7:15 P.M. REGULAR CITY COMMISSION MEETING
A. CALL TO ORDER
Mayor Vandergrift called the regular session to order at 7:15 p.m. in the Commission
Chambers of City Hall. Commissioner Keller gave the invocation, followed by the Pledge of
Allegiance to the Flag, led by Commissioner Hood. City Clerk Eikenberry called roll and
declared a quorum present.
Roll Call: Commissioner Hood, Commissioner Wilsen, Mayor Vandergrift, Commissioner
Johnson, and Commissioner Keller.
Also Present: City Attorney Cookson, City Manager Frank, City Clerk Eikenberry
B. PRESENTATIONS AND PROCLAMATIONS
Presentation of 2012 Ocoee Tennis Players of the Year
Ocoee Tennis Pro Jack Vinson presented awards to female tennis player of the year Emma
Tum Suden and male tennis player of the year Brandon Carr. Mr. Vinson furthered announced
that it has been an honor to be able to be a part of this program for 14 years.
This presentation was heard after Item #11 during the visit from Operation Santa
Presentation of Ocoee Firefighter of the Quarter to Fire Inspector Shawn Sorenson -
CACOFD Board Member Vaughn presented Fire Inspector Shawn Sorenson with the
Firefighter of the Quarter Award for his work and dedication to the community.

C. COMMENTS FROM CITIZENS/PUBLIC - None
D. STAFF REPORTS AND AGENDA REVIEW
City Manager Frank made the following announcements:
1) At the last meeting they passed a contract for the harvesting of pine trees on the Crown
Point Property and he would like for Assistant City Manager Shadrix to explain some
options of the harvest. Assistant City Manager Shadrix explained that a methodology
was done is accessing the timber value on the city owned portions of the Crown Point
Property. The assessment is usually within a 90 -95% accuracy level of confidence. With
the city owned portion it has been estimated $120,000 for the existing timber and the city
has a buyer that is ready to go. Assistant City Manager Shadrix said the decision before
the commission tonight relates to how the logging occurs. The first option would be
thinning every other row which would result in $60,000 worth of revenue. The second
option would be to require a 50 ft. buffer around the viewable vantage points of the
property and the buyer could clear cut (create a field) behind the buffer. This option
would result in revenue of $90,000 4100,000. Brief discussion ensued on the second row
thinning option and the proximity of homes to the Crown Point property.
Commissioner Hood, seconded by Commissioner Keller, moved to go to with
the second row thinning option on the harvesting of trees on the city owned
portions of the Crown Point property. Motion carried 5 -0.
2) Withers Maguire House will be hosting a Santa visit on Friday, December 21 from 6:30
to 9:00 p.m. Guests can have their picture taken with Santa for $5.00. Along with Santa's
visit there will be Food Trucks and a Movie in the Park at Bill Breeze Park. Guests can
grab a bite to eat from a variety of Food Trucks between 6:00 to 9:00 pm. and watch the
movie "Arthur Christmas" beginning at 7:30 p.m. The interior of the Withers- Maguire
House has been beautifully decorated in the holiday spirit and will be open for the public
to see from 6:30 to 9:00 pm. So bring a camera for family photo opportunities inside the
house and enjoy a festive evening at the park.
3) The City of Ocoee Parks and Recreation Department is currently holding open
registration for its Youth Basketball League through January 5 1h at the Beech Recreation
Center. The season will begin on Saturday, January 26th. The Department is also seeking
volunteer parent coaches; individuals interested in volunteering can call 407 - 905 -3180.
4) The city's 7th Annual Martin Luther King, Jr. Day Unity Parade. The parade will be held
on Monday, January 21 at 10:00am on Clarke Road. A celebration will be held
immediately following the parade at West Oaks Mall. For parade registration forms and

Mayor Vandergrift announced that the next Regular City Commission meeting will be held
on Tuesday, January 15 at 7:15 p.m. The January 1 St City Commission meeting has been
cancelled due to the New Year's holiday and city hall being closed.

Commissioner Keller— 1) congratulated all the winners of the Christmas Parade. 2) wished
everyone a Merry Christmas, Happy New Year, and Happy Holiday.
Commissioner Johnson — thanked Kathy Lipton and Gloria Vyka for the great job they did with
the Christmas Dinner for the families in need.
Commissioner Wilsen thanked Cathy Sills and Bob Godek for the awards they gave out for
the Christmas Parade.
Commissioner Hood — None
Mayor Vandergrift — announced his wife is doing well and is home. He further thanked
everyone for their support.
F. CONSENT AGENDA

2. Approval for Renewal of West Orange Narcotics Task Force Agreement. (Police Chief
Brown)
The current West Orange Narcotics Task Force Agreement with the Orange County Sheriff's Office and the
Winter Garden Police Department expires December 31, 2012. The new agreement shall take effect on January
1, 2013 and shall continue in full force and effect through December 31, 2016. Other than the dates, this is the
same agreement previously reviewed by the City Attorney and approved by the City Commission in 2009.
Approved on Consent. Motion carried 5 -0.
3. Approval of Renewal of Combined Operational Assistance and Voluntary Cooperation`
Mutual Aid Agreement with the Orange County Sheriffs Office. (Police Chief Brown)
Per Florida State Statutes Chapter 23, law enforcement agencies within the state of Florida may enter into
mutual aid agreements with one another. The current Combined Operational Assistance and Voluntary
Cooperation Mutual Aid Agreement between the City of Ocoee Police Department and the Orange County
Sheriffs Office expires December 31, 2012. The new agreement shall take effect on January 1, 2013 and shall
continue in full force and effect through December 31, 2016.
Other than the dates, the clarification of three accepted asset forfeiture issues not covered in the previous
agreement, and an address change for the Ocoee Police Department, this is the same agreement previously
reviewed by the City Attorney and approved by the City Commission in 2009.

A. Approval of Renewal of Municipal Inter -local Voluntary Cooperation Mutual Aid,
Agreement with Orange County Police Departments. (Police Chief Brown 4
Per Florida State Statutes Chapter 23, law enforcement agencies within the state of Florida may enter into
mutual aid agreements with one another. The current Municipal Inter -local Voluntary Cooperation Mutual Aid
Agreement between the City of Ocoee Police Department and law enforcement agencies of the Cities of
Apopka, Belle Isle, Eatonville. Edgewood, Maitland, Orlando, Winter Garden and Winter Park; the Towns of
Oakland and Windermere, and the University of Central Florida and Florida Agricultural and Mechanical
University expires December 31, 2012. The new agreement shall take effect on January 1, 2013, and shall
continue in full force and effect through December 31, 2016.
Other than the dates, this agreement is the same as the one previously reviewed by the City Attorney and
approved by the City Commission in 2009.
Approved on Consent. Motion carried 5 -0.
5. Approval of Renewal of School Resource Officer Agreement with Orange County
Public Schools. (Police Chief Brown)
The Ocoee Police Department provides one (1) DARE officer to five (5) elementary schools, one (1) School
Resource Officer to one (1) middle school, and two (2) School Resource Officers to one (1) high school, all of
which are located within the city limits of Ocoee. An annual agreement between the City and the School Board
of Orange County is required in order for the Police Department to understand its officers' responsibilities and
for the City to be reimbursed by the School Board of Orange County for a portion of the officers' salaries. This
agreement is effective from July 1, 2012 to June 30, 2013. This is the same agreement previously reviewed by
the City Attorney and approved by the City Commission for 2011 -2012.

In November 1995, the Honorable Mayor and Board of City Commissioners authorized the purchase of the
Motorola 800 MHz Radio system, which is still being utilized by the City in conjunction with Orange County's
radio system. Also purchased with the radio system was a service maintenance agreement. The agreement is
required for equipment that is no longer under factory warranty. Included in the agreement is all covered radio
equipment currently owned by the City of Ocoee with the exception of the radio equipment purchased by the
City for the Fire Department. The most recent agreement expired as of September 30, 2012. The proposed
agreement takes effect October 1, 2012, and runs through September 30, 2013.
The cost of the service agreement for the next 12 months is $17,735.31 (payable in monthly payments). The
cost of last year's agreement was $15,178.44. Some pieces of equipment are no longer covered by warranty and
some items are still covered by the original factory warranty. $54,000.00 is allocated in the FY 2012 -2013
budget for Equipment Maintenance Contracts. Currently there are approximately 126 items (portable radios,
mobile radios, and consolettes covered under the Motorola maintenance contract). Other than dates, the costs
involved, and some equipment covered, this is the same agreement previously reviewed by the City Attorney
and approved by the City Commission for 2011 -2012.

7. Approval pf Police Digital Portable Radii Purchase, (Po1 e,Chie1 3ro t }
The FY 2012/2013 budget provided up to $24,000 for the purchase of four (4) Motorola APX 7000 digital
portable radios and related accessories. In order to maintain compatibility and interoperability with Motorola
radios currently utilized by the Orange County radio users group, Motorola radios must be
purchased. Motorola is the sole source provider for these radios and offers only the State of Florida contract
pricing of $5,474.40 per radio and related accessories. These radios will also be compliant with pending
Federal mandates.

8. Approval of 2012/2013 I3udgeted Sanitation Side Arm Demonstrator Garbage Truck
Purchase. (Public Works Director Krug)
The City traditionally purchases vehicles and equipment through bids from the Florida Sheriffs Association's
annual contract. Public Works has researched pricing throughout the State and has found the Florida Sheriffs
Association continues to provide the lowest competitively bid pricing.
The Sanitation Division budget includes the replacement of a side loading garbage truck. Following the
demonstration of a Kann Manufacturing Corp. automated side arm loader, where a factory representative
accompanied a Team Member as the garbage truck was put through its paces on an entire day's route, the City
was offered a discounted price to purchase the demonstration unit. The discounted price of $180,000.00
includes factory refurbishing and painting the truck in the standard City colors. The quote for the same vehicle
on the Florida Sheriffs Assoc. contract is $229,233.00. This provides a $49,233.00 savings to the City's
Sanitation Division.
Public Works recommends Commission approval of this purchase offer on the Kann Manufacturing Corp.
demonstrator unit to take advantage of the savings over the Florida Sheriffs Association annual contract
published pricing. A side arm sanitation truck in our existing fleet will be declared surplus and auctioned
following delivery of the new truck. The Finance Department will secure four (4) year financing of the
approved total cost.

9. Approval of Purchase, of Fire, Departmen

The FY 2012/2013 budget provided $20,203 in account 4400 for the lease /purchase of 42 sets each of structural
and wildfire protective clothing. An additional $11,995 was approved in account 5204 Protective Clothing.
The Fire Department has the opportunity to piggyback off Lake County Contract #12-080611 with Fisher Safety
for the purchase of Morning Pride structural coats and pants, as well as Tecgen wildfire coats and pants at a
total cost of $92,190. With the attached quote there is also the opportunity to actually receive a 35% discount
on the Tecgen gear as opposed to the 20% discount available through the Lake County contract. This additional
discount is due to the purchase of both structural and wildfire gear together, as well as the manufacturers desire
to get the Tecgen product into our area.
This purchase will not have a negative impact on the current FY 20012/2013 budget. If approved, the lease
purchase of the requested protective clothing will be combined by the Finance Department with other City lease
purchases over a four -year period to create and annual cost that falls well within our current lease payment and
protective clothing budget.

10. Second Reading of Ordinance for Wild (216 1st Street). (Advertised in the Orlando Sentinel on

The subject property is located on the west side of I" Street and approximately 900 feet south of Silver Star
Road (SR 438) intersection. The subject parcel has one existing Single- Family Residence. The Applicant has
requested annexation into the City limits mainly for potable water connection.

I1. Second Reading of Ordinance for Capital Improvements Element — Amendment to
Capital Improvement Program Table. (Advertised in the Orlando Sentinel on Thursduy, Deceinher 6,

The Capital Improvement Element (CIE) of the City of Ocoee Comprehensive Plan is a requirement of Chapter
163, Florida Statutes (FS) and enables implementation of the Plan goals, objectives, and policies needing capital
funding for a 5 -20 year planning horizon. Each year, the table section of the CIE will be updated to ensure that
the adopted list of capital projects in the CIE matches the City's newly adopted fiscal year budget and approved
five year Capital Improvements Program (CIP). The CIE does not propose any new projects not previously
reviewed and approved by the Commission.
City Attorney Cookson read the title of the Ordinance.
Principal Planner Fabre explained this is more or less the same Capital Improvement plan that
was presented to the Commission and approved. The city is required by Florida Statutes to adopt
an ordinance approving the amended list.

12. Second Reading of Ordinance for Reduction of Impact Fees — Extension until January!

The City passed economic incentives for new construction earlier this year that are by ordinance set to expire in
January 2013. The incentives included reducing impact fees for police, fire, recreational park, and
transportation. Other incentives included the deferral of transportation impact fee payments until Certificate of
Occupancy, and the waiving of the fire plan review fee, which is' /z of one percent of the cost of construction.
With the economic conditions still in the state of flux as they were with the original passage of the economic
incentives, and to remain consistent with surrounding local government agencies, staff is proposing to extend all
but one of the incentives for one additional year. Staff is not proposing to extend the waiving of the fire plan
review fee which will reinstate the fee.

City Planner Rumer advised that adoption of this ordinance would be in keeping with the
surrounding agencies. They have received positive feedback from the impact fees reductions.

Use Manual. ( dveraved in the Orlando Sentinel on Sunday, December 9, 2012). (Utilities Director

The City last updated a Cross - Connection Control Manual in June 1990, and last updated the City Code of
Ordinances' Article VIII, Regulation of Sewer Usage, in June 1994. The proposed ordinance will update both
the Cross - Connection Control Manual; and remove the regulation of sewer usage currently in the City Code of
Ordinances and replace those provisions with the "Sewer and Industrial Pretreatment Use Manual ". The new
ordinance also provides that future manual revisions can be by adopted by City Commission - approved
resolution.
City Attorney Cookson read the title of the Ordinance.
Utilities Director Smith explained that before them are two manuals that are just clean -up of the
older manuals which are about 20 years old.

Pretreatment Use Manual. Motion carried 4 -0 with Mayor Vandergrift away from

14. Approval of Resolution for Uniform Method of Collecting Non -Ad Valorem
Assessments. (A(kertised in the Orlando Sentinel on Noi 19 c4 26 2012, and Gecemher 3, 10, & 17,

In September, the City Commission approved retaining Government Services Group, Inc. (GSG) to update the
City's tax roll information in order to use the uniform collection method for any special assessments in the year
2013. The Resolution of Intent is required for consideration of fees, and intends to use the uniform method of
collecting non -ad valorem assessments authorized in section 197.3632, Florida Statutes, as amended, for
collecting non -ad valorem assessments for the cost of providing fire services, stormwater services, street
lighting services and/or neighborhood improvement services. Approval of the resolution is necessary to
authorize use of the uniform collection method in the upcoming year, but does not bind the Commission to
assign fees other than zero. Due to recent history of homeowners' associations falling into arrears with payment
for items like street lighting, this method could also prove to be a tool that would allow such circumstances to
be avoided in the future along with the inevitable assistance from the City in resolving such matters.
Assistant City Manager Shadrix said that in September the Commission approved and
authorized the hiring of the Government Services Group, Inc. to conduct a regular audit and
update of tax roll information to set up an assessment using the uniform method of collection for

The City Commission of the City of Ocoee adopted Ordinance 2012 -17 on November 6, 2012, creating the
"Abandoned Property Ordinance." The ordinance provides for fees to register abandoned properties with the City of
Ocoee and fines for failure to register such properties that are within the city limits of Ocoee. The fees and fines are
to be set by resolution. Staff recommends the fee for registration to be set at $200.00 and the fine for failure to
register abandoned property to be set at $500.00.
City Attorney Cookson read the title of the Resolution.
Deputy Police Chief Goclon explained that last month the Commission passed an ordinance for
vacant property registry; all that was left to do was set the fines and fees for the registry. Those
fees have been set by ordinance. He advised it is estimated Ocoee will generate about $15,000
of revenue.
Commissioner Johnson inquired if this will be the same as code liens where people will appeal
to the commission. DC Goclon advised that it will just be a flat fee, it will not be a fee that
accrues over time, but they do have the right to appeal to the Commission. He also noted that
there may be Code Enforcement liens attached to some of the properties, if such violations were
found, but they would go through the same Code Enforcement process unrelated to this process.
Commissioner Johnson, seconded by Commissioner Wilsen moved to approve

B. COMMENTS FROM COMMISSIONERS
Commissioner Keller- 1) said that he received an e -mail that there was a party out at Hackney
Prairie Park that went late into the night. The complainant who called the police never received
word back as to park hours or whether or not the party was broken up. Parks and Recreation
Director Hayes said that that the park hours were adjusted for that park only during the
construction period a few years back. All of the other parks are 7:00 am —11:00 pm. They have
been closing Hackney Prairie Park earlier due to vandalism issues. He apologized for having not

been able to reach the resident who made the call, but he will do that in the morning. He added
that they will be bringing an ordinance forward in January that will establish park hours for all of
the parks, as they will vary according to need. 2) said that he received an e -mail from
McCormick Woods's residents regarding lights after the meeting that they had with
Commissioner Hood. He stated they want a traffic light on either end of their development and
they now understand that it is in the county jurisdiction.
Commissioner Johnson — ',inquired on the completion date for the landscaping along Maguire
Road. Public Works Director Krug explained they will be out there the week of January 7 -14 and
then it will take about four weeks to complete. They will remove the cabbage palms and coontie
palms and re- landscaping. There will be some lane closures during that time frame. 2) wished
everyone a Happy Holiday and safe travels. Mentioned the recent shooting incident at Sandy
Hook Elementary in Connecticut and noted that the whole country is saddened by this. He asked
the City Manager about Orange County School's policy with regard to school safety. City
Manager Frank said that they will have a meeting very shortly and asked the City to participate.
Mr. Frank stated that he disagrees with the recent statement the by the County Mayor was that
monies received for school security was going to be used only for the schools in the
unincorporated area.
Commissioner Wilsen — said this past week we lost a good friend in the community, Frances
Watts. She was a school crossing guard, president of the senior's community, a volunteer at the
Christian Service Center, and a regular attendee at the City commission meetings. She loved
Ocoee and was always willing to serve her community. She will be dearly missed; our
condolences go out to Teddy and Kathy.
Commissioner Hood wished everyone a Happy Holiday and safe travels.
