Antonio Fabre, AIC' Department Director: Contact Number: 407 - 905 - 3100/1019 City Manager: f /�'-` Subject: Ocoee Town Center Preliminary Subdivision Plan Project # LS- 2010 -004 Commission District # 3 — Rusty Johnson Background Summary: The Ocoee Town Center is located on the northeast corner of Bluford Avenue and W. Colonial Drive (SR 50) adjoining Lake Bennet. The subject property is approximately 36.08 acres in size of which 12.87 acres are submerged and 1.69 acres are designated as conservation /wetlands. The site is undeveloped and covered with a mixture of pine trees, large oak trees and other varieties of trees scattered around the property. The subject property is currently zoned "Community Commercial" (C -2). The Future Land Use designation for the ubject site is "Commercial" with "Conservation /Floodplains" along Lake Bennet. The table below references the land uses, jurisdiction, zoning classifications and existing land uses of the surrounding parcels: Direction Future Land Use Zoning Classification Existing Land Use North Commercial City of Ocoee (C -2) Vacant Undeveloped Land East North: Commercial City of Ocoee (C -2) North: Vacant Undeveloped Land South: Conservation /Floodplains South: Lake Bennet and its associated wetlands /floodplains South Commercial City of Ocoee (C -2) Commercial (State Farm, Dan's Fans, House Blend Coffee) and Institutional (Highpoint Church) West Commercial City of Ocoee (C -2) Commercial (7 -11 Convenience Store, and ABC Fine Wine & Spirits) and Vacant Undeveloped Land On July 6, 2010, the City Commission adopted the "CRA Target Areas Special Development Plan ". The subject site is located within what is considered Target Area 2. Target Area 2 has been divided into two general sub areas (Sub -Area 1 and Sub -Area 2). Sub -Area 1, which is located along the frontage of Bluford Avenue and SR 50, provides for a more conventional suburban design while Sub -Area 2 is intended to be a more urban environment. The Ocoee Town Center Preliminary Subdivision Plan (PSP) will be developed as a commercial subdivision consisting of six (6) buildable lots. Phase 1 will consist of Tots 1 -4 with associated infrastructure. It should be noted that Lot 1 is currently planned to be developed as a gas station with a convenience market (RaceTrac). Dedication of right -of -way for construction of Public Roads #1 and #2 will also be done at Phase 1. Tract "G" will e covered by a conservation, drainage, public access and recreational easements dedicated to the City. Furthermore, approximately .72 acres of land between the relocated Maine Street and Lot 6 is currently owned by the City and will be transferred to the developer /owner. Phase 2 will consist of Lot 5 and Phase 3 will consist of development of Lot 6. As shown in the PSP, the internal road network will eventually connect to the future CRA Target Area 2 planned road network. Access into the subject site will be provided via a right/in right /out on SR 50. In addition, there will be two (2) right /in right /outs and a full access on Bluford Avenue to service the site. Along the entire length of Bluford \venue, there will be turn lanes to service the individual access driveways. The construction of relocated Maine Street shall be governed by the Maine Street Development Agreement and not by this Preliminary Subdivision Plan. Nonetheless, no building permits will be issued for any portion of the project until such time as construction of the relocated Maine Street has commenced pursuant to the Maine Street Development Agreement. The Developer is requesting one (1) waiver from the Land Development Code: The applicant is requesting a waiver from Art. VI, Sec. 6 -14, C, (4), (i), i, which requires Gas Stations, Service Stations and Commercial Convenience Stores shall utilize either gable or hip roof structures. The canopies for gas pumps shall be attached to the main building and integrated into the architectural roof design. The Proposed Standard is for the Gas Stations, Service Stations and Commercial Convenience Stores shall meet the proposed architectural standards for the development. The canopies for gas pumps are not required to be attached to the main building, if outdoor seating is provided and the building is at least 5,900 gross square feet. The Justification listed in the waiver table indicates that all architectural details in the project should be compatible with the remaining development. A requirement for attached canopies is unnecessary restrictive as long as it meets the architectural standards. Issue: Should the Honorable Mayor and City Commissioners approve the Preliminary Subdivision Plan for Ocoee Town Center? Development Review Committee Recommendation: The Development Review Committee (DRC) met on July 5, 2011 and reviewed the Ocoee Town Center Preliminary Subdivision Plan. The applicant was notified on the last remaining staff comments. All of the issues were discussed and changes to the plans were agreed upon. The applicant was also notified that all comments need to be resolved prior to the item being scheduled for City Commission action. When the discussion was finished, the Committee voted unanimously to recommend approval of the Ocoee Town Center Preliminary Subdivision Plan, subject to making the changes agreed upon at the DRC meeting before the City Commission meeting. Planning & Zoning Commission Recommendation: The Planning and Zoning Commission reviewed the Ocoee Town Center Preliminary Subdivision Plan on August 9, 2011. City staff gave a brief overview of the CRA Target Area 2 and how it relates to this commercial subdivision. In addition, staff presented a brief overview of the Preliminary Subdivision Plan for Ocoee Town Center. Staff and the Applicant answered several questions regarding the proposed project including: tree preservation, tree replacement, drainage, recreational trail, utilities along SR 50, Wekiva Study Area regulations, and the Maine Street existing brick road. All of these questions were addressed adequately in the P &Z meeting. There was no one from the public to speak regarding this proposal. The P &Z Commission raised two overall concerns relating to the Preliminary Subdivision Plan. Vice - Chairman Golden believed that further emphasis on preserving existing trees should be warranted for this area. Additionally, he asked if a specific tree ( #1378) could be saved. The applicant agreed to see if the tree in question can be saved. Member McKey added that he would like staff and the developer to work together to preserve as many trees as possible. Finally, Chairman Campbell was not necessarily in favor of the development of a :aceTrac in Lot 1 and wish the CRA would have found something more appropriate than a gas station. After finishing its deliberations, the Planning & Zoning Commission voted to recommend approval (5 -2) of the Preliminary Subdivision Plan for Ocoee Town Center, subject to resolving the last remaining staff comments before the Ocoee City Commission meeting. "'Subsequent to the P &Z Commission meeting, the applicant/owner has resolved all outstanding Staff comments. It should be noted that the tree in question was determined by the project's Landscape Architect as unable to be saved because it is too close to the planned roadway retaining wall. Staff Recommendation: Based on the recommendation of the DRC and Planning & Zoning Commission, Staff recommends that the Mayor and City Commissioners approve the Preliminary Subdivision Plan for Ocoee Town Center.
