HomeMy WebLinkAboutBOA 03-21-2013 MINUTES OF THE BOARD OF ADJUSTMENT REGULAR MEETING HELD MARCH 21, 2013 CALL TO ORDER Chairman Wilsen called the meeting to order at 5:57 p.m. in the Commission Chambers at City Hall. Member Colburn led the Invocation and the Pledge of Allegiance to the Flag; the Clerk called roll and declared a quorum. PRESENT: Chairman Wilsen, Members Colburn, Wrobel, Alternate Member Carrington and Alternate Member Carpenter. Also present were City Planner Rumer, City Attorney Cookson, and Deputy City Clerk Sibbitt. ABSENT: Vice Chair Cadle and Member Warren APPROVAL OF MINUTES — JANUARY 10, 2013 Alt. Member Carrington, seconded by Member Colburn, moved to approve the minutes of January 10, 2013. Motion carried 5 -0. NEW BUSINESS ARMSTEAD VARIANCE (1107 COASTAL CIRCLE) City Planner Rumer presented exhibits and the staff report for the variance request by applicant, Rodney Armstead, for a rear yard setback variance to encroach 10.2 feet into the 50 foot setback from the normal high water level for a proposed retaining wall and a brick paver patio addition. BACKGROUND The subject property is located at lot 14 of Admiral Pointe Phase 2. Lot 14 contains "C" drainage, which is from front to rear. The subject property does show visible erosion on both sides of the rear yard from years of drainage. Similar lots have retaining walls at the same setback. RECOMMENDATION Based on findings stated above, staff does find the variance requested by Rodney Armstead supportable. DISCUSSION The Public Hearing was opened. Rodney Armstead (applicant) thanked the Ocoee Planning Department for all their help. Throughout this process everyone has been friendly and informative. Mr. Armstead advised that his design and plans were all made based on the assumption that the original high water setbacks were in place. He designed and submitted his permit application on maintaining his setback from his elevations on his original survey from 2005. Mr. Armstead advised that he is constructing the wall equal to what the neighbors have and began this process now instead of waiting for the elevation lines to go back down. Board of Adjustment Regular Meeting March 21, 2013 Mr. Armstead briefly explained the ribbons in his yard that were shown in the exhibits provided by City Planner Rumer. Chairperson Wilsen inquired from Mr. Armstead if he is aware of any of the neighbors opposing this variance request. Mr. Armstead said he is not aware of any opposition. City Planner Rumer further shared that the City has not received any e -mails in opposition. The City notified neighbors that reside within 300 feet of the property and they placed an orange sign on the subject property with the meeting date and the City's phone number, as well as, an ad in the West Orange Times. Member Colburn inquired if in his travel, did he find that putting the wall will help with the erosion which means the lake will survive. City Planner Rumer advised the retaining wall will not help the side yard erosion. Mr. Armstead explained that the rear yard is sliding which is why they chose to do a wall verses just a wood deck on post /blocks. The wall will help with the erosion since they will be putting down spouts and drain pipes under the patio so more of the run -off can go into the lake or back yard. This drainage will be connected on both sides of the yard. Chairperson Wilsen summarized that the project, when completed, will be no further than any of the other property walls. City Planner Rumer said that it is his visual depiction but he will inspect it as well. The Public Hearing was closed. Member Colburn, seconded by Member Wrobel, moved to recommend to the City Commission approval of the Armstead Variance as presented by staff. Motion carried S- 0.
