APRIL 23, 2013
CALL TO ORDER
Chairman Godek called the regular meeting of the Ocoee Code Enforcement Board to order at 7:00 p.m. in
the Commission Chambers at City Hall. Member Carrington led the invocation and Member Kelley led
the Pledge of Allegiance to the Flag. The roll was called and a quorum was declared present.
PRESENT: Chairman Godek, Vice - Chairman Lowery, Members Carrington, Kelley, and Osborne. Also
present were Asst. Support Services Director - Code Enforcement Manager Doug Gaines,
Code Enforcement Officer Edward Loeffler; Administrative Assistant Bridgett Ballard,
Board Attorney Mary Sneed, and Recording Clerk Stella McLeod.
ABSENT: Members Amey & Blynder were absent excused.
GUESTS: None.
Administrative Assistant Ballard administered the oath to the code enforcement officers and to anyone
intending to speak regarding a case.

Officer Loeffler presented the case and gave its history. A copy of the paid permit was presented as an
exhibit. The permit has not been reinstated as required by the code rule. The violation has not been brought
into compliance. The City recommends fifteen days be given for the respondents to come into compliance
or face a $50 per day fine.
Chairman Godek asked if the work was completed. Officer Loeffler replied that it has been done.
Mr. Paul Gray, 415 East Lakeshore Dr., testified that he has not put the trees in because he can no longer
afford to.
Chairman Godek asked if there was any time limit that the respondent could ask for. Mr. Gray replied
that he has been living off of his savings for the last 18 months. He said that he just did not see the trees
being as important as his employees and his family.

Chairman Godek asked Officer Loeffler to repeat what is being asked for. Officer Loeffler said that the
City is recommending a fifteen -day compliance time and fine of $50 per day.
Member Osborne, seconded by Member Kelley, moved that the respondent be found in violation as cited as
of as of 2 -15 -2013, and be given until 6 -28 -2013, to come into compliance or be fined $25 per day. Motion
carried by roll -call vote of 4 to 1 with Chairman Godek dissenting.

Officer Siegrist (who has inherited the case) presented the case and gave its history. He met with the
property owners on site and significant progress has been made; he was on site with the deputy building
official who is suggesting a six -month extension on the permit.
Ms. Angela Schmitt, 1903 Jessica Lea Lane, spoke on the case. She presented photos showing the
property's progress. Turner Construction is the contractor that was being used. Mrs. Schmitt said that they
have volunteers working with them to complete the project. It was discovered that there is a conflict of
interest to have Turner Construction working on the project because Mrs. Schmitt's mother is also helping.
Her mother is a City of Orlando employee and Turner Construction does work for the city, thus creating a
conflict. They are in talks with Home Depot to donate time, and there are more volunteers waiting to help.
She continued showing photos of the project's progress.
They have not made progress on the project since the end of February and are still waiting to hear from
Home Depot as to whether they will be joining to complete the project. Chief Robert Pigman (spelling ?) of
the City of Orlando Police Department is heading up the project and is in talks with Home Depot. He has
heard nothing from Home Depot since the end of February. He has suggested that Mrs. Schmitt ask for six
months to complete the room.
Member Carrington asked if the project manager has a back -up plan if Home Depot falls through. Mrs.
Schmitt answered that she did not know. She knows that there is manpower, she is just unsure about the
materials from Home Depot.
Chairman Godek asked if Mrs. Schmitt is requesting that the extension be six months from March 25,
2013, or six months from today's date. Mrs. Schmitt answered that it would be six months from today's
date.

Chairman Godek asked if the City is okay with six month from today. Officer Siegrist replied that he was
okay with the extension.
Attorney Sneed said that the motion will simply move to extend the compliance date from March 25, 2013,
to October 22, 2013, which is also the board's meeting date for that month.
Vice - Chairman Lowery, seconded by Member Carrington, moved to extend the compliance date from
March 25, 2013, to October 22, 2013. Motion carried unanimously.

Discussion ensued as to whether all four cases could be handled at one time. Attorney Sneed advised that
the cases may all be heard together, but action must be taken on the cases individually. Four motions will
be needed.
Chairman Godek declared that there are four cases.
Member Carrington, seconded Member Lowery, moved that the board re -hear Cases No. 01 -046, 02 -067,
03- 002728, and 05 -043 cases all together. Motion carried unanimously.

Officer Loeffler presented an updated photograph (February 19, 2013) for the cases. The home is no
longer on the property due to a fire. He presented an exhibit showing an itemization of the City's total cost.
There has been compliance on all violations.
Chairman Godek clarified that the respondent had made some payments on the fines. The cost presented
shows the fines minus what the respondent has paid.
Vice - Chairman Lowery asked was asked if some of the violations were repeat violations. Officer
Loeffler was not sure since he did not have the case file in front of him, but he reiterated that all code
violations were now in compliance.
Senior Mr. Rawa and Junior Mr. Rawa, 1902 Lauren Beth (the son), approached the podium to speak for
the case.
Chairman Godek asked why board should reduce fine.
Junior Mr. Rawa responded that he had financial hardship, as well as health matters. Junior Mr. Rawa
said he further explained he was not able to pay the fines due to financial hardship. He could not afford a
new car, so was usually in the position of having to repair a vehicle. He is living on a VA stipend, has lost
his wife, and is being treated for PTSD. Senior Mr. Rawa asked if the board had the April 10th memo from
the Rawas. The board acknowledged that they have the memo.
The Rawas have offered to deed the property to the City as payment for the liens. Junior Mr. Rawa said that
he does not want to relocate outside of Ocoee.
Member Osborne asked if Mr. Rawa was asking to leave off paying for the City's costs. Junior Mr.
Rawa answered `no'. He understood that taxpayers money was used to accrue the outstanding costs, and
those costs should be repaid, he said.
Code Enforcement / Asst. to the City Manager Doug Gaines spoke on the case; he talked with city
manager about land in lieu of payment. The city manager did not like the idea when he spoke with the
Rawas. The city manager did agree to have the Rawas come back and address the board again, Mr. Gaines
said. Donating the land, however, is off the table according to the city manager, Mr. Gaines concluded.
Further discussion ensued.
Attorney Sneed advised that the board can do one motion for the cases as long as all four cases are
mentioned in the motion.
Member Carrington, seconded by Vice - Chairman Lowery, moved that in Cases #01 -046, 02 -067, 03-
002728, and 05 -043, the board recommend to reduce the fines to the City's cost of $3,540.50. Motion
carried by roll -call vote of 3 to 2 with Chairman Godek and Member Osborne dissenting.

Officer Siegrist presented case and gave its history and presented exhibits (photos).
Separate from the main house is a structure containing two bedrooms. There was a separate structure with a
bathroom as well. An attached structure that has been plumbed for which is used as a laundry room was
also on the property. There is also a shed on the property. None of the structures have permits.
The city is recommending a thirty -day compliance date and $100 -day fine.
Member Carrington asked if the board has to give the respondent thirty days to comply. Board Attorney
Sneed answered `no'.
Member Kelley, seconded by Member Osborne, moved that in Case #13 -029, the respondent be found in
violation as cited as of March 23, 2013, and be given until May 22, 2013, to come into compliance or be
fined $100 per day. Motion carried unanimously.

Officer Loeffler presented case and gave its history. The officer presented exhibits (copy of permit). The
occupant stated he was the son of the owner, Brian Peterson when notification was hand- delivered to him.
The City is recommending a 15 -day compliance date and a $50 per day fine. The City has heard from
neither the occupant, nor the contractor.
Vice - Chairman Lowery, seconded by Member Carrinjton, moved that in Case #13 -036, respondents be
found in violation as cited as of February 15, 2013 for the violation of 105.4.1.2 and that they be given until
May 8, 2013, to comply or be fined $50 per day until violation is reached.
Chairman Godek asked if there are two violations or one. The officer answered that there is only one
violation. Rule 51 -1 refers to the date that the City adopted the rule.
Motion passes by a roll call vote of 4 to 1 with Member Kelley dissenting.

Vice - Chairman Lowery, seconded by Member Kelley, moved in Case #13 -021 to impose fine as of April 2,
2013. Motion carried unanimously.
COMMENTS
Officer Loeffler —said that the staff is able to get compliance by working with the building department who
are following up on expired permits, compliance is gained from sending out notice of hearing, and also
when a case goes to hearing. The efforts are worth it.

Recording Clerk McLeod — reminded the board that there are gifts for those who were unable to attend the
volunteer dinner.
Vice - Chairman Lowery — welcomed Code Enforcement Manager Gaines from his travels, and he
expressed pleasure at the efforts of the staff.
Member Kelley — thanked staff for their continued efforts.
Chairman Godek - solicited for two more members to fill vacant alternate member positions.
