Background Summary:
Traditionally, the City of Ocoee has not been involved in the operation of the City Cemetery on East
Geneva Street in that the City does not provide services such as opening and closing graves. (Staff
does identify grave sites at the time of need and permit monument installation.) During a review of local
cemetery practices conducted as part of the process that led to the decision to construct a columbarium
at the Cemetery, it was discovered that Ocoee is the only Central Florida city that does not provide
consumer services related to its cemetery.
Following further discussion, the City decided to undertake a stronger role in operation of the City
Cemetery using contractor services managed by City staff. Under City direction, the selected contractor
would provide services to the funeral industry and the general public related to interments and
inurnments at the Cemetery. The purchasing of materials, such as vaults, caskets, and monuments,
would continue to be outside the scope of City operations. The City issued a Request for Proposals
(RFP) to solicit offers from qualified companies to provide cemetery services as a contractor to the City.
A single response from Quality Vaults and Monuments, Inc. (Ocoee, FL) was received. The five
assigned City staff members serving as a review committee examined the proposal submitted and found
that the offer met the requirements of the RFP.
Issue:
Should the City Commission award a term contract for cemetery services to Quality Vaults and
Monuments, Inc.?
Recommendations
The review committee unanimously voted to recommend the City Commission award a term contract for
cemetery services to Quality Vaults and Monuments, Inc. Staff additionally recommends that the City
Manager be authorized to establish a price schedule and other elements of a final contract for services
through negotiation with the contractor.

Financial Impact:
There is no direct cost to the City under the proposed contract. The delivery of cemetery services
requires only cash flow management. All services are paid by the consumer or funeral home at the time
they are rendered. Payment to the service contractor will be made on a monthly basis. The contract
establishes a price schedule of costs to the City that will be used to construct a consumer price schedule
to be brought before the City Commission at a later date. The consumer price schedule will be
structured so as to cover the costs of contractor services and City staff time and to recognize the value of
City assets; a sample is attached. Note that some listed services, such as reserving a columbarium
niche, are rendered only by City staff and do not involve the contractor.

SCOPE OF WORK
RFP #12 -006 INTERMENT & INURNMENT SERVICES TERM CONTRACT
DESCRIPTION OF WORK
This solicitation is for qualified contractors to provide interment and inurnment services at the
City Cemetery on East Geneva Street. The City intends to award contracts to one or more
qualified contractors based on proposed pricing and terms of service, ability of contractor to
perform the required work, satisfaction of required insurance, proximity of the contractors office
to the City Cemetery, and a successful reference check. Contractor(s) selected by the City will
provide services to the City on an as- needed basis; there is no guaranteed minimum dollar
amount. The City has not previously been involved in the interment or inurnment process at the
City Cemetery and is presently constructing the first columbarium for cremated remains.
The scope of work to be performed under task orders issued under this contract may consist of,
but will not necessarily be limited to, the types of work indicated in Exhibit B. The following
terms govern the work.
The main function expected of the Contractor is to open and close graves; i.e., interment.
Opening and closing a grave typically will require the Contractor to:
• Transport the necessary equipment, personnel, and supplies to the grave site
designated by City staff;
• Excavate the grave to the dimensions required (minimum depth below grade of 12
inches with horizontal dimensions sufficient for the vault to be used);
• Properly store any excess material needed to close the grave and cover it with an
artificial turf blanket;
• Remove any excess material not needed to close the grave to a location within the
cemetery for material storage;
• Install the required vault for casket burial, as necessary;
• Erect the casket - lowering equipment;
• Prepare the site for a funeral service;
• Lower the casket into the vault following a funeral service;
• Install the vault top and seal the grave;
• Remove all casket - lowering equipment;
• Cover the vault with sufficient soil to reach the final grade level, as determined by the
site, so as to prevent water ponding on the grave site;
• Remove any remaining excess materials;
• Install sod to cover the disturbed area of the site;
• Perform any final cleanup activities; and
• Transport all equipment and personnel to the Contractor's place of business.
The process for burial of a cremation urn vault differs slightly in that the volume of soil to be
removed, stored, and replaced is significantly reduced, no separate vault is required, and the
process of lowering the urn into the grave site may not require the use of lifting equipment.
A vault will be required for all interments. The City will provide its customers with a list of
approved burial vaults, cremation urn vaults, and their sources. The selected Contractor will be

invited to supply an additional proposal for such products at a later date. The Contractor may or
may not be the vendor used to supply the vault for any specific burial and may chose not to
supply vaults at all under such an arrangement. If the client does not use the Contractor as the
vault supplier, the Contractor will be expected to coordinate the delivery with the supplier and /or
client in a professional and respectful manner that exemplifies the ideals of customer service in
the City of Ocoee.
Opening and closing a grave for interment of a casket in a vault or inurnment of a cremation urn
vault is a basic service component of all burials. In addition to this basic service, the City wants
to offer a complete funeral service set -up, which includes supplying, transporting, erecting,
breaking down, and removing:
• Three rows of four chairs (12 chairs total) with funeral chair covers;
• Carpet covering for the area of chairs, casket, and excess materials; and
• Tent large enough to cover all chairs and the casket area.
The City is presently constructing a free - standing columbarium containing 48 niches of
approximately one cubic foot each. The two -sided granite structure will have 24 niches on each
side and is located on a brick paver patio with a bench facing each niche grouping. Up to three
additional units of this type and arrangement are planned for the Cemetery, as justified by
demand. Thus, the City is also soliciting proposals for opening and closing columbarium niches
and the making and mounting of identification plaques.
Contractor services associated with inurnment procedures at the columbarium will differ from
those of a typical interment. For example, there is no need for heavy equipment and any tent
supplied will need to cover the supplied chairs and columbarium structure and also take into
account the fixed bench. However, there may be some clients who do not need the full funeral
service at the time of inurnment, as the memorial service may take place at a separate facility or
at a later time. Scheduling of inurnments may need to be coordinated with the crematory
performing the cremation process. Creation and mounting of the niche plaque is not part of the
basic service.
Any response to this RFP should include the cost of accessory items that may be required for a
particular graveside service, such as a podium, additional chairs, a larger tent, portable sound
system, folding table with cloth cover, etc. Respondents should also include add -ons or
surcharges for holiday and weekend work, late and /or early work, short notice, and other time -
or condition -based pricing elements, along with a full description of the times and conditions that
will result in imposition of those additional costs.
No specific bid form is provided in order to allow for the greatest flexibility in responding. The
following is a list of items for which the City specifically solicits price proposals, although a
Respondent need not submit a proposal for all listed items:

Price proposals should be stated in the form normally utilized by the Respondent. For example,
holiday surcharges may produce a different price for each basic and full set -up service listed
above or may be simply an additional lump sum charge or percentage increase. If necessary
for the price proposal to be well understood, the Respondent should use as many rows and
columns in the proposed price list as required for the manner of pricing.
Not every possible service or product needed for the solicited services is described in this RFP.
Each respondent is encouraged to offer additional services and products not included in the
Price Proposal Form but that may be useful to the City and /or its clients. The City expects the
Respondents to differentiate themselves by, among other things, showing how they would
provide complete services under a variety of conditions and how they could respond to needs
not explicitly included. It would be particularly useful for each Respondent to describe difficult
situations they have faced and how they were resolved.
Conditions of the Work
The area of a grave must be neat and orderly to present a comforting and professional
appearance during the period of time that visitation of the site is likely. The sensitivities of the
deceased person's family and friends are to be anticipated and respected, before, during, and
after the funeral service. It shall be the Contractor's responsibility to maintain traffic through the
cemetery at all times that it is open to the public.
To the extent practical, the grave site should be returned to its original or better condition
following the closing of the grave. Covering soil should be placed in layers of no more than 12
inches in depth, with each layer being compacted to prevent settling. The grave site must not
be mounded; all excess materials shall be removed and disposed of as part of the opening and
closing process. The original groundcover shall be restored. If a vegetative cover was existing
prior to burial, then sod acceptable to the City shall be installed after the grave is closed. If a
gravel cover was present, then new gravel matching the original shall be supplied; original
gravel should not generally be reused, as it is difficult to separate from the underlying soil during
grave opening. Any flower arrangements, monuments, curbs, and other items that must be
temporarily removed from the grave site for interment shall be returned to the grave site once
the work of groundcover restoration is completed.

Mechanical equipment will normally be used to excavate and fill grave sites; however, graves
may be dug by hand when surrounding conditions are not conducive to the use of equipment.
No tracked or skid - steered vehicles may be used in the cemetery due to the damages they
inherently produce. Any ruts or other markings left by excavation and /or delivery vehicles and
equipment must be filled and sodded or otherwise repaired so as to return the affected area to
the original condition.
Any damages to existing improvements are the responsibility of the Contractor to correct without
additional cost to the City. Any such damage shall be reported to the City's Cemetery
Superintendent, who shall indicate the nature of corrective action to be taken and the timetable
for completion of the work. Failure on the part of the Contractor to timely address property
damage may result in termination of the services contract and /or other action by the City,
including the hiring of another service provider to make repairs with the cost charged back to the
Contractor.
Task Orders and Payment
Task orders will be issued by the Cemetery Superintendent or other authorized City employee
to the selected Contractor(s) for specific services using a scope of work, which will be based on
the approved Service Price List that will be incorporated into the final Agreement. Due to the
time - critical aspect of cemetery services, the normal process of preparing a purchase order for
each purchase in advance of delivery will not be used. When the need arises for services from
the Contractor, the Superintendent or other authorized person will prepare and e-mail or fax a
brief description of the work required, information regarding the funeral home and /or other City
client requesting at -need services, a time schedule for services, a map showing the grave site
or columbarium niche for which services are to be provided, and any other information
necessary for the Contractor to complete the work.
The City may issue a blanket purchase order for a fixed amount or a monthly purchase order to
reconcile and confirm all task orders for the prior month so the Contractor can prepare the
monthly pay application. Invoicing for completed work shall be submitted to the Superintendent
or other person designated by the City for processing using the Contractor's usual invoice form
supplemented by a spreadsheet showing the number of each pay item performed or supplied
during the applicable pay period.
Respondents are specifically warned that the City may chose to itself undertake some or all of
the work described here or in the Respondent's proposal. For example, the Contractor may be
tasked with opening and closing a grave while the City provides the tent, chairs, and other
components of a full set -up. Similarly, City staff may directly provide services related to opening
and closing columbarium niches with no involvement by the Contractor. The specific tasks
assigned to the chosen Contractor may change over time.
The City does not anticipate being involved in the sale or installation of monuments or other
improvements to a grave site or burial plot, except for supplying, engraving, and mounting niche
plaques. No proposal should include an offer to provide or install grave monuments, curbs,
slabs, or mausoleums. Provision of any such services or products is an independent matter for
which the Contractor is free to make its own solicitations and arrangements; however, the
Contractor should not solicit such business at the time of need while acting for the City.
Warranty Period
The City will accept each service after an inspection of the final product. The Contractor will be
expected to warrant all work for a period of at least one (1) year. In most cases, this warranty

will apply to settlement of grave overburden. The City will perform periodic inspections of the
work and note any items that require correction. Unless a discovered defect poses a danger to
the public or may lead to further damage to the affected improvement if not corrected, the City
will normally wait to compile a list of all required corrective actions and transmit it to the
Contractor near the end of each month. The notice of required corrective action will include the
period allowed for correction, which will generally be 30 days, but may be extended in
consideration of the need to fabricate or receive necessary materials, arrange for the work to be
performed by a qualified subcontractor, and other reasonable causes. Any corrective work
provided may be subject to a warranty extension determined by the City, but in no case longer
than one year in duration from the date of correction.
Unit Prices; Annual Price Adjustment
Any contract awarded under this solicitation shall be based upon fixed labor costs and variable
material costs or such other arrangement as may be agreed to by the parties. Each price
proposal submitted should describe the specific items included in each pay item with a specified
cost, whether it is a lump sum item with many components, such as the "Basic service of
opening and closing of a grave," or a single component, such as "Additional folding chair with
funeral cover." For those services where the amount of material to be routinely used is well
known, such as the amount of sod to cover the area of a grave site, the fixed price should
include an allowance for the standard quantity of such material.
The adopted prices are subject to annual evaluations. Contractor may request a price
adjustment each year at least sixty (60) days prior to the renewal date of the Agreement. In its
request, the Contractor must provide reliable and verifiable justification for the unit cost
adjustments. The City's Superintendent, upon review of the justification, may recommend or
reject the request. Any rate escalation shall be subject to approval by the City Manager.
Working Hours and Surcharges
The list of solicited services included above has entries for holiday, weekend, and extra hour
surcharges. Unless otherwise indicated in the proposal, the City will assume that each
response is based on a normal weekday workday that starts at 8:00 am and ends at 5:00 pm,
Monday through Friday; however, the Contractor may begin or end work outside these hours for
its own convenience without imposing surcharges on the City. Holidays will be those observed
by the City of Ocoee. Short notice is anything less than 24 hours before the scheduled time of
the funeral service. Surcharges for early and late work on weekdays should be expressed as a
cost per hour incurred. Surcharges for holiday and weekend work may be expressed as a rate,
such as 50% increase above the usual price, as a fixed amount, or by use of a separate price
schedule. Hourly surcharges can only be incurred for that portion of the work meeting the
surcharge conditions. For example, if opening a grave begins at 4:00 pm and ends at 6:00 pm,
then only the hour after 5:00 pm may be subject to the late work surcharge. The Contractor
must indicate an estimated amount for any and all surcharges in its response to each task order
from the City. Subsequent claims for surcharges not included in the original authorization must
be due to extraordinary conditions and may require specific approval by the City Manager.
