Home My WebLink About04-27-2004 Minutes MINUTES OF THE CITY OF OCOEE CODE ENFORCEMENT BOARD MEETING APRIL 27, 2004 CALL TO ORDER Chairman Linebarier called the regular meeting of the Ocoee Code Enforcement Board to order at 7:00 p.m. in the Commission Chambers at City Hall. Chairman Linebarier led the Pledge of Allegiance to the Flag and the Invocation. The roll was called and a quorum was declared present. PRESENT: Chairman Linebarier, Members Chancey, Donenfeld, Godek, Konicek and Vice-Chairman Lenko. Also present were Building & Zoning Official Phelps, Enforcement Officers Braddy-Bagwell, Loeffler and Siegrist, Permitting Clerk Ramos, Attorney Sneed, and Deputy City Clerk Brasher. ABSENT: Member Henderson and Alternate Member Stanley who were excused. CONSENT AGENDA ALL MATIERS LISTED UNDER THE CONSENT AGENDA ARE CONSIDERED TO BE ROUTINE BY THE CODE ENFORCEMENT BOARD AND WILL BE ACTED UPON BY ONE MOTION. THERE WILL BE NO SEPARATE DISCUSSION OF THESE ITEMS UNLESS DISCUSSION IS DESIRED BY A MEMBER OF THE BOARD, IN WHICH CASE THE CHAIRMAN WILL INSTRUCT THE BOARD CLERK TO REMOVE THE ITEM FROM THE CONSENT AGENDA AND SUCH ITEM WILL BE CONSIDERED SEP ARA TEL Y. The Consent Agenda consisted of approval of Items A, B & C. A. Minutes of the Code Enforcement Board Regular Meeting held on Tuesday, March 23, 2004. B. Order of Continuance - May 25, 2004 - None C. Order of Dismissal- None Member Godek, seconded by Member Konicek, moved to approve the Consent Agenda as presented. Motion carried 6-0. COMMENTS FROM CITIZENS None HEARINGS OF STATEMENTS OF VIOLATIONS PURSUANT TO THE HEARING RULES ADOPTED BY THIS BOARD ON JUNE 27, 1995, V ARlOUS DOCUMENTS ARE USED BY THE CODE ENFORCEMENT OFFICERS IN EACH CASE AND ARE REPORTED IN THE CASE TESTIMONY GIVEN BY THE CODE ENFORCEMENT OFFICER. HEARINGS ON STATEMENT OF VIOLATIONS PURSUANT TO NOTICES OF HEARINGS Case No. 04-005 - Mararetta Russell 807 Apricot Drive Officer Braddy-Bagwell Violation Cited: 105-4 and 106.6 02-11-04 NOCV Re-Inspection Date: 02-27-04 03-04-04 SOV 03-04-04 NOH Meeting Date: 03-23-04 03-04-04 POS Certified Mail 03-04-04 POS Regular Mail Observation: Failed to complete Mechanical Final. Building Official Phelps stated that there is no return of service for this case and the City of Ocoee is withdrawing the case. Building Official Phelps announced the following information: Case No. 03-002719 is in compliance. Case No. 03-003314 is still trying to resolve problems with the plans. Case No. 04-002 is in compliance. Member Donenfeld, seconded by Vice-Chairman Lenko, moved to continue Case No. 03- 003314 until the April 27, 204, Code Enforcement Board Meeting. Motion carried 6-0. Case No. 04-004 - Ricky L. Moore 578 W. Silver Star Road Violation Cited: 165-3 02-02-04 NOCV Re-Inspection Date: 02-16-04 02-17-04 SOV Officer Siegrist 2 Code Enforcement Board Minutes March 23, 2004 02-17-04 NOH 02-17 -04 POS 02-17-04 POS 02-17 -04 POS 02-24-04 CO 03-03-04 AONC Observation: One blue Toyota pick-up truck FL tag# E70KEB, expired June 2002, and one Mazda 4X4 SE5 B2600 tan pick-up truck, no tag, and one red Nissan pick-up truck, FL tag# URS824, expired June 2000. Meeting Date: 02-24-04 Certified Mail Regular Mail Posting Given until 03-02-04 or pay $50 a day Vice-Chairman Lenko, seconded by Member Donenfeld, moved in Case No. 04-004 to impose fine of $50.00 per day effective March 3, 2004, pursuant to original order date of February 24, 2004. Motion carried 6-0. Chairman Linebarier inquired as to the recording date of the lien with Case No. 03- 0300219. Building Clerk Ramos stated that liens are not recorded for thirty days in order to give the respondents time to pay the fine before a lien is filed. COMMENTS Building Official Phelps - Welcomed Mr. Donenfeld as a regular member to the Code Enforcement Board. Attorney Sneed - Said it is the City ofOcoee's decision to decide when to record a lien. Code Enforcement Officer Siegrist - None Code Enforcement Officer Loeffler - None Code Enforcement Officer Braddy-Bagwell- None Permitting Clerk Ramos - None Member Donenfeld - Said thanks for being made a regular member of the Code Enforcement Board and his son who is in the Marines in Japan is doing well. Member Godek - None Member Konicek - Welcomed Member Donenfeld and thanked Mr. Skiles for his years of service on the Code Enforcement Board. Chairman Linebarier - None Vice-Chairman Lenko - Asked is the Code Enforcement Board could place a time frame on a lien to be recorded. Attorney Sneed said the Code Enforcement Board could request a time frame for a lien to be recorded. Ms. Lenko also thanked Mr. Skiles for his years of service on the Code Enforcement Board.
