HomeMy WebLinkAboutPlanning & Zoning 10/12/2004 THE MINUTES OF THE PLANNING AND ZONING COMMISSION ACTING AS THE LOCAL PLANNING AGENCY MEETING HELD TUESDAY, OCTOBER 12, 2004 CALL TO ORDER Chairman Golden called the meeting to order at 7:00 p.m. Following a moment of silent meditation and the Pledge of Allegiance to the Flag, a quorum was declared present. PRESENT: Chairman Golden, Members Campbell, Keller, McKey, Morris, Riffe, Sills, and West. Also present were Community Development Director Wagner, Planning Manager Armstrong, Senior Planner Fabre, Senior Planner Grimms, City Attorney Storey, and Deputy City Clerk Brasher. ABSENT: Member Rhodus, who was excused. CONSENT AGENDA A. Minutes of the Planning and Zoning Commission Regular Meeting held on Tuesday, July 13, 2004. Member Keller. seconded bv Vice-Chairman McKev. moved to accept the Consent Aqenda as presented. Motion carried 8-0. City Attorney Storey announced a disclosure that Foley & Lardner represents the property owner for the McCormick Woods project; therefore, he will be unable to advise the City on any matters relating to this project. NEW BUSINESS McCormick Woods Final Subdivision Plan - Project #LS-2001-002 Principal Planner Fabre presented the staff report for McCormick Woods Final Subdivision Plan and stated the :!:69.9-acre parcel is located on the south side of McCormick Road between the Western Expressway and Ingram Road. The Final Subdivision Plan proposed 182 single-family residential lots. The property is zoned R-1A requiring a minimum lot width of 70 feet and lot size of 8,000 SF. Proposed lot sizes are a minimum of 8,750 SF. On December 2, 2003, the City Commission reviewed and approved the Preliminary Subdivision Plan for McCormick Woods with a condition to make the sidewalks in Tract "C" and Tract "I" 6-feet wide and the conditions have been met with this Final Subdivision Plan submittal. McCormick Woods will be developed in two phases and include a 1,000 SF community meeting building and recreation facilities. Both the McCormick Road and Ingram Road Planning and Zoning Commission Regular Meeting October 12, 2004 entrances will be gated and on McCormick Road, there will be a left turn lane, which will serve this subdivision and Irmalee Lane. Along the length of the subdivision, Ingram Road will be improved to provide a 24-feet curb and gutter and left and right turn lanes into the subdivision at both entrances. A northbound left turn lane on Ingram Road to McCormick road will be built and, anticipating the future need for a southbound right turn lane on McCormick Road to Ingram Road, an additional 10 feet of right-of-way will be dedicated by the property owner to Orange County. Homes along the Expressway will have a 20-foot wide landscape buffer (Tract "G") that will be planted along the entire eastern boundary. Bicycle-pedestrian access easements (Tract "C" and Tract "I") will be provided between McCormick Woods and the middle school in two locations. There will be a 6-foot brick wall with appropriate landscaping along McCormick and Ingram Roads. Water and wastewater will be provided by Orange County. DEVELOPMENT REVIEW COMMITTEE RECOMMENDATION The Development Review Committee (DRC) reviewed the McCormick Woods Final Subdivision Plan on September 17, 2004. The DRC voted unanimously to recommend approval of the Final Subdivision Plan, subject to the developer making minor changes to the plans as discussed and noted on the Planning Comments correspondence. These changes were made and shown on the plans date stamped received "October 4, 2004." STAFF RECOMMENDATION Based on the recommendation of the DRC, Staff respectfully recommended the Planning and Zoning Commission recommend approval of the Final Subdivision Plan for McCormick Woods, as date stamped received by the City on October 4,2004. Chairman Golden asked about the proposed Rails to Trails line on the plans. Randy June, representing June Engineering, stated the existing trail is at the southwest corner of the retention pond. Member West asked if the additional 9 acres is a part of Memorial Gardens. Mr. June said it was. Mr. June asked if it would be possible to defer completion of the Community Center until the 50th home permit is issued due to vandalism. Community Development Director Wagner said the City Commission would make that decision. 2 Planning and Zoning Commission Regular Meeting October 12, 2004 Member Keller asked if the outside sidewalks on Ingram and McCormick Roads could be 6-feet wide instead of 5-feet wide for the safety of the bike riders. Community Development Director Wagner said he recalled that the Planning and Zoning Commission and/or City Commission approved the Preliminary Subdivision Plan with a widened sidewalk on McCormick Road. Mr. June said that there were two particular points that were to be widened to 6-feet. Community Development Director Wagner said his Staff would look into this change before it goes before the City Commission or the board can make the recommendation. Chairman Golden told Randy June that he liked the Landscape Plan and the turn lanes. He asked if the re-use lines would be activated right away. Community Development Director Wagner said the re-use lines are in Ocoee's territory and there are no current plans to install re-use lines in the area. Member Keller. seconded by Vice-Chairman McKev. moved to recommend approval of the Final Subdivision Plan for McCormick Woods. as date stamped received by the City on October 4. 2004. and with an additional condition that the developer put 6-foot wide sidewalks on Inqram and McCormick Roads. Motion carried 8-0. COLONIAL DRIVE/SR 50 ACCESS MANAGEMENT PLAN - LAND DEVELOPMENT CODE AMENDMENT Principal Planner James presented the staff report for the Colonial Drive/SR 50 Access Management Plan Land Development Code Amendment. This amendment would move the full access intersection on SR 50 from Consumer Court to Economic Court, and provide a directional left turn access into the Towne Square Shopping Center. The current plan connects Consumer Court to the south between Discount Auto Parts and Dunkin Donuts with a new entrance to the Towne Square Shopping Center on the north. The new shopping center entrance is between Goodyear and Arby's, continuing north, turning east along Arby's property line entering the shopping center from the west. The developer of the site located south of Discount Auto Parts and Dunkin Donuts has requested that the access roadway, which will connect Professional Parkway with SR 50, be moved to their western property line. The relocation of this full access intersection to Economic Court and the associated changes to Consumer Court were inconsistent with the City's adopted SR 50 Access management Plan, and, as such, were opposed by Staff. 3 Planning and Zoning Commission Regular Meeting October 12, 2004 On August 26, 2004, Staff met with the representatives of the development site, Jim Bartoe, the Towne Square Shopping Center representative, and Fred Ferrell, the Florida Department of Transportation (FDOT)-District 5 Traffic Operations Manager. During this meeting, Fred Ferrell indicated the FDOT had already directed their SR 50 design consultants for the widening of SR 50 to move the intersection from Consumer Court to Economic Court contrary to the Access Management Plan adopted by the City. Mr. Ferrell stated during the meeting that FDOT reserved the right to change access management plans on state roadways even if these changes were not consistent with the plans of local governments. Fred Ferrell also indicated the following changes on SR 50 between Maguire Road and Marshall Farms Road. ~ The old intersection site at Consumer Court have a right-in from SR 50 (turning south) and a right-out on to SR 50 (turning east); ~ The new intersection site at Economic Court/SR 50 would be signalized with an east and westbound left turn lane from SR 50 and; ~ The entrance to Towne Square Shopping Center (between Arby's and McDonalds) would have a directional eastbound left turn land (turning north) into the shopping center. ~ Both the intersections (Economic Court) and the shopping center entrance (between Arby's and McDonalds) would require parallel left turn lanes to accommodate the necessary turn lane capacity to function properly. These improvements would be completed with the SR 50 widening project in 5 to 6 years. At this meeting, the representative of the development site and the Towne Square Shopping Center were in agreement with the FDOT decision. The City Attorney suggested the attorney for the developer prepare a request for an amendment to the SR 50 Access Management Plan. This request was presented to the Mayor and City Commissioners on September 7, 2004, who directed Staff to prepare this amendment request and the associated ordinance. Since FDOT has already unilaterally exercised its right to alter the access plans on the roadway by instructing the design consultant to make the changes stated above, the City has no choice but to adopt the FDOT-mandated changes. It should be noted that the movement of the full intersection from Consumer to Economic Court would affect wetland and the 1 OO-year floodplain in this area. 4 Planning and Zoning Commission Regular Meeting October 12, 2004 RECOMMENDATION Based on the analysis, Staff recommended that the Planning and Zoning Commission recommend approval of the changes to the "Access Management and Intersection Operations Study" for SR 50 to move the full access intersection on SR 50 from Consumer Court to Economic Court, and to provide a directional left turn access into the Towne Square Shopping Center. Vice-Chairman McKey inquired as to why FDOT made these changes. Principal Planner James said that FDOT felt it would accommodate the area better. A lengthy discussion ensued regarding the Access Management Plan Amendment. The public hearing was opened. Scott Glass, Shutts & Bowen, representing the owner of the Regional Development Group stated there had been several meetings held regarding the Colonial Drive/SR 50 Access Management Plan and this was not an arbitrary decision by FDOT. Mr. Glass gave the following reasons for the change: ~ It allows the road to be built today, at no cost to the City. ~ If the western shift is not approved, the City will have to acquire the right-of-way and build the road at the City's expense sometime over the next two decades. The Loop Road is identified as a needed road in the city's Roadway Improvement Master Plan 2020, and as such, has already been determined by the City as necessary "to achieve the Transportation Element Objectives." ~ Provides immediate relief to SR 50/Maguire Road intersection. Westbound traffic on Old Winter Garden Road can bypass Maguire/SR 50 intersection completely. The extension of Professional Parkway as a 2-lane road from Maguire Road was "identified to provide added east-west capacity and to address severe congestion problems on SR 50, as well as accessibility to developments planned in the area." ~ People coming north on Maguire Road who want to turn south on Maguire can also avoid the Maguire/SR 50 intersection. ~ People coming eastbound on SR 50 who want to turn south on Maguire Road can also avoid the Maguire/SR 50 intersection. ~ Mr. Ferrell, P.E., the FDOT's trained and experienced traffic engineer who is in charge of improving traffic flow and safety on SR 50, has reviewed the proposed shift to the west and stated, based on his professional training and substantial experience, the western shift will improve both traffic flow and safety. 5 Planning and Zoning Commission Regular Meeting October 12, 2004 ~ Owners of Towne Square Shopping Center do not oppose the shift and recognize the need to improve traffic flow on SR 50 and reduce congestion in the Maguire/SR 50 intersection. ~ City's current Access Management Plan channels cut through traffic through a shopping center parking lot, creating a decidedly non-pedestrian friendly situation. This is inconsistent with the City's Transportation Element, which discourages cut-through traffic. ~ Construction of the shifted Loop Road now would be consistent with Transportation Element Objectives. Member Riffe stated her concerns regarding the existing Commercial businesses. Member Campbell asked when the access road to Discount Auto Parts and Dunkin Donuts would be constructed. Mr. Glass said the plan is to construct all roads at the same time. Member Morris said he would like confirmation that if you go east on SR 50 and turn into the new development, you will have access to the existing businesses. Mr. Glass said you would have access to the existing businesses. Vice-Chairman McKey said enough right-of-way should be included in this project so SR 50 could be widened to five lanes in the future. The public hearing was closed. Chairman Golden said it seems like FDOT just shoved this down the City's throat and he asked if FDOT worked with the City on this. Community Development Director Wagner said it was the decision of FDOT and he had concerns with protecting the property owners to the north. Vice-Chairman McKey asked if the City has had any additional expenses due to this change. Community Development Director Wagner said there have been none to date but he cannot predict what expenses there could be in the future. Member West asked if there would be cross-access between Denny's and the old fruit stand because who ever develops that property will need more than a right in and a right out. Member Riffe. seconded by Vice-Chairman McKey. moved to recommend approval of the chanqes to the "Access Manaqement and Intersection Operations Study" for SR 50 6 Planning and Zoning Commission Regular Meeting October 12, 2004 to move the full access intersection on State Road 50 from Consumer Court to Economic Court, and to provide a directional left turn access into the Towne Square Shoppinq Center. Motion carried 8-0. COMMENTS Community Development Wagner gave the following development updates: ~ Old Time Pottery is coming to the old Wal-Mart site. ~ A flooring store is coming in at the old Alderman Marine location. ~ A retail strip center and offices will be built at the corner of Old Winter Garden Road and Hwy 50 ~ A strip shopping center, restaurants, and a Bank of America will be at the Ocoee Commons project at Blackwood and Hwy 50. ~ An office building is being constructed across from Health Central Hospital. Community Development Director Wagner said the curve on Old Winter Garden Road will be straightened out, Professional Parkway will become Old Winter Garden Road, and the "T" intersection that goes up to Hwy 50 will be called Bluford Avenue. He further stated there would be meetings held in November and December due to the large number of projects. Member Riffe inquired as to the status of the lake water coming over Hwy 50. Community Development Director Wagner said the road was put through the lake when it was first built, which is below the 1 OO-year floodplain. The water is being pumped south to the Turnpike.
