ZIEGLER, AND JOHN TIMBES ... ABSENT : DICK JOOSTEN CALL TO ORDER The Fire and Building Trades Board meeting was called to order at 8:00 P.M. by City Building Official, Cecil Hurst, in commission chambers. ELECTION OF NEW CHAIRMAN Nominations were opened for the election of a new Chairman. Mr. Timbes nominated Mr. Sam Hodge, seconded by Mr. Ziegler. Motion was made to close nominations by Mr. Muns, seconded by Mr. Mathiasen. Vote was unanimous to elect Mr. Hodge as Chairman. Chairman Hodge opened nominations for Vice-Chairman. Mr. Timbes nominated L. M. Ziegler. Mr. Ziegler declined nomination at this time. Mr. Muns nominated John Timbes as Vice-Chairman, seconded by Mr. Ziegler. Vote was unanimous. Mr. Timbes nominated Roy Mathiasen as Secretary, seconded by Mr. Muns. Vote was unanimous. APPEAL BY MR. BEN GRIFFIN liD\, ;h Mr. Ben Griffin, owner of the building in question at 12 E. McKey St., stated that he had this building redecorated by painting, paneling, hanging doors and installing windows. At this time Mr. Hurst, Building Official, informed Mr. Griffin that a building permit was needed in order to do this type of work. Upon inspection by Mr. Hurst, the electrical installation was found to be faulty and a hazard. Through written correspondence, Mr. Griffin was informed that he was in violation of City Ordinances #637 and 638. Mr. Griffin stated that his appeal was based on whether the correct ordinances were being used to establish the violation. Mr. Hurst stated he felt what ordinanee was used had no bearing on this ease but that the violation was covered in Section 35 of Ordinance 638. Mr. Griffin confirmed that two master electricians had inspected his building and advised that the wiring was indeed faulty and a hazard. Vice-Chairman Timbes stated that he had entered said building this day and agreed that the wiring was not up to code. Mr. Griffin requested that Mr. Timbes disqualify himself from voting because of prejudice. Request was declined. Mr. Timbes asked if Mr. Griffin was willing to bring the electrical system up to electrical code standard. Mr. Griffin stated that he would do so only if the Board forced him to. ' The unanimous vote of the Board was that the City Building Official should take measures to insure that Mr. Griffin brings the electrical system in his building up to standard. ADJOURNMENT Motion was made by Mr. Mathiasen, seconded by Mr. Timbes to adjourn the meeting at 9:07 P.M. VOTING MEMBERS PRESENT: Samuel J. Hodge Roy L. Mathiasen Arthur Muns Thomas Ritten John Timbes L. M. Zeigler Building Contractor Lay Citizen Plumbing Contractor Fire Prevention Industry Electric Contractor Heat./Air Conditioning Contractor VOTING MEMBER ABSENT: Richard Joosten Pool Contractor NON-VOTING MEMBER PRESENT: Cecil Hurst Ocoee Building Inspector __ The meeting was called to order at 8:00 P.M. in the Ocoee Commission Chambers by City Building Inspector, Mr. Cecil Hurst. Mr. Samuel Hodge was elected as the new board chairman; Mr. John Timbes as vice-chairman; and Mr. Roy Mathiasen as secretary. The main order of business was an appeal by Mr. Ben Griffin, owner of a renovated office building located at 12 East McKey St. particularly in regards to the refusal of the building inspeetor to issue a certificate of occupancy until the electrical installation of the building was up-dated to eurrent safety standards. Mr. Griffin stated in his lengthy verbal appeal that the two City Ordinances #637 and #638, cited by Mr. Cecil Hurst, in this case were not applicable. However, in rebuttal, Mr. Hurst read several paragraphs from c.o. #638 and stressed in particular Section #35 which covered the violations cited. This point was further eonfirmed by Board Member Timbes, an electrical contraetor, who expanded on the details of Section #35 of C.O. #638 which related to the explicit duties of the building inspector regarding buildings where the electrical system is not up to code and is considered unsafe. similar confirmation for the building inspector's action to withhold the certificate of occupancy was also brought out by Mr. Timbes in reading applicable paragraphs from Standard Building Code, 1979 Edition: Section 103.4 - Unsafe Buildings. In an effort to settle this appeal amicably, Chairman Hodge . asked Mr. Griffin if he would bring his admitted unsafe electrical system of the building in question up to the current electrical code standards. Mr. Griffin emphatically stated "not unless he was forced to". Additional conciliatory appeals by board members to Mr. Griffin proved futile. By unanimous vote, the Board denied Mr. Griffin's appeal and instructed the Building Inspector to Red Tag the building and take the necessary steps to assure the building in question would be brought up to meet current electrical standards.
