MINUTES OF THE CITY OF OCOEE
CODE ENFORCEMENT BOARD MEETING
AUGUST 23, 2005
CALL TO ORDER
Chairman Godek called the regular meeting of the Ocoee Code Enforcement Board to order
at 7:02 p.m. in the Commission Chambers at City Hall. Member Donenfeld led the
Invocation and Chairman Godek led the Pledge of Allegiance to the Flag. The roll was
called and a quorum was declared present.
PRESENT: Chairman Godek, Vice-Chairman Chancey, Members Arney, Donenfeld,
Hopper, Stanley, and Alternate Member Lenko (arrived at 7:04 p.rn.). Also
present were Community Development Director Wagner, Building Official
Jones, Code Enforcement Officers Braddy-Bagwell, Loeffler, Rodriguez, and
Siegrist, Permitting Clerk Ramos, Attorney Sneed, and Deputy City Clerk
Brasher.
ABSENT: Member Henderson, who was un-excused.
Community Development Director Wagner gave an overview of the Code
Enforcement Board and said the Community Development Department is all about
enforcing City codes. The Code Enforcement Board is one of the most important
boards in the City. The purpose of this board is to keep the City safe and looking nice; the
primary function is to enforce City codes. The codes are about the safety, health, and welfare
of the residents and businesses. The City of Ocoee does have the right to prosecute a case
independently from the Code Enforcement Board.
Community Development Director Wagner further stated the Code Enforcement
Board Attorney is not an advocate for the City; the attorney is here to keep the process legal.
He said that he or Staff is always willing to attend the meetings to clarify or give additional
information regarding a case. He further stated the Code Enforcement Board members can
obtain access to the Land Development Code (LDC) on the City's website or can get a copy
from the Planning Department.

MEMBER OF THE BOARD, IN WHICH CASE THE CHAIRMAN WILL INSTRUCT THE BOARD CLERK TO REMOVE THE ITEM FROM THE

QUESTIONS AND COMMENTS REGARDING CASE NO. 05-072
Emerson Moorley, having been sworn, said he knew he needed a permit but failed to obtain
one. He further stated he has no money to obtain the plans needed to obtain the permit and
due to the fact that he is recently divorced, his ex-wife and mother-in-law are living with him,
and his mother-in-law is terminally ill with cancer. Due to these circumstances, he will have
no extra money until tax time.
Building Official Jones, having been sworn, stated there is a set-back requirement that has
not been met in this case and that would need to be addressed as well as the other issues.
Member Hopper. seconded bv Alternate Member Lenko. moved in Case No. 05-072 to find
the Respondents in violation of Section 51-13 as of Julv 31. 2005. but to give until October 24.

Officer Rodriguez, having been sworn, presented exhibits, gave a detailed history of the Case
and stated the property is in non-compliance for the fence.
QUESTIONS AND COMMENTS REGARDING CASE NO. 05-081
Georgiana Paul, having been sworn, stated she is purchasing the property from her mother's
estate. The person who installed the fence told her a permit was not needed since she was
replacing fencing, not installing new fencing. She said she has tried to obtain a permit for the
fence but there is a problem with obtaining a survey due to a problem with a discrepancy
between the survey and the plat on record with Orange County. The surveying company that
she hired said they would resolve this with Orange County but the problem has not been
resolved. She said her hands are tied until the matter with Orange County is resolved and at
this time the only way to resolve this is to have her property re-platted. She further stated that
she has been advised not to close on the home until this issue is resolved.
Building Official Jones said it may be possible to accept an alternative type of documentation
to issue the fence permit.

Officer Loeffler, having been sworn, presented exhibits, gave a detailed history of the Case,
and stated the property was in non-compliance.
QUESTIONS AND COMMENTS REGARDING CASE NO. 05-082
Larry Dobson, having been sworn, stated he submitted the required information for the Site
Plan on July 25,2005, along with the $2,500 Review Fee and comments regarding the Site
Plan were returned by the City on August 19,2005. He stated that the City claims he was in
violation due to the Site Plan not being submitted, un-permitted gravel and drive areas, un-
permitted electric fuel tanks installed, un-permitted storage shed construction, and un-
permitted structure demolition. He presented the following information and/or exhibits:
1. Copy of structure demolition permit, which was issued on March 2, 2005.
2. The gravel driveway has existed since 1939. AT&T has used and
maintained the gravel driveway since 1999.
3. The storage shed is shown on the survey dated 2002.
Officer Loeffler reiterated that a Large Scale Site Plan is required based on the square footage
of the building for the property as well as the required permits. Mr. Loeffler presented an
additional exhibit from Planning Manager Armstrong stating that the Site Plan submitted on
August 19,2005, was insufficient, with regards to the following items:
~ Plat & Survey does not indicate what is occurring along the 12 foot row along
Marshall Farms Road leading into the rear of the property, and who owns it.
~ Paved roadway 24 feet in width.
~ Fence type details and location need to be shown on the Site Plan.

~ Parking spaces need to be designated for employees and customers. This is to
include calculations from the City of Ocoee Code demonstrating compliance.
Spaces must be asphalt and designed at 9 feet and 20 feet. Show location(s) of
Handicap spaces, striped areas according to ADA standards.
~ Location of monument sign and details need to be included on the Site Plan in
addition to location of wall sign.
~ Building elevations on all four sides, cut sheets for all lighting (including wiring),
landscape buffers, and building setbacks, drainage, topiary, shown on Site Plan.
~ Details on what is occurring on mulch and potted plant storage areas.
~ Dumpsters and screening
Member Donenfeld asked for the differences between Small Scale and Large Scale Site
Plans. Officer Loeffler said the difference is based on square footage of the building.
Mr. Dobson said he is a registered landscape architect and he submitted a signed, sealed
duplicate copy of the irrigation landscape plans. He further stated he submitted four sets of
Development Plans, a drawing survey, as well as the other items that were requested.
Building Official Jones stated that when land use changes on any property, a Site Plan is
required. Attorney Sneed asked Officer Loeffler to address the issue of the shed on the 2002
survey. Officer Loeffler said the degree of permitted items on the property is unclear and any
un-permitted items would be dealt with when they arise.
Chairman Godek asked Mr. Dobson how much time he would need to come into
compliance. Mr. Dobson said there are several reports he must obtain but he would try to get
the report from the engineer in 60 days but 90 days would be more reasonable. Officer
Loeffler said in addition to the LDC requiring the Large Scale Site Plan and because of the
land use change; the LDC is a tool used to keep the areas up to Code. Attorney Sneed asked
Officer Loeffler ifhe was asking the board for a resolution of the Large Scale Site Plan issue
and a continuance for Section 51-13.
Alternate Member Lenko asked if there were any life safety issues involved with this case.
Building Official Jones said there had been, but the Fire Marshall inspected the property and
those issues have been resolved.

Joel Trevino, having been sworn, stated he purchased the home in 2003 from a relative and
he did not live at the property until 2004. When he tried to refinance the home, he was told
there was a lien on the property.
Member Stanley asked what costs the City has incurred. Officer Siegrist said the City has
incurred approximately $730 in costs for Case No. 05-041.

QUESTIONS AND COMMENTS REGARDING CASE NO. 05-036
Jeff Clark, having been sworn, stated his employer is trying to help Mr. Alexander's daughter
get some money from the sale of her father's property. Officer Siegrist said that the City has
incurred approximately $340 in costs for Case No. 05-036.
