Subject: Approval of and authorization for the Finance Department to temporarily allocate Stormwater
Utility funding in the amount of $200,000 to modify an Orange County construction project at the
intersection of Clarcona -Ocoee Road and Clarke Road, pending receipt of payment by the Arden Park
developer, in order to accommodate traffic impacts of that development. (District 4 — Commissioner

Background Summary:
The City Commission approved an emergency item at its September 18, 2012 meeting authorizing the
Finance Department to issue a purchase order in the amount of $183,416.46 to DeWitt Excavating. The
purpose of the action was to authorize changes at the intersection of Clarcona -Ocoee Road and Clarke
Road. The action was deemed to be an emergency by the City Commission due to the immediate need
to carry out certain elements of the construction concurrent with other activities underway as part of an
Orange County construction project. However, the Finance Department determined that it was unable to
issue the required purchase order until such time as payment was received from the developer of the
Arden Park subdivision, which is Standard Pacific. In order to avoid the resulting delay in issuing the
purchase order and risk a substantial increase in construction costs, staff requests authority to
temporarily allocate funds from the Stormwater Utility to allow the purchase order to be issued prior to
receipt of the payment from Standard Pacific. The temporary use of funds will not impact stormwater
operations or construction projects.
Issue:
Should the City Commission authorize the Finance Department to temporarily allocate Stormwater funds
so it can issue a purchase order in the amount of $183,416.46 to DeWitt Excavating to make
modifications to the Clarcona -Ocoee Road at Clarke Road intersection?
Recommendation:
The Engineering Department recommends that the City Commission authorize the Finance Department
to temporarily allocate Stormwater funds to roadway construction so it can issue a purchase order in the
amount of $183,416.46 to DeWitt Excavating to make modifications to the Clarcona -Ocoee Road at
Clarke Road intersection. In order provide for a contingency allowance, staff recommends that $200,000
be temporarily reallocated. Under the terms of the development agreement, the limit of the available
funding from the developer is $227,565.80.

Financial Impact:
There is no long -term cost to the City for this action. The City will utilize its available, unallocated funds
in the Stormwater Utility to serve as a working capital funding mechanism and backstop for future
payment by the developer.
