HomeMy WebLinkAbout07-26-2011 Minutes MINUTES OF THE CITY OF OCOEE CODE ENFORCEMENT BOARD MEETING JULY 26, 2011 CALL TO ORDER Chairman Godek called the regular meeting of the Ocoee Code Enforcement Board to order at 7:01 p.m. in the Commission Chambers at City Hall. Member Hopper led the Invocation and Member Kelley led the Pledge of Allegiance to the Flag. The roll was called and a quorum was declared present. PRESENT: Chairman Godek, Vice -Chair M. Godek, Members Hopper, Kelley, Lowery, and Osborne. Also present were Code Enforcement Officers Delgado, Loeffler, Rodriguez, Siegrist, Administrative Assistant Ballard, Attorney Sneed, and Recording Clerk Stella McLeod. ABSENT: Members Amey and Lowery and Alternate Members Blynder and Sais were absent excused. GUESTS: None. Administrative Assistant Ballard administered the oath to the Code Enforcement Officers, Fire Inspector, and anyone intending to speak regarding a case. Page 2 of 16 Code Enforcement Board Minutes July 26, 2011 The case was presented and history given by Officer Delgado. Exhibits given (photos). There is no permit for the garage. The property is not in compliance. Mr. Richard Wilson, 23 Cockles Key Drive, spoke for this case. He explained the instruction that he was given which was to contact the building department. He applied for a permit but was unable to get one because the structure in question is too close to the house. Mr. Wilson is asking for more time to comply. He says that he believes that he should be grandfathered in since the original building is 32 years old. Mr. Wilson is disabled. Chairman Godek remarked that he was notified two months ago. He asked Mr. Wilson how much time he needs. Mr. Wilson replied that he needs two months. Member Hopper asked what is in violation. Officer Delgado replied that the garage is in violation. After further discussion, Member Hopper clarified that Mr. Wilson did not know that he needed a permit to put siding on. Mr. Wilson said that is correct. Member Hopper asked how much time Mr. Wilson would need. Mr. Wilson said that three months would be best. Member Kelley, seconded by Member Hopper, moved that in Case # 11 -109 the respondent be found in violation as cited as of May 16, 2011, and be given until October 25, 2011 to come into compliance or be fined $100 per day for every day thereafter. Electrical receptacle for range is hazardous exposed wiring and needs to be secured to structure. Electrical service is dangerous, install new single service. Permits required for electrical, plumbing and building. Have a licensed electrical, plumbing, and building contractor obtain permit(s) and coordinate with city to bring electrical service and equipment, all plumbing and building to code. Toilet needs to be properly installed to a secure solid floor. Toilet held up by wood block under trailer and draining on ground. Bathroom floors rotted; floors and walls need to be structurally sound and attached to each other. Holes behind the stove, holes under kitchen cabinet by sink, holes in walls, and floors around a/c window units need to be repaired weathertight and rodent free. Kitchen sink drains to ground not connected to sewer system. Wall panels loose throughout trailer. Washer waste drain not connected to waste septic system. Front and rear steps are unsafe, rotted wood need to be secured and have secured rails. Miscellaneous trash and debris throughout the property. Due to major violations on property tenant was required to vacate the property. Trap not installed under kitchen sink. Old washer waste drain not connected to waste septic system needs to be removed and old fitting capped off. Other plumbing items too numerous to list. Plumbing needs completely repaired both inside and outside of residence to meet 2007 FI. Plumbing Code. Electrical service is dangerous, install new single service or repair existing service to safety minimums per National Electrical Code 2008. Rotted floors and walls throughout need to be repaired /replaced to make structurally sound and attached to each other in a way which meets 2007 FI. Existing Building Code. Front and rear step and steps with landing are not safe, replace or repair. All structural repairs per 2007 Florida Existing Building Code. Finish interior walls of closet. Support piers and tiedowns not per FDOT requirements. Skirting to be removed for inspecting plumbing, piers, tiedowns and support then replace after rough inspection for finals. Property was placard for unsafe living conditions. Tenant was required to vacate the property due to unsafe conditions. Officer Delgado presented the case and gave its history. Exhibits presented (document). As of today the property is non - compliant with the exception of the previous violation 301.3. The respondent has obtained a plumbing permit. Ms. Betty Gourm was asked if she wanted to speak. She deferred to Mr. Scott Bean to speak for the case. Mr. Scott Bean, 167 Silver Star Drive, the maintenance man for the Dean Harper, Inc., explained the circumstances that caused the property to be in its current condition. After giving testimony concerning other properties, the board directed Mr. Bean that the matter for the discussion is the case before the board at this time. Mr. Bean said that he thought that he was here to discuss a different set of violations. He began to give testimony about the current case including the fact that much of the damage was caused by a tenant of the property. Member Hopper asked Officer Delgado how many violations there were. She replied that there are twenty violations. Member Hopper asked what he needed from the City in order to get the violations resolved. He said that he was not in a position to give the board a completion date. Member Hopper replied that the board is able to do just that. Officer Delgado said that she wants to leave the violation of 301.3 (connection to the sanitary drainage) wants to leave it in since it ties to the electrical issue. This brings the total violations to twenty -one (21). After further discussion, the chairman solicited the board a motion. Member Kelley, seconded by Member Hopper, moved that in Case #11 -120 the respondent be ound in violation as cited as o Ma 26 2011 and be .iven until September 1 2011 to comply or be fined $50 /day, per violation for each day the violations remain not in compliance. Officer Delgado presented the case and gave its history. Exhibits presented (documents). As of today the property is not in compliance. Officer Delgado said that the matter had come before the board with Prestige Plumbing, but the board dismissed the case against the plumber after it was determined that the contractor had nothing to do with the work itself, but rather with the solar system. Mr. Jerry Boettcher, 1406 Wanda Street, said that permits were paid for but the work was not done, and that he was hoodwinked. Member Hopper asked Mr. Boettcher if he paid for a permit. Officer Delgado clarified that apparently the problem is that Mr. Boettcher was under the impression that the contractor, A and T, had pulled the permit. Member Osborne asked what the problem was with getting the permit now. Mr. Boettcher replied that he did not understand why he should have to pay twice for the permit. Vice -Chair M. Godek said that Mr. Boettcher was under the impression that, after paying the contractor, the permit would be pulled. The vice - chairman continued by stating that Mr. Boettcher could not come and pull the permit himself, hence he relied on the contractor. Vice -Chair M. Godek continued that Mr. Boettcher needs to get the plumber here who can pull the permit given that he is licensed. Member Hopper asked if there was any reply from the contractor. Officer Delgado said no. Board Attorney Sneed asked if there was constructive service on A and T. Officer Delgado replied that there was, but no reply has been received. Member Hopper informed Mr. Boettcher that, unfortunately, he will have to go through the expense of having a permit pulled again. Member Hopper, seconded by Vice -Chair M. Godek, moved that in Case #11 -121, the respondents be found in violation as cited as of May 22, 2011, and be given until September 6, 2011, to comply or be fined $25 /day, per violation. The motion carried unanimously. Member Hopper asked Officer Delgado to stay in touch with the respondents so that they do not get lost [in the process]. Officer Delgado agreed to do so. Case No. 11 -157 — Wingate Rentals, Inc., LLC; A -1 Drill Tech, Inc. 670 S. Page 5of16 Code Enforcement Board Minutes July 26, 2011 Officer Delgado presented the case and gave its history. The property is non - compliant. The fence was a requirement that would block the equipment from view. There is a fence permit in the Building Department. Member Hopper asked Officer Delgado if code enforcement had not thought it worthwhile to continue the case. Officer Delgado said that she needed to get direction from the board given the time lapse regarding the case. Mr. Don Wingate, 110 Americana Court, Winter Garden, explained the delay in resolving this matter. The past Friday he met with Officer Delgado and Bruce Dunford (building department). They determined that putting the equipment behind a fence would resolve the matter. He is awaiting a response from the building staff regarding the permit submitted. Mr. Wingate said that after obtaining the fence permit, it should take a couple of weeks to get the project done. Mr. Wingate sought clarification regarding the violation concerning his vehicle with his business information on it. He said that he feels that code enforcement is going after what a previous tenant used to do which was to park a large truck on the property which showed the name of the tenant's business and contact information on the outside of the truck. Officer Delgado said that if the name and contact information of the business is on the vehicle which is basically used as signage, it is not compliant with the code. Member Hopper suggested that Mr. Wingate seek clarification from the building staff regarding what is compliant regarding signs on vehicles. Member Osborne, seconded by Vice -Chair M. Godek, moved that in Case #11 -157, the respondent be found in violation as cited as of May 26, 2011, and be given until August 30, 2011, to come into compliance or be fined $100 /day, per violation. The motion carried unanimously. Member Hopper expressed concern given that the permit application is in the City's building office; hence, staff could influence the time that will be taken to comply. Chairman Godek said that there will be a board meeting before the expiration of the time the board has given the respondent. He noted that the respondent can contact the board for an extension at that meeting, if needed. He submitted exhibits (photos). As of this date, the property is not in compliance. He noted that the property is in foreclosure and a copy of the action was sent to the bank that has ownership. Ms. Phyllis Harley, 350 Jim Moran Blvd, Law Offices of Elizabeth Wellborn on behalf of the bank, spoke about the case. Ms. Harley said that the bank does not have title yet. There was a bankruptcy filed by homeowners and there was an objection to foreclosure; both of these actions have delayed the foreclosure process. There is also one judge rather than two who is hearing the foreclosure cases. She requested a ninety -day extension. Officer Loeffler suggested abating the property. Member Hopper, seconded by Vice -Chair M. Godek, moved that in Case #11 -170, the respondents be found in violation as of June 30, 2011, and be given until July 29, 2011 to comply. A fine of $50 /day, per violation will be established after the July 29, 2011. The City is authorized to abate the property as soon as possible because the property is a public nuisance. The cost of abatement will be assigned to the respondent. The motion carried unanimously. Omar Riley, 1826 Orchard Park Drive, explained that they had intended to move, but did not. They have since moved back into the home and corrected the violation. Officer Loeffler said that the board could find the respondents in violation and that he could do a re- inspection of the property tomorrow. Member Kelley, seconded by Member Hopper, moved that in Case #11 -174 the respondents be found in violation as cited as of June 28, 2011 and be given until August 1, 2011, to comply or be fined $50 /day thereafter. The motion carried unanimously. Case No. 11 -111— James W. Page 7 of 16 Code Enforcement Board Minutes July 26, 2011 Officer Rodriguez presented the case and gave its history. The property is in compliance. Mr. James Hill, 9084 Floribunda, Orlando, FL, gave testimony for the case. He said that he is a boat mechanic who moved to Orlando. Mr. Hill owned a boat as a resident of Orlando, but the City of Ocoee annexed his neighborhood into Ocoee. He cannot have a boat according to Ocoee's code. He asked if there was any way that he can have a boat. Member Hopper said that Mr. Hill can call the City of Ocoee staff and have them advise him as to where he can park his boat. Further discussion ensued. Vice -Chair M. Godek, seconded by Member Osborne, moved that in Case# 11 -111 that the respondent be found in violation as cited as of May 12, 2011, and in compliance as of July 26, 2011, and that no fine be assessed at this time. The motion carried unanimously. Officer Delgado presented the case and gave its history. Exhibits were presented (photos). This is a repeat violation. The property is not in compliance. Member Hopper said that the respondents need a permit. Officer Delgado agreed. She also said that they need a grand opening, but they would need to go to the building department to obtain one. Vice -Chair M. Godek said that they have already had a grand opening according to the paperwork. Officer Delgado responded that the ordinance does give a citizen four grand opening per year as long as certain requirements are met. Shawndell Thomas and Gary Kisson, 751 Roper Parkway, appeared to speak about the case before the board. Ms. Thomas asked for Officer Siegrist to be present as well. She explained that the business started at 667 Roper Parkway and grew to expand into 751 Roper Parkway. She thought that she had permission to have signs. As she gave testimony, Ms. Thomas stated that she felt that she was being harassed because similar signs of other businesses were not being removed. Member Hopper said that she needs a permit regardless of other signs and that maybe the other sign owners had a permit. Board Attorney Mary Sneed said that if she sees other violations, she is welcomed to make a complaint to code enforcement. Officer Delgado said that all the respondent needs to do is contact her if she sees violations. The attorney continued that other property in the city is not relevant; it is her property that is before the board tonight. Member Hopper asked if the respondent had gotten a permit. Member Hopper said that no matter what anyone else does, she needs to comply with the ordinance, Member Hopper asked if the signs of the respondent are still up. Officer Delgado answered that the signs are still up. Vice -Chair M. Godek, seconded by Member Kelley, moved that in Case #11 -140 the respondents be found in violation as of May10, 2011, as a repeat violator. They will give them until August 5, 2011, to come into compliance or be fined $100 /day, per violation thereafter. The motion carried unanimously. Vice -Chair M. Mr. Mike Rappaport, 6805 Green Haran Drive, spoke about the case. He said that a release of lien should be granted. Chairman Godek reminded him that the lien was on the property when he purchased it. Mr. Rappaport agreed. The chairman informed Mr. Rappaport that the board only makes a recommendation to the City Commission. Chairman Godek explained to the respondent that there were administrative costs incurred from the case. Board Attorney Sneed termed it as prosecution costs. Vice -Chair M. Godek, seconded by Member Osborne, moved in Case #09 -005 to recommend that the fine be reduced from $19, 950.00 to $569.33 and that the lien be removed. The motion carried unanimously. Member Osborne, seconded by Member Kelley, moved to re -hear Case #09 -162 for possible reduction offine and lien. The motion carried unanimously.
