Dabbs said Mr. O'Halloran should make mention that they have looked at four plans but they were very similar, hence the reason for elimination. The Chairman did not believe there should be any display of the other plans. The Board consented. Vice Chair Laney suggested along with the two revised board plans they should also display the census map with no changes and current deviations. DISCUSSION REGARDING DISTRICTING COMMISSION REPORT THAT IS DUE TO THE CITY COMMISSION • City Attorney Rosenthal suggested a packet with just the minutes and recommendation should be sufficient and would meet the requirement of the Charter. Minutes should be detailed with what the discussions were and the board's final motion will be the recommendation. Assistant City Manager Shadrix, who was in City Hall, was invited to briefly comment about the county's redistricting meeting which he also attended. He briefly advised the board of the 4 City of Ocoee Districting Commission Meeting August 24, 2011 concerns he expressed at that meeting. He said waited until the end of the meeting to express the concerns of the City Commission in keeping the city whole with neighboring West Orange cities such as Winter Garden, Windermere, etc. Those concerns echoed very clearly with what many other West Orange cities represented there. He said there was a representative, Doug Head, from Hunter's Creek who took several shots at Ocoee and stated that Ocoee had urban sprawl. He added there are a lot of political agendas being played out and he tried to stay clear of that. He said that none of the maps shown at the meeting were in conflict with the Commission's concerns so he did not address individual maps. Mr. Shadrix agreed with Ms. Laney that we need to maintain vigilance on this because there is a major effort underway to take Ocoee out of District 1. Vice Chair Laney, seconded by Member Chinelly, moved to adopt the report format recommended by the City Attorney. Motion carried unanimously. He then led in prayer and the Pledge of Allegiance. The roll was called and a quorum declared present. PRESENT Chairman Dabbs, Vice Chair Laney, Members Butler, and Chinelly were present. Also present were City Attorney Rosenthal, Staff GIS Analyst O'Halloran, City Clerk Eikenberry and Deputy City Clerk Sibbitt. ABSENT Member Adams was absent. GUEST Also present were Mayor Vandergrift, Commissioner Hood, Commissioner Wilsen, Commissioner Johnson, Commissioner Keller, and Supervisor of Elections Bill Cowles. APPROVAL OF MINUTES FOR AUGUST 24, 2011 Vice Chair Laney, seconded by Member Chine11v, moved to approve the regular minutes of August 24, 2011. Motion carried unanimously. OLD BUSINESS PRESENTATION OF DATA RELATED TO THE MAPS AND THE PROCESS BY WHICH THE DISTRICTING COMMISSION SELECTED REVISED BOARD PLANS 5 & 6 — GIS ANALYST O'HALLORAN GIS Analyst O'Halloran gave a PowerPoint presentation regarding what went into the board plans. His PowerPoint presentation covered the revised board plans 5 & 6, as well as, explanation on the process of eliminating board plans 1 -4 due to similarities. Further explanation was given on the charter requirement, which was the reason the committee was formed, as well as, the 2010 census numbers and the splitting of census blocks among more than one district (i.e. a district boundary line going through a census block would require that census block to be split). Information was also provided showing the comparison of the 2007 commission district population with the 2010 commission district population, race and ethnic groups within the districts, foreclosures for 2007 and 2010, and planned residential projects. Chairman Dabbs briefly interrupted GIS Analyst O'Halloran to welcome the Mayor, Commissioner Hood, Commissioner Wilsen, Commissioner Johnson, Commissioner Keller, and Supervisor of Elections Bill Cowles, as guests before the board. City of Ocoee Districting Commission Public Hearing August 30, 2011 GIS Analyst O'Halloran provided commission district population and deviation % numbers for the existing population and for the two revised board plans; all plans were within the allowed 5% deviation. He ended his presentation by showing an aerial photograph of each location being affected by the boundary changes, proposed by the board, for revised board plan 5 and 6. riRVIA . ; , . ,+ Yt r B oard- -Plan 5 Boar 1, a District 1 3.96 0.19 0.17 District 2 -2.45 3.58 0.35 District 3 1.39 -3.37 -0.13 District 4 -2.88 -0.40 -0.40 Chairman Dabbs thanked GIS Analyst O'Halloran for his presentation and explained that the board started with no preconceived end in mind and had asked staff for a lot of data, which they provided. The board looked at as many as six plans and found that some were similar, so after much discussion and debate, they came up with the two revised board plans. The chairman stated his personal choice would have been revised board plan 6 because of the deviations but both plans have a deviation below 5% so either plan is acceptable. He further thanked the city attorney for steering them through the redistricting process. PUBLIC HEARING — COMMENTS FOR REVISED BOARD PLAN 5 & 6 The public hearing was opened. Commissioner Keller inquired if he could comment since more than one commissioner was present. City Attorney Rosenthal said he did not think about the commission all being their tonight and they did not notice the meeting as a joint meeting; the report from tonight's meeting will be presented to the commission for action. City Clerk Eikenberry advised the City Attorney that the agenda posted did note that one or more commissioners will be present. City Attorney Rosenthal clarified since the agenda was noted correctly than the commission is invited to speak. Commissioner Hood thanked the board for their sacrifices by taking time away from their loved ones to meet and volunteer for this board. He said he served on the redistricting board many years ago so he knows they had excellent help from the city and that staff does an outstanding job, as they have done each year. He further said he knows this was not an easy task and he does not like to lose anyone from his district but the city is growing and he knows the board had to do what was needed to make the numbers work. Commissioner Hood said he would go back to look at the plans and study it more. Chairman Dabbs added that they tried not to look at personality but just numbers when they looked at the boundary changes. Commissioner Wilsen said she too served on the redistricting board many years no and enjoyed it so she hopes they did as well. She further commented that it was fascinating to see that District 2 was the smallest with growth coming forward. She is happy seeing what they have done with allowing District 2 to gain. Chairman Dabbs again commented that he realizes that the commissioners are possessive of the residents in their district which is why they only looked at the numbers. He further added that they were charged with making the city in compliance with low deviations and they gave it their best shot which is how they carne up with their preferred plan. Commissioner Wilsen added that she is very pleased that they looked at her district. Commissioner Johnson said he has been through this process but never formally served on a redistricting board. He further said that one of the reasons they look at the districts is because of what the county tells them with regards to the districting process. Commissio Johnson said what he looks at is what they do with the numbers. He said he knows they are all volunteers and are up there doing their job for the better purpose of the city. If they look at board plan 5 and board plan 6 and see the numbers they can tell which one stands out. The range deviation is 5% but the purpose is to have the numbers leveled out. If they look at board plan 5 the numbers are completely screwed up where board plan 6 is more overall even throughout the city. Commissioner Johnson said if they are going to make changes they should do it where it evens out. He added that he looked at a couple of things himself and in District 2 they do not have some of the growth that is going to happen on Clarke Road such as the retirement home that is being built on that road. He further added there are a couple of projects missing from his district which he does not even know when it will happen. Commissioner Johnson said when votes at the commission meeting he will vote for board plan 6 because board plan 5 is way off. He added that he appreciates any one that volunteers in the city but he was told when they were doing the districting it was mainly to get the numbers near the same. If they look at the two plans, board plan 6 is more in order with having the districts the same. Chairman Dabbs thanked Commissioner Johnson for his comments and added that in defense of their efforts they were attempting to look at future growth. Commissioner Johnson said it does not matter what was put on paper, the growth that is being anticipated will not be happening any time soon. He again commented that there is a project on C 1 rke Road that does not even show as projected growth. Commissioner Johnson said it all comes down to what they vote at during the commission meeting anyways. Commissioner Keller also thanked the board for all their time and efforts into this board. He further said he also appreciated what they did with board plans 5 and 6 because he shows they were really concerned about the city since they presented two very different plans. Board plan 5 allows for growth 3 -5 years out also allowing for the numbers to be somewhat equal in the future. Board plan 6 shows what is will make the numbers even now and allows for them to make changes during the next census. Commissioner Keller said he may have to sit down and think the plans over. His gut feeling would be to try to keep the districts as even as possible but he does remember at the last redistricting he lost part of his district because District 2 had no growth pattern until Rose Hill came along. He believes that there are talks that the other part of Rose Hill may want to come into the city but of course that is not anything they can count on. He again thanked the board for the two plans options. 3 City of Ocoee Districting Commission Public Hearing August 30, 2011 Chairman Dabbs said he appreciated the opportunity to serve on this board and knew they would not be able to satisfy everyone. He added that he did not receive but one phone call about his subdivision moving from District 3 to District 2. The public hearing was closed. MOTION TO PRESENT THE DISTRICTING COMMISSION RECOMI\IENDATION TO THE CITY COMMISSION ON SEPTEMBER 6, 2011 AGENDA City Attorney Rosenthal advised that at the last meeting they only had a recommendation of a preferred plan which was to be presented before tonight's hearing. It would then be appropriate following the public hearing for the board to have a motion with the specific plan fur with the Districting Commission is recommending to the City Commission. Vice Chair Laney, seconded by Member Chinellv, moved to recommend to the City Commission the revised Board Plan S. Member Chinelly asked the chairman if they could have a discussion to give clarity regarding the basis for the board plan recommendation. He further said they were looking at ensuring the integrity of each of the neighborhoods in the community and in doing so they did not want to split up any neighborhoods. That is what defined the numbers that were involved in the changes to the districts. The question came into play because if they look at the current deviations between districts they did not want to be in a position 5 years from now where they would be greater than 5 %. He further explained the magnitude of the difference between the districts was taking into account the change in population from 2007 (pop. 34,300) to today (pop. 35,600) and the gaining of 1,300 residents. Member Chinelly said they are not expecting a large magnitude of growth so he did not rely on the numbers for the projected buildings underway but more or less on the macro view of what they can expect during that time so they would n.)t be over the 5% deviations. Vice Chair Laney said she does recall that they did talk about the new senior housing being built on Clarke Road as well as the new senior housing proposed for the Maine Strc.t area. That discussion regarding the senior housing is one reason they drew the line the w<<y they did; to account for that future growth. They did not want to move citizens from one district to another every 5 years so they planned for future growth to allow residents to stay in the saute district. After the discussion, motion carried unanimously. City Attorney Rosenthal advised that now the board will need to formalize a report to the City Commission and at the last meeting they spoke about that report basically being the package of minutes with the recommended maps. He further said he is recommending t: cy adopt the minutes of the districting commission and the maps, along with their recommendation, as the official report to the City Commission and direct the clerk to forward that to the co : .mission. 4 City of Ocoee Districting Commission Public Hearing August 30, 2011 Vice Chair Laney, seconded by Member Butler, moved to present to the City Commission a packet with the minutes, preferred maps, and the board's recommendation. Motion carried unanimously. GIS Analyst O'Halloran inquired as to how the packet would be presented to the City Commission and if the Districting Commission or staff would need to be present. City Attorney Rosenthal said that City Clerk Eikenberry would be coordinating the specific agenda. City Clerk Eikenberry advised that she is trying to get it onto the next Commission meeting which is September 6 City Attorney Rosenthal said he believes in the past, the chairman of the Districting Commission would be the one to actually present the report to the commission. He further added all the members of the City Commission were present in the audience tonight so unless they want a full repeat of the presentation, it should not be needed. Commissioner Hood inquired if he could have a copy of the PowerPoint slide so he may look at it. City Clerk Eikenberry said she can make it part of the agenda packet. Chairman Dabbs announced he would not be in town on September 6th and hopes that Vice Cahir Laney could be present at the Commission meeting. Vice Chair Laney said she also is scheduled to be out of town but her plans may not work out. City Attorney Rosenthal said the issue is that no one knows when they the presidential election is going to be. He further said the only thing that will happen doing the Commission meeting is a formal presentation of the report to the City Commission. Under the charter, once the report is presented the City Commission than has two months from the receipt of the report of which to accept, reject, or take other appropriate action with respect to the recommendations of the Districting Commission. He recalls one instance in the past when they referred the report back to the Districting Commission and the Districting Commi .lion than reconvened. City Attorney Rosenthal said if they take action within those two m( aths they would then put together the appropriate ordinance which would go through the normal process and be scheduled for a public hearing for adoption. The schedule of the public hearing on the proposed plan is really going to be dictated by when the City Commission acts, in whit!. they can act when the report is presented to them, but they are not obligated too. City Clerk Li :enberry advised that Supervisor of Elections Bill Cowles shared with her that they are betting heavily on Thursday, March 1 being the presidential preference. City Attorney Rosenthal said another alternative if no one from the board can be present at the meeting is to have the report delivered to the City Commission which would start the clock running. That can be one 1-2. fore the September 6 meeting and then they can schedule on another agenda, the aprearar;e by the Districting Commission before the City Commission. Vice Chair Laney inquired if could put it on the September 20 agenda if they wanted too. City Attorney Rosenthal inqu :ed from City Clerk Eikenberry if presenting the report on September 20 would meet the time ne. City Clerk Eikenberry said it would give them a little bit of time. City Attorney 1 osenthal reminded the board that the charter basically provided that the district boundaries c mnot be changed less than 4 months prior to regular municipal election. Ile said if the presidential election is scheduled for March 1 than by November 1 the City Commission wc have needed to act. The effect of them not having reached a decision by November I'' wou' 1 be that the 2012 elections would occur based on the existing districts and the boundary moves v hen than occur after the election. City Clerk Eikenberry advised that they can put the rep( t on the September 6 agenda since the Commission has heard the presentation. It will allow i .ore time just in case the Commission wants to have a joint meeting or consider another bo Ord plan. 5 City of Ocoee Districting Commission Public Hearing August 30, 2011 Member Butler agreed that they just need to get the report to the Commission as quickly as possible. City Attorney Rosenthal suggested to the elected officials in the audience that if they have any individual views on the agenda than they may communicate with the City Clerk on what their preference would be.
