HomeMy WebLinkAboutPlanning & Zoning 01/13/2004 THE MINUTES OF THE PLANNING AND ZONING COMMISSION REGULAR MEETING HELD TUESDAY, JANUARY 13, 2004 AS LOCAL PLANNING AGENCY CALL TO ORDER Chairman Golden called the meeting to order at 7:00 p.m. Following a moment of silent meditation and the Pledge of Allegiance to the Flag, a quorum was declared present. PRESENT: Chairman Golden, Vice-Chairman McKey, Members Campbell, Keller, Sikora, Sills, and West. Also present were Community Development Director Wagner, Senior Planner Willman, Assistant City Attorney Cookson, and Deputy City Clerk Maxwell. ABSENT: Members Riffe and Rhodus, who were excused. CONSENT AGENDA The consent agenda consisted of approval of Item A: A. Minutes of the Planning and Zoning Commission Regular Meeting held on Tuesday, December 9, 2003. Member Keller, seconded by Member West, moved to accept the Consent Agenda as presented. Motion carried unanimously. NEW BUSINESS POER PROPERTY-ANNEXATION ORDINANCE NO. 2004-01 (Case No. AX-03-12-14) ELEVENTH AMENDMENT TO THE JPA AGREEMENT (CASE NO. JPA-03-008) Senior Planner Willman presented the Staff Report for the proposed Annexation for the Poer Property and the Eleventh Amendment to the Joint Planning Area (JP A) Agreement for the Poer Property and the Richardson Property. The +/-29.25 acre parcel known as the Poer Property is located south of the Ocoee Crown Point PUD and west of the West Orange Trail. The proposed property is vacant, and historically a significant portion of the site was used for agricultural activities including citrus farming. The Poer Property was recently purchased by the City because the property offers an excellent opportunity to expand the City's land holdings as part of the Ocoee Crown Point PUD. Incorporating this land into the PUD is important to the overall development of residential property in the PUD, by increasing the number of single-family units by up to 115 lots. Given the reasonable purchase price of the property compared to its potential sales price, the City acquired the site in expectation of realizing a significant return, which will help pay down the original acquisition price of the Coke Property and help with infrastructure costs. Planning and Zoning Commission Regular Meeting January 13,2004 The Poer Property is currently outside the City limits and outside of the Ocoee/Orange County JP A. Before it can be added to the Ocoee Crown Point PUD, the property must be annexed and moved from the Winter Garden/Orange County JP A to the Ocoee/Orange County JP A. Annexation of the Poer Property will be subject to approval of an Amendment to the JP A Agreement, which is the eleventh Amendment to date. The Eleventh Amendment will also include the Richardson Property, which in not within any JP A at this time. The +/- 14.11- acre Richardson Property is located southeast of the Poer Property, between East Crown Point Road and the West Orange Trail. Adding this parcel to the JP A would assure the integrity of any new development at that location, which is the entrance to Ocoee Crown Point PUD. As a requirement of the JP A Agreement, the City has completed an Annexation Feasibility and Public Facilities Analysis report as a component of the annexation procedure. Staff has determined that the full range of urban services can be provided. State annexation criteria grants municipalities the authority to annex contiguous, compact, non- circuitous territory so long as it does not create an enclave. The proposed annexation of the Poer Property is consistent with State and local regulations. Because the Poer Property is not located within the JP A, approval of an amendment to the JP A Agreement is required before the annexation can be effective. The Eleventh Amendment to the JP A Agreement would amend the JP A boundary to include the Poer Property and Richardson Property and establish a JP A land use designation for both parcels as Low Density Residential. City Staff has met with Winter Garden staff to discuss JP A boundary issues, including this proposal to remove the Poer Property from the Winter Garden JP A to be places within the Ocoee JP A. Subsequently, the City has received a letter stating that Winter Garden concurs with this proposal. DEVELOPMENT REVIEW COMMITTEE RECOMMENDATION On January 6,2004, the Development Review Committee (DRC) met to determine if the proposed annexation and JP A Amendment were consistent with the City's regulations and policies. The DRC voted unanimously to recommend approval for annexation of the Poer Property and approval of the Eleventh Amendment to the Ocoee-Orange County Joint Planning Area Agreement for the Poer Property and Richardson Property. 2 Planning and Zoning Commission Regular Meeting January 13, 2004 ST AFF RECOMMENDATION Based on the recommendation of DRC, staff respectfully recommends that the Planning & Zoning Commission, acting as the Local Planning Agency, recommend that the Mayor and City Commission: 1. Approve the Eleventh Amendment to the Joint Planning Area (JPA) Agreement, amending the boundary to include the Poer Property and Richardson Property, and establishing a land use designation for both parcels as "Low Density Residential" on the JP A Land Use Map; and 2. Approve Ordinance No. 2004-01 to annex the Poer Property, subject to the County's approval of the Eleventh Amendment to the JP A Agreement. The public hearing was opened. Beverly Willis, 1779 Americus Minor Drive, Winter Garden, stated her property is located south of the property in question and she has concerns regarding drainage features and wants to make sure there is no impact of drainage onto her property. Mrs. Willis further stated she would like to be included in any consideration regarding storm water/drainage plans. Community Development Director Wagner responded throughout the hearing to questions and concerns to assure adjoining property owners that the City would resolve their concerns when development plans are prepared. Ron Whitehead, 1 032 Woodson Hammock Circle, Winter Garden, stated he would like to see a "buffer" backing up to his subdivision due to the wildlife and drainage issues. Gus Pickett, 1106 Juniper Hammock Court, Winter Garden, stated he does not want the area in question to be developed but if the area is to be developed he is requesting that a "buffer" be put in place. Don Miller, 1073 Woodson Hammock Circle, Winter Garden, stated he is not against developing the area but he, as well as the others that spoke, has drainage concerns due to the fact that there are already drainage problems in the area. The public hearing was closed. 3 Planning and Zoning Commission Regular Meeting January 13, 2004 Member Keller, seconded by Member Campbell, moved that the Planning and Zoning Commission, acting as the Local Planning Agency, recommend approval of the Eleventh Amendment to the Joint Planning Area Agreement, amending the boundary to include the Poer Property and Richardson Property, and establishing a land use designation for both parcels as "Low Density Residential" on the JP A Land Use Map. Motion carried unanimously. Vice-Chairman McKey, seconded by Member Keller, moved that the Planning and Zoning Commission, acting as the Local Planning Agency, recommend approval of Ordinance No. 2004- 01 to annex the Poer Property, subject to the County's approval of the Eleventh Amendment to the JP A Agreement.
