ACTING AS THE LOCAL PLANNING AGENCY
MEETING HELD TUESDAY, NOVEMBER 8, 2011
CALL TO ORDER
Chairman Campbell called the meeting to order at 7:00 p.m. Following a moment of
silent meditation and the Pledge of Allegiance to the Flag, a quorum was declared
present.
PRESENT: Chairman Campbell, Member McKey, Member Sills, Member Morris and
Member West. Also present were City Planner Rumer, Principal Planner
Fabre, Planner I Jones, City Attorney Rosenthal and Recording Clerk T.
Williams
ABSENT: Member Dillard (NE) and Member de la Portilla (A/E)
CONSENT AGENDA
Minutes of the Planning and Zoning Commission Meeting held on Tuesday, September
13, 2011.
Member Sills seconded by Member West, moved to accept the minutes of the
September 13, 2011, Planning and Zoning Commission meeting. Motion carried
unanimously.
OCOEE TOWN CENTER PHASE 1 FINAL SUBDIVISION PLAN
Member McKey inquired about the use of stucco on this project and if there had been
any variation to the Land Development Code. Principal Planner Fabre stated these
are the final site plans and staff did not see a challenge with the use of stucco on this
project as it will be used for a three foot garden wall. City Planner Rumer reminded the
board that it was listed on their Preliminary Site Plan and has been used in that area for
other projects.
Member West seconded by Member Morris, moved to approve the Ocoee Town
Center Phase 1 Final Subdivision Plan for recommendation to the City
Commission for approval. Motion carried unanimously.

NEW BUSINESS
MARTINEZ (9051 A.D. MIMs ROAD)
Principal Planner Fabre detailed the location and gave a description of the property,
stating the annexation and rezoning was requested by the applicant so that they can
receive water and other city services.

Member McKev seconded by Chairman Campbell, moved to approve the
annexation and rezoning for Martinez Property (9051 AD Mims Road) for
recommendation to the City Commission for approval. Motion carried
unanimously.
Chairman Campbell inquired of City Attorney Rosenthal if the Planning and Zoning
Commission had to review the next three items separately. City Attorney Rosenthal
stated they must be done separately as individual public hearings however, the
commission can do a combined staff report.
CAMPFIELD (524 3 STREET)
PLANNER 1 JONES detailed the location and gave a description of the property, stating
the annexation and rezoning was requested by the applicant so that they can receive
utility and other city services.
LUNA (520 3 STREET)
PLANNER 1 JONES detailed the location and gave a description of the property, stating
the annexation and rezoning was requested by the applicant so that they can receive
utility and other city services.
MEDINA (521 2 ND STREET)
PLANNER 1 JONES detailed the location and gave a description of the property, stating
the annexation and rezoning was requested by the applicant so that they can receive
utility and other city services.
City Planner Rumer stated the reason for these annexations is because they are
receiving city utility services but are not part of the city boundaries. The city is offering
them annexations or there utility services will be discontinued. Member Morris inquired
if all three of the properties are currently receiving city utility services. City Planner
Rumer stated they are and were given a year to decide to annex. City Attorney
Rosenthal stated there was a policy adopted by the city commission several years ago
setting forth criteria for receipt of utility services from the city; a property is required to
annex into the city unless the city declines the annexation; at which time they will still
be entitled to receive utility services from the city. Member Sills inquired of the other

properties in the area that should also be reviewed for annexation. City Planner Rumer
stated there are other properties currently under review which have been issued intent
to annex agreements and will be annexing when they are eligible by state law. Member
Sills inquired if this will be done for the properties not receiving city services. City
Planner Rumer stated if they are not receiving city services they cannot be forced to
annex.

Member McKev seconded by Member West, moved to approve the annexation
and rezoning for Campfield (524 3 Street) for recommendation to the City
Commission for approval. Motion carried unanimously.

Public Hearing - Closed
Chairman Campbell seconded by Member McKev, moved to approve the
annexation and rezoning for Luna (520 3 Street) for recommendation to the City
Commission for approval. Motion carried unanimously.

Medina (521 2 Street)
Public Hearing - Closed
Member Morris seconded by Member McKev, moved to approve the annexation
and rezoning for Medina (521 2" Street) for recommendation to the City
Commission for approval. Motion carried unanimously.
CAPITAL IMPROVEMENTS ELEMENT
City Planner Rumer explained why the item was being addressed and identified key
changes to the CIE. This item particularly addresses text changes and modifications to
the capital improvements inside the CIE.

Chairman Campbell inquired if the planning and zoning commission will be updated
regularly. City Planner Rumer responded yes.
Member McKev, seconded by Member Dillard, moved to approve, for
recommendation to the City Commission, the amendment and text language to
the Capital Improvement Element. Motion carried unanimously.
MISCELLANEOUS
City Planner Rumer gave the board an update on the business community meeting
workshop.
Chairman Campbell inquired about the resignation of Vice - Chairman Golden. City
Planner Rumer stated his resignation was received and there are currently two open
positions on the board.
Chairman Campbell thanked City Attorney Rosenthal on behalf of the Planning and
Zoning Commission for his hard work and dedication; wishing him the best of luck in his
retirement. Member West and Member Sills echoed Chairman Campbell's remarks to
City Attorney Rosenthal.
City Planner Rumer stated there will not be another meeting until January at which time
several projects will be breaking ground: Arden Park South, Ingram Estates, Lexington
Park and construction on Maine Street will begin.
