CALL TO ORDER
Vice - Chairman Darrell Lowery called the regular meeting of the Ocoee Code Enforcement Board to order
at 7:00 p.m. in the Commission Chambers at City Hall. The vice - chairman led the invocation and Member
Kelley led the Pledge of Allegiance to the Flag. The roll was called and a quorum was declared present.
PRESENT: Present were Vice - Chairman Lowery, Members Amey, Kelley, and Osborne. Also present
were Asst. Support Services Director - Code Enforcement Manager Doug Gaines, Code
Enforcement Officers Edward Loeffler and Robert Siegrist; Administrative Assistant
Bridgett Ballard, Board Attorney Mary Sneed, and Recording Clerk Stella McLeod.
ABSENT: Chairman Godek, Members Blynder and Carrington were all absent /excused.
GUESTS: None.
Administrative Assistant Ballard administered the oath to the code enforcement officers and to anyone
intending to speak regarding a case.

Officer Loeffler presented the case and gave its history. The expired permit was presented as an exhibit.
The City recommended a 15 -day compliance time and $25 /day fine.
Member Kelley asked if the officer said that the old siding was covering the new siding, or if he said it was
vice versa. Officer Loeffler said he meant to say that the new siding was covering the old siding.
Mr. Leonard Mosely, SHIP representative, 4628 Northern Dance Way, Orlando, 32826, spoke about the
case. He apologized for not getting repairs done in a timely fashion. He explained that it was due to an
oversight on their part. His understanding was that the permit had been renewed and they had tried to
contact the homeowner, but to no avail. They plan to send her a certified letter.
Member Osborne asked if the homeowner had to be present to do the inspection. He answered saying, "In
some cities you do, in others you do not."
Office Loeffler said that it appears that the procedure could be invasive (inspection which might require the
removal of a piece of stucco). The officer went on to say that it is possible that the building official will
allow an affidavit to be done attesting to the completed inspection. This possibility has not been
substantiated.
Member Amey asked Mr. Mosely if he put on the stucco. He answered that they put vinyl siding over
stucco. Member Amey asked what the inspection was about. He answered that the building staff wants to
see what is under the siding.
Mr. Mosely said that his company is ready to move ahead toward the inspection. Member Amey asked if
the homeowner will have to be present for the inspection. Officer Loeffler replied that the building
department will have to determine if the homeowner has to be present.
Member Osborne asked who gets sanctioned if the homeowner is not home. Board Attorney Sneed
clarified that the respondents are both the homeowner and SHIP, but the board can find either one, both, or
neither in violation. Member Osborne said that finding the homeowner in violation would not relieve
SHIP from their responsibility. Board Attorney Sneed agreed. After additional discussion she clarified
that the board's decision is simply about finalizing the permit issue.
Officer Loeffler said that based upon the discussion, the City would recommend a 30 -day compliance
period rather than a 15 -day period.
Member Osborne, seconded Member Amey, moved that in Case 13 -044, the homeowner be found in
violation as cited as of February 17, 2013, and be given until July 19, 2013, to come into compliance or be
fined $25.00 per day. The motion passed by maiority roll -call vote, with Member Kellen casting the
dissenting vote.

Officer Siegrist presented the case and gave its history in place of Officer Rodriguez. The property is in
compliance. The fine equals $48,600. The total cost to the City: $1,030.00.
Vice - Chairman Lowery invited forward whomever was going to speak about the case.
Mr. Max Rosenblum, listing agent, 356 S. Osceola, Orlando FL, 32801, stated that the house was
possessed by the bank earlier this year. He added that the homeowner was incredibly neglectful of the
property to the detriment of his neighbors. When they entered the home, it appeared that a number of
animals were left in the property. Those animals had to be evacuated. The property was cleaned up in a
couple of weeks. The previous buyer walked away because they could not close on time. The property now
has a new buyer. Mr. Rosenblum reiterated that they brought the property into compliance as quickly as
they could.
Member Amey questioned whether the bank was really ignorant of the condition of the property. Mr.
Rosenblum replied that banks only know what listing agents tell them. He said that the first inkling that the
bank had that there was a problem with the home was when his firm told the bank earlier this year in
January.
Board Attorney Sneed advised that the board would be making a recommendation.
Member Osborne, seconded by Member Amev, moved that the board recommend that the fine be reduced
to $5, 000 and include the City's costs of $1030.00, for a total cost of $6,030.00.

Member Kelley asked when the first closing fell through. Mr. Rosenblum responded that the closing fell
through towards the end of April. Member Kelley asked when Mr. Rosenblum became the listing agent.
Mr. Rosenblum answered that he became the agent around February. Member Kelley, noting that they got
the property in compliance within six weeks after it had been left non - compliant for 18 months, questioned
why the board wanted to recommend a fine when the listing agent brought the property into compliance so
quickly.
Member Osborne answered that she was trying to be consistent.
The roll -call vote resulted in a tie; hence, the motion failed with Vice - Chairman Lowery and Member
Kelley casting the dissenting votes.
Member Kelley, seconded by Member Amey, moved that the board recommend that the fine be reduced to
$2000, including the City's costs. The motion passed by majority roll -call vote with Member Osborne
casting the dissenting vote.
Mr. Mosely commended Officer Loeffler on his help in resolving the matter.

Office Siegrist presented the case and gave its history. He submitted exhibits (photos). As of today's date,
the property is non - compliant with violation 115 -5. Officer Siegrist stated that the City is recommending a
seven -day compliance date with a $50 /day fine.
Member Kelley asked if the violation resulted from a neighbor complaint. Office Siegrist said that it did.
Member Amey asked if it was grass or weeds. The officer answered `weeds'.
Member Kelley, seconded by Member Amey, moved that the respondents be found in violation as cited as of
May 30, 2013, and in compliance as of June 25, 2013, and in violation of 115 -5 and be given until July 5,
2013, to comply or be fined $100 per day. Motion passed unanimously.

Officer Loeffler presented the case and gave its history. The violation is where the building once was.
Exhibits (photos) were presented. The violation was determined to be a public nuisance. As of this date, the
property is non - compliant. The City is recommending a 30 -day compliance time and a $75 /day fine along
with permission to abate the nuisance.
Vice Chairman Lowery asked if the City's recommendation was for each code violation. Officer Loeffler
answered `no'.
Member Kelley, seconded by Member Osborne, moved that in Case #13 -063 the respondent be found in
violation as cited for as of May 21, 2013, and given until July 22, 2013, to comply or be fined $100 per day,
per violation. Additionally, the City is authorized to abate the property and assess cost to respondent.
Member Osborne asked if there were three different violations on 115 -5ABC. "The motion is one," the
board attorney replied.
Motion passed unanimously.
Member Amey asked why charge the fine if the City is going to go in and abate the property. Board
Attorney Sneed answered that the fine would accrue starting July 23, but the City may not abate the
property until September.
Member Kelley asked if it was possible to abate part of the property containing the safety issues. Officer
Loeffler responded affirmatively.

property is still in violation. The City recommends compliance period of 10 days, and $75.00 /day fine in
the case of non - compliance and the opportunity to abate the property.
Member Osborne asked if the City has costs involved. The officer answered that the City has not mowed
the grass. The owners do. But they let it get overgrown again.
Member Kelley asked about the cost from previous times that the grass got long. Officer Loeffler
answered that the City has not mowed the grass. The owners took care of it.
Vice Chairman Lowery asked if the City could go on the property if there is utility power going to the
property. Officer Loeffler said that the City would need to make that determination.
Member Osborne, seconded by Member Kelley, moved that in Case #13 -064, the respondent be found in
violation as cited as of June 10, 2013, and be given until July 8, 2013, to comply or be fined $100 per day,
per violation, and that the city be authorized to abate the nuisance and add the cost to the respondents.
Motion passed unanimously.

Officer Loeffler presented the case in place of Officer Delgado. A demolition permit has been obtained. A
continuation is sought by the City.
Member Kelley asked how long a continuation would be needed. Officer Loeffler replied, "Thirty days."
Member Kelley, seconded by Member Osborne, moved in Case #13 -054 to extend the compliance date from
June 21, 2013, to July 22, 2013. Motion passed.
COMMENTS
Recording Clerk McLeod - congratulated Members Amey and Kelley on their reappointment to the board.
Member Amey - congratulated Vice - Chairman Lowery for standing in for Chairman Godek in his absence.
