MINUTES OF THE OCOEE CITY COMMISSION REGULAR MEETING HELD AUGUST 31, 1982
PRESENT: MAYOR FREEMAN; COMMISSIONERS HAGER, LYLE, STINNETT AND WHITEHEAD;
CITY MANAGER VIGNETTI; CITY ATTORNEY RHODES; DEPUTY CLERK GRAFTON
ABSENT: NONE
CALL TO ORDER
Mayor Freeman called the regul~r meeting to order at 7:31 PM in the commission chambers
and led those present in the pledge of allegiance.
3 AUGUST 82 MINUTES APPROVED
Upon a motion by Comm. Whitehead and second by Comm. Hager, minutes of the 3 August 82
meeting were unanimously approved as read.
PLANNING AND ZONING BOARD DID NOT MEET
ORDINANCE: AMENDING COMPREHENSIVE LAND USE PLAN-REWIS PROPERTY ON SR 438
Comm. Hager moved to read by title only the ordinance to change zoning on Rewis
property located on SR438 from Agricultural to RIAA. Comm. Lyle seconded and vote
was unanimous in favor. City Manager read the title of the ordinance. Public hearing
is scheduled for 7 September 82.

ORDINANCE: AMENDING COMPREHENSIVE LAND USE PLAN-BREEZE PROPERTY SE OF BLUFORD/GENEVA ST
INTERSECTION
Comm. Lyle moved to read by title only the ordinance amending the Comprehensive Land
Use Plan as regards Future Land Use (Figure 4-2) to show the area southeast of Bluford
and Geneva Street intersection commercial instead of residential. Comm. Whitehead
seconded and vote was unanimous in favor. City Manager read the title of the ordi-
nance. Public hearing is scheduled for 7 September 82.
TRI-CITY AIRPORT AGREEMENT
City Attorney Rhodes explained that the agreement has been rewritten to have the
three cities receive their investment upon sale of the property. Comm. Stinnett
moved to execute the agreement and Comm. Hager seconded. Vote was split: Comms.
Stinnett and Hager, yea and Comms. Lyle and Whitehead, nay. Mayor Freeman voted
yea to break tie. Motion carried. .
PERMISSION TO SELL BEER/WINE GRANTED GO-BAR, INC.
Mr. Herb Schmidt requested permission to sell beer and wine at Go-Bar, Inc., his
pub located in the Village Market Square. Comm. Stinnett moved to grant request.
Comm. Lyle seconded and vote was unanimous in favor.
SANDERS REAPPOINTED TO P & Z
Comm. Lyle moved to reappoint Marvin Sanders to serve on Planning and Zoning Board.
Comm. Stinnett seconded and vote was unanimous in favor.
DRAW DOWN OF LAKE MOXIE
City Manager reported the meeting Sunday resulted in a decision to draw down Lake
","" Moxie and in 7 to 8 weeks possibly to put in a permanent pump. Some progress has
been made even though heavy rain Sunday caused small setback. Commissioners assurred
citizens who were inconvenienced by pipes blocking driveways that these measures were
both necessary and temporary.

USE OF POWER BOATS NO LONGER PERMITTED ON LAKE MOXIE AND PEACH LAKE
City Manager advised that power boats on Lake Moxie and Peach Lake were causing a
problem with erosion from waves. Camm. Whitehead moved to authorize City Manager
to put up signs preventing the use of power boats on both lakes. Comm. Hager
seconded and vote was unanimous in favor.
OCOEE JR. HIGH BAND REQUESTS FINANCIAL AID
Mrs. Van Kuren, representing Ocoee Junior High School Band, requested financial
assistance ($500.00) toward band uniforms. Comm. Stinnett moved to grant request.
Motion died for lack of a second.
WEST ORANGE HIGH SCHOOL REQUESTS FINANCIAL AID
Mr. Jim Merchant, President of West Orange High School Band Parents Association,
requested funds to buy 20 uniforms ($5,000) and an ongoing contribution of $1,500
each year. Mr. Merchant was advised that this commission could not obligate future
commissions with such a committment as an ongoing contribution and no action was
taken on a contribution this year, either. Mr. Merchant was advised that he would
find a more sympathetic ear in the commission later, after he has exhausted all
other avenues of fund raising, including the school board.
TENTATIVE BUDGET AND PROPOSED MILLAGE PUBLIC HEARING DELAYED UNTIL LAST ON AGENDA
REPORTS/INFORMATION
Comm. Lyle moved to authorize City Manager to pay $5,000 from Acct.#533.46C for new
water department pickup truck. Comm. Whitehead seconded and vote was unanimous in
favor.

City Manager advised:
1. The population estimate for Ocoee 1 April 82 is 9,659.
2. Paving projects on Lady Avenue, Starke Lake Circle and Story Rd/Geneva St.
intersection will begin after Labor Day.
3. City Hall will be closed 6 Sept 82 for Labor Day and Sanitation Department
will work as usual.
LAKEFRONT HOMEOWNERS IN DISTRESS
There were a number of lakefront homeowners from Peach Lake/Lake Moxie area re-
questing action on flooding situation in their yards and wondering why something
was not done sooner. They were advised, again, by Mayor Freeman that Department
of Environmental Regulation has stringent guidelines the City must follow. that
nothing could be done until an emergency situation had developed, that on Sunday
the water level was considered high enough to constitute an emergency situation
and the pumping was started, and a tentative schedule has been set up to provide
for a permanent pumping station.

PIONEER KEY PARK #2 TOO WET
Citizens' from Pioneer Key Park #2 requested relief from flooding in their yards.
Commissioners agreed to provide the city's front end loader over the weekend to
move earth to make a water diverting barrier. City Attorney advised that the
machine should be operated by a qualified city employee. Mayor Freeman volunteered
to pay employee's salary himself. Citizens also requested speed limit signs in
the park and that city order trailers and trucks moved from 16 Sundial Key Drive.

MORE DRAINAGE PROBLEM
Dave Graves, 706 Nicolp.,advised that rains have washed everyones soil into his
yard and the water does not go into the swale. City Manager will check it out
Wednesday.
5 MINUTE RECESS AT 10:15PM
When meeting reconvened City Manager presented Proposed Budget and Timetable and
requested directions for use of Federal Revenue Sharing Funds. Comm. Lyle proposed
money be spent 1st on sanitation truck and 2nd on drainage. Mayor Freeman announced
that future builders will be required to put in a well before any more houses are
authorized. Mr. Sam Woodson asked that sidewalks be considered on Malcolm Street.
Comm. Whitehead moved to approve tentative budget as presented and Comm. Hager
seconded. Vote was Whitehead, Hager and Stinnett, yea and Lyle, nay due to proposed
increase in water and garbage rates. Motion carried by majority vote.
Comm. Stinnett moved to adopt proposed millage rate of 3.1657. Comm. Hager seconded
and vote was unanimous in favor. The new millage rate exceeds the rollback rate by
0%. There are no Federal Revenue Sharing Funds included in the budget.
REWIS LEGAL DESCRIPTION CHALLENGED
Ron Collela, attorney representing the neighboring McCloskys, challenged the accuracy
of the legal description used in Petition 82-6, a request for rezoning. City Attorney
Rhodes will research and report.

DOSS PROPERTY IN DISTRESS
Comm. Hager reported that Mr. Doss now has a flooding problem as a result of the
ditch he requested several months ago and wants to put in a bulkhead to divert water.
Commission refused to assist as he was advised when previous request was made and
granted that this would be the result.
OLD WATER DEPARTMENT TRUCK FOR SALE
Comm. Stinnett moved to put the '74 water truck up for bids. Comm. Whitehead seconded
and vote was unanimous in favor.
ADJOURNMENT
Upon a motion by Comm. Hager and second by Comm. Lyle meeting adjourned at 11:26PM.
