MINUTES OF THE PLANNING AND ZONING COMMISSION MEETING HELD ON AUGUST 14, 2012 MINUTES OF THE PLANNING AND ZONING COMMISSION ACTING AS THE LOCAL PLANNING AGENCY MEETING HELD TUESDAY, AUGUST 14, 2012 CALL TO ORDER Chairman Campbell called the meeting to order at 6:57 p.m. Following a moment of silent meditation and the Pledge of Allegiance to the Flag, a quorum was declared present. PRESENT: Chairman Campbell, Member McKey, Member Sills, Member Dunn, Member Marcotte, Member Morris and Member West. Also present were City Planner Rumer, Principal Planner Fabre, City Attorney Cookson and Recording Clerk T. Williams ABSENT: Member(s): de la Portilla (A/E), Dillard (NE) CONSENT AGENDA Minutes of the Planning and Zoning Commission Meeting held on Tuesday, June 12, 2012. Member West seconded by Member McKey, moved to accept the minutes of the June 12, 2012, Planning and Zoning Commission meeting. Motion carried unanimously. OLD BUSINESS - none NEW BUSINESS HANCOCK - 628 E. SILVER STAR ROAD City Planner Rumer briefed the board stating the applicant is seeking potable water service via a voluntary annexation and rezoning. Staff recommends approval of this annexation and rezoning. Member Marcotte asked the qualifications for AAA zoning classification. City Planner Rumer responded 10,000 square foot lot with 35 foot rear setback. Public Hearing — Opened no comments Public Hearing — Closed DISCUSSION Member West asked the acreage size of the property. City Planner Rumer stated the total legal description acreage is 2.04. In order to sub - divide it would have to meet the subdivision requirements. Member West inquired if the applicant had any aspirations of developing a small sub - division. City Planner Rumer stated no. Planning and Zoning Commission Meeting August 14, 2012 Member Marcotte inquired how many lots in the enclave are in unincorporated Orange County. City Planner Rumer stated this property is eligible because it abuts city property on the west and across Starke Lake. Member Marcotte seconded by Member McKey, moved to approve the annexation of the Hancock property located at 628 E. Silver Star Road for recommendation to the City Commission for approval. Motion carried unanimously. Member Marcotte seconded by Member McKey, moved to approve the rezoning to R -1A of the Hancock property located at 628 E. Silver Star Road for recommendation to the City Commission for approval. Motion carried unanimously. PARK PLACE (FKA LAKE BUTLER PROFESSIONAL CAMPUS) City Planner Rumer briefed the board on the rezoning of property from C -3 commercial to commercial PUD. The property will consist of 2.5 acres of commercial retail and 11 acres of multi - family dwelling. The site is vacant with no trees; a site plan and development agreement was approved in May 2008. The city will receive a $300,000 traffic mitigation payment for the construction of a right turn lane from Maguire to Old Winter Garden Road and the city will receive $20,000 toward landscaping for Maguire Road. City Planner Rumer showed via power point a site plan of the property with lot 1 of the proposed PUD being the 242 multi - family apartments and clubhouse. The access to the PUD will be primary a right in on Maguire and Tomyn Blvd. Member McKey asked about the two outparcels and the potential of them becoming a residential combination in the future. City Planner Rumer responded that is not the intended use, but if they received the right urban design plan and a further amendment to the PUD it could be, but currently the density is set at 242. City Planner Rumer stated they did host two community meetings, they sent out letters to HOA's in the surrounding area. Member McKey asked how the apartment complex will be held accountable for landscaping and such as the surrounding homeowner associations. City Planner Rumer stated they will have a management company and the city's code enforcement officers will communicate directly with the owners as listed on the property appraiser's office. Member McKey asked what the normal parking ratio is. City Planner Rumer stated 2.25 is the normal parking ratio, in which the applicant is requesting a waiver to reduce the ratio to 2.15. Member Mckey then inquired if overflow parking was built into this space. City Planner Rumer stated overflow parking is not part of the LDC requirement. Member Marcotte inquired why Oak Forest Apartments was not called out in the market study analysis for multi - family rental community. City Planner Rumer stated the market study analysis was only for comparable housing communities. Planning and Zoning Commission Meeting August 14, 2012 Bob Koch, Architect for the project spoke in detail of the scope, design and target market. He explained how economics and the job market are key drivers. The project will be marketed to professionals that have chosen to be renters, more refined to individuals in the health care profession. The project will have a strong since of arrival via a round -about directing you to either the mercantile or multi - family residential community. The residential community will provide inside gated access, three stories, tile roofs, and garage availability. Member Marcotte asked the applicant to explain the exclusion of Oak Forest Apartments. Dorothy Watson, Attorney for the applicant explained the market study was an analysis of a high -end market and representative of the type of consumers they seek. Member Morris inquired if the garages were part of the 2.15 parking ratio. Mr. Koch stated they were and explained how the garage will increase the parking ratio. He also stated that RV's and boats will not be allowed to be stored in the parking area for the residential community. Member Marcotte shared his concern for having another multi - family rental community within the city and how it will affect the surrounding single - family homeowners if there is not enough demand for the product. Mr. Koch responded by further detailing how this product will sustain even in an economic downturn. Member McKey asked for an explanation of the landscape variation waiver. Mr. Koch explained the LDC requires a 10 ft. separation, but with the garages that is excluded. They are also requesting to exclude a sidewalk on the front of the building and bring them into the exterior courtyard. The primary pedestrian environment of this community will be at the exterior of the buildings. City Planner Rumer added that with the landscape waiver they have left space for future parking use. Public Hearing — Opened Adriano Barberi stated he currently lives in Key Isle, but recently purchased a home in Villages of Wesmere. His concerns are about a potential traffic increase on Maguire Road with the approval of this project. He spoke of the current elementary, high school and daycare facility in the area, therefore stating adding this multi - family project will cause more traffic and require expansion of Maguire Road. Chairman Campbell stated as a board they try to represent the city residents in the best manner possible without hindering the growth of the city. 3 Planning and Zoning Commission Meeting August 14, 2012 David Andrea stated he doesn't recall the HOA of Brookestone in which he is the president being invited to a community meeting. Suggest more restaurants and entertainment in the area. Public Hearing — Closed Member McKey asked for a review of the original traffic study and how the current project and population density will compare to the original proposed development. City Planner Rumer stated he does not have the traffic study with him, but does recall there will be a significant decrease in trips with the new project. Further discussion ensued about population density and the traffic study analysis. Member West proposed a motion. City Planner Rumer stated the city attorney will name some conditions of the motion. City Attorney Cookson asked what the proposed motion is. Member West stated it is for approval of rezoning from C -3 to PUD. City Attorney Cookson stated staff will condition the approval upon the satisfactory completion of the development agreement, traffic mitigation, and commencement of construction, blanket easements and any other comments of city staff dated August 8, 2012. Member Mckey inquired if City Attorney Cookson had read through the conditions sheets. City Attorney Cookson stated the majority of the conditions were left over from years ago, but he concurs with the conditions. Member West seconded by Member Sills, moved to approve the Park Place rezoning from C -3 to PUD, upon satisfactory completion of staff recommendations for recommendation to the City Commission for approval. Motion carried unanimously. MISCELLANEOUS Project Status Update City Planner Rumer stated they have seen an increase in the pre - application process and currently in the process of finalizing some smaller developments. Keller, District 4 STAFF REPORT DATE:September 11, 2012 TO:The Planning and Zoning Commission FROM:Michael Rumer, City Planner SUBJECT: Raynor Shine Recycling Solutions, LLC Preliminary / Final Site Plan Project # LS- 2012 -001 ISSUE: Should the Planning & Zoning Commission recommend approval of the Preliminary / Final Site Plan for Raynor Shine Recycling Solutions, LLC? BACKGROUND: The proposed site is approximately 9.85 acres in size and is located on the west side of Ocoee - Apopka Road, across from the West Orange Girls Club. The future land use designation is Light Industrial with an 1 -1 (light industrial) zoning designation. The applicant is proposing a yard waste and land clearing debris recycling facility on the site. A Development Agreement was approved by the City Commission on November 18, 2003, which provides conditions for the development of the subject property. The owner /applicant intends to keep the option for developing the West RV and Boat Storage site should the proposed temporary use not continue after the contract period. On October 6, 2010, the site received Small Scale Site plan approval for five (5) years for the recycling of green waste with a limit of 200 cubic yards of recycled waste stored on -site. The Planning and Zoning Commission September 11, 2012 Page 2 of 3 DISCUSSION: The Preliminary / Final Site Plan proposes a wood and yard waste recycling facility. The proposed operation will occupy ± 9 acres of land. Raynor Shine Recycling Solutions, LLC RSRS) will accept yard waste and land clearing debris (green waste). The green waste will be ground and screened into a sellable product. Finished products will be used in landscaping materials such as wood chips, colored mulches and bark products. The green waste will consist of vegetative matter resulting from landscape maintenance or land clearing operations, including tree and shrub trimmings, grass clippings, palm fronds, trees, soil, and tree stumps. Retail sales of the recycled products will not be made available to the public. The site does not contain any trees and limited site development will be required. The site will consist of grass, with a stabilized subgrade entrance road. Orange County has already provided a right -of -way permit for the existing entrance. The property will have one access from Ocoee Apopka Road. A landscape berm is provided along the Ocoee Apopka Road frontage. Additionally, a modular office building is used on site. A drainage ditch runs on the west side of the property and is protected with a buffer area and silt fence. The West RV and Boat Storage site plan contains several conditions of approval that the City Commission granted relief from, which only pertained to the West RV and Boat Storage site plan (see attached conditions). The applicant requests and staff is supportive of the continued waiving of the conditions. Raynor Shine Recycling Solutions, LLC (RSRS) will be required to obtain a permit from Orange County Environmental Protection for yard trash recycling. DEVELOPMENT REVIEW COMMITTEE RECOMMENDATION: The Development Review Committee (DRC) met on August 7, 2012, and reviewed the Raynor Shine Recycling Solutions Site Plan. The applicant was notified on the last remaining staff comments. All of the issues were discussed and changes to the plans were agreed upon. When the discussion was finished, the DRC voted unanimously to recommend approval of the Raynor Shine Recycling Solutions Site plan subject to staff's conditions. STAFF RECOMMENDATION: Based on the recommendation of the DRC, Staff recommends that the Planning and Zoning Commission recommend Approval of the Preliminary / Final Site Plan for Raynor Shine Recycling Solutions with conditions. Staff will provide the language to the conditions at the Planning and Zoning meeting. Correspondence and inquiries concerning the Facility should be addressed to: Raynor Shine Recycling Solutions, LLC 103 Donnington Court Longwood, Florida 32779 Phone: (407) 595 -5332 Fax: 407) 641 -8088 2.0 SITE DESCRIPTION The location of the subject facility is shown on Figure 1 (Site Location Map) and Figure 2 (Site Plan). The site consists of approximately ±10 acres within the City of Ocoee and is accessed from Ocoee Apopka Road. The facility has one paved entrance constructed with recycled asphalt, with a sign and locking gate present at the entrance. Operational hours, disposal fees, and emergency contact information will be posted on the sign. A wooden fence is present along the northern property boundary, while a wire fence is present along the western boundary. An office /ticket house structure and a barn are present at the facility. The yard waste processing area will be located in the western central portion of the facility. An eight -foot high berm is present along the northern, eastern, and southern property boundaries. A drainage ditch is present along the southern and western property boundaries (see Figure 2). 3.0 OPERATING HOURS The standard hours of operation are as follows: Day Hours of Operati Monday- Friday 7:00 A.M. - 5:00 P.M. Upon Orange County and City of Ocoee approval, RSRS ma tend operating urs in the event of a hurricane to operate 24 hours a day, seven days a week to ive process yard waste resulting from hurricane or storm damage. Operations and Maintenance Plan Raynor Shine Recycling Solutions, LLC Page 1 April 2011 4.0 SCHEDULE OF FEES The proposed fee for dump trucks is $3.00 /cubic yard for wood waste and $5.00 /cubic yard for vegetative waste such as palm fronds. Incoming trucks are charged a flat rate per cubic yard, no weight scales are used at the facility; however, they may be used in the future. 5.0 PRIMARY HAUL ROUTE The facility can be accessed from State Road 50 (a.k.a. West Colonial Drive) by driving north on Maguire Road which ultimately changes name to Ocoee Apopka Road (a.k.a State Road 437). The facility can also be accessed from State Road 429 (a.k.a Daniel Webster Western Beltway) to east on Franklin Street (State Road 438) to north on Ocoee Apopka Road (see Figure 3). Access to the facility is via the entrance gate in the fence and paved apron located along Ocoee Apopka Road. Truck flow traffic within the confines of the facility is shown on the Site Plan (Figure 2). Truck staging prior to facility opening will be discouraged. 6.0 EFFECTIVE BARRIER 6.1 Access The RSRS is surrounded along the northern and western perimeter with a wooden and wire fence respectively. A drainage ditch prohibits site access from the south and the west. In addition, an eight -foot high berm is present along the northern, eastern, and southern/southwestern sides of the property. The entrance gate is locked during closed hours. Signs indicating "No Trespassing" shall be posted at the corners of the fence and along the fence no more than 500 feet apart. The signs are at least three feet square with at least five -inch lettering. 6.2 Setbacks A 25 -foot setback will be maintained for all development along the southern and western sides of the property, where the drainage ditch is located. All structures on -site are at least 25 feet from property lines. A 50 -foot setback shall be maintained for the yard waste products from the drainage ditch. There are no potable wells within 100 feet of the facility. 6.3 Litter Control Plan Portable fences, silt fencing, other suitable devices will be used for litter control as needed. A litter policing operation will be performed to keep litter from leaving the working area of the facility. Litter outside the working area will be collected daily and placed into appropriate containers. On a weekly basis, employees will patrol Ocoee Apopka Road within one -half mile of the facility for control of litter from vehicles going to and from the facility. Operations and Maintenance Plan Raynor Shine Recycling Solutions, LLC Page 2 April 2011 7.0 RECEIPT OF YARD WASTE Yard waste, or yard trash, is defined as vegetative matter resulting from landscaping maintenance or land clearing operations and includes materials such as tree and shrub trimmings, grass clippings, palm fronds, trees and tree stumps, and associated rocks and soils as defined in Rule 62- 701.200(135), F.A.C. and Section 32 -213 of the Orange County Code. RSRS will only accept yard waste and bags used to collect yard waste. Unacceptable materials: construction & demolition (C &D) debris, Class III materials, household putrescible waste, and chromated copper arsenate (CCA)- treated wood received shall be removed from the yard waste and containerized, with all putrescible material removed within 48 hours. Further, if any of the following materials are discovered, they shall be immediately containerized and removed from the facility: treated or untreated biomedical waste, hazardous waste, or any materials containing polychlorinated biphenyl (PCB) concentrations of 50 parts per million or greater. Unacceptable waste container locations are shown on Figure 2. CCA- treated wood will be spotted and removed for appropriate off -site disposal within 30 days. Waste quality control is further discussed in Section 8.2. A CCA- treated wood management plan is de e. in ction 8.3. Any yard waste received at the f. ility shall be processed or removed within six months. The facility has a maximum storage capac ty of 10,000 cubi yards of yard waste and mulched products; however, RSRS plans to only process 200 cubic yards /day or 40,000 cubic yards /year. To be considered processed, material ust pass a 6 -inc ieve. Logs with a diameter of 6 inches or greater may be stored for up to 12 mo the before th- are processed or removed, provided the logs are separated and stored apart from o • er mat- ''als onsite. 7.1 Recycling Since RSRS accepts yard waste for recycling and processing into firewood, fines, mulch, and colored mulch, the facility has a goal of recycling 100% of the acceptable yard waste received into new products available for sale to end users (e.g. fines and mulch). 7.1.1 Colored Mulch Products Untreated mulch will be loaded into a hopper and then fed into a coloring tank, where water and dye will be applied to the mulch. The mulch is stirred to ensure an even distribution of dye. When the color process is complete, the colored mulch will be placed in separate piles to await distribution. Copies of mulch dye material safety data sheets (MSDS) are provided in Appendix 1. 8.0 YARD WASTE PROCESSING 8.1 Equipment RSRS will use the following equipment, or equivalent, to process yard waste received at the facility: Operations and Maintenance Plan Raynor Shine Recycling Solutions, LLC Page 3 April 2011 1.John Deere Loader; 2.Kobelco Excavator; 3.Morbark 1300B Tub Grinder 4.Track - mounted vibrating screen. 5.Grapple Trucks Additional information regarding these pieces of equipment is provided in Appendix 2. The yard waste processing equipment listed above has the capacity to process more than 5,000 cubic yards per day. 8.2 Waste Quality Control and Process Flow Customers with loads of yard waste are directed to the yard waste processing area where the load is dumped and inspected by a trained RSRS spotter. A process flow chart is shown on Figure 4. The trained spotter may also serve as an equipment operator and may perform some of their duties from the cab of their equipment. If the spotter or operator is located on equipment spreading waste when unauthorized waste (i.e. CCA- treated wood, putrescible waste, hazardous waste, C &D debris, or Class III materials) is discovered, the equipment operator shall either move the unauthorized waste away from the active area for placement in an appropriate container, or shall stop operation and notify another person on the ground, or another equipment operator to remove the unauthorized waste for placement in the appropriate container, before operations are resumed. RSRS spotters have the authority and responsibility to reject unauthorized loads, have unauthorized materials removed by the transporter, and/or assess appropriate surcharges for removal and disposal of the unacceptable wastes at an offsite permitted facility. If any regulated hazardous wastes are identified or discovered to be improperly deposited at the facility, the facility operator will promptly notify the FDEP, OCEPD, the person responsible for shipping the hazardous wastes to the facility, and the generator of the wastes, if known. The area where any regulated hazardous wastes are deposited will be immediately cordoned off from public access. If the generator or hauler cannot be identified, the facility operator will assure the cleanup, transportation, and disposal of the waste at a permitted hazardous waste management facility. If non - hazardous unacceptable wastes are discovered deposited at the facility or observed during unloading at the facility, the unacceptable material will be placed back in the transporter's truck for removal from the site or placed into an appropriate container, such as a roll -off container. Putrescible wastes will be removed from the site within 48 hours and non - putrescible wastes within 30 days. The facility will contract a commercial hauler to transport unacceptable wastes for disposal at a facility permitted to accept the wastes. Putrescible wastes and household hazardous wastes will be stored in covered roll -off containers, sized from eight cubic yards to 20 cubic yards. Yard waste will be temporarily stored in piles before being processed by a Morbark 1300B Tub Grinder (or similar model). Yard waste processing via the grinder and screen will result in the generation of fines (below %2 inch) and %2 inch to 2 inch diameter mulch. A separate pile for mulch and fines will be maintained. Some mulch will be processed further by adding coloring, resulting Operations and Maintenance Plan Raynor Shine Recycling Solutions, LLC Page 4 April 2011 in a third finished product pile for colored mulch. Finished product piles will be maintained before delivery to the end user. All temporary and finished product piles will be approximately 150 feet long by 100 feet wide and planned be a maximum of 17 feet high. A 25 -foot wide fire lane will be maintained around all sides of the piles. 8.3 CCA- Treated Wood Management Plan RSRS will recycle or process only clean wood. Painted, treated (preserved), or contaminated wood will not be recycled. CCA pressure treated wood will not be accepted for processing at RSRS. CCA- treated wood is defined in 62- 701.200(11) as lumber, timber, or plywood treated with chromated copper arsenate. This CCA- treated Wood Management Plan is designed to minimize the amount of CCA- treated wood that is delivered to or processed at the facility. The criteria below will be used to identify CCA- treated wood so that it may be separated from other yard waste. The RSRS spotters will make reasonable efforts to separate the following common CCA- treated wood products from the waste stream: all wastes that are wood fencing, decking, or pressure treated lumber (such as 4 "x4" posts); wood with a greenish color; and other known outdoor use wood products. The facility spotter will reject known segregated loads of CCA- treated wood wastes. Spotters or operators that identify any CCA- treated wood by the methods above, will remove the wood from the waste stream and place it into a reject waste container for proper disposal in a lined landfill. Other CCA- treated wood identification methods may be used as developed. RSRS will also follow best management practices recommended in the document Guidance for the Management and Disposal of CCA- Treated Wood, authored by the Florida Center for Solid and Hazardous Waste Management and FDEP. Excerpts from the FDEP guidance can be found in Appendix 3. In accordance with Rule 62 -701 F.A.C., CCA- treated wood shall not be incorporated into compost or made into mulch, decorative landscape chips, or any other wood product that is applied as ground cover, soil, or soil amendment. CCA- treated wood shall not be disposed of through open burning or through combustion in an air curtain incinerator. 9.0 BEST MANAGEMENT PRACTICES RSRS will operate the Yard Waste Processing Facility to control vectors and odors. During operating hours, a spotter will be present monitoring incoming loads. Measures will be taken to avoid mixing incoming yard waste with finished products ready to be used or sold for use, to discourage the re- introduction of weed seeds and pathogens. Yard waste which is not made into Operations and Maintenance Plan Raynor Shine Recycling Solutions, LLC Page 5 April 2011 compost (for onsite use only) or processed into other usable material shall be removed at least monthly from the facility. Yard waste received at the facility shall be separated and stored in a manner that prevents vector problems. A copy of Chapter 7 "Operation Considerations" from Florida Center for Solid and Hazardous Waste Management's Recycling Yard Trash: Best Management Practices Manual for Florida, May 1996 is provided as Appendix 4. 10.0 CONTINGENCY PLAN 10.1 Fire Protection and Control Fires that originate in the yard waste processing area are primarily extinguished with soil application. Soil and heavy equipment shall be available for fire suppression. Dedicated soil for suppressionoperationsisstockpiledinthevicinityoftheyardwasteprocessingarea. Supplemental fire protection is furnished by the City of Ocoee Fire Rescue (OFR). If the fire cannot be extinguished or controlled by RSRS within two hours, RSRS shall notify Ocoee Fire Rescue. Methods of fire suppression will ultimately be determined by OFR for the different types of fires that may be encountered (structure, vehicle, and facility). The various methods of suppression are as follows: Separation Soil suppression Foam (subsurface application) Copious amounts of water Specialized fire fighting equipment and materials required by OFR will be provided solely at the facility owner's expense to protect public health and environmental issues. Within five days of any emergency, the operator of the site will submit to the FDEP and OCEPD a written report of the emergency. This report will describe the origins of the emergency, the actions taken to control the emergency, the results of the action taken, and an evaluation of the success or failure of the actions. An emergency contact sign with the name and phone number of responsible persons is posted at thesiteentrancesoitisvisibletoemergencyvehicles. Radio or cell phone communications are available to employees in all operating areas of the facility and the office. Appropriate emergency notifications will be performed immediately. Instructions on fire fightingproceduresareroutinelyprovidedforsitepersonnel. Fire extinguishers in accordance with NFPA 10 are carried on equipment at all times. A minimum 25 -foot wide access fire lane will be maintained around the perimeter of the yard waste processing area, and down the center of the area. The fire lane shall accommodate fire apparatus with a minimum weight of 42 tons. As shown on Figure 2, the proposed dimensions of the yardwaste /mulch areas and raw wood area measure 150 feet long by 100 feet wide. The planned maximum height of the piles will be 17 feet. A mobile grinder will be mobilized to the yard waste area on an as- needed basis, for processing. In case of a fire within the waste pile at the facility, all reasonable efforts shall be made toisediatelyextinguishorcontrolthefire. If the fire cannot be extinguished or controlled within an ho the owner or operator shall immediately: 1.Implement the contingency plan which is included as part of this Operation Plan;2.Cease accepting yard waste for processing in those areas of the facility impacted by the fire;and 3.Notify the FDEP and OCEPD of the fire and of the fire control plan being implemented. 10.1.1 Safety Devices All operating equipment at the facility site will be fitted with protective structures and fire extinguishers. Brush fire gear is to be made available for on -site personnel. Personnel safety gear, such as hard hats, safety glasses, and steel toed shoes, are required for operational personnel. The above safety devices will be provided solely at the facility owner's expense. 10.1.2 Emergency Access In the event of an emergency, debris originally destined for the facility will be rerouted to another permitted facility site. The site access roads are currently constructed to allow passage of vehicles under all expected weather conditions. The facility entrance has been paved, providing suitable access for all emergency vehicles. Access roadways shall be 25 -foot wide and have 13'6" verticalclearance. 10.2 Fire Suppression Methods and Procedures Facility fires can start by spontaneous combustion of material under extensive heat and pressure.Sometimes though, it has been determined that some fires were started by arson or hot loads. The following sections describe some suppression methods, but do not supersede the methods used by Operations and Maintenance Plan Raynor Shine Recycling Solutions, LLC Page 7 April 2011 the responding fire department. Personnel must work together with the OFR personnel by providing heavy equipment, soil, water and logistical support during a fire or emergency. OFR command officers will be in charge of the scene upon arrival and work closely with the facility personnel to mitigate any emergency situation. Emergency operations will adhere to OFR Standard OperatingProcedures. Structural and vehicle fires will be suppressed in accordance with EmergencyOperationalGuidelines. 10.2.1 Fire and Emergency Response Personnel are expected to immediately respond to a fir or emergency, since - sponse time could be the difference between a controlled or out of control s uation. Next, OFR ill respond to ensure adequate fire control. OFR is to be notified immediatel of any fire at the fa ility property. 10.2.2 Construction of a Fire Lane The function of a fire line is to provide a barrier to contain the fire boundaries. The following procedures should be followed during line construction to contain a facility fire: Remove all ground cover and debris along the fire line; Use natural barriers, trenches, etc.; Separate burned and unburned materials; and Construct a fire line to bare soil, free of leaves, twigs, roots, disposed debris, etc. 10.2.3 Use of Heavy Earth Moving Equipment The use of heavy earth moving equipment to suppress facility fires is effective because fire line construction can be completed at a faster rate. OFR will support and protect heavy equipment operators by way of exposure lines and oversight. Caution must be taken to prevent earthmoving equipment from working alone out in front of a fire. Because they have no fire extinguishing capability other than removal of fire fuel, they can easily be overrun by a fast - moving fire. Personnel will be expected to operate the on -site heavy equipment to assist in fire suppression and separate materials immediately and suppress burning materials with soil. OFR will maintain control and have oversight of all emergency operations. 10.2.4 Water Supply and Use Water can be used to supplement on -site material to extinguish the fire. A fire hydrant is currently located across from the facility entrance on Ocoee Apopka Road. RSRS plans to extend the water line onto the subject property and install two fire hydrants onsite (see Figure 2). In addition, one irrigation supply well is proposed to be installed on the property (refer to Figure 2), that can provide up to 100 gallons per minute. Operations and Maintenance Plan Raynor Shine Recycling Solutions, LLC Page 8 April 2011 10.2.5 Personnel Safety and Fire Control Fighting fires is a dangerous activity and could cause serious injury or result in a fatality if hurried or incorrect decisions are rendered. Remember: The safety of personnel and equipment always comes first. The following standards are adopted from the U.S. Forest Service and are good rules to follow when encountering a facility fire: Keep informed of fire weather conditions and forecasts. Be aware of the weather conditions, particularly to direction and velocity of the wind. Know what your fire is doing at all times. Many small fires become large if not kept under constant observation. Base all actions on the current and expected behavior of the fire. The action taken should be determined by everything that is happening and everything that might happen. Every fire has to be approached differently because of the changing conditions encountered. Have escape routes for everyone and make them known. Identify escape routes and notify personnel where they are and what to do when they get to the safety zone. Use natural barriers as much as possible Post a lookout when there is a possible danger. A lookout observer, with communications capability, can view the "large picture" of the fire containment process and can see potential danger that may exist for those fighting the fire directly. Be alert, keep calm, think clearly, act decisively. When faced with a situation, think, know, and understand what is happening, and keep calm. Panic can injure personnel. Maintain prompt communication with personnel, supervisor and adjoining forces. Adequate communication is essential to good fire control safety. Give clear instructions and be sure they are understood. Issue concise instructions and make sure the personnel understand the directions precisely. Maintain control of personnel at all times. When issuing assignments, one consideration should be the reliability of the personnel. Other considerations will include inspection of tools and coordination of available equipment. Fight fire aggressively, but provide for safety first. Aggressive action is the key to fire suppression, but it must neither shortcut nor violate any safety rule covering a particular situation. 10.2.6 Protective Clothing One of the best ways to prevent injury during a fire is to wear gloves, goggles and protective clothing, including proper footwear. Gloves should be comfortable and the right size to prevent Operations and Maintenance Plan Raynor Shine Recycling Solutions, LLC Page 9 April 2011 abrasions and blisters. Goggles should have vents in the side and should be designed for the greatest possible field of vision. Lace -up boots are preferred, especially for uneven terrain. Heavy socksshouldbewornwithboots. 10.3 Fire Investigation When determined by OFR, fire investigation will be referred to the State Fire Marshal's Office forfurtherinvestigation. Safety of the fire department and facility personnel will be the primaryconcern. 10.4 Disposal of Burned Debris The burned debris will be isolated as much as practicable from the rest of the facility using various means, such as earthen berms, pits, transport bins, etc. Once all hot spots have cooled and the fire is fully suppressed, the remains of burned debris will be disposed of at a permitted off site facility. 10.5 Personal Injury Accidents In the event of a personal injury at the facility, the nature and extent of the injury will be assessed to the extent possible by on -site personnel, and emergency first aid techniques administered by appropriately trained personnel as necessary. If the injury appears to require professional medical attention, emergency assistance will be summoned. In all cases, the facility supervisor will benotified. 10.6 Vehicular Accidents In the event of a vehicular accident at the site, a determination will be made regarding the feasibilityofsafelymovingthevehicle(s) under their own power. If possible, the vehicles will be moved out of the way of normal traffic flow. If the vehicles cannot move under their own power and the vehicles are interrupting traffic flow, the vehicles will be pushed out of the way using on -siteequipment. The facility Site Supervisor will be notified and arrangements to have the disabled vehicles moved will be made in accordance with the directions of the facility site supervisor. 10.7 Hazardous Waste and Spills No hazardous wastes are to be accepted at the facility. RSRS spotters will be responsible for identifying suspect wastes. In the event materials of a questionable nature are unloaded before they are spotted by facility personnel, the hauler will be detained (if possible), and the facility SiteSupervisornotifiedimmediatelytodeterminetheappropriateaction. In the event the hauler has left the site, the facility site Supervisor shall be immediately notified, and if possible, the hauleridentifiedviaavailablerecords. Despite these precautions, if unauthorized hazardous waste, fuel, or oil is spilled at the site, the spill area will be immediately cordoned off from public access, bermed or absorbent material placed to Operations and Maintenance Plan Raynor Shine Recycling Solutions, LLC Page 10 April 2011 contain the spill. The facility Site Supervisor will be notified immediately in the event a spill occurs. During the operational hours of the facility, at least one person who is trained in the spill response procedures will be on -site. The following spill contingency plan will be implemented in case of a spill. A.In case of, or as soon as any spill is observed, the source of the spill will be located and actions taken to prevent further spillage, if possible. B.Divert all traffic from the spill area and keep personnel upwind to avoid any vapors. C.Valves, pumps, and electrical equipment will be shut off as appropriate. D.Potential ignition sources will be removed from and restricted from entering the area of the spill, if the material is flammable. E.A temporary dike will be constructed to contain the spill, and the area cordoned off to prevent unauthorized access. F.Absorbent socks/booms will be used where appropriate. The fire station and hazard response contacts listed in Section 10.1 will be immediately advised of the nature and location of the spill. G.All absorbed material or contained liquid will be removed and packaged in Florida Department of Transportation (FDOT) approved containers. Used absorbent materials should be packaged separately from liquids. H.All containers used for the disposal of spill response debris will be labeled with the type of waste and the start date of accumulation and disposed in accordance with federal and state environmental regulations. I.Notify the FDEP and the OCEPD within 24 hours of the spill, and management of suspect hazardous wastes within five days of detection. J.Identify the person responsible for shipping the wastes to RSRS, if known. K.Assure the cleanup, transportation, and disposal of the waste at a permitted hazardous waste or petroleum management facility. 10.8 Hot Loads Any hot material which is found, will be deposited on an area away from the yard waste processing area. The load will immediately be covered with soil if a fire is imminent. The fire department will be called if significant open flames are observed. Operations and Maintenance Plan Raynor Shine Recycling Solutions, LLC Page 11 April 2011 10.9 Equipment Failure Sufficient backup equipment will be available for equipment breakdowns and downtime for normal routine equipment maintenance. In the case of major equipment failure the following procedureswillbeobserved. A.Arrangements with contractors and rental equipment dealers will be made to furnish equipment on a short -term basis. B.Applicable facility operations will cease until equipment capacity is retained. 11.0 STORM PRECAUTIONS At the onset of a major storm all lightweight signs and equipment will be collected and stored in a secure area. Maintenance will be performed (if necessary) to allow for yard waste processing operations to continue during inclement weather. Waste material will not be placed in any areas ofstandingwater. 11.1 Natural Disasters In the event a natural disaster occurs, the City of Ocoee, FDEP, and OCEPD will be contacted within 24 hours to agree upon any additional contingency operations required to resume operations, such as extending operation hours to meet community needs. Any additional equipment deemed necessary to perform contingency operations will be rented and additional support personnel will be temporarily assigned to the facility to operate equipment. Other contractors will be contacted, if necessary. In the event operations are restricted or modified, appropriate public notices will beissuedandroutinefacilitycustomerswillbenotifiedbytelephone. Hurricane and Storm Preparedness Guidelines are provided in Appendix 5. 12.0 RECORD KEEPING AND REPORTING Monthly records of incoming and outgoing material shall be kept on site for at least three years. The values may be in cubic yards or tonnage, but the same unit of measurement shall be used to record both incoming and outgoing material. An annual report, based on the preceding calendar year, shall summarize the monthly records and shall be submitted to the City of Ocoee, Florida Department of Environmental Protection (FDEP) and the OCEPD on Form 62- 709.901(3) with the application for registration. A copy of said form is provided as Appendix 6. 13.0 FACILITY STAFFING AND TRAINING PLAN Initially, each operator will complete at least 16 hours of training and pass an examination in a FDEP approved course. Subsequently, 16 hours of continuing training will be completed each three -yearperiod. Spotters will receive eight (8) hours of initial training and four (4) hours of continuingtrainingeachthree -year period. Employee training certificate renewal will occur prior to the Operations and Maintenance Plan Raynor Shine Recycling Solutions, LLC Page 12 April 2011 expiration date of the initial training to comply with Rule 62- 701.320(15) F.A.C. A list of approved training courses is maintained by the FDEP. A schedule of training courses available in 2011 is provided in Appendix 7. Records documenting employee training will be kept at the facility office. FDEP approved course orientation training will be performed for interim facility personnel includinginspectors, equipment operators, and spotters. These personnel will be trained to identify unauthorized wastes or potential sources of regulated hazardous wastes. The training program will emphasize familiarity with containers and labels typically used for hazardous wastes and hazardous materials. All training courses shall be approved by the FDEP in accordance with Section 403.716, F.S. and administered by an independent third party. A list and schedule of all classes to be attended by current operations and spotters is in Appendix 7. Certificates of training completion will be maintained at the facility to document proof of training, see examples in Appendix 6. A list and schedule of all classes to be attended, with a list of operators and spotters to be trained shall be maintained at the facility. The employee training plan and records documenting implementation of the plan will be kept at the facility and will be available for regulatory inspection.
