HomeMy WebLinkAbout10-25-2011 Minutes CODE ENFORCEMENT BOARD MINUTES OCTOBER 25, 2011 CALL TO ORDER Chairman Godek called the regular meeting of the Ocoee Code Enforcement Board to order at 6:56 p.m. in the Commission Chambers at City Hall. Member Lowery led the invocation and Alt. Member Blynder led the Pledge of Allegiance to the Flag. The roll was called and a quorum was declared present. PRESENT: Chairman Godek, Members Amey, Hopper, Kelley, Lowery, Osborne, and Alt. Member Blynder. Also present was Assistant to the City Manager / Code Enforcement Manager Doug Gaines, Administrative Assistant Bridgett Ballard, Board Attorney Mary Sneed, and Recording Clerk Stella McLeod. ABSENT: Vice -Chair M. Godek and Alt. Member Sais were absent excused. GUESTS: None. Administrative Assistant Ballard administered the oath to the Code Enforcement Officers, Fire Inspector, and anyone intending to speak regarding a case. CONSENT AGENDA ALL MATTERS LISTED UNDER THE CONSENT AGENDA ARE CONSIDERED TO BE ROUTINE BY THE CODE ENFORCEMENT BOARD AND WILL BE ACTED UPON BY ONE MOTION. THERE WILL BE NO SEPARATE DISCUSSION OF THESE ITEMS UNLESS DISCUSSION IS DESIRED BY A MEMBER OF THE BOARD, IN WHICH CASE THE CHAIRMAN WILL INSTRUCT THE BOARD CLERK TO REMOVE THE ITEM FROM THE CONSENT AGENDA AND SUCH ITEM WILL BE CONSIDERED SEPARATELY. Wilson, Jr. Life Estate / REM: Joel David Buckley 23 Cokles Key Drive Officer Delgado Violation Cited: 51- 13,115 -3 05 -02 -11 NOV Re- Inspection Date: 05 -31 -11 05 -19 -11 SOV 05 -19 -11 NOH Meeting Date: 07 -26 -11 05 -19 -11 ROCS SENT BY Regular and certified mail 07 -26 -11 CO Found in violation as of 05- 16 -11, to be in compliance by 10- 25 -11, or be fined $100.00 per day, per violation Observation: Garage / shop and temporary structure without required permits, plans, approval and inspections. Respondent(s) must obtain required permit(s) from City of Ocoee Building Division, as well as acquire any other required items as determined by the permitting and review process. Code Enforcement Manager Doug Gaines presented the case. The property was found in violation as of May 16, 2011, with the respondent(s) having been given until October 25, 2011, to comply. As of the meeting, the property was not in compliance. During the discussion phase of the motion, Member Kelley asked how many violations were still in effect. Manager Gaines replied that it was 51 -13 that was still in effect. Violation 115 -3 should not have been listed on the case this evening, he said. Page 2 Member Osborne, seconded by Member Lowery, moved that in Case #11 -109 the fine be imposed as of October 26, 2011. The motion carried unanimously. Case No. 11 -207 — Maricella Cook 1 Sundial Key Drive Officer Delgado Violation Cited: 168- 4A.(16), Article VIII Q 08 -03 -11 NOV Re- Inspection Date: 07 -28 -11 08 -18 -11 SOV 08 -18 -11 NOH Meeting Date: 08 -23 -11 08 -18 -11 DOCS SENT BY Reg. & certified mail 09 -27 -11 POP 10 -12 -11 CO Found in violation as of 08- 07 -11. Must comply by 10- 07 -11, or pay a fine of $100 per day, per violation. Observation: Vehicle(s) routinely parked / stored in the front yard. Holiday lights hanging around house border. Manager Gaines presented the case which came into compliance eight (8) days after the compliance date. A citizen complaint precipitated the code investigation and subsequent citation. Member Lowery, seconded by Member Amey, moved that in Case #11 -207 the respondent be found in compliance as of October 17, 2011, and that no fine be assessed. The motion carried unanimously. Case No. 11 -209 — Herbert Cole 4 Sunset Key Court Officer Delgado Violation Cited: 51 -13, 115 -3 08 -05 -11 NOV Re- Inspection Date: 08 -11 -11 08 -18 -11 SOV 08 -18 -11 NOH Meeting Date: 09 -27 -11 08 -18 -11 DOCS SENT BY Reg. & certified mail 09 -27 -11 CO Found in violation as of 08- 11 -11. Must comply by 10 -14 -11 or pay a fine of $150 per day, per violation. 10 -17 -11 ANC Observation: Demolition of mobile home without required permits, plans, approval and inspections. Miscellaneous junk / debris was also on the property from demolition of mobile home. Manager Gaines presented the case which came into compliance one (1) day after the compliance date which could carry a fine totaling $300 [$150 (fine previously assessed by the board) x 2 (the two violations)]. Page 3 Member Kelley, seconded by Member Arne), moved that in Case #11 -209 the respondent be found in compliance as of October 15, 2011, and that no fine be assessed. The motion carried unanimously. December 2011 Meeting Manager Gaines asked the board about whether or not there would be a December meeting. The board agreed to continue its custom of not meeting in the month of December.
