ACTING AS THE LOCAL PLANNING AGENCY
MEETING HELD TUESDAY, NOVEMBER 13, 2012
CALL TO ORDER
Chairman Campbell called the meeting to order at 7:00 p.m. Following a moment of
silent meditation and the Pledge of Allegiance to the Flag, a quorum was declared
present.
PRESENT: Chairman Campbell, Members De La Portilla, Dillard, Dunn, Marcotte,
Morris, Sills, and West. Also present were City Planner Rumer, Principal
Planner Fabre, City Attorney Cookson and Recording Clerk T. Williams
•
ABSENT: Vice Chair McKey was absent excused.
CONSENT AGENDA
Minutes of the Planning and Zoning Commission Meeting held on Tuesday, September
11, 2012.
Member West, seconded by Member Sills, moved to accept the minutes of the
September 11, 2012, Planning and Zoning Commission meeting. Motion carried
unanimously.
OLD BUSINESS - none
NEW BUSINESS
WILD (216 1 ST STREET) ANNEXATION AND INITIAL ZONING
Principal Planner Fabre gave a brief overview of the proposed annexation /rezoning. The
subject parcel has one existing Single - Family Residence. The Applicant has requested
annexation into the City limits mainly for potable water connection. City staff has requested
a City of Ocoee zoning designation of R -1A (Single - Family Dwelling), which is consistent
with the zoning of the properties to the North.
Based on the analysis and the subsequent DRC recommendation, Staff recommends that
the Planning & Zoning Commission, acting as the Local Planning Agency, recommend
approval of the Annexation of the +/ -.81 acre parcel of land known as the Wild Property
with an Initial Zoning classification of "R -1A ".
DISCUSSION
Chairman Campbell inquired if the parcel was sub - dividable. Principal Planner Fabre
stated the existing house is a fairly good size and is consistent with the other homes so he
does not believe the parcel will get subdivided since the applicant has not indicated doing
so.
The Public Hearing was opened; as no one wished to speak the Public Hearing was
closed.
Member West inquired if there was a waterline running down the road. Principal Planner
Fabre advised the waterline is adjacent to the road (exhibits were shown). City Planner

Rumer advised due to contaminated wells in that area many homes have annexed in and
the utilities division was able to run a water line from the Lake Olympia sub - division to the
1 Street easement. Member West inquired if most of the properties were in Ocoee. City
Planner Rumer answered affirmatively.
Member Marcotte, seconded by Member Sills, moved to approve the annexation of
the +/ -.81 acre parcel of land known as the Wild Property. Motion carried
unanimously.
Member Marcotte, seconded by Member Sills, moved to approve the Initial Zoning
classification of "R -1A" for the parcel of land known as the Wild Property. Motion
carried unanimously.
COMPREHENSIVE PLAN AMENDMENT — CAPITAL IMPROVEMENTS ELEMENT (CIE) UPDATE
City Planner Rumer asked for this item to be cancelled. He advised with an update of
just, the table it will not require a public hearing and can instead go before the City
Commission for adoption.
The Public Hearing was opened; as no one wished to speak the Public Hearing was
closed.
17 JOINT PLANNING AREA AGREEMENT (JPA) AMENDMENT
City Planner Rumer gave a brief history of JPA and how it became established. The
proposed JPA amendments include changes to the JPA boundary, changes to Future
Land use designations of lands, and the inclusion of facsimile as an authorized form of
notification.
City Planner Rumer advised that the 17 amendment is proposing to adjust the western
boundary line to include all of the SR 429 Expressway and remove and add properties into
the JPA. Second, the JPA Future Land Use Map will be amended to change the future
land use designation from Low Density Residential (LDR) to Commercial (COM) for
properties located on the south side of West Road and west of SR 429. Third, the JPA
Future Land Use Map will be amended to change the future land use designation from
Low Density Residential (LDR) to Commercial (COM) for properties located on the
northeast corner of Roberson Road and Tomyn Blvd.
DISCUSSION
Member Dunn inquired what preceded this amendment to come before the commission.
City Planner Rumer stated this amendment was originally to be included into the 16th
amendment but due to an applicant coming forward and the road transfer agreement, it
was decided to hold off. Member Dunn asked if this amendment was proposed due to
someone wanting to buy the property and thinking if they went commercial they could do

so much more with it. City Planner Rumer explained this amendment is not a result of
potential buyers as the city was already reviewing these areas to amend the zoning.
Member Dillard inquired about the acreage of the properties included in the amendment.
City Planner Rumer said he does not recall the acreage of the land use changes but a
majority of the acres are wetlands so they are not looking at 20 acres of buildable land.

Member Dillard, seconded by Member Morris, moved to approve the proposed 17
Amendment to the Joint Planning Area Agreement including the map and text per
staff's recommendation. Motion carried unanimously.
MISCELLANEOUS
Land Development Code Amendment - Engineering Manual Update
City Planner Rumer explained the engineering standards stating that some of the
standards are outdated. Their efforts will be to create a manual which would be referenced
in the LDC, for engineers, so they will have a design standard. The policy has been vetted
by engineering firms and planning is ready to take this before the commission.
Member Campbell inquired if this will go hand in hand with their design standards. City
Planner Rumer answered affirmatively. Member Campbell inquired if a process will be
set up so this can now be updated on a bi- annual basis. City Planner Rumer said that is
their intention.
Impact Fee Reduction Extension & Suspension of Fire Plan Review Fees
City Planner Rumer stated they are quickly approaching the sunset of the impact fee
reduction. He briefly explained why and how these reductions assist the economic health
of the city. City Planner Rumer advised he is proposing to take to the commission an
extension of the impact reductions for another year. They are currently under an impact
fee study and may possibly bring back some changes. He further advised he is looking at
having the Fire Plan Review Fees reinstated.
Project Status Report
City Planner Rumer announced the following:
1) McDonalds on West Road will be starting construction.
2) Raynor Shine was approved by Ocoee City Commission and also received 5 year
permit approval from Orange County.
3) Park Place PUD was denied by the Ocoee City Commission and is currently
working with the HOA's in the surrounding areas.

4) Casa Mirella on Roberson and Maguire has applied for a building permit. It will be a
216 unit apartment building.
5) Property off of Maine Street (south of the cemetery) sold on Friday. New owner is
looking to continue the realignment of Maine Street.
Member West stated he is impressed with the design of the RaceTrac and is pleased with
the appearance thus far. City Planner Rumer stated they are looking to have an opening
date the beginning of December.
Member Morris inquired about the selling of West Oaks Mall. City Planner Rumer stated
the mall was sold on an on -line auction. The city will be meeting with the new owners on
Thursday to discuss their thoughts regarding the property.
