REGULAR CITY COMMISSION MEETING Mayor Pro Tem Keller called the regular session to order at 7:15 p.m. in the Commission Chambers of City Hall. Mayor Pro Tem Keller gave the invocation, followed by the Pledge of Allegiance to the Flag, led by Commissioner Grogan. Acting City Cleric Sibbitt called roll and declared a quorum present. PRESENTATIONS AND PROCLAM Proclamation - International Walk to School Day — October 9 2013 Mayor Vandergrift proclaimed October 9"' as International Walk to School Day, Proclamation - Put the Brakes on Fatalities Day — October 10, 2013 ,y iayor Vandergrift proclaimed October 10th as Put the Brakes on Fatalities Day. 13. CO MMENTS FROM C ITIZENS /PUBLIC I)avid Denmark, 610 Gallego Avenue, addressed the commission regarding unpaved roads in Ocoee. He advised there have been many roads around the City limits that have been repaved and was wondering when the City roads will be redone verses patched. Public Works Director Krug advised that fortunately the Commission was gracious in recently approving half a million dollars to resurface roads. Ile said residents should expect to see road improvements starting in 1ai�uar } %. Public Works Director Krug clarified that resurfacing will not be done around the \� holc City, hilt it will cover some of the major roads. Discussion ensued regarding road resurfacing on Colonial Drive. City Engineer Wheeler briefly explained the future State Road improvements that are being proposed by DOT. Westyn Bav Tree Removal Discussion: Several residents of the Westyn Bay Subdivision addressed the commission to discuss issues they were having with their HOA after the September 17` commission approval of deletion of condition 437 (street trees) from their subdivision development agreement. The residents felt the commission was lead to believe that a majority of the Westyn Bay residents were in agreement with the removal of trees within their community. Residents are currently working on a petition to overturn this decision. It was not the intention of the commission that residents of Westyn Bay had to remove their trees; they just had the option to if they wanted to. The commission encouraged the residents of Bay to go before their HOA to address the concerns they have since the residents have a say regarding what goes on in their ColIlmllnity. Several members of the Westyn Bay HOA were present and requested to speak after the residents so they may give an explanation on their decision regarding the removal of trees. Tlie police department is requesting that item 448, the orange and black ATV, be removed from the Surplus List as it is not ready to be declared as surplus property at this time. D. COMMISSIONERS ANNOUNCEMENTS Commissioner Grogan — announced the Handgun Safety Class is Saturday October 12, 2013, from 8:00a.m. to 12:00p.m. Tliis is a frec handgun safety class taught by Ocoee Police Officers. Topics include terminology, safety.. loading and unloading, shooting basics, taws, use of force, concealed weapon permits and proficiency. The class is held at the Ocoee Police Department. There is a $75 entry fee per person, or $280 for a foursome. (City Clerk Eikenberry) Ocoee Police lnfr lction I learing Board was established May I5, 2007, by Ordinance No. 2007 -007. City Staff had determined that it would be beneficial to amend the Code to provide for a new Chapter 16 — Violations, in order to have all of the procedures related to certain code violations in one chapter of the Code of Ordinances. On ,March 5, 2013, the Police Infractions Board was renamed to the Violations Board and Article III, Chapter 168 was deleted. In addition to hearing matters related to certain traffic infractions, the Violations Board hears cases related to violations of the following code provisions: Bowfishing, Cemeteries, Noise, Golf Carts on Public Property, Parks and Recreation, Alcoholic Beverages and Abandoned Property. The Violations Hearing Board consists of seven (7) ill einbers of which two must be members of the Citizens Advisory Council of the Ocoee Police Department (the "CACOPD "). Additional members of the Violations 11caring Board may also he members of the CACOPD. (City Cleric Eikenberry) Members of the Parks and Recreation Advisory Board serve two -year terms. The Ordinance provides that the Parks and Recreation Advisory Board membership shall consist of nine (9) members and whenever possible, appointments to the Board may include one member from each of the following organizations: Ocoee Little League, Ocoee Youth Soccer League (OYSI ); Ocoee Biitldot =_ Pop Warner Football, and West Orange Senior Citicens Association. Approval of Two -Year Warranty Surety and Maintenance, Materials, and Workmanship Escrow Agreement with Standard Pacific Homes of Florida GP, Inc. for Arden Park South. (City Engineer Wheeler) Arden Park South is a 157 lot single family residential subdivision located on Clarcona -Ocoee Road between in-ram and Clarke Roads. The developer has completed construction of the infrastructure improvements and Im", rcgiiestecl a Certificate of (' ompletion. The infrastructure irnpiovements include the water, sanitary sewer, and reuse utilities the streets and stormwater collection system, and the perimeter wall and fence. All identified punch list repairs have beei7 completed and the developer is ready to start the two -year warranty period. Asa requiicnient oftlic Land Development Code, the developer is required to furnish the City a surety to cover any possible damages discovered during the next two ycu�s should the developer not choose to make those. repairs. Standard Pacific Homes of' Florida GP, Inc, has provided the City with a check in the amount of 10 /0 of the constructed improvements. The Maintenance, Materials, and Workmanship hscrow Agreement (Form 8 fr om the Land Development Code) will act as the. executable document between the. developer and the City in the event that the surety is monetary. Staff requests the approval ofthe City Commission to contract GcortLze Gideon Auctioneers, Inc. for the public sale of the City's surplus property. This action will present the City with the opportunity of a larger coverage area and would alleviate the overtime costs incurred in conducting the auction in- house. The City has had good results in the past with Gideon, and found the dollar amount received for items sold by Gideon to be comparable to those sold by the City or EBay.
